California: Suspect Arrested 3 Times in 12 Hours Thanks to Zero-Bail Policy

A suspect was arrested three times over the course of 12 hours by Orange County, California, law enforcement officials thanks to the state’s newly enacted zero-bail policy for accused criminals charged with a variety of crimes.

Dijon Landrum, 24-years-old, was first arrested by the Glendora Police Department on the morning of April 29 after he was allegedly caught breaking into a vehicle and attempting to steal it. When police arrived at the scene, they said Landrum tried to drive off in the stolen car, along with stolen property and narcotics.

Landrum was arrested but quickly released thanks to California’s newest zero-bail policy for most suspects accused of misdemeanors and felonies considered “low-level.” The policy was passed by the state’s Judicial Council in early April as part of a larger effort to empty prisons during the Chinese coronavirus crisis.

About an hour after Landrum’s release, the Glendora Police Department was called after eyewitnesses said a man was walking through their neighborhood with a box and stealing items off residents’ front lawns. . .

Flynn Documents Are the ‘Smoking Gun’ on Comey’s FBI; The FBI Set Flynn up to Preserve the Trump–Russia Probe

By The Hill. Had the Department of Justice (DOJ) released the newly disclosed documents related to Gen. Michael Flynn three years ago, instead of fired FBI Director James Comey improperly leaking his “memos” on President Trump, there definitely would have been a special counsel — only it would have been investigating the FBI for gross abuse of power, not the Trump administration.

The new documents are in effect the “smoking gun” proving that a cabal at the FBI acted above the law and with extreme political bias, targeting people for prosecution rather than investigating crimes.

DOJ Inspector General Michael Horowitz found 17 violations of policy and procedure in the initiation of the investigation of Trump’s campaign. Former special counsel Robert Mueller’s report found no evidence of any Trump-Russia collusion. And yet much of the media coverage of all this has been so riddled with bias that, in a recent poll, 53 percent still believe Trump colluded with the Russians to win the 2016 presidential election.

Let’s remember how this all started: The principal evidence that prompted the FBI to open the overall investigation into Trump has been definitively determined to be the Steele dossier. We now know, based on recently disclosed footnotes in the Horowitz report, that the dossier was discredited by its own sources and may even have been deliberate Russian disinformation. After receiving this information, the FBI’s top brass — even after learning that the dossier was paid for by the Democratic National Committee and the Hillary Clinton campaign — opened a broad investigation into Trump and his campaign. The FBI Set Flynn up to Preserve the Trump–Russia Probe

By National Review. Michael Flynn was not the objective. He was the obstacle.

Once you grasp that fundamental fact, it becomes easier to understand the latest disclosures the Justice Department made in the Flynn case on Thursday. They are the most important revelations to date about the FBI’s Trump–Russia investigation, code-named Crossfire Hurricane.

The new disclosures, in conjunction with all we have learned in the last week, answer the all-important why question: Why was Flynn set up?

The answer to the what question has been clear for a long time: The FBI set a perjury trap for Flynn, hoping to lure him into misstatements that the bureau could portray as lies. In the frenzied political climate of the time, that would have been enough to get him removed from his new position as national security adviser (NSA), perhaps even to prosecute him. On that score, the new disclosures, startling as they are to read, just elucidate what was already obvious. . .

To understand what happened here, you have to understand what the FBI’s objective was, first formed in collaboration with Obama-administration officials. That includes President Obama, Vice President Biden, and Flynn’s predecessor, national-security adviser Susan Rice, with whom then-Acting Attorney General Sally Yates and then-FBI director James Comey met at the White House on January 5, 2017 — smack in the middle of the chain-of-events that led to Flynn’s ouster. Recall Rice’s CYA memo about the meeting: “President Obama said he wants to be sure that, as we engage with the incoming team, we are mindful to ascertain if there is any reason that we cannot share information fully as it relates to Russia” (emphasis added). With Fears of Meat Shortages on the Rise During the COVID-19 Pandemic, More Americans Are Hunting

. . .Game and fish agencies across the nation have seen increased interest in hunting licenses. In Vermont, resident fishing license sales are up by more than 50% over this time last year, according to VTDigger.

The turkey hunting season starts this Friday, and turkey hunting licenses are already up 26%. Hunting and fishing license sales have increased by almost a quarter, which is a reversal of recent years that saw a decline in hunting licenses in every county in Vermont. The U.S. saw a 255,000 drop in the number of hunters between 2016 and 2020, according to the U.S. Fish and Wildlife Service license data.

As of April 20, the Vermont Fish and Wildlife Department sold around 17,000 fishing licenses for the year, compared to 11,700 the same time last year.

In the first week of its turkey hunting season, Indiana experienced a 28% jump in turkey license sales.

Georgia saw a 47% increase in turkey hunters in wildlife management areas this year compared to 2019. In the first 23 days of Georgia’s turkey hunting season, there was a 26% increase in turkeys killed despite no rise in the turkey population, according to Reuters. Why Is the Trump Administration Allowing Judges to Illegally Release Criminal Aliens?

Attorney General Barr threatened to file lawsuits against governors overstepping their power to infringe upon civil liberties, yet the only lawsuits that are succeeding are the ones from illegal aliens. Suddenly, when it comes to those with no right to be in our communities, the courts are all-powerful and the executives are weak. In fact, the president really has the power to deport illegal aliens and prevent them from being released into our communities.

Late on Thursday, U.S. District Judge Marcia G. Cooke in Miami became the latest federal judge to illegally mandate that ICE release “vulnerable” populations in detention facilities. She charged that ICE acted with “deliberate indifference” and engaged in what amounts to “cruel and unusual punishment” against illegal aliens by not releasing them during the coronavirus epidemic.

Therefore, Cooke ordered ICE to submit twice-weekly reports on the status of the detainees and who is being released. She also ordered that ICE shall immediately provide masks to all detainees and replace them once a week.

Well, I don’t have masks – maybe I can get a judge to order them for me too?

There’s one ingredient missing here, and it sheds light both on the morality of detaining illegal aliens during this epidemic and the legality of a judge ordering them released into our communities rather than released to their home countries. These people are in detention of their own volition. They broke into our country and can always voluntarily depart. The only reason they are being held is because they are the ones resisting repatriation and are trying to litigate their way into the country. That is their choice. If they want to do so during an epidemic they must wait in detention. If they are truly concerned about dying of the virus – enough to file a lawsuit – then they should ask for voluntary departure.

This is an illegal ruling. 8 U.S.C. §1226(e) states plainly that these decisions are not subject to judicial review: “The [AG’s] discretionary judgment regarding the application of this section shall not be subject to review. No court may set aside any action or decision by the [AG] under this section regarding the detention or release of any alien or the grant, revocation, or denial of bond or parole.”

Indeed, ICE lawyers as well as the magistrate judge originally hearing the case under Judge Marcia Cooke agreed there is no authority to adjudicate this case.

Now, an illegal ruling can potentially lead to the release of another 1,200 into our communities, but only if the administration lets it happen.

It’s truly disgusting how during a time of unprecedented executive power, when courts are so passive in the face of the onslaught against citizens’ rights, the federal government is so passive and submissive to an illegal court ruling purporting to govern people who have no right to be here.

If this is truly against statute, the executive branch has an obligation to uphold statute. Yes, all things equal, the law provides these illegal aliens with an immigration court process. But that requires detention, and if a judge is going to subvert detention, then Trump has every right to remove them from the country.

The Supreme Court has said for 130 years, in what is considered one of the most uninterrupted chains of case law, that illegal aliens who have not been affirmatively and consensually admitted to this country are as if they are standing physically outside our country. Clarence Thomas has suggested that perhaps the president has inherent authority to deport even a legal immigrant who is here under statute. But Trump certainly can apply that to an illegal alien who is considered as if he’s standing outside our country.

Already as far back as the 1950s, the Supreme Court had already said, “For over a half century this Court has held that the detention of an alien in custody pending determination of his admissibility does not legally constitute an entry though the alien is physically within the United States.” Leng May Ma v. Barber, 1958.

Even an alien under questionable status, and certainly someone who snuck into the country “was to be regarded as stopped at the boundary line and kept there unless and until her right to enter should be declared.” Kaplan v. Tod, 267 U.S. 228, 230 (1925). Even after she was no longer detained, “[s]he was still in theory of law at the boundary line and had gained no foothold in the United States.”

Once they are regarded as if they are outside the country, not only does the president have inherent constitutional authority (governing foreign affairs and foreign commerce) to repatriate them, but even delegated authority under his emergency health crisis powers.

In fact, what the courts are doing – mandating the release of illegal aliens rather than returning them – is not only harming our security and breaking our laws, but is going to spread the virus even more.

Here’s the reality: the ACLU is right – coronavirus spreads like wildfire in prisons and ICE facilities. But that ship has sailed a long time ago. The good news is it demonstrates that the fatality rate, especially for this predominantly young population, is remarkably low. Out of over 50,000 foreign nationals detained in ICE detention facilities, not a single one has died (although two guards have died). We don’t know how many have contracted COVID-19, but over 60% of the over 1,000 who were tested for it were confirmed positive. Which means it’s likely that thousands have been exposed. This is yet one more data point showing the virus has an even lower fatality rate than people think.

But on the other hand, by releasing them, you will be taking predominantly younger people who have already developed herd immunity in a confined setting and releasing them into a population that has not been exposed quite as much. Moreover, as I noted with regard to domestic criminals being released under COVID-19 jailbreak, they are being thrust suddenly into communities without much of a home and will get even less treatment than they would in the facilities. This is certainly true for illegal aliens who often have no connection to a community but receive better health care at ICE facilities than American inmates in prison. Why release them and not remove them?

What sense does that make? Who knows, but one thing is clear: Like every policy decision revolving around this virus, it is not determined by either science or law. Another Woman Comes Forward With Disturbing Allegation Against Joe Biden; Reade Says Complaint Would Prove Biden Aides Lied

On the heels of Biden publicly responding to Tara Reade’s sexual assault allegations comes a new allegation from 26-year-old Eva Murry, who claims that in 2008, then-Senator Joe Biden complimented her on the size of her breasts at the First State Gridiron Dinner & Show. Murry was just 14 years old at the time.

“One friend and her sister said that Murry told her details of the alleged incident more or less immediately after it happened,” reports Law&Crime. “Four other friends of Murry’s said they were told about the incident, with the same details, between two and three years after it originally occurred.”

Law&Crime interviewed the friends and family Murry says she told. Murry is the niece of Christine O’Donnell, who ran for the U.S. Senate in Delaware 2010 in a longshot bid for Biden’s vacated U.S. Senate seat. Murry says she occasionally got school credit for attending political events.

“I remember walking into the lobby and being in awe of all the people in such fancy clothes,” Murry said in an interview. “Our two parties of people gravitated towards each other and everyone started saying their hellos. When it was Biden and my aunt’s turn to say hello he quickly turned to me and asked how old I was. I replied with my age and he replied with the comment ‘Fourteen? You’re very well endowed for 14!’ I was confused but it was definitely weird, he looked me up and down and hovered his eyes on my chest so I had some clue [about] the notion of his comment but didn’t fully understand at the time. We quickly separated from his area after the encounter.”

Reade Says Complaint Would Prove Biden Aides Dennis Toner and Ted Kaufman Lied About Not Knowing Her

By Daily Caller. 2020 presidential candidate Joe Biden’s accuser Tara Reade says a complaint she filed with the Senate personnel office would prove that former Biden aides Dennis Toner and Ted Kaufman have lied in their denials of her story. . .

After the alleged assault, Reade told the Daily Caller News Foundation, she complained about sexual harassment to three Biden staffers: Marianne Baker, Biden’s executive assistant, and Dennis Toner and Ted Kaufman, who were both top Biden aides at the time.

Kaufman served as Biden’s chief of staff from 1976 until 1994 and as a Delaware senator from 2009 to 2010. He worked on former President Barack Obama’s transition team in 2008 and has begun work with Biden preparing for Biden’s potential transition to the White House in the case he wins the presidential election, according to the New York Times. . .

But Kaufman, Baker and Toner would not take action when Reade complained to them about sexual harassment, Reade said, so she filed a written complaint with an office she called the “Senate Personnel Office.” . . .

The Office of Senate Fair Employment Practices received 28 formal complaints between June 1992 and September 1994, according to a Senate report on the office published in the 1990s. However, OCWR would not say whether it maintains records relating to the complaints received by its progenitor. ‘Don’t Defend Trump’ Memo Uncovered, Written by Top Republican Strategist

The linchpin of the ludicrous strategy put forth in the document is to avoid mentioning President Donald Trump’s role during the national emergency. . .

In essence, the document advises Republican Senate candidates to distance themselves from Trump.

GOP Memo Urges ‘Anti-China’ Assault Over Coronavirus

By Politico. The National Republican Senatorial Committee has sent campaigns a detailed, 57-page memo authored by a top Republican strategist advising GOP candidates to address the coronavirus crisis by aggressively attacking China. . .

The document urges candidates to stay relentlessly on message against the country when responding to any questions about the virus. When asked whether the spread of the coronavirus is Trump’s fault, candidates are advised to respond by pivoting to China. . .

The NRSC memo shows that Republicans are also eager to make China an issue in down-ballot races. It was distributed by the Senate GOP campaign arm, though it was not explicitly drafted by or for the committee. It was authored by the political consulting firm of Brett O’Donnell, a veteran Republican strategist who has advised Secretary of State Mike Pompeo and Arkansas Sen. Tom Cotton. . .

The memo includes guidance on what Republican candidates can say when asked whether blaming China for the pandemic incites racism. Candidates are urged to respond by saying that, “No one is blaming Chinese Americans. This is the fault of the Chinese Communist Party for covering up the virus and lying about its danger. The very next day, January 5th, James Comey goes to the White House for a meeting with President Obama and Vice-President Biden.

Bombshell Flynn Files Helping Durham Build ‘Serious Case’

The files unsealed this week in the Michael Flynn case showing FBI officials discussed trying to get the former national security adviser to lie are bolstering the “serious case” the Justice Department is building against FBI and DOJ officials who carried out a counter-intelligence “Russia collusion” probe of the Trump campaign in 2016.

Sources who spoke to Fox News said charges could be justified against officials, and Attorney General Bill Barr is speaking regularly with U.S. Attorney John Durham, who is leading the investigation.

New Poll: Trump Approval Rating Hits All-Time High

By National Review. President Trump’s approval rating hit an all-time high in a Gallup survey released on Friday, with 49 percent of respondents approving of his performance versus 47 percent disapproving.

The results continue a wide swing in polling for Trump, who garnered a 43 percent approval rating two weeks ago.

Joe Biden Almost Tied With Donald Trump as Lead Falls Within Margin of Error: Poll

By Newsweek. Former Vice President Joe Biden’s lead over President Donald Trump is within the margin of error, according to new polling data.

The latest survey published by The Hill and Harris X on Thursday found that 42 percent of registered voters said they would back Biden if an election were held today, while 40 percent threw their votes behind the president.

A further 5 percent of voters said they would vote for a third party candidate instead of the Republican incumbent or his Democratic challenger.

Department of Education Investigating University Over Links to Wuhan Lab

The United States Department of Education is investigating the University of Texas over links to the Chinese lab in Wuhan potentially involved in the origin of the Chinese virus, along with the university’s ties to companies including Huawei and Zoom, the popular video conferencing app criticized for its poor security.

The U.S. Department of Education has requested for the University of Texas System to provide documents involving records or gifts from the Wuhan Institute of Virology and its researcher Shi Zhengli, according to a report by the Wall Street Journal.

The report added that the Education Department’s probe into the university is part of a broader investigation into potential improper financial disclosures of foreign money by the University of Texas System.

The Education Department is also asking the university system to provide documents regarding possible ties to the Chinese Communist Party (CCP), as well as about two dozen Chinese universities and businesses — including Huawei Technologies Co. — according to a letter obtained by the Wall Street Journal.

Bombshell: Strzok Reopened Flynn Case After FBI Closed It; Trump Says He Would ‘Certainly Consider’ Bringing Flynn Back Into His Administration

By WND. Newly unsealed court filings show disgraced former FBI agent Peter Strzok reopened the investigation into former national security adviser Michael Flynn after it had been closed due to a lack of evidence.

The closure, according to a memo, was three weeks prior to the controversial “ambush” interview of Flynn at the White House that resulted in him being charged with perjury, The Washington Times reported.

Among the other evidence unsealed this week in the Flynn case is a handwritten note by the FBI’s former head of counterintelligence, Bill Priestap, showing agents discussed whether they should try “to get [Flynn] to lie, so we can prosecute him or get him fired.”

The Jan. 4, 2017, FBI memo, unsealed Thursday, said the investigation of Flynn, dubbed Crossfire Razor, had been closed due to “the absence of any derogatory information or lead information.” . . .

Trump Says He Would ‘Certainly Consider’ Bringing Flynn Back Into His Administration

By Fox News. President Trump said Thursday he would “certainly consider” bringing retired Lt. Gen. Michael Flynn back into his administration, adding he believes his former national security adviser will be “fully exonerated” in light of new evidence in the federal case against him.

“It looks to me like Flynn would be fully exonerated based on everything I see. I’m not a judge but I have a different type of power,” Trump said while taking questions at an address on protecting America’s seniors amid coronavirus.

“I don’t think I would have to use that power,” Trump said when asked if he would consider pardoning Flynn. “Hopefully we won’t have to get there.” . . .

The president on Thursday said he would “certainly consider” bringing Flynn back into his administration. “He’s a fine man,” he added. “Yeah, I would.” Trump declined to say in what capacity he might bring Flynn back, adding he hadn’t given much thought to the matter, but pointed to new evidence in the Flynn case revealed this week. Nunes: We Knew From Day One Michael Flynn Was Innocent — Because FBI Top Officials ‘Told Us so’

By Breitbart. Representative Devin Nunes (R-CA), the ranking Republican on the House Intelligence Committee, says it is a no-brainer that former National Security Advisor Michael Flynn was innocent from the beginning and that he was a victim of an overzealous FBI.

Nunes told Fox Business Network’s Maria Bartiromo the sources of documents promoting the notion that the 2016 Trump campaign was in cahoots with Russia to steer the outcome of that election warranted an investigation, given they were used to justify the Department of Justice and the FBI’s handling of Flynn. . .

“So you know, we’re running an investigation, but the problem is, is that you know, we have a small team on the House Intelligence Committee, but the bottom line with Flynn, is this — Maria,” Nunes said. “We knew from essentially day one, early on in 2017, and that he was innocent. How do we know that? Because the top officials at the FBI told us so. This wasn’t rocket science. Then you talked about the report that we did, so we have the gold standard. The House Republican report is really the gold standard of reports. In fact, there are no other reports to even look at because the others are all based on lies or innuendo or corruption, OK?” So our report was right at the time, and you may recall this, but we had to fight for nearly two months.
