Cop Beat, Chocked, Tased Suspected Jaywalker

A western North Carolina police officer who resigned after a body camera video shows him hitting and using a Taser on a man suspected of jaywalking will face preliminary charges of assault, the Buncombe County District Attorney’s Office said Thursday.

Senior Police Officer Christopher Hickman, 31, was removed from patrol duty a day after the incident last August and resigned from the Asheville Police Department in January, the same day he was to be terminated, according to a timeline of the case released by the Asheville City Council . . .

The release of body cam video in late February caused outrage in this North Carolina city in the Blue Ridge Mountains. The video shows Hickman and an officer in training stopping Johnnie Jermaine Rush, then 32, for allegedly jaywalking in the early morning hours of August 25, 2017 . . .

The officers catch Rush and tackle him. As Rush is being restrained on the ground, Hickman punches him in the head several times, shoots him with a stun gun and chokes him. (Read more from “Cop Beat, Chocked, Tased Suspected Jaywalker” HERE)

Records Sought to Reveal Whether Carter Center Funding Terror

The American Center for Law and Justice is asking the State Department for records related to former President Jimmy Carter’s Carter Center, to determine whether the activist organization channeled taxpayer funds to terrorist organizations.

Carter, whose support for the Palestinians’ ruling Fatah and Hamas movements is well known, may have violated federal law, according to ACLJ.

It is a federal crime to “knowingly provide material support or resources to a foreign terrorist organization,” ACLJ explained, noting Hamas has been designated a foreign terrorist organization by the State Department.

Carter, a Democrat, was president when the U.S. sustained one of its worst foreign policy failures ever, the Islamic revolution in Iran and the hostage-taking of American government workers at the U.S. Embassy. The 52 diplomats, held by the Muslim Student Followers of the Imam’s Line, were released after 444 days when Republican President Ronald Reagan was inaugurated.

“The Carter Center has also been open about the fact that that it maintains close contacts with both Fatah and Hamas,” ACLJ said. (Read more from “Records Sought to Reveal Whether Carter Center Funding Terror” HERE)

U.S. To Overtake Russia as World’s Biggest Oil Producer

With mainstream media and establishment politicians stacked against him from the moment he announced his run for the presidency, Donald J. Trump has been in an ongoing pitched battle to communicate his plans – and his eventual successes – to Americans. Through public rallies and social media, he has managed to bypass the traditional information gatekeepers and has spoken directly to the people . . .

Immigration: In its effort to fight so-called “sanctuary” cities and states, the Justice Department filed a lawsuit March 6 against the state of California for obstructing federal immigration law “and putting the interests of criminal aliens ahead of the well-being of American citizens.”

Oil: The U.S. will overtake Russia to become the world’s largest oil producer by 2023, according to the International Energy Agency, reflecting Trump administration policies such as approving major oil pipelines, opening up areas to drilling and regulation reform.

President Trump’s administration already has outpaced President Reagan in its implementation of agenda items proposed by a prominent conservative Washington, D.C., think tank. Nearly two-thirds of the 334 items called for by the Heritage Foundation’s legendary “Mandate for Leadership” blueprint have been accomplished in Trump’s first year in office.

Defense: Noting Russia and China are not abiding by international norms, the Defense Department’s new Nuclear Posture Review focuses on a nuclear deterrent that is “modern, robust, flexible, resilient, ready and tailored to deter 21st century threats and reassure allies.” Reacting to critics, the administration says it is not “a new arms race, nor is it a return to the Cold War. Rather, it is a hard-eyed view of the world as it is.” (Read more from “U.S. To Overtake Russia as World’s Biggest Oil Producer” HERE)

FBI Geek Squad Cozy Relationship Exposed: Geek Squad Employees Used as Informants for 10 Years

The FBI paid Best Buy’s Geek Squad employees to act as informants, according to several documents obtained by the nonprofit Electronic Frontier Foundation (EFF).

The documents expose the cozy relationship between Best Buy and the FBI that goes back at least 10 years.

With the release of WikiLeaks Vault 7, everyone is talking about government surveillance again. It is déjà vu of Edward Snowden’s 2013 NSA release all over again.

Turns out the CIA and NSA aren’t the only ones spying on the population. The FBI was caught in 2017 using Best Buy’s Geek Squad to increase their own surveillance apparatus, and the details from unsealed court records are troubling.

The FBI and Geek Squad appear to have had a process for how the Bureau would investigate and prosecute people who had given their devices to Geek Squad to be repaired.

Geek Squad would let the FBI know if they found what they believed to be child pornography or other illegal content on a device and the FBI would go to the Geek Squad facility to assess the materials and determine if they were illegal, the documents reportedly show.

The FBI would then take the device for further investigation.

The documents show that Geek Squad would only call the FBI if they found possible illegal material during manual searches.

The issue came to light when a gynecologist named Mark Rettenmaier was indicted with two felony counts of possession of child pornography in November 2014 after Geek Squad discovered an image on his computer in the course of performing repairs that Rettenmaier paid for. As Techdirt reported:

According to court records, Geek Squad technician John “Trey” Westphal, an FBI informant, reported he accidentally located on Rettenmaier’s computer an image of “a fully nude, white prepubescent female on her hands and knees on a bed, with a brown choker-type collar around her neck.” Westphal notified his boss, Justin Meade, also an FBI informant, who alerted colleague Randall Ratliff, another FBI informant at Best Buy, as well as the FBI. Claiming the image met the definition of child pornography and was tied to a series of illicit pictures known as the “Jenny” shots, agent Tracey Riley said who seized the hard drive.

At the time, Best Buy released a statement that any employee who finds child pornography is required to report it to law enforcement.

‘If we discover child pornography in the normal course of servicing a computer, phone or tablet, we have an obligation to contact law enforcement. We believe this is the right thing to do, and we inform our customers before beginning any work that this is our policy,’ vice president for communications Jeff Haydock said. (Source)

This isn’t necessarily a problem, considering companies performing computer repairs are legally obligated to report discovered child porn or pirated software to law enforcement.
However, the EFF’s argument in the case of Mark Rettenmaier — a California doctor who was charged with child pornography possession after Geek Squad employees say they discovered it on his computer, is that the documents show that Geek Squad employees made actual efforts to find the illegal material, potentially using forensic software to search his devices.

Further, there is evidence that Geek Squad employees were paid when they would find child pornography, which the EFF said would act to encourage the employees to actively search for the content. That changes the motivation from legal obligation to a chance to earn some additional extra cash by digging around in files that may not be essential to the repair, which is an obvious overreach.

One of the documents obtained recorded a $500 payment from the FBI to a Geek Squad employee, OC Weekly reported. According to the EFF, this payment is one of the payments that has been linked to Rettenmaier’s case.

The released documents found that Best Buy had the FBI visit one of their repair facilities for the agency’s “Cyber Working Group” and that Geek Squad employees gave FBI officials a tour of the facilities.

One former agent confirms in her declaration that the employee who alerted the FBI to alleged child pornography found on the computer of the defendant in this case had been signed up by the FBI as a “confidential human source” (CHS) in 2009 two years before the offending content was discovered in this case but contends that this worker was “never asked” to “search for child pornography or evidence of any other crime on behalf of the FBI.”

However, in a December 19th order, in this case, the judge notes that emailed communications may hint at a deeper connection between the agency and the Geek Squad employee.

For instance, in Oct. 2009, this agent emailed the Best Buy staffer to set up a meeting “to discuss some other ideas for collaboration.” The since-retired agent now says she has no “independent recollection of what ‘collaboration’” refers to in that email, blaming her memory lapse on brain damage caused by Lyme disease.

The documents were released following an EFF Freedom of Information Act lawsuit in 2017.

The EFF has plans to challenge the FBI in court later this year for withholding other requested documents and refusing to answer questions about whether the agency had similar relationships with other computer repair companies.

What should be taken away from this is that the FBI directed Geek Squad to search through customers’ computers without probable cause.

There is also a very problematic scenario when you introduce any type of financial incentive. What if a Geek Squad employee decides to start planting child pornography on customers’ computers just to get paid?

Another issue is that malware can secretly implant files on the computer. There is malware that will implant child porn on a person’s computer, which is why that can’t be relied upon. A person’s own search history and capturing their IP address on a child porn site is more reliable than metadata.

That may be why a federal appellate court declared in February 2011 (USA v. Andrew Flyer) in an unrelated case that “pictures found on unallocated space did not constitute knowing possession because it is impossible to determine when, why or who downloaded them.”

Then there is the issue of a parent having a picture of their own child in the bathtub or something of a similar nature on the computer and the Geek Squad agent falsely accusing someone by reporting them to the FBI. And what if a customer has legal pornographic images of a girlfriend, boyfriend, husband, or wife– it’s a severe invasion of privacy.

However, in this case, during a search of Rettenmaier’s seized iPhone, prosecutors say the phone contained more than 800 pictures of naked or partially nude girls including some taken during gynecological exams, the LA Times reported.

What more should we take away from this? This case will set a precedent, and whether you think the individual is a sick child predator doesn’t matter because this will affect your own rights, too.

While Activist Post doesn’t have any sympathy for pedophiles and purveyors of child pornography, we worry about how the information was obtained by agents at Best Buy without a warrant, as this is a violation of the Fourth Amendment which protects against “illegal search and seizure.” (For more from the author of “FBI Geek Squad Cozy Relationship Exposed: Geek Squad Employees Used as Informants for 10 Years” please click HERE)

Why Trump Is So Hated by Leftists

My brother expressed his disgust watching an animated TV show trashing Trump, titled Our Cartoon President. Incredibly, leftists have hijacked the airwaves and everywhere people gather to exploit as platforms to spread their vitriolic, insane hatred for Trump. Outrageously, TV coverage of the Olympics included leftist hatred for the Trump administration.

Despite the shocking discovery that leftist policies probably played a role in the deaths of 17 kids in the Florida school shooting, leftists continue puppet-mastering students to blame Trump.

Even Sunday worship has been hijacked by leftists to trash Trump. My brother asked the pastor of his all black church to please stop including a lie-filled Democrat-talking-points rant about Trump in his sermons.

Leftist disrespect and venomous hatred for President Trump is unprecedented, over the top, and boldly spewed 24/7. I wondered, why?

I reached out to prominent conservatives and Republicans for their thoughts. Why Trump Is So Hated by Leftists

VICTORIA JACKSON

I think Trump is hated by the left because his ideology, his words and actions, are the exact opposite of the left’s ideology. He is not a “globalist,” but loves America, our homeland; he knows that we can’t continue being the world’s number-one giver if we are not safe and successful ourselves. He knows that capitalism, not communism, will feed the poor; capitalism makes everyone richer, while communism makes everyone equally poor. He knows that free enterprise and less government regulation will provide jobs and boost our economy, not socialist handouts and overregulation.

He knows that less unemployment and getting out of debt will save our nation much more than wasting time and money on things like the scientifically unproven climate change hoax and its hidden goal of controlling the masses. He believes in individual freedom and responsibility, not government control. He’s not a secularist (new word for atheist, according to Julia Sweeney’s TED talk), but a defender of religious liberty, including Christianity. He is protective of Americans and not protective of our enemies, some of whom sneak into our midst through unenforced immigration law.

He thinks all lives matter, not just black lives; he respects the police, firefighters, and military instead of fanning the Saul Alinsky Rules for Radicals flames of violent civil unrest and class and racial warfare. He is not a saint, and he doesn’t pretend to be. He believes in free speech, not political correctness. The left is confused; leftists don’t know how to respond to a politician who speaks from the heart, not from talking points. The left hates Trump because the Tea Party loves him.

JUDSON PHILLIPS

Trump is hated the same way and for the same reason President Reagan was hated. He is a fighter, and he is moving a conservative agenda forward. The left did not like George W. Bush, but they did not hate him the way they hate Trump, because Trump believes in fighting and winning.

MYCHAL MASSIE

Why are the reprobates in both parties so averse to helping President Trump stabilize and protect what little of a future we have left? What is it that both political parties find so repulsive about protecting American citizens?

The answer is fairly easy to state, and more complex to explain in intricate detail. Ergo, I will simplify the explanation as much as possible. They are fighting President Trump because he is a threat to their “one-world government.”

President Trump’s victory in America has spawned a new generation of pro-nationalist leaders who refuse to be ruled by a heteronomous government that is handpicked in a wine- and cheese-filled room located in a hotel at some posh island retreat. Bush had great dreams for a North American-style European Union by implementing NAFTA, full amnesty, and open borders.

While we were marginally successful in stopping Bush, Obama destroyed any chance of making it happen because of his contemptible arrogance and his hedonistic wife, who viewed the American taxpayers as her American Express Card.

Notwithstanding, the bones of North America becoming the Western-type E.U. were still in place, and both parties knew that it was only a matter of time until they succeeded.

But then “Along Came Donald J. Trump.” Once again, the arrogance of the ruling elite thought We the People could be bullied and intimidated into doing as we were told. But this time, their schemes and machinations did not work because we saw in President Trump a man we could trust. And the power elite will never forgive President Trump nor will they forgive We the People for electing him.

JOE MILLER

As I explained in the run-up to the 2016 election here and here, I’ve always believed that Donald Trump is the Real Deal. That doesn’t mean I agree with everything he does or says. But there’s little question that the president is his own man. And that drives the Establishment crazy. The oligarchs want someone they can control. They rely on leveraged politicos to do their evil bidding, but Trump has given them no such foothold. So they use their Establishment-controlled media to foment hate against him. This fake news jihad is effective but will not stop Trump.

LARRY PRATT

He fights!

NINA MAY

Trump is hated not only by the left, but by the RINOs for the exact same reason: they can’t control him. They can’t intimidate or shame him as they do everyone else, and probably the most poignant and profound is that he believes in something greater than himself, than the state, than politics…and that is God.

I wish to thank these great patriots for their insightful input. Here’s why I believe that Trump is so hated by leftists.

Leftist hatred for Trump is rooted in their mission to undermine all things wholesome, godly, and good for America. Everything leftists do, in essence, gives the God of Christianity the middle finger. It is not coincidental that leftists hijack Christian symbols and institutions for their anti-God agenda.

For example: The rainbow was God’s promise to Noah to never again let floodwaters destroy all life. Homosexuals hijacked God’s rainbow to symbolize behavior God calls an abomination.

God created marriage as a holy union between one man and one woman.

Despite civil unions readily available to them, homosexuals successfully broke down marriage, resulting in every conceivable deviant configuration to eventually be legally declared marriage.

Trump in the White House is a miracle. Despite leftists’ 24-7 efforts to stop and destroy him, President Trump has remarkably implemented 64% of his Make-America-Great-Again agenda. Fasten your seat belts, leftists: Trump has only just begun. (Published with permission of the author, read more from Llyod Marcus HERE)

Trump Will Accept Kim Jong Un’s Invitation to Meet, White House Says

President Trump will accept an invitation by North Korean dictator Kim Jong Un to meet, the White House confirmed Thursday night, in a dramatic development after months of sabre-rattling between the two world leaders.

Kim extended the invitation and the president agreed that the two would meet by May, South Korean National Security Adviser Chung Eui-yong announced at the White House.

“Kim Jong Un talked about denuclearization with the South Korean Representatives, not just a freeze,” Trump tweeted. “Also, no missile testing by North Korea during this period of time. Great progress being made but sanctions will remain until an agreement is reached. Meeting being planned!”

Trump, according to White House press secretary Sarah Sanders, “will accept the invitation to meet with Kim Jong Un at a place and time to be determined.” But, Sanders added, “in the meantime, all sanctions and maximum pressure must remain.” . . .

Kim “expressed his eagerness to meet President Trump as soon as possible,” Chung said. “President Trump appreciated the briefing and said he would meet Kim Jong Un by May to achieve permanent denuclearization.” (Read more from “Trump Will Accept Kim Jong Un’s Invitation to Meet, White House Says” please click HERE)

SWAT Officers Punished for Rushing to Florida Shooting to Save Children

As word spread that an armed attacker was shooting up a Parkland high school, two members of the Miramar Police Department’s SWAT team responded to the scene.

They had been training in nearby Coral Springs earlier that day and wanted to help end a deadly mass shooting that claimed 17 lives.

But their own commander said he didn’t know they were going. And the Broward Sheriff’s Office — worried about over-crowding a chaotic scene with law enforcement officers — didn’t ask for them to show up. BSO already had its own SWAT team in motion . . .

“Effective immediately you have been suspended from the SWAT Team until further notice,” wrote Capt. Kevin Nosowicz, the unit’s commander, in a Feb. 22 memo obtained by the Miami Herald through a public records request. “Please make arrangements with the training department to turn in your SWAT-issued rifle.”

The human urge to aid in a disaster is strong. But it can also run counter to police training. Too much response to a mass casualty situation can create confusion and hinder responders, as recent mass shootings have shown, according to Pat Franklin, a retired Miami Beach police detective. Needles, Debris, Human Waste Tallied After Cleanup of California Homeless Camp

Gritty details from the cleanup of a homeless encampment in Southern California were revealed Thursday — and the numbers were stunning.

According to the figures, public works crews in Orange County collected 404 tons of debris, 13,950 needles, and 5,279 pounds of human waste during a massive overhaul between Jan. 22 and March 3, the Orange County Register reported.

The specter of the ever-increasing homeless encampment along the Santa Ana River Trail had drawn the ire of local residents, prompting city officials to take action.

Todd Spitzer, who sits on the Orange County Board of Supervisors and led an effort to address the growing encampment, says he felt compelled to take a different course than other major cities in California that have been experiencing growing homeless populations . . .

The encampment, located in the heart of Orange County, stretched from Interstate 5 in Orange to Ball Road in Anaheim along a bike trail, according to a spokesperson for Orange County Public Works. Pelosi Mocks Pence’s Religion, so GOP Rep. Literally Mocks Pelosi’s Face

House Minority Leader Nancy Pelosi joined the mockery of Vice President Mike Pence’s religion and found her face mocked in return.

The insults were exchanged at the Washington Press Club Foundation’s annual Congressional Dinner on Tuesday Night, the U.K. Daily Mail reported.

Pelosi was one of the four lawmakers who performed stand-up at the event that brings journalists and lawmakers together.

“Do you think Mike Pence is allowed to dine alone with a man in drag?” the Democrat asked.

Pelosi was recently a judge on RuPaul’s Drag Race and her comment referenced her cameo and an interview Pence did with the Hill in 2002.

The Indianapolis Star highlighted the interview during the 2016 presidential race saying that in his 12 years in Congress, “Pence had rules to avoid infidelity temptations, or even rumors of impropriety,” following what is known as the Billy Graham Rule, according to the Washington Post.

“Those included requiring that any aide who had to work late to assist him be male, never dining alone with a woman other than his wife, and not attending an event where alcohol is served unless Karen was there.”

During the 2002 interview, Pence called this, “building a zone around your marriage.”

“If there’s alcohol being served and people are being loose, I want to have the best-looking brunette in the room standing next to me,” he reportedly said.

After Pelosi’s comments on Pence, Rep. Ileana Ros-Lehtinen turned the mockery around.

“Let’s be serious — it’s tough to win legislation in Congress,” she said, according to the Daily Mail. “Many times, the process is as frozen as Nancy Pelosi’s face.”

She added, “I’m kidding, but sometimes her happy and her angry face, they’re pretty similar.”

House Majority Whip Steve Scalise also took aim at Pelosi.

“Nancy, it’s always great to break bread with you. I promise next time not to leave so many crumbs,” he joked in reference to her comment that the tax cuts were “crumbs” for Americans.

Pelosi was not the first to make fun of Pence and his religious views. Joy Behar took aim at his religion as well on “The View.”

“It’s one thing to talk to Jesus, it’s another thing when Jesus talks to you,” Behar asserted. “That’s called mental illness if I’m not correct.” (For more from the author of “Pelosi Mocks Pence’s Religion, so GOP Rep. Literally Mocks Pelosi’s Face” please click HERE)

Watch: Fed-Up Parkland Survivor Absolutely Destroys David Hogg on National TV

As a number of Marjory Stoneman Douglas High School students continue building a coalition of young gun-control advocates, a less vocal group of individuals tied to last month’s deadly shooting in Florida is making a different argument with a similar end goal: safer schools.

One such advocate is Kyle Kashuv, a survivor of the Feb. 14 shooting in Parkland who recently appeared on Fox News to voice his support for more attainable immediate goals.

“My perspective is that we have to focus first on what we can achieve,” the student told host Martha MacCallum. “That is mental health restrictions and deeper background checks.”

Sharing his belief that those pushing for a more measured response are being drowned out by the voices of fledgling activist groups, Kashuv insisted that “gun control should be a broader discussion that we need to have after we can secure our schools.”

Instead of retreating to ideological corners, he urged those committed to changing America’s gun culture for the better to work on proposals with widespread support.

Some of his schoolmates, he argued, have failed to heed that advice.

Specifically, he responded to MacCallum’s prompt after she aired a clip from a recent broadcast of HBO’s “Real Time with Bill Maher.”

Survivor-turned-activist David Hogg shared his account of hanging up on a call from the White House, which Kashuv felt was a “counterproductive” approach.

According to Hogg, an administration representative called him “the day before the listening session” President Donald Trump planned in response to the Parkland shooting to find out if he planned to attend.

“I said I’m not coming because we expect President Trump to come to the CNN town hall,” Hogg said, according to The Daily Caller. “And I ended on this message with them, I said, ‘We don’t need to listen to President Trump. President Trump needs to listen to the screams of the children and the screams of this nation.’”

While the teen’s impassioned remarks received enthusiastic applause from host Bill Maher’s studio audience, Kashuv had a different take.

“You know, I’m really trying to control my anger at what he said,” Kashuv told MacCallum. “Because, you know, the president calls you and then shows he wants to make a change, and you’re talking about bipartisan change and the one man who controls, who leads our nation … comes to you and is like, ‘Look, let’s do something. Let’s make it happen.’”

He continued by accusing Hogg of being “so hypocritical” for hanging up on a possible opportunity to affect the change for which he is advocating.

As lawmakers in his home state announce passage of a bill including several specific gun-related measures, Kashuv said he is “really hopeful” that positive change will result from the tragedy that struck his high school.

“Right now I see a lot of positive legislation is being passed,” he said. “We see that mental health restrictions are getting in place and deeper background checks. And I really think it represents how non-divided our country is and how decisive we can be.” (For more from the author of “Watch: Fed-Up Parkland Survivor Absolutely Destroys David Hogg on National TV” please click HERE)
