Justice Scalia’s Final Dissent

Justice Scalia’s final written dissent was in an obscure case that is only known to those in the electric power industry. But this case, Federal Energy Regulatory Commission v. Electric Power Supply Association, is the embodiment of what is wrong with the modern court system and exemplifies Scalia’s commitment to the written law.

Without getting into the weeds of the case, the Federal Power Act [16 U.S.C. § 791] authorizes the Federal Energy Regulatory Commission (FERC) to regulate wholesale electric power market but explicitly prohibits the FERC from regulating “any other sale” of electricity. Anything on the retail side is left to the states. In 2011, FERC promulgated a “demand response” regulation providing for monetary incentives to large electricity consumers, such as hospitals and schools, that reduce their consumption during peak usage times. This is one of the tools in the “clean energy” cartel’s arsenal to limit the use of fossil fuels.

Obviously, the case, its ramifications, and its stakeholders is an extremely complex case study. But the legal question was very simple. Does FERC have the authority to promulgate such a regulation on the consumer side when statute explicitly leaves this to the states and actually prohibits FERC from stepping outside of the wholesale market?

In an opinion eerily similar to King v. Burwell, in which Chief Justice Roberts completely rewrote Obamacare’s health care subsidy scheme in order to accommodate a lawless executive agency, Justice Kagan rewrote the Federal Power Act to do the exact opposite of its intent. Just like Obamacare was designed to only incentivized those states that establishes state exchanges, yet Roberts translated “state” into “federal,” Kagan translated “wholesale” into retail – manifestly opposite from the original intent of the statute.

At its core, the key function of the court is to apply statutes to cases and controversies, not rewrite statutes and the Constitution. As I’ve often said before, when executive agencies violate congressional laws, it is the quintessential time for the courts to step in and do their job; namely, interpret the law as written. Yet, in the FERC case, Roberts and Kennedy joined with the four liberals to overturn the D.C. Court of Appeals, which struck down the FERC rule, in an opinion written by the inimitable Janice Rogers Brown.

In his characteristic clarity for explaining the written law, Scalia demolished Kagan’s opinion, noting that anything that does not regulate wholesale markets is not within the authority of FERC:

While the majority would find every sale of electric energy to be within FERC’s authority to regulate unless the transaction is demonstrably a retail sale, the statute actually excludes from FERC’s jurisdiction all sales of electric energy except those that are demonstrably sales at wholesale. So what, exactly, is a “sale of electric energy at wholesale”? We need not guess, for the Act provides a definition: “a sale of electric energy to any person for resale.” §824(d) (emphasis added). No matter how many times the majority incants and italicizes the word “wholesale,” ante, at 19–20, nothing can change the fact that the vast majority of (and likely all) demand-response participants—“[a]ggregators of multiple users of electricity, as well as large-scale individual users like factories or big-box stores,” ante,at 7—do not resell electric energy; they consume it themselves. FERC’s own definition of demand response is aimed at energy consumers, not resellers.

Scalia went on to use the majority’s own examples against their conclusion. The bottom line in this case and in every case of statutory interpretation is that one must always interpret the law as written, not as one wants it written or in a way that would make things more practical.

This is what Scalia taught us for his almost three decades on the court. And it was so eloquently on display in this dissent published on January 25, 2016. The law is the law. If you don’t like it, there is a democratic process through which one can modify it. But the court is not the place for rewriting statutes.

It’s also worth reading another dissent Scalia wrote on January 25 in Montgomery v. Louisiana. In that case, Roberts and Kennedy joined with the four leftists to retroactively apply a decision rewriting the Eighth Amendment’s cruel and unusual punishment clause, thereby paving the road for the release of a number of violent murderers who were sentenced to life without parole.

Sadly, not only do we have 4-6 justices who, at any given time, believe it is their job to rewrite the Constitution and the role of the court, but we have 4-6 justices who abdicate their core Constitutional responsibility to interpret statutes as written and not factor in political considerations or efficient market outcomes.

Infected Women Aborting Babies, but Zika Virus Is Likely Not the Cause of Microcephaly

In recent weeks, many news reports suggest there may be a strong connection between new cases of microcephaly in Brazil and the Zika virus outbreak there. Predictably, pregnant women infected with Zika are being encouraged to abort their babies. However, several health organizations have noticed issues that may point to other factors in the environment being the actual cause of the increase of Brazilian microcephaly.

The first cases of Zika virus in Brazil were confirmed in May 2015 and most likely came from French Polynesia. The Zika virus affected French Polynesia in 2013 through the first part of 2014 and then receded as quickly as it came. During that outbreak, there were at least 17 central nervous system malformations (microcephaly is a type of central nervous system malformation) seen in newborns which may have been related to the virus. Or they may have been due to something entirely different.

Importantly, microcephaly was never identified as one of the 17 malformations in French Polynesia. Researchers are also finding that many other areas that have had Zika virus outbreaks have not seen increases in microcephaly.

The Brazilian Ministry of Health noticed that the increase of microcephaly was occurring around 9 months after the Zika virus outbreak began and hurriedly concluded the two were likely related. However, researcher Dr. Sandra Mattos disagrees. When the outbreak occurred, she had already been collecting data on newborns in the Northeast Brazilian state of Paraiba. Looking back at her data, she discovered the increase of microcephaly had been occurring long before the initial outbreak of the Zika virus. Dr. Mattos believes that pesticides, malnutrition, drugs and infection by multiple viruses at once are the likely causes of the deformity.

Two other Latin American medical organizations believe that the larvicide (pyriproxyfen) – added to drinking water in 2014 – is the likely cause of the increase in microcephaly and other birth defects. Their findings, combined with the research by Dr. Mattos, strongly implicate factors other than the Zika virus as the true causes of increasing cases of microcephaly.

The Ministry of Health of Brazil – and the US Centers for Disease Control – should take note of this research rather than causing unwarranted panic and increasing abortions by suggesting that the rapidly-spreading Zika virus is likely to cause an explosion in birth defects across Latin America and the southern United States.

Father of Child Murdered by Illegal Alien: Trump ‘Sent From God’ [+video]

A new ad released Friday by Donald Trump’s campaign team tells the story of Jamiel Shaw, a Los Angeles man who lost his teenage son in 2008 when a man in the U.S. illegally randomly shot and killed 17-year-old Jas.

In his first interview since the ad debuted, Shaw, an African-American man, told the Washington Examiner why he chose to support the Republican Manhattan billionaire who has been criticized by some as a racist and a phony.

It started on March 2, 2008, in the Arlington Heights neighborhood of Los Angeles were Jas had been walking home, talking with his girlfriend on a cellphone. He was three doors down from his house when a car pulled up by him. Two Hispanic men in the vehicle asked Jas which gang he belonged to. Police reports indicate Jas did not respond, which frustrated one of the men who pulled out a gun and shot the teen . . .

The journey for Shaw in the eight years since his son’s death still takes a toll on him, he said. But now he has some hope, that in helping to change the policies that abetted his son’s murder, he can find a way to go on.

Russia’s Prime Minister: We Are in a New Cold War

Russian Prime Minister Dmitry Medvedev said his country is in a new Cold War with the U.S. and its allies, underscoring the tenuous level of trust that’s putting a day-old plan for a truce in Syria at risk.

The clash, with echoes of superpower rhetoric during the 20th century, played out at the Munich Security Conference on Saturday even as Russia, Europe and the U.S. say they’re seeking cooperation to end Syria’s civil war, resolve the armed standoff in eastern Ukraine and make progress toward lifting European economic sanctions against Russia.

Fresh from helping craft the accord for Syria, Russian Foreign Minister Sergei Lavrov suggested that the U.S. is reneging on the agreement and put the chances of success at less than 50 percent. U.S. Secretary of State John Kerry, addressing the meeting separately, demanded an end to Russian bombing of groups opposed to Syrian President Bashar al-Assad.

“This is a hinge point,” Kerry told the Munich Security Conference on Saturday. “We hope this week can be a week of change. It is critical for all of us to take advantage of this moment to make this cessation of hostilities work.”

On stage at the international gathering of diplomats and defense officials, Medvedev set a different tone, blaming the U.S.-led North Atlantic Treaty Organization for stoking conflict. Ted Cruz’s Father Just Sent out a Major Warning to Christians

The First Amendment to the United States Constitution begins, “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof,” and Americans throughout history have interpreted this as a guarantee of freedom of religion.

However, as WND has documented, the Obama administration has stealthily replaced the term “freedom of religion” with “freedom of worship” in official pronouncements.

Pastor Rafael Cruz, the father of GOP presidential candidate Sen. Ted Cruz and author of the new book, “A Time for Action: Empowering the Faithful to Reclaim America,” warns that this subtle shift in language would be devastating for America if the policy and practice come to follow the words.

“Most Christians don’t realize the danger of freedom of worship,” Cruz said during a recent appearance on “Hagee Hotline” with pastor Matthew Hagee. “Freedom of worship is not the same as freedom of religion. Every Communist country around the world has freedom of worship. What freedom of worship means is you can worship inside a house of worship.”

Cruz explained even in his native Cuba a person can share the gospel inside a church. There may be spies present to ensure no one speaks out against the government, but congregants nevertheless have the freedom to go to church and worship their God. Democrats and Republicans alike, in desperate efforts to discredit him, like to point out Trump is not a suitable candidate because he’s not conservative, highlighting his various activities and contributions involving the Clintons and other liberals.

But in a 1988 interview with Larry King, Trump is introduced by Mary Alice Williams, then part of CNN’s political anchor team, as: “He’s young, he has Robert Redford good looks, he’s conservative and he’s rich. I’m not talking about Dan Quayle; I’m talking about Larry King’s guest, Donald Trump.”

Even as far back as 28 years ago, the question of Trump’s run for the White House was being discussed . . .

“Let’s give America a different look at you,” said King. “You’re the author of a best-seller and everyone knows you as the owner of buildings and hotels. But you might be classified as an eastern Republican. Fair?”

Air Force Crew Refueling Plane Saves Pilot in Emergency Over ISIS Territory

A quick-thinking refueling plane crew saved a fighter pilot who faced having to eject over Islamic State territory.

The F-16 had been trying to refuel in mid-air when the pilot discovered a malfunction with his fuel system, which meant he could only fly for 15 minutes – nowhere near enough to reach safety.

Instead of leaving the pilot to cope with the emergency himself, the US Air Force KC-135 Stratotanker crew managed to escort him back to its base while refueling every 15 minutes to keep the jet in the air.

US Air Force commander Lt Col Eric Hallberg said: “Over 80% of his total fuel capability was trapped and unusable.

Hawaii Governor Signs Emergency Proclamation on Zika, Other Illnesses

The governor of Hawaii has signed an emergency proclamation regarding Zika and other mosquito-borne illnesses.

Gov. David Ige signed the declaration Friday as “a preventative measure” to guard against Zika, dengue fever and other diseases, his office said in a statement.

The action follows the recent decision by the Centers for Disease Control and Prevention to take emergency steps to prepare for and mitigate the Zika risk, the statement said.

“There have been no locally acquired Zika cases in the U.S. or Hawaii, and we’d like to keep it that way,” the new release quoted the governor as saying. “This is about getting in front of the situation across the state.” (Read more from “Hawaii Governor Signs Emergency Proclamation on Zika, Other Illnesses” HERE)

Mother of Columbine Killer Said She Never Realized Her Son Was Troubled

Nearly 17 years after Dylan Klebold and Eric Harris murdered 13 people in a slaughter at Colorado’s Columbine High School, Klebold’s mother offered insight into her son’s behavior leading up to the attack.

In an exclusive interview with ABC News’ Diane Sawyer that aired Friday, Sue Klebold said she was like many parents who believe they would know if something were wrong with their child.

“Before Columbine happened, I would have been one of those parents,” Klebold told Diane Sawyer in an exclusive interview. “I think we like to believe that our love and our understanding is protective, and that ‘if anything were wrong with my kids, I would know,’ but I didn’t know, and I wasn’t able to stop him from hurting other people. I wasn’t able to stop his hurting himself and it’s very hard to live with that.”

On April 20, 1999, Dylan Klebold and Eric Harris walked into Columbine High School in Littleton, Colo., and began a murderous rampage that left 12 students and 1 teacher dead. The two, who were part of what they called the “Trench Coat Mafia,” carried weapons and homemade bombs in addition to their guns, which they used to kill themselves after the slaughter.

Supreme Court Justice Scalia Found Dead

Associate Justice Antonin Scalia was found dead of apparent natural causes Saturday on a luxury resort in West Texas, federal officials said.

Scalia, 79, was a guest at the Cibolo Creek Ranch, a resort in the Big Bend region south of Marfa.

According to a report, Scalia arrived at the ranch on Friday and attended a private party with about 40 people. When he did not appear for breakfast, a person associated with the ranch went to his room and found a body.

Chief U.S. District Judge Orlando Garcia, of the Western Judicial District of Texas, was notified about the death from the U.S. Marshals Service. (Read more from this story HERE)

Leftists: “Breathtaking” Consequences of Scalia’s Death

IMMIGRATION: United States v. Texas concerns the legality of Obama administration immigration policies that, if allowed to take effect, will temporarily enable close to five million undocumented immigrants to remain in the county. It is also the case that presents the most opportunity for chaos if the Court evenly divides on the outcome…

ABORTION: Another case out of Texas, Whole Woman’s Health v. Hellerstedt, also could lead to confusion if the Court evenly divides. Whole Woman’s Health is the greatest threat to Roe v. Wade to reach the Supreme Court in a generation. If five justices back the Texas law in this case, it is unclear that there will be any meaningful limits on states’ ability to pass anti-abortion laws. . .

UNIONS: Public sector unions are saved, at least for now. After oral arguments in Friedrichs v. California Teachers Association, it appeared likely that an ambitious effort to defund public sector unions would gain five votes on the Supreme Court. Now this effort only has four votes. Moreover, because the plaintiffs in this case lost in the court below, a decision affirming the lower court in an evenly divided vote is effectively a victory for organized workers…
