North Korea dispatched covert commando teams to the United States in the 1990s to attack nuclear power plants and major cities in a conflict, according to a declassified Defense Intelligence Agency report.

The DIA report, dated Sept. 13, 2004, reveals that five units of covert commandos were trained for the attacks inside the country.

According to the report, the “Reconnaissance Bureau, North Korea, had agents in place to attack American nuclear power plants.”

The document states that the North Korean Ministry of People’s Armed Forces, the ministry in charge of the military, “established five liaison offices in the early 1990s, to train and infiltrate operatives into the United States to attack nuclear power plants and major cities in case of hostilities.”

“One of the driving forces behind the establishment of the units and infiltration of operatives was the slow progress in developing a multi-stage ballistic missile.”

Elite opinion on Obama’s attempt to bury the Cold War hatchet with Cuba is shaping up just as you might expect it would.

The New York Times editorial board gushed over the decision, calling it “a bold move that ends one of the most misguided chapters in American foreign policy.”

The Times applauded Obama for doing everything within his power to normalize relations with Cuba within the constraints of a 1996 law imposing sanctions on the Cuban regime. Odd that The Times’ argument against the Cuban sanctions is that they are so “outmoded,” and yet they must concede that they were ratified by the American Congress as recently as the eve of President Bill Clinton’s second term…

With these powerful political actors heading into their familiar corners, The Washington Post editorial board’s vote of no confidence in Obama’s move came as a shock…

The Post’s editorial is not merely a registration of their disapproval in Obama’s decision, but an indictment. The paper suggests that any progress toward Democracy in Cuba has been arrested by the president’s shortsighted move.

Obama Gives the Castro Regime in Cuba an Undeserved Bailout

IN RECENT months, the outlook for the Castro regime in Cuba was growing steadily darker. The modest reforms it adopted in recent years to improve abysmal economic conditions had stalled, due to the regime’s refusal to allow Cubans greater freedoms. Worse, the accelerating economic collapse of Venezuela meant that the huge subsidies that have kept the Castros afloat for the past decade were in peril. A growing number of Cubans were demanding basic human rights, such as freedom of speech and assembly.

On Wednesday, the Castros suddenly obtained a comprehensive bailout — from the Obama administration. President Obama granted the regime everything on its wish list that was within his power to grant; a full lifting of the trade embargo requires congressional action. Full diplomatic relations will be established, Cuba’s place on the list of terrorism sponsors reviewed and restrictions lifted on U.S. investment and most travel to Cuba. That liberalization will provide Havana with a fresh source of desperately needed hard currency and eliminate U.S. leverage for political reforms.

As part of the bargain, Havana released Alan Gross, a U.S. Agency for International Development contractor who was unjustly imprisoned five years ago for trying to help Cuban Jews. Also freed was an unidentified U.S. intelligence agent in Cuba — as were three Cuban spies who had been convicted of operations in Florida that led to Cuba’s 1996 shootdown of a plane carrying anti-Castro activists. While Mr. Obama sought to portray Mr. Gross’s release as unrelated to the spy swap, there can be no question that Cuba’s hard-line intelligence apparatus obtained exactly what it sought when it made Mr. Gross a de facto hostage.

Candidate Barack Obama said that, as president, he would talk to anti-American dictators without precondition. He didn’t mention that he would also give them historic policy concessions without precondition.

His surprise unilateral change in the U.S. posture toward the Castro dictatorship came without even the pretense of serious promises by the Cubans to reform their kleptocratic, totalitarian rule.

The trade of Alan Gross, the American aid worker jailed in Cuba for the offense of trying to help Jewish Cubans get on the Internet, for three Cuban spies is understandable (we also got back one of our spies, and Cuba released several dozen political prisoners as a sweetener).

The rest of Obama’s sweeping revisions — diplomatic relations and the loosening of every economic sanction he can plausibly change on his own — are freely granted, no questions asked. It is quid with no pro quo. Even if you oppose the isolation of Cuba, this is not a good trade.

After waiting out 10 other U.S. presidents, the Castro regime finally hit the jackpot in Obama, whose beliefs about our Cuba policy probably don’t differ much from those of the average black-turtleneck-clad graduate student in Latin American studies.

In his first-ever media interview, the military chaplain who was punished for making references to the Bible during a suicide-prevention seminar last month says he was simply doing his job.

“What I had tried to communicate with my audience is that depression can be conquered, depression can be overcome, and there are a myriad of ways of dealing with depression,” the chaplain, Capt. Joe Lawhorn, told The Daily Signal in a Skype interview.

“In this particular case,” Lawhorn explained, “I had struggled myself personally with the issue at hand I was teaching.”

Lawhorn conducted the mandatory training session on depression and suicide prevention Nov. 20 at the University of North Georgia.

During the class, he explained how he followed the example of Israel’s King David to overcome his own depression while an Army Ranger. He also distributed a handout to soldiers that included references to the Bible and provided referrals for local counseling that included secular and non-secular options.

“It was my faith that helped me to persevere and remain resilient in the face of depression,” says Lawhorn.

In an utterly unsurprising development this week, Jeb Bush announced that he’s “actively exploring” a 2016 Presidential run.

Allow me to offer some perspective for the GOP Elites and others suffering from the fevered delusions that Jeb Bush might someday serve as President, in this universe or any other.

1. This is one situation where an open primary benefits conservatives: I contend that Democrats will turn out in droves — like there was an announcement for free government cheese at the mall — to vote against the Bush name. Heck, you and I have heard it for years: debate any policy position with a progressive and, no matter the facts, logic, history, and reason you muster — the inevitable result is what some call Bush Tourette’s Syndrome (i.e., “But- but- but- Bush!). This sad disease is sure to manifest itself in the primaries and amplify Democrat turnout like nothing we’ve seen since the dead walked the streets of Chicago in 1960 to cast ballots for John F. Kennedy.

2. Jeb Bush’s support for Amnesty is wildly unpopular among a huge majority of Americans: 88% of Republicans, 66% of independents and even 50% of Democrats believe that the border should be locked down before any Amnesty efforts are undertaken.

3. Bush’s support for a nationalized education curriculum (also known as “Common Core”) is generally despised. Only 34% of U.S. adults with children of elementary or secondary school support the federal takeover of educational standards.

4. Should Bush secure the nomination (which, if it occurs, we can thank John Boehner’s newly uncorked personal campaign contribution limits in the CRomnibus), I believe we’ll see the first viable third-party candidate since 1992. Reince Priebus, Karl Rove and the rest of the GOP Oligarchs should know that the Republican Party will be torn asunder by a Bush nomination. Guaranteed. A third party will result and the GOP will go the way of the Whigs — deservedly so.

5. BONUS: Jeb’s formula for victory:

Jeb Bush has no chance of winning the presidency — zero, none — and anyone who tells him otherwise is lying or a paid political operative. Or, more likely, both.

On Wednesday, the Associated Press called the outstanding race for congress in Arizona’s 2nd Congressional district. Rep. Ron Barber (D-AZ), a former aide to Rep. Gabrielle Giffords (D-AZ) and her successor in office, was narrowly defeated by Republican Martha McSally.

With McSally’s victory, the 2014 midterm elections have officially concluded. At the start of the 114th Congress, Republicans will enjoy their largest majority in the House of Representatives since prior to the Great Depression and the presidency of Franklin Roosevelt with 247 members. The last time the GOP enjoyed that large of a majority was the 71st Congress in 1929 and 1930.

In the Senate, the GOP will be in an almost equally unparalleled position of power.

“Republicans will control 54 out of 100 seats,” The Washington Post’s Aaron Blake noted. “That’s tied for their fourth-highest number of seats since that same 1929-30 Congress, but the larger three were majorities of 55 seats — i.e. only one more seat.”

Combined with the GOP’s dominance at the state legislative level (Republicans control 56 percent of seats in the legislatures, the highest number since 1920), and the party’s control of 31 of 50 gubernatorial mansions, the Republican Party will be in the strongest position it has seen since prior to the popularization of Democratic progressivism.

Gasoline prices continue to drop across the country with the national average falling to $2.50 per gallon.

Are low prices good or bad for the prospects for lifting the ban to export crude oil? The reality is it shouldn’t matter because energy free trade will benefit the United States in both the near term and the long run. That’s why Congress should lift the ban regardless.

One of the primary concerns among skeptics of lifting the crude export ban is the effect that increased oil exports might have on domestic gas prices.

Several studies have projected that lifting the ban would actually decrease gas prices both in the United States and globally. Because oil is a globally traded commodity and refiners are equipped to handle different qualities of crude oil, an open market for shipping crude would better match global refining capabilities. Despite the fact that all signs point to lower fuel prices in the U.S., the skepticism remains.

The federal ban on exporting crude oil has been in place since the 1970s to fight potential fuel shortages caused by the Organization of Arab Petroleum Exporting Countries (OAPEC) oil embargo. Rep. Joe Barton, R–Texas, recently introduced a bill to lift the still-in-place ban on crude oil exports.

Alaska has built up layers of budgetary reserves that allow it to absorb one or two years of large operating deficits — just outside of our outlook time horizon –at its current rating level. But in order for it to avert credit quality deterioration, we believe the state must make material progress in reducing the deficit in its fiscal 2016 budget.

Although the rapid decline in oil prices exacerbates Alaska’s existing fiscal budget deficit, whether it will weaken the state’s credit quality will depend on the state’s budgetary response. For fiscal 2015, the state assumed oil prices would average $105.06 per barrel, giving rise to about 495,900 barrels
per day of production on Alaska’s North Slope. Based on more recent price and production information, the state has revised its estimates to $76 per barrel and 509,500 barrels per day for fiscal 2015.

The state’s assumptions regarding oil prices and production are integral to its budget condition because oil-related revenues made up 88% of its estimated revenue for the 2014 fiscal year and 79% of fiscal 2015. At enactment, the state’s budgeted general fund expenditures for fiscal 2015 exceeded its unrestricted revenues by $1.4 billion. Weaker oil prices and production resulted in an updated budget gap of $3.5 billion, equal to 57% of general fund expenditures. For most states, an operating deficit of this magnitude would likely result in immediate negative rating consequences. In Alaska’s case, however, extraordinarily large budget reserves effectively buy the state time to deal with its structural misalignment.

German researchers have discovered security flaws that could let hackers, spies and criminals listen to private phone calls and intercept text messages on a potentially massive scale – even when cellular networks are using the most advanced encryption now available.

The flaws, to be reported at a hacker conference in Hamburg this month, are the latest evidence of widespread insecurity on SS7, the global network that allows the world’s cellular carriers to route calls, texts and other services to each other. Experts say it’s increasingly clear that SS7, first designed in the 1980s, is riddled with serious vulnerabilities that undermine the privacy of the world’s billions of cellular customers.

The flaws discovered by the German researchers are actually functions built into SS7 for other purposes – such as keeping calls connected as users speed down highways, switching from cell tower to cell tower – that hackers can repurpose for surveillance because of the lax security on the network.

Those skilled at the myriad functions built into SS7 can locate callers anywhere in the world, listen to calls as they happen or record hundreds of encrypted calls and texts at a time for later decryption. There also is potential to defraud users and cellular carriers by using SS7 functions, the researchers say.

These vulnerabilities continue to exist even as cellular carriers invest billions of dollars to upgrade to advanced 3G technology aimed, in part, at securing communications against unauthorized eavesdropping. But even as individual carriers harden their systems, they still must communicate with each other over SS7, leaving them open to any of thousands of companies worldwide with access to the network. That means that a single carrier in Congo or Kazakhstan, for example, could be used to hack into cellular networks in the United States, Europe or anywhere else.

“The Real Story” updated us this afternoon on the continuing investigation into the murder of a 19-year-old Mississippi woman who was burned alive.

Jessica Chambers’ father, Ben, vowed that whoever killed his daughter would be brought to justice.

“To the person that done this: They’re coming for you. They’re working day and night, day and night, away from their own families,” he said, calling for the killer to eventually be kept in solitary confinement.

Chambers said he never knew of his daughter having any enemies. He also said he is relying on faith to get him through this difficult time.

A University of Michigan department chairwoman has published an article titled, “It’s Okay To Hate Republicans,” which will probably make all of her conservative students feel really comfortable and totally certain that they’re being graded fairly.

“I hate Republicans,” communications department chairwoman and professor Susan J. Douglas boldly declares in the opening of the piece. “I can’t stand the thought of having to spend the next two years watching Mitch McConnell, John Boehner, Ted Cruz, Darrell Issa or any of the legions of other blowhards denying climate change, thwarting immigration reform or championing fetal ‘personhood.’”

She writes that although the fact that her “tendency is to blame the Republicans . . . may seem biased,” historical and psychological research back her up, and so it’s basically actually a fact that Republicans are bad!

Douglas said that in the 1970s she did work for a Republican, Rhode Island’s senate minority leader Fred Lippitt, but she hates them all now because Lippitt was a “brand of Republican” who no longer exists in that he was “fiscally conservative but progressive about women’s rights, racial justice and environmental preservation.”

Now that the former Florida governor has all but confirmed his plans to run for president in 2016, the issue threatens to overshadow his likely campaign. Bush’s name, matched with consistently high polling numbers among potential 2016 Republican candidates, makes landing a seat in the Oval Office feasible. But in order to reach the general election—to perhaps take on Hillary Clinton—Bush must first overcome concerns about Common Core with conservative primary voters. Bush’s longstanding support for Common Core is no secret: Over a year ago, Frederick M. Hess, an education expert at the American Enterprise Institute, predicted that if he decided to run for president, “Common Core could be his Romneycare.” What is Common Core? Common Core standards were created by the National Governors Association and Council of Chief State School Officers, and funded by the Bill and Melinda Gates Foundation. I had promised myself I wasn’t going to write about 2016 until at least Jan. 1, 2015. So much for that.

Jeb Bush announced today via Facebook that he has “decided to actively explore” a presidential run and will launch a leadership PAC early next year to help him “facilitate conversations with citizens across America.”

That’s as close as any potential GOP presidential candidate has come yet to saying, “I’m in.”

But before everyone starts dusting off their old Bush and Clinton paraphernalia for a rematch of the families in 2016, let’s consider that while Democrats may have a weak bench of candidates this go round, the same is not true for the GOP.

For the first time in a very long time, the Republican Party has not one, not two, but several would-be candidates, at both the state and national level, who are not only “viable,” but also conservative. And it’s the latter ingredient that many today question about Jeb Bush.

Jeb Bush’s Common Core Problem

Jeb Bush has long advocated for all 50 states to adopt Common Core national standards.

Now that the former Florida governor has all but confirmed his plans to run for president in 2016, the issue threatens to overshadow his likely campaign.

Bush’s name, matched with consistently high polling numbers among potential 2016 Republican candidates, makes landing a seat in the Oval Office feasible. But in order to reach the general election—to perhaps take on Hillary Clinton—Bush must first overcome concerns about Common Core with conservative primary voters.

Bush’s longstanding support for Common Core is no secret: Over a year ago, Frederick M. Hess, an education expert at the American Enterprise Institute, predicted that if he decided to run for president, “Common Core could be his Romneycare.”

What is Common Core?

Common Core standards were created by the National Governors Association and Council of Chief State School Officers, and funded by the Bill and Melinda Gates Foundation. The goal, supported by the Obama administration, was to increase education standards in America.

Among conservatives, however, the issue one of the most controversial. Several politicians have flip-flopped on the issue, pulling their support or even abandoning the standards in their states.

The White House “Fact Sheet” on Cuba makes clear that the Obama administration received nothing in exchange for its many and substantial concessions to Havana’s Communist regime. In essence, after five years of “negotiations,” the White House ended up where Raul Castro started: Gross would be exchanged for three Cuban spies whose activities led to the death of an American in the 1990s.

The administration’s announcement that “the president has instructed the secretary of state to immediately initiate discussions with Cuba on the re-establishment of diplomatic relations with Cuba,” also gives in to a longstanding Castro demand. Cubans will not gain freedom of expression, of association, of thought or of anything else as a result.

Obama announces the ‘most significant changes’ in Cuba policy in more than 50 years

President Obama announced the normalization of relations with Cuba Wednesday, stating that while the decades-old policy toward Cuba was “rooted in the best of intentions,” it has had little effect.

In what Obama called the “most significant changes” in Cuba policy in more than 50 years, the president announced that the United States plans to reopen its embassy in Cuba and ease travel and trade restrictions. The changes end an “outdated approach,” Obama said.

“Neither the American nor the Cuban people are served by a rigid policy that’s rooted in events that took place before most of us were born,” Obama said.

While the policy was “rooted in the best of intentions,” Obama said, “…it has had little effect.”

Obama said he spoke with Cuban President Raul Castro yesterday, the first time the leaders of the two countries have spoken since the Cold War. Obama said he told Castro that Cuban society remains constrained due to restrictions, and said that he is under “no illusion” that barriers to freedom remain for Cuban citizens.

LOS ANGELES – The FBI has connected North Korea to the Sony Pictures cyberattack, a federal law enforcement source told Fox News Wednesday, hours after the company announced it had scrapped the Dec. 25 release of “The Interview” after a number of major movie chains said they would not show the film.

The administration reportedly will call out North Korea on its role on Thursday.

However, the source also told Fox the hacking attack did not necessarily come from inside the borders of North Korea.

Until Wednesday, the Obama administration had been saying it was not immediately clear who might have been responsible for the computer break-in. North Korea has publicly denied it was involved.

In canceling he Christmas day release, Sony released a statement saying, “In light of the decision by the majority of our exhibitors not to show the film The Interview, we have decided not to move forward with the planned December 25 theatrical release. We respect and understand our partners’ decision and, of course, completely share their paramount interest in the safety of employees and theater-goers.”

Later, a Sony spokesman said the company had no further release plans for the film, Variety reported.

Well, I hate to break it to Jeb Inc. There’s no popular groundswell for Bush Part III. None, zip, nada. Only in the hallowed bubble of D.C. and New York City elites does a Jeb Bush presidential bid make any sense.

Jeb’s indulgent (and ultimately doomed) enterprise has three privileged constituencies: Big Business, Big Government and Big Media. This iron triumvirate explains how the failed campaigns of so-called “pragmatic,” “thoughtful” and “moooooderate” liberal Republican candidates such as John McCain, Jon Huntsman and Bob Dole ever got off the ground. The “Reasonable Republican,” anointed and enabled by the statist Big Three, serves as a useful tool for bashing conservatives and marginalizing conservatism.

For Republicans who argue that Jeb is the most “electable” choice, I ask: What planet are you on? After two disastrous terms of Barack Obama’s Hope and Change Theater, the last thing the Republican Party needs is an establishment poster child for Washington business as usual. I mean, really? A third Bush who’s been working for his dad, his dad’s friends or the government since 1980?

The man who waterboarded 9/11 mastermind Khalid Sheikh Mohammed is standing by the CIA’s controversial enhanced interrogation program, saying the intelligence agency and its agents “had to do our duty.”

In an interview with Daily Signal senior independent contributor Sharyl Attkisson, James Mitchell, a former Air Force psychologist, shared his thoughts on the controversial Senate Intelligence Committee report on the CIA’s enhanced interrogation program. Mitchell has faced threats since Sen. Dianne Feinstein, D-Calif, released the report last week.

“We had to do our duty,” he told Attkisson of the enhanced interrogation techniques used on terror suspects. “We were trying to save American lives. The point is that we had just been hit after 9/11 in an attack where they tried to decapitate us.”

Mitchell is one of the men who waterboarded Mohammed and terror suspect Abu Zubaydah. The psychologist assisted the CIA in developing the controversial enhanced interrogation program.

The Senate Intelligence Committee’s investigation, conducted by Democrats, concluded that the CIA did not glean any new information through the interrogation techniques that saved American lives. Mitchell, who has been waterboarded himself, disagreed.

It’s not uncommon to hear someone say, “I’ve been waiting my whole life for this or that story to be made into a movie.”I can’t say that about UNBROKEN, though. I’ve only been waiting 57 years.

I was 4 when the movie rights to my father’s life story were acquired by Hollywood –and finally, on Christmas Day, it will reach the big screen in the new movie directed by Angelina Jolie and starring Jack O’Connell as my Dad, Louis Zamperini.

To say I’m thrilled is an understatement. To say Dad, who passed away over the summer at 97, was thrilled is a bigger understatement.

He got to see the film before he died –Angelina showed it to him on her laptop in his hospital bed –and he was ecstatic at how it portrays his triumphs and tragedies, up till now most famously told in Laura Hillenbrand’s New York Times best-seller also titled UNBROKEN. The remarkable beats of his life are all there: the troubled and troublesome kid who turned to running for a sense of purpose and wound up representing the U.S. in the 1936 Olympics. The World War II bombardier whose plane crashed in the Pacific Ocean in 1943 and who survived for an excruciating 47 days adrift in a life raft with two fellow servicemen; and the prisoner of war who endured unspeakable psychological and physical abuse at the hands of his unusually cruel Japanese captors.

‘Unbroken’ Hero Found Christ at Billy Graham Crusade

The much-anticipated movie “Unbroken” tells the story Louis Zamperini, an Olympic runner who became a World War II hero after his plane was shot down over the Pacific Ocean.

The film covers Zamperini’s brutal internment in a Japanese POW camp, but it doesn’t chronicle the years after the war, when Zamperini found Christianity after attending a Billy Graham crusade.

In fact, there is a only brief mention of Zamperini’s Christian faith at the very end of the film.

Billy Graham’s son, Franklin Graham, the president and CEO of Samaritan’s Purse, appeared on “America’s Newsroom” today to react to the decision not to feature Zamperini’s faith more prominently in the film.

Graham said director Angelina Jolie did an amazing job adapting the book, but she only covered 33 chapters out of 39.

For two decades Atlanta restaurant owner Jim Dunn offered a group health plan to his managers and helped pay for it. That ended Dec. 1, after the Affordable Care Act made him an offer he couldn’t refuse.

Health-law subsidies for workers to buy their own coverage combined with years of rising costs in the company plan made dropping the plan an obvious – though not easy – choice.

“I had a lot of regrets going into it,” Dunn, who owns three Italian Oven restaurants in suburban Atlanta, said of his decision. “I don’t think I have as many now — only because I’ve seen the affordability factor for my managers improve.”

Dunn and five managers are now covered under individual plans bought on healthcare.gov. How many other owners make the same decision will help set the future of small-business health insurance. Although the evidence so far is mixed, brokers expect more firms to follow in the next few years.

Companies like Dunn’s — those with fewer than 50 workers — provide medical coverage to roughly 20 million people. Unlike larger employers, they have no obligation under the health law to offer a plan. Now they often have good reason not to.

Vermont Gov. Peter Shumlin is canceling his dream plan to create a single-payer health system in the state, he announced Wednesday.

“I am not going to undermine the hope of achieving critically important health care reforms for this state by pushing prematurely for single payer when it is not the right time for Vermont,” Shumlin said in a statement Wednesday. “In my judgment, now is not the right time to ask our legislature to take the step of passing a financing plan for Green Mountain Care.”

The problem is, of course, how to pay for it. Even while plans were moving forward for a 2017 launch of the single-payer system, to be called Green Mountain Care, Shumlin had held off on releasing a plan for how to pay for the system, waiting until his announcement Wednesday.

Tax hikes required to pay for the system would include a 11.5 percent payroll tax as well as an additional income tax ranging all the way up to 9.5 percent. Shumlin admitted that in the current climate, such a precipitous hike would be disastrous for Vermont’s economy.

“Pushing for single payer health care when the time isn’t right and it might hurt our economy would not be good for Vermont and it would not be good for true health care reform,” Shumlin said. “It could set back for years all of our hard work toward the important goal of universal, publicly-financed health care for all.”

A Texas plumber has been receiving threats after a photo emerged of Islamic extremists in Syria firing a high-powered gun from the bed of his old pickup, which still bears his company’s logo on the door.

An extremist group, Ansar al-Deen Front, posted the photo of its fighters aboard the Ford F-250 sometime on Monday. That prompted a flood of calls to Mark Oberholtzer, who owns Mark-1 Plumbing in Texas City, and has nothing to do with Syria’s bloody civil war.

“How it ended up in Syria, I’ll never know,” Oberholtzer told The Galveston Daily News.

Oberholtzer told the paper that he traded in the truck three years ago. The Houston dealership he turned it over to, AutoNation, told KHOU.com that the truck was auctioned and was likely traded from owner to owner over the course of three years.

President Obama has issued a form of executive action known as the presidential memorandum more often than any other president in history — using it to take unilateral action even as he has signed fewer executive orders.

When these two forms of directives are taken together, Obama is on track to take more high-level executive actions than any president since Harry Truman battled the “Do Nothing Congress” almost seven decades ago, according to a USA TODAY review of presidential documents.

Obama has issued executive orders to give federal employees the day after Christmas off, to impose economic sanctions and to determine how national secrets are classified. He’s used presidential memoranda to make policy on gun control, immigration and labor regulations. Tuesday, he used a memorandum to declare Bristol Bay, Alaska, off-limits to oil and gas exploration.

Like executive orders, presidential memoranda don’t require action by Congress. They have the same force of law as executive orders and often have consequences just as far-reaching. And some of the most significant actions of the Obama presidency have come not by executive order but by presidential memoranda.

Obama has made prolific use of memoranda despite his own claims that he’s used his executive power less than other presidents. “The truth is, even with all the actions I’ve taken this year, I’m issuing executive orders at the lowest rate in more than 100 years,” Obama said in a speech in Austin last July. “So it’s not clear how it is that Republicans didn’t seem to mind when President Bush took more executive actions than I did.”

A federal district court judge in Pennsylvania ruled Tuesday that portions of President Obama’s executive amnesty are unconstitutional, according to the Washington Post.

Western Pennsylvania District Judge Arthur Schwab concluded in his opinion that Obama’s executive actions go “beyond prosecutorial discretion” and into the realm of legislating.

“President Obama’s unilateral legislative action violates the separation of powers provided for int he United States Constitution as well as the Take Care Clause, and therefore, is unconstitutional,” Schwab wrote in his opinion.

Schwab’s ruling, the Washington Post notes, is the first judicial opinion rendered about President Obama’s executive amnesty.

Federal Judge: Obama Immigration Actions Unconstitutional

A federal judge today ruled that President Obama’s executive actions on immigration are unconstitutional—the first time a court has weighed in since the president’s Nov. 20 announcement.

“President Obama’s unilateral legislative action violates the separation of powers provided for in the Constitution as well as the Take Care Clause, and therefore, is unconstitutional,” wrote U.S. District Court Judge Arthur Schwab, in a 38-page opinion.

Schwab, an appointee of President George W. Bush, issued the ruling in a criminal case that was not a direct challenge to Obama’s moves.

The case involved a once-deported Honduran immigrant, Elionardo Juarez-Escobar, charged in federal court with illegally re-entering the United States after being arrested earlier this year in Pennsylvania for drunk driving.

The court only considered Obama’s immigration policy changes in sentencing Juarez-Escobar to see if he could qualify for deferred deportation under the president’s new enforcement guidelines.

As the 113th Congress draws to a close, Republican Sens. Ted Cruz of Texas and Mike Lee of Utah are facing harsh criticism from colleagues for supposedly opening the door to confirmation of presidential nominees — a claim Lee’s office said is “a complete fabrication.”

Through a series of procedural moves, Lee and Cruz tried to slow passage of the $1.1 trillion government spending bill, which kept the Senate in session through the weekend — a rarity in Washington — instead of returning to address the measure Monday.

The move angered lawmakers on both sides of the aisle. According to The Washington Post, senators were forced to miss events like the Army-Navy football game in Baltimore, Md., and holiday festivities in their home states.

Now, Lee and Cruz stand accused of paving the way for Reid to push through more than two dozen pending presidential nominees.

Lee’s office, however, contends the Senate would have voted on the nominees before the session ended either way.

Ted Cruz Strikes Back: ‘Too Many Republicans Willing to Be Complicit’

In the midst of the debate over a mammoth government spending bill, Republicans and Democrats found something to agree on: their dislike for Sen. Ted Cruz, who forced a rare weekend session for the Senate.

But rather than back down, Cruz opted to call out Washington politicians on Sean Hannity’s radio show Monday.

“Enough is enough,” he told Hannity.

The outspoken Texas Republican joined with Sen. Mike Lee, R-Utah, to force the Senate to take a vote related to funding President Obama’s recent immigration actions. The measure was defeated, 74-22, after Cruz said Republican leaders urged senators to vote against the constitutional point of order. (View the roll call vote.)

“Too many politicians in Washington don’t believe we can stand and fight,” Cruz told Hannity.

He lamented that Republican leaders frequently plead to put off tough fights for another day, as they wanted to do on immigration. Cruz predicted Republicans once again would find an excuse not to act next year as well…
