Tea Partyers Rally at Capitol, Blame White House for IRS Mess

Thousands of activists rallied outside the Capitol on Wednesday to protest the IRS targeting of conservative and tea party groups, with many of the event’s speakers laying the blame for the fiasco squarely at the White House.

The “Audit the IRS” rally, organized by the Tea Party Patriots organization in response to the agency’s improper scrutiny of conservative groups applying for tax-exempt status, drew members and leaders of tea party groups across the country, radio personality Glenn Beck and the Senate’s tea party trio: Republicans Rand Paul of Kentucky, Mike Lee of Utah and Ted Cruz of Texas.

“When Richard Nixon tried to use the IRS to target his political enemies, it was wrong,” Mr. Cruz said. “And when the Obama administration does it, it’s still wrong.”

Rep. Tim Huelskamp, Kansas Republican, said the two presidents have become so intertwined in his mind that he thinks of Mr. Obama as “President O’Nixon.”

Ken Hoagland, chairman of Restore America’s Voice PAC, accused former White House counsel Bob Bauer of sending “memo after memo to the Justice Department, to the IRS and other interested parties urging them to go after law-abiding citizens who wanted to end voter fraud [and] exercise their rights to stop an out-of-control government. This abuse of Americans was directed by Washington at the very highest levels of the Obama administration and campaign.”

Think the IRS Is Bad Now? Just Wait

The Internal Revenue Service has never been an agency much loved by the American people. With the IRS’s targeting of conservative groups, its already bad reputation has now sunk to a new low.

But the scandal raises a critical question: If the IRS can’t manage an increase of 1,700 applications for tax-exempt status that the agency said spurred its targeting of conservative groups, how will the IRS handle its massive new role in implementing ObamaCare?

Under the Affordable Care Act, premium subsidies—tax credits in ObamaCare designed to defray the cost of purchasing health insurance—will go to some seven million tax filers and flow to households earning as much as $94,000 a year. The credits are both advanceable and refundable, meaning the IRS will pay them first and verify the claims for them later, what some call “pay and chase.”

Refundable tax credits are essentially a form of spending through the tax code, something the IRS has struggled to administer for years with other programs. That’s why it’s not far-fetched to say that these premium credits will go to a lot of people inappropriately, and that we can expect to see a lot of erroneous and fraudulent payments.

Look at the Earned Income Tax Credit. Whether you like this refundable credit or not, the Treasury Department’s inspector general for tax administration reported in April that improper payments account for 21% to 25% of total EITC payments in 2012. Take the percentage of improper EITC payments and apply it to the approximate $1 trillion we’ll spend on ObamaCare premium credits in the decade beginning 2014. The math shows that we could see between $210 billion and $250 billion distributed to those who shouldn’t get it—because the IRS has no system in place to verify reported household income.

FBI Hasn’t Contacted a Single Tea Party Group in IRS Probe, Groups Say

There is no evidence that the FBI has contacted a single tea party group in its criminal investigation of the Internal Revenue Service, according to the groups the IRS abused.

“We have not been contacted by any federal investigative agency and, to date, none of our clients have been contacted or interviewed by the FBI,” Jay Sekulow of the American Center for Law and Justice told The Daily Caller on Thursday. The ACLJ has filed suit against the IRS on behalf of 25 conservative groups, with additional groups being added in the next couple weeks, according to a spokesman…

Tea Party Patriots — a group with thousands of local chapters — “has not been contacted by the FBI” either, according to Jameson Cunningham, the group’s spokesman.

The revelation suggests that the FBI is in no hurry to get to the bottom of the scandal, despite the Obama administration’s promise to investigate the IRS’s multi-year abuse of conservative groups…

Attorney General Eric Holder promised in mid-May that the FBI would get to the bottom of the IRS’s behavior by opening a criminal investigation.

IG: More Than 1,000 IRS Employees Misused Government Charge Cards; Wrote 325 Bad Checks

The Treasury Inspector General for Tax Administration revealed in a recently released audit report that in fiscal years 2010 and 2011 more than 1,000 Internal Revenue Service employees misused government charge cards issued by Citibank.

The report said that during the two years in question agency employees sent Citibank a total of 325 bad checks written on personal accounts that had insufficient funds to cover them, that agency officials with top-secret security clearances had their charge accounts suspended for failure to pay the balances, and that the IRS had a tendency of being “overly lenient” in disciplining those who misued the cards.

Despite the more than 1,000 IRS employees who misused the charge cards, the inspector general’s report found that the IRS did a “generally effective” job in controlling its employees use of the cards.

“We found that the IRS was generally effective in implementing travel card controls,” said the IG report. “However, in some instances controls were not implemented effectively, which increased the risk for misuse and resulted in some travel card misuse going undetected.”

The report, which is dated April 18, 2013, was released on May 29.

FBI Director Dropping the Ball on IRS Investigation, Defends NSA (+video)

The country’s top investigator seemed to be in the dark Thursday when pressed to provide details of the IRS investigation into the tax agency’s targeting of Tea Party and conservative groups.

Rep. Jim Jordan, R-Ohio, seemed to rattle FBI Director Robert Mueller for not knowing the specifics surrounding the IRS probe.

“You’ve had a month now to investigate,” Jordan said. “This has been the biggest story in the country and you can’t even tell me who the lead investigator is. You can’t tell me the actions the inspector general took which are not typically how investigations are done. You can’t tell me if that’s appropriate or not. This is not speculation. This is what happened.”

Mueller repeatedly declined to answer Jordan’s questions, saying he couldn’t because the investigation was ongoing or that he’d have to get back to the lawmakers with answers.

When Jordan asked again,” Can you tell me who the lead investigator is?” Mueller responded, “Off the top of my head, no.”

FOIA: 201 IRS Agents Working Full Time on Union Work, Not Government Business

In a response to a Freedom of Information Act (FOIA) request from Americans for Limited Government, the Internal Revenue Service revealed this month that 201 of its employees work full-time on union activities…

The redacted list of 201 IRS employees, whose names have been blacked out, features only those employees who are entirely engaged in union work. The list does not include employees who spend part of their time on government work and other portions on union work, according to ALG.

The list of 201 employees offers job titles, salary information, and some location information. The job titles appear innocuous and make the work appear to be focused on agency business rather than union business. Titles include “Internal Revenue Agent,” “Revenue Officer,” “Tax Specialist,” “Rev Officer,” “Clerk,” “Contact Representative,” “Case Advocate,” and the like. Some boast six-figure salaries, with the highest paid employee on the list earning $138,092.

[Americans for Limited Government President Nathan] Mehrens explained that in many cases employees are hired for a certain job classification but end up doing union work.

“This person was hired to file things,” Mehrens said of one of the employees listed on the documents under the job title “File Clerk.” ”But instead of filing things this person is doing union work. So somebody else presumably has to pick up the slack and handle that. There is not a job classification for ‘union steward’… so they are in these positions and instead of actually doing the work that would fit the job classification they are basically excused from doing that job in order to work on behalf of the union.”

Congressman Sees IRS Agents Training with AR-15s During DHS Tour, Demands Answers

Jeff Duncan questions IRS rifle usage

By Tal Kopan. Rep. Jeff Duncan wants to know why IRS law enforcement agents are training with AR-15 rifles.

As chairman of the House Homeland Security oversight subcommittee, Duncan (R-S.C.) toured a federal law enforcement facility in late May and noticed agents training with the semi-automatic weapons at a firing range. They identified themselves as IRS, he said.

“When I left there, it’s been bugging me for weeks now, why IRS agents are training with a semi-automatic rifle AR-15, which has stand-off capability,” Duncan told POLITICO. “Are Americans that much of a target that you need that kind of capability?”

While Duncan acknowledges that the IRS has an enforcement division, he questions if that level of firepower is appropriate when they could coordinate operations with other agencies, like the FBI, especially in a time of austerity.

“I think Americans raise eyebrows when you tell them that IRS agents are training with a type of weapon that has stand-off capability. It’s not like they’re carrying a sidearm and they knock on someone’s door and say, ‘You’re evading your taxes,’” Duncan said. Read more from this story HERE.

Ted Cruz: Obama Targeting Enemies, Can’t be Trusted

Texas Sen. Ted Cruz on Tuesday decried the spread of unaccountable federal agencies like the IRS and National Security Agency caught prying into American lives, charging that President Obama’s promise that his administration isn’t snooping on citizens can’t be trusted.

What’s more, Cruz said that by spreading a broad net to include average Americans in its search for terrorists via the NSA, the administration missed catching actual U.S. enemies such as the Boston Marathon bombers and the Fort Hood, Texas killer.

“It may well be that the administration is focusing more energy on casting the net wide and invading the privacy of law abiding-Americans rather than targeting the bad guys, targeting actual terrorists,” Cruz said after addressing a Federalist Society conference focused on the expansion of the executive branch.

IRS Agent: Keep Faith to Yourself (+video)

An Internal Revenue Service agent was recorded on audiotape telling a pro-life organization that they had to remain neutral on the issue of abortion and lectured the group’s president about forcing its religious beliefs on others.

“You have to know your boundaries,” IRS agent Sherry Wan can be heard telling Ania Joseph, president of the Pro-Life Revolution. “You have to know your limits. You have to respect other people’s beliefs.”

The Alliance Defending Freedom said Joseph recorded the March 8, 2012 conversation during a two-year battle with the IRS to obtain tax-exempt status.

“You have the religious freedom; the freedom of speech,” Wan told the pro-life president. “And other people also have the civil rights; human rights. You cannot, you know, use your religious belief to tell other people you don’t have a belief. So I don’t believe you need the right to do this.”

ADF attorney Erik Stanley said the actions of the IRS are simply unconstitutional.

IRS Buying Spying Equipment: Covert Cameras in Coffee Trays, Plants

The IRS, currently in the midst of scandals involving the targeting of conservative groups and lavish taxpayer-funded conferences, is ordering surveillance equipment that includes hidden cameras in coffee trays, plants and clock radios.

The IRS wants to secure the surveillance equipment quickly – it posted a solicitation on June 6 and is looking to close the deal by Monday, June 10. The agency already has a company lined up for the order but is not commenting on the details.

“The Internal Revenue Service intends to award a Purchase Order to an undisclosed Corporation,” reads the solicitation.

“The following descriptions are vague due to the use and nature of the items,” it says.

“If you feel that you can provide the following equipment, please respond to this email no later than 4 days after the solicitation date,” the IRS said.
