Arizona State House Passes Bill Barring Biological Males From Girls’ Sports

Lawmakers in Arizona moved a step closer to barring biological males from competing in girls’ sports.

According to a report Tuesday from the Arizona Republic, the state’s House of Representatives passed a bill that would close off designated female sports “to students of the male sex”:

The emotional hours-long debate on House Bill 2706 culminated in a party-line vote of 31-29, sending the measure to the state Senate, where it will become another flashpoint in the culture wars at the state Capitol.

Rep. Nancy Barto, a Phoenix Republican who is sponsoring the measure, argued it is necessary in the face of a lawsuit in Connecticut brought by the conservative Scottsdale-based group Alliance Defending Freedom and students who argue they unfairly lost out in competition with transgender athletes.

H.B. 2706 would require sports or teams sponsored by educational institutions to be designated as either coed, male or female, with biological males not being allowed to compete in female-designated events. Schumer Is Right About SCOTUS and Abortion – Just Not the Way He Meant

“To say that the departments of our government are co-ordinate is to say that the judgment of one of them is not binding upon the other two, as to the arguments and principles involved in the judgment. It binds only the parties to the case decided.” ~Edward Bates, attorney general under President Lincoln

Sen. Chuck Schumer might not realize it, but he inadvertently stumbled across the truth about the Supreme Court. Rather than focusing on the catfight of his war of words against Justices Gorsuch and Kavanaugh, Republicans would be wise to call his bluff on concern over the power of the court and challenge him to join in a bipartisan effort to reduce the runaway powers of the judiciary.

Obviously, if Schumer had a gracious bone in his body, he would simply apologize for his remarks yesterday outside the Supreme Court building saying that Gorsuch and Kavanaugh “will pay the price” for any potential decision they make on abortion cases. In today’s political tinderbox, whether he meant it or not, his comments certainly sounded like a direct threat against the justices.

However, we should all take a step back and ponder why the atmosphere around Supreme Court politics has become so charged in recent years and what can be done to reverse the trend. Democrats are now providing us with the perfect opportunity.

Given how politics has become a blood sport, it’s no surprise that Supreme Court nominations, and now the lead-up to big court decisions, have become such a blood fest. Both parties have wrongly elevated the judiciary to the status of a tribunal super-legislature that can decide every single political and social question with finality. Schumer is 100 percent correct that courts should not decide the abortion issue. Conservatives should call his bluff and offer to take all abortion questions away from the judiciary, a power Congress can use over the courts any day of the week, and let state legislatures decide the issue.

Schumer is forgetting how this latest abortion case even got to the courts. It’s not a potential 5-4 “conservative majority” on the Supreme Court that is wading into the abortion issue. It’s lower courts that continue getting involved in this and other political issues that should be left to the political branches of states or the federal government. How about we keep federal judges out of overtly political issues altogether, and then Schumer won’t have to worry about the coming apocalypse of a supposedly conservative Supreme Court?

Here’s another irony lost on Schumer, one that conservatives should easily recognize. The Louisiana case before the Supreme Court right now, June Medical Services LLC v. Russo, actually demonstrates that Republican-appointed justices, aside from Clarence Thomas and maybe one other, will never overturn even recent expansions for abortion “rights,” much less the foundation of Roe and Casey.

The current case deals with Louisiana’s law requiring that abortion providers have admitting privileges at nearby hospitals within 30 miles of the abortion clinic. If you listened to the premise debated throughout the oral arguments on Wednesday, it was clear that the majority of the justices won’t even reverse the 2016 Hellerstedt decision, the ruling that states can’t “burden” abortion “rights” with certain health care regulations. The entire question they appeared to be debating was whether the Louisiana law could be justified under the Hellerstedt precedent.

As we’ve seen time and again, Roberts and Kavanaugh worship precedent, including even recent cases where Roberts dissented and Kennedy provided the fifth vote, as was the case in Hellerstedt. Once there is a majority behind an opinion, those two will almost always stick with the liberal precedent. Gorsuch and Alito are up in the air depending on the issue. Thomas is the only one who has made it clear he is always willing to reverse cases he believes were wrongly decided, even if they are 150 years old.

Here we are practically engaging in a civil war over the direction of the Supreme Court, when the only question is whether it will continue moving even further to the left or just maintain all of the liberal decisions it has promulgated until now. If Schumer is really concerned about this supposed right-wing court, let’s call his bluff and agree to limit the power of the judiciary altogether and stop it wielding such broad power over political issues.

Conservatives would be short-sighted not to turn the Democrats’ fear of a potential right-wing court into broad judicial reform. We only stand to benefit from keeping our political fights within the political branches.

For example, just yesterday, the Ninth Circuit finalized an injunction against Trump’s border policies, essentially demanding we bring in endless unvetted caravans during a time of global pandemic. Are we really to believe the courts have this power? If Democrats want to chant, “Keep your policies off my body,” shouldn’t we all chant to the Ninth Circuit, “Keep your policies off our sovereign borders”? It is our right to have a sovereign nation. What about a hashtag: “#OurRightOurDecision”?

Rather than spending the rest of the week feigning outrage over the attack on the much-vaunted “independent” judiciary, how about Republicans use this as the impetus for de-escalating the problem by de-emphasizing the power of the courts over the other branches?

Again, there is a kernel of truth to what the Democrats are saying. Republican judges shouldn’t have the final say over the most vital national questions. But neither should Democrat judges. In a republic, unelected courts don’t get to decide with finality broad political questions, stealing the sovereignty of the people, as Abraham Lincoln rightfully believed. That’s exactly why we need to make the courts boring again and keep both the lower courts and the Supreme Court out of political decisions. What Could Go Wrong? Lindsey Graham Leading Group Called to WH — to Talk About Amnesty

Republican voters chose Donald Trump as their nominee, partly inspired by his famous “escalator speech” at Trump Tower decrying how the American people always come last in immigration, as illegal aliens take advantage of us. They voted to reject Lindsey Graham’s view, a view that would tell “bigots” like Trump to “shut up,” in the words of the South Carolina senator.

Fox News reported today that Lindsey Graham led a group of senators from both parties to meet with the president on how to respond to a potential court ruling validating Trump’s elimination of Obama’s illegal executive amnesty. The story comes on the heels of the news that Graham is working with others in the administration to push for a mass amnesty bill.

There are so many grievances the American taxpayer have with illegal immigration that require immediate action. Where is the sense of urgency to meet on an immediate sanctuary fix, criminal alien fix, or judicial amnesty fix? Courts are ordering the opening of our borders during a time of pandemic, yet there is no impetus from these senators to deal with the issue. Why are the American needs on the issue always last or relegated to vacuous campaign rally rhetoric, while the amnesty for illegal aliens is always the first and only focus in the real legislation they plan to enact?

Why is there no emergency to deal with all of the identity theft committed by DACA recipients and all of the gang members and drug traffickers among them? Remember, it’s not usually the older illegal aliens committing all the crime. As with any demographic, it’s the younger ones.

After repeating this mistake over and over again, shouldn’t we finally put enforcement of current laws before any amnesty this time? Isn’t that a baseline expectation we should be guaranteed during the Trump presidency?

The courts have destroyed so much of our rule of law, society, and policies we’ve fought hard for. Why is it that the only time there is a clamor for a legislative “fix” of a judicial decision is when the court actually rules properly and in our favor? What about an Obergefell fix? A Roe fix? Or a fix of any number of court rulings that are ensuring more illegal aliens come here, remain here, commit crimes with impunity, and collect benefits?

Why would someone like Lindsey Graham be the leader on this issue when voters picked Trump precisely to reject people like him and what he stands for? Why does it seem that, in Orwellian fashion, at every turn, we see the swampiest parts of the swamp propped up in the White House that was supposed to drain it?

Even if one supports some sort of an amnesty yet again, this is the wrong way to do it. “We got called over,” Graham told Politico. “I think the president will win in court on DACA that he can set aside the Obama-era DACA rules, then what do you do? I mean if you’re going to give them legal status I hope we get something for it.”

Well, gee, Lindsey, this has been the problem from day one. When you show the other side that you are desperate to give them the amnesty and that you believe in it as strongly as they do, what sort of leverage do you then have to say, “Pretty please, give us something for it?”

As Trump wrote in “The Art of the Deal,” “The worst thing you can possibly do in a deal is seem desperate to make it. That makes the other guy smell blood, and then you’re dead.”

At least if you are going to exalt the dreams of illegal aliens over those of Americans, make sure to enact enforcement measures first this time. Moreover, while they might be here through no fault of their own, it certainly is through no fault of the American taxpayers, who must deal with the costs in their communities. It’s the fault of these very politicians who broke our laws and their side of the bargain in 1986 that enabled this cycle to repeat itself and these people to be brought here in the first place.

This is part of a broader problem we are seeing on multiple issues.

Rather than pushing endless anti-crime measures at a time of rising crime and listening to the voices of law enforcement and prosecutors, Trump is being convinced to hand over criminal justice policy to Kim Kardashian and literally espouse views that are the opposite of what he’s said his entire life, including even today.

Rather than constantly fighting for the American worker at a time when China and India are keeping us out of our own jobs and engaging in trade theft, there is a unanimous clamor from the White House to bring in more foreign workers.

E-verify was dropped from the White House’s plan. Members of the administration are working with Graham and Tillis on a sperate amnesty for 3.3 million illegal aliens who claim to illegally work in agriculture. They are expanding H-2 low skilled visas more than any other administration. Rather than ending TPS, it has been extended indefinitely for the countries that have the most illegal aliens here benefitting from that status.

There have certainly been good policies implemented as well, such as the public charge rule. But that reveals the broader problem we face: a schizophrenic administration. The policies reflect the divergent goals of competing voices.

But at some point, you can’t have it both ways. It’s either the vision of Trump’s escalator speech or the vision of Lindsey Graham. Either Americans are dreamers, or only illegal aliens are. At some point, Trump is going to have to decide for himself.

Jason Chaffetz: If Dems Pick Biden to Face Trump, ‘Hallelujah Because Donald Trump Is Going to Kick His Butt’

By Fox News. Former Utah congressman and Fox News contributor Jason Chaffetz said on “Outnumbered Overtime” on Wednesday that if Democrats are going to choose former Vice President Joe Biden as their nominee then “hallelujah because Donald Trump is going to kick his butt.”

The former Chairman of the House Oversight Committee reacted after Biden won ten of 14 state primaries on Super Tuesday, surging to victory in a series of contests across the South and beyond, while Sen. Bernie Sanders, I-Vt., claimed a sizable win in delegate-rich California, setting up a battle between the two men that is likely to drag on for weeks, or longer.

“In terms of messaging, you can’t have somebody who fumbles the ball more than Joe Biden so if that’s the messenger, it’s a messenger from the past, it’s not vibrant, it’s not exciting, it’s not the future and it is embarrassing to watch on a daily basis,” Chaffetz said.

“I think Donald Trump is stronger politically than he’s ever been before,” Chaffetz added on Wednesday. “If he plays his A-game, I think he will dominate and win by a bigger margin than he beat Hillary Clinton [by]. Kellyanne Conway’s Husband Donates Max Amount to This Candidate’s Campaign

George Conway, the husband of Counselor to the President Kellyanne Conway, revealed on Tuesday that he donated $2,800 to former Vice President Joe Biden’s presidential campaign, the maximum contribution allowed by law from an individual to a candidate committee.

New York magazine’s Washington correspondent Olivia Nuzzi tweeted that Conway told her that he tried giving $5,600 but the “website wouldn’t take it. They need to change that.” Nuzzi also tweeted that Conway explained his donation by saying, “the nation can’t afford four more years with a megalomaniacal moron in the White House.”

A longtime critic of his wife’s boss, Conway is a co-founder of the Lincoln Project, an anti-Trump super PAC.

In a December New York Times op-ed, the group denounced what it called the “corruption and corrosive nature of Donald Trump.”

“Over these next 11 months, our efforts will be dedicated to defeating President Trump and Trumpism at the ballot box and to elect those patriots who will hold the line,” said the piece which was signed by George Conway and Republican strategists Rick Wilson, Steve Schmidt and John Weaver. WATCH: Biden Wants to Put Beto in Charge of Gun Control?

Last night, Allahpundit speculated that if Biden had cut a deal with Pete Buttigieg to get him to step aside before today’s cascade of delegates being awarded, it would probably involve making him the head of Housing and Urban Development. In terms of the way business normally gets done in the swamp, that’s not a bad bet. After all, it’s the department where you can stick almost anyone and they won’t wind up doing too much damage even if they majorly mess up.

But what about Beto O’Rourke? For some reason, he was on the stage last night endorsing Uncle Joe as well. Does he get some sort of consolation prize for hopping on the “moderate” bandwagon and helping to defeat Bernie Sanders? When the Big Reveal arrived last night, Biden offered a hint as to what the future may hold for the failed Senate and presidential candidate. O’Rourke will “take care of the gun problem” in the country.

What does that even mean? Gun control is a law enforcement issue. Could Biden actually be considering putting O’Rourke in as Attorney General? Looking over his resume, you will find that Beto has just about the least qualifications imaginable for such a position. He was an English major in college and worked a series of what were basically odd jobs before becoming a perennial candidate for public office. Even in Congress, none of the committees he sat on had anything to do with gun control or any other law enforcement activities. In reality, the sum total of O’Rourke’s involvement with the law was being arrested for burglary and fleeing the scene of his DUI accident.

Conflict of Interest: GOP Rep. Duncan Hunter’s Prosecutors Attended Hillary Clinton Fundraiser

. . .Duncan Hunter submitted court documents on Tuesday claiming that the criminal indictment against him should be dismissed because two of the U.S. Attorneys who prosecuted his case displayed a clear conflict of interest by attending a fundraiser for then-presidential candidate Hillary Clinton in 2015.

Hunter, who pleaded guilty to one count of misusing campaign funds in December, submitted the motion to dismiss in advance of his March 17 sentencing hearing; he faces a maximum of five years in prison and a fine of up to $250,000.

Hunter’s defense lawyers argued that the prosecutors were required to recuse themselves from his case because their attendance at the fundraiser constituted a conflict of interest and appearance of a loss of impartiality in accordance with the U.S. Attorney’s Manual.

“Here, the former Acting US Attorney for the Southern District of California and the Assistant US Attorney leading the investigation of Congressman Hunter both attended a political fundraiser for candidate Clinton and shortly thereafter both were involved in initiating an investigation of the first Congressman to endorse candidate Trump,” Hunter’s attorneys wrote. “The Defendant argued those facts alone warranted recusal.” (Read more from “Conflict of Interest: GOP Rep. Failed Democratic presidential candidate Mike Bloomberg gave up on his White House bid Wednesday after a dismal showing on Super Tuesday, but the former New York mayor still believes he “would’ve beaten [President] Donald Trump in November” if only he could have won his party’s nomination. . .

During his farewell speech, Bloomberg told an audience of supporters, “This really is the best, most creative, most hardworking campaign team ever assembled. And I have to say, there is no doubt in my mind we would’ve beaten Donald Trump in November.”

Bloomberg added, “And you know who else knows that? Donald Trump. He’s been scared stiff of us and for good reason.”

According to NPR, Mr. Bloomberg, a billionaire, ran “the most expensive self-funded campaign ever” in his pursuit of the Oval Office, shelling out more than $500 million just in advertising ahead of Super Tuesday. But his big spending did not pay off — Bloomberg failed to win a single state on Tuesday, only securing U.S. territory American Samoa. Inside Bloomberg’s Half-Billion-Dollar Belly Flop

By Politico. Mike Bloomberg left the West Palm Beach ballroom where his campaign held an upbeat Super Tuesday party feeling deflated but resolute. He knew the results coming in from across the country looked increasingly grim. But he wanted to assess the final count in the light of day before deciding whether to end his short-lived bid for the White House. . .

Bloomberg started with a record-breaking ad buy of $34 million. The blitz was aimed at attracting African-American and Latino voters, two demographic groups key to winning the nomination. It was his means of catching up with those at the top of the Democratic ticket and for a while, polls showed that it may have worked in his favor: By the end of January,he polled in double digits, just behind Elizabeth Warren. By mid-February, he was the top choice among 20 percent of black voters.

He spent nearly $200 million in Super Tuesday states, including more than $30 million in the South, but he crossed the 15 percent threshold in just two Southern states.

He reasoned that he could skip the first four voting states in favor of delegate-rich ones that vote on Super Tuesday. In recent weeks, at least two high-ranking campaign advisers have privately questioned his decision not to compete in South Carolina, where they believe he could have done well. New York Officials Order 1,000 Quarantined Fearing Possible Contact With Coronavirus Patients

By The Blaze. Roughly 1,000 people in New York City have been ordered quarantined by health officials, most over fears that they many may have come in contact with any of five individuals in one community who have tested positive for the coronavirus known as COVID-19. . .

The Washington Post reported that the outbreak began as such: “First, a lawyer who commutes between the suburbs and his midtown Manhattan office was diagnosed with the coronavirus. Then, his wife and children tested positive, along with a neighbor who drove him to the hospital.”

The lawyer was admitted to a hospital and his wife and the two children were quarantined in their home. One of the kids, a boy, is a student who lived on campus at Yeshiva University, according to the New York Post. The outlet noted that “his 14-year-old sister attends the private Jewish SAR Academy in Riverdale that closed Tuesday for ‘precautionary measures.'”

Now, anyone who came into contact with the family or the neighbor either through the kids’ schools, the parents’ law firm, their medical treatment, the family’s synagogue, or in any other capacity have been ordered by health officials to self-quarantine. . .

In addition to the folks who may have come in contact with the family or the neighbor, Gov. Andrew Cuomo told reporters that another 300 study-abroad students at state-run universities are being recalled back from countries with high numbers of coronavirus cases, namely China, Italy, Japan, Iran, and South Korea. Five More New York Coronavirus Cases Confirmed, Bringing State Total to 11

By New York Post. New York’s tally of coronavirus cases rose to 11 on Wednesday, as officials revealed that nine people linked to an infected Westchester attorney tested positive — and some 1,000 people were asked to self-isolate.

“This is the most complex case we’ve had in terms of the number of interactions,” Gov. Cuomo said at an afternoon press briefing in Albany announcing the most recent batch of confirmed cases.

Since the lawyer — identified by sources as Lawrence Garbuz, 50, of New Rochelle — on Tuesday became the second Empire State resident to test positive for the contagion, those around him have fallen like dominoes. Chief Justice Roberts Condemns Schumer for ‘Dangerous’ and ‘Threatening Statements’

By Daily Caller. Supreme Court Chief Justice John Roberts said House Minority Leader Chuck Schumer’s Wednesday remarks were “dangerous” and “threatening statements.”

Schumer said during a rally in front of the United States Supreme Court that Justices Neil Gorsuch and Brett Kavanaugh “released the whirlwind,” and would “pay the price.” The New York Democrat also said the pair “won’t know what hit you” if they side in a way that hurts abortion access in a case before the court Wednesday. . .

“All members of the Court will continue to do their job, without fear or favor, from whatever quarter,” Roberts added.

GOP Senator to Try to Censure Schumer Over SCOTUS Remark

By The Hill. Sen. Josh Hawley (R-Mo.) said on Wednesday night that he will try to censure Senate Minority Leader Charles Schumer (D-N.Y.) after remarks made toward Supreme Court Justices Brett Kavanaugh and Neil Gorsuch.

The Democratic leader earlier in the day warned that the two conservative justices would “pay the price” if they voted against abortion rights.

“I would call on Schumer to apologize, but we all know he has no shame,” Hawley tweeted. “So tomorrow I will introduce a motion to censure Schumer for his pathetic attempt at intimidation” of SCOUS.
