Senator Introduces Bill Authorizing Death Penalty for Those Who Intentionally Kill With Fentanyl

There is no crime killing more people in this country than fentanyl trafficking – not terrorism, not shootings, not stabbings, not any other form of violence.

There are roughly 16,000 official homicides a year, but 30,000 a year are dying from fentanyl, and likely more from other drugs that are laced with it. They are usually unsuspecting youngsters who think they are getting regular pain pills but are purposely sold chemical warfare as a death sentence. Rather than wringing our hands about the problem and spending billions on wasteful programs, shouldn’t we finally get serious about deterring it?

To that end, Sen. Tom Cotton has introduced a bill to finally treat fentanyl trafficking with the seriousness the crime deserves. The Zero Tolerance for Deceptive Fentanyl Trafficking Act would create a mandatory minimum of 20 years in prison for those convicted of dealing fentanyl while misrepresenting it as something else. If the offender has a prior felony conviction or is here illegally, he would get life in prison. And if the dealer intended to kill someone with fentanyl and succeeded, this bill would make that crime eligible for the death penalty, as any other first-degree murder is.

This bill does not target someone who possesses fentanyl or consumes it. This is solely targeting those who engage in mass chemical warfare that is killing more people than any other form of murder.

The bill is co-sponsored by Sens. Marsha Blackburn, R-Tenn., and Kelly Loeffler, R-Ga.

At present, there is very little deterrent against fentanyl traffickers. Virginia Krieger, who lost her daughter to fentanyl in Ohio, told me on my podcast that the two people who sold her daughter Tiffany the fentanyl under the guise that it was a prescription-type painkiller for her back injury got no jail time.

“Once Tiffany was incapacitated, the two women then spent the next six to eight hours going back and forth to two separate ATMs near the home, making withdrawals from Tiffany’s bank account using her ATM card and even going back the last time only hours after the coroner had come to the residence and removed my child’s lifeless body,” Krieger said on my podcast.

What ultimately happened to the two women who sold Tiffany the drugs?

“In the end, one woman served 28 days in jail for her participation in my daughter’s death,” according to Krieger. “The other (much worse) woman and the ringleader was not punished at all and was subsequently present at two other opioid overdose deaths with similar circumstances of theft. She was also revived herself with narcan after an overdose, but charges against her for possession of illegal narcotics were later dismissed. This woman has a very lengthy criminal record involving petty crimes, possession and drug trafficking and remained in the public domain to eventually contribute to my daughter’s death.”

Later on, the second woman was sentenced to two years in prison, only because she was convicted on a subsequent robbery. “I went out of my way to travel the one hour to Warren, Ohio, to remind the prosecutor who she was and that given her long list of criminal activity and her participation in Tiffany’s death, she should not be given a light sentence again,” Krieger told me.

What about the guy who distributed the drugs to those two women? “The drug dealer has a long criminal history involving drug trafficking and domestic violence, and he continues to traffic drugs with impunity, including illicit fentanyl.”

Trump is 100 correct when he talks about the need for deterrent. “States with a very powerful death penalty on drug dealers don’t have a drug problem,” said Trump earlier this month during a White House event with governors. “I don’t know that our country is ready for that, but if you look throughout the world, the countries with a powerful death penalty — death penalty — with a fair but quick trial, they have very little if any drug problem. That includes China.”

Well, now it’s time to put this into legislation before hundreds of thousands more are killed. Do we want to solve the problem or not?

Remember, this is not primarily about drug addiction. Most people do not intend to consume fentanyl. It’s being laced into other drugs or being packaged and sold as prescription painkillers. We have a drug problem in this country, but what is going on with the fentanyl trafficking is chemical warfare.

At some point, the political elites must be confronted with their hypocritical approach. When it comes to drug treatment, they are spending billions of dollars on dubious programs and clamping down on legitimate prescription painkillers. But when it comes to the worst illicit drug trafficking, they are frantically promoting jailbreak. Which one is it? Do we have a fentanyl crisis or not?

“There was no justice for my family,” lamented the Ohio mom. “We were first victimized by government legislation that denied my daughter the care of her physician, then we were denied justice when she was killed by the very illicit narcotics that were at the heart of the ‘opioid epidemic.’ The very same illicit narcotics that drove panicked legislation that ultimately caused her physician and many, many others to be fearful of treating their patients, thereby driving valid patients out of the doctor’s office and to the street corners, where the dealers and cartel drugs were waiting for them.”

Last March, speaking to a crowd in New Hampshire, which is a hard-hit state, Trump laid down the gauntlet:

You know, it’s an amazing thing. Some of these drug dealers will kill thousands of people during their lifetime — thousands of people — and destroy many more lives than that. But they will kill thousands of people during their lifetime, and they’ll get caught and they’ll get 30 days in jail. Or they’ll go away for a year, or they’ll be fined. And yet, if you kill one person, you get the death penalty or you go to jail for life.

That is the story of Virginia’s daughter and countless thousands of others over the past five years.

Illegal Alien Criminal Released by Chicago Rearrested for Sexually Assaulting 3-Year-Old

Last year, Chicago police posted a video suggesting that immigration status is in line with gender and race as identities that don’t matter to their officers. Sadly, it matters a lot to a three-year-old who was allegedly sexually assaulted by a career criminal illegal alien who could have been removed from the country just months before the incident if not for Chicago’s recalcitrant policies.

The Chicago Sun-Times reports that Christopher Puente, 34, confessed to luring a three-year-old girl into the bathroom at the River North McDonald’s, pulling off the girl’s pants and underwear, and sitting her on his lap.

“He said that the victim called out ‘Daddy, Daddy,’” said Assistant State’s Attorney James Murphy about the horrific incident. “And so he covered the girl’s mouth.”

Like most criminals of this magnitude, this was not his first rodeo. According to the Sun-Times, “Puente has a lengthy criminal record, having served several stints in prison for theft and burglary. He currently faces a misdemeanor battery charges for allegedly touching a woman inappropriately and then shoving her while downtown.”

But the article omits the most important detail. Puente, according to ICE, is an illegal alien from Mexico who was previously deported and could have been removed again last year had Chicago police honored the detainer.

Thus, unlike the gender or race of a suspect, immigration status matters a lot. If Chicago cooperated with ICE, this alleged sexual assault and possibly the prior assault on a woman could have been prevented.

This man, like thousands of other illegal aliens, is committing countless preventable crimes because not only are they barely locked up on domestic criminal charges, thanks to “criminal justice reform,” they are not turned over to ICE for removal.

“In June 2019, ICE lodged an immigration detainer with the Chicago Police Department on Puente, who has several felony convictions and a prior removal, after he was arrested for theft,” said ICE in a press release this morning. “That detainer was not honored and on Feb. 19, 2020, Puente was once again arrested, except this time it was for sexually assaulting a 3-year-old at a fast food restaurant.”

“How many more victims must there be before lawmakers realize that sanctuary policies do not protect the innocent?” asked Robert Guadian, field office director of Chicago Enforcement and Removal Operations (ERO). “Puente should have been in ICE custody last year and removed to his home country. Instead, irresponsible lawmaking allowed him to walk free and prey on our most vulnerable.”

On Feb. 20, 2020, ICE filed an immigration detainer with Cook County Jail after Puente’s sexual assault arrest. Thankfully, the suspect is being held without bond because if he did post bail, the county would still not honor the detainer, even after such a horrific criminal charge.

According to ICE, Puente was previously deported in 2014 and also had felony convictions in 2011, 2012, and 2017.

Puente is not an anomaly. In fiscal year 2019, Cook County declined more than 1,070 detainers. There is no way of knowing how many others like him are reoffending and harming Americans because, as ICE noted in the release, “Since ICE does not have access to standard Illinois law enforcement databases, the agency cannot account for all the aliens who have been arrested, released and arrested for additional crimes.”

Statute (8 U.S. Code § 1373) makes it unlawful for a state or city to “prohibit, or in any way restrict, any government entity or official from sending to, or receiving from, the Immigration and Naturalization Service information regarding the citizenship or immigration status, lawful or unlawful, of any individual.”

Just this week, the inspector general for the Department of Homeland Security published a report showing that 17,000 criminal aliens arrested for crimes and released in contravention to ICE detainers remain at large in this country. In total, there were 58,900 declined detainers between October 1, 2013, and September 30, 2019, 70 percent of which were eventually captured by ICE at a great cost in manpower.

However, the scope of the problem is getting worse. In FY 2016, there were 3,686 declined detainers. In FY 2019, there were over 16,000. As the report notes, “Arresting violent offenders at large [not in jail custody] requires even more resources to ensure officer safety.” This prevents them from removing more illegal aliens, including violent criminals.

Yet after thousands upon thousands of the worst criminal aliens have been released throughout the country, there is still no effort by Congress to better enforce the laws. Bill Banning Transgender Operations on Children to Move Forward In Alabama

A bill to prohibit doctors from performing transgender medical treatments on minor-aged children moved ahead in two committees of the Alabama Legislature on Wednesday, bringing it another step closer to becoming law.

Introduced last week, the Vulnerable Child Compassion and Protection Act, which is sponsored by Republican state lawmakers Rep. Wes Allen and Sen. Shay Shelnutt, would “prohibit the performance of a medical procedure or the prescription or issuance of medication, upon or to a minor child, that is intended to alter the minor child’s gender or delay puberty” and would make doing so a class C felony under state law. It does, however, make exception in the case of procedures “undertaken to treat a minor born with a medically verifiable disorder of sex development.”

According to a story at AL.com, the bill is now ready to be considered and voted on in both of the state’s legislative chambers:

The Alabama House Health Committee approved Allen’s bill [Wednesday] morning after 10 people spoke at a public hearing on the measure, five in favor and five against. They included medical professionals on both sides and people with first-hand experiences on both sides. The committee approval moves the bill in line for consideration by the full House. . .

The Senate Health Committee followed with a public hearing on Shelnutt’s bill that included some of the same speakers and some different speakers. Both hearings drew overflow crowds. The Senate Health Committee approved Shelnutt’s bill on a 10-1 vote, sending it to the full Senate.

Experts: Coronavirus on Verge of U.S. “Explosion”; Retailers Will See Empty Shelves by Mid-April; 2nd Cruise Ship Turned Away From Multiple Ports

While each country faces its own health and containment challenges, experts say, there is little reason to believe the United States won’t soon face a similar coronavirus surge, even as President Trump on Wednesday urged calm and put Vice President Mike Pence in charge of the disease’s containment. . .

Earlier this month, experts suggested some patients of this virus are ultra-contagious “super-spreaders.” That is, they more easily transmit the infection to others in a manner similar to the way “Typhoid Mary” became notorious for transmitting the bacteria that causes typhoid to at least 50 other people before she died in 1938.

By The Hill. A second cruise ship has been refused entry at multiple ports over fears of coronavirus among those on board.

The New York Times reported Wednesday that the MSC Meraviglia was refused entry in Jamaica and the Cayman Islands after a crew member reported flu-like symptoms, raising fears from health officials in the two countries of a possible coronavirus transmission.

“In an abundance of caution, in order to provide protection to the health and safety of the residents of the Cayman Islands, the government has denied permission for the cruise ship to call on Grand Cayman as previously scheduled,” said Cayman Islands health minister Dwayne Seymour.

“The crew member had a cough, fever and associated muscle pains with a travel history to a country of interest relating to the Covid-19,” added Jamaica’s health ministry in a statement to the Times. Coronavirus Epidemic: U.S. Retailers Could See Some Empty Shelves by Mid-April

Trump rails against Dems ‘wasting time’ amid coronavirus threat

A series of late-night tweets marked the latest exchange between the White House and congressional Democrats over the outbreak, with each side simultaneously urging the other not to politicize the potential crisis yet also taking shots at press conferences and on social media — complicating efforts to work together.

. . . House Speaker Nancy Pelosi, D-Calif., and Senate Minority Leader Chuck Schumer, D-N.Y., released a joint statement Thursday on what they want to see in a funding bill to help fight the coronavirus that also included what appeared to be a swipe at Trump.

Coronavirus Could Spread Rapidly in U.S.

By Daily Beast. . . .Though novel 2019 coronavirus cases in the United States have so far ticked up in fits and starts, experts on deadly diseases say Americans should be prepared to see an overnight boom in cases that mirror the skyrocketing outbreaks in Italy and South Korea.

At last count from the Centers for Disease Control and Prevention (CDC), there were 60 confirmed novel 2019 coronavirus cases in the U.S. One of those cases—in northern California—marked the first case of unknown origin, as The Washington Post first reported Wednesday. Fourteen patients came through the American health system after traveling to China or having close contact with someone who had. The rest were either repatriated individuals who fled the vicinity of the virus’s origin in China on State Department-chartered planes or else were rescued from the disastrous Diamond Princess cruise ship outbreak.

Nancy Messonnier, director of the National Center for Immunization and Respiratory Diseases at the CDC, acknowledged Tuesday that community spread—when cases are detected in an area but the source of the infection is not known—was very likely to cause more infections in the United States. The case in California, which a CDC statement said was “picked up by astute clinicians,” appeared to prove her right, and set the stage for a serious test of American health infrastructure after years of atrophy.

Pope Francis Sick the Day After Encouraging Coronavirus Victims

By Breitbart. Just 24 hours after he expressed public support for the people suffering from coronavirus around the world, Pope Francis has fallen ill.

“I wish, again, to express my closeness to those who are ill with coronavirus and to healthcare workers who are caring for them,” Pope Francis said on Wednesday. He was visibly ill during the Ash Wednesday Mass, coughing and blowing his nose. And while he shook hands — and even kissed an infant — most parishioners appeared reluctant to physically interact.

On Thursday, the 82-year-old pontiff was forced to cancel a penitential Mass at St. John Lateran basilica that would have marked the beginning of Lent. While he still plans to continue his work, Francis “preferred to stay near [his residence in] Santa Marta,” while he is under the weather. Coronavirus Updates: Italy Reports 650 Cases and 17 Deaths

Italy’s number of COVID-19 coronavirus cases spiked by more than 50% in just 24 hours and now stands at 650, the Italian Ministry of Health says, adding that 17 people have died from the respiratory virus. More than 400 of the cases are in the hard-hit Lombardy region, where some towns are under a lockdown.

Nearly 250 of the people who were infected are currently in the hospital, including 56 patients who are in intensive care, the Italian ministry says, citing a Thursday afternoon update from Angelo Borrelli, commissioner for the coronavirus emergency. Another 284 people who have been infected are in home isolation to try to stop the coronavirus from spreading further.

The outbreak of COVID-19 in Italy led the U.S. State Department to add concerns about the virus to its travel advisory for Italy this week. The advisory stands at Level 2: “exercise increased caution” – one level short of “reconsider travel.”

Bloomberg Reportedly Approached Andrew Yang About Possible VP Pick

Democratic candidate Michael Bloomberg has approached former Democratic candidate Andrew Yang about a potential political endorsement, going so far as to raise the possibility of Andrew Yang joining the ticket as vice president, The Wall Street Journal reported on Thursday.

Michael Bloomberg’s presidential campaign has made overtures to Democrat Andrew Yang, courting the former candidate’s endorsement and floating the possibility of Mr. Yang becoming his running mate, according to two people familiar with the discussions.

Aides to the former New York City mayor reached out to discuss ways the two entrepreneurs-turned-politicians could work together as Mr. Bloomberg seeks the Democratic nomination, these people said.

Mr. Yang, who dropped out of the race earlier this month, didn’t commit to join forces, as he considers his own political future, a third person familiar with the discussions said.

Mr. Yang didn’t immediately respond to a request for comment. A senior Bloomberg aide said Mr. Yang wasn’t being seriously considered to be the former mayor’s running mate if he secured the nomination.

Superdelegates Oppose Handing Bernie the Nomination If Candidate Falls Short in Delegate Count; Poll: Sanders Knocks Biden out of First, Majority Thinks Trump Wins

The New York Times has interviewed several Democratic leaders, including 93 superdelegates, a majority of who said they oppose handing Bernie Sanders the party’s nomination should the democratic socialist fail to reach a majority of delegates before the national convention in July. . .

Jay Jacobs, the New York State Democratic Party chairman and a superdelegate, echoing many others interviewed, said that superdelegates should choose a nominee they believed had the best chance of defeating Mr. Trump if no candidate wins a majority of delegates during the primaries. …

In a reflection of the establishment’s wariness about Mr. Sanders, only nine of the 93 superdelegates interviewed said that Mr. Sanders should become the nominee purely on the basis of arriving at the convention with a plurality, if he was short of a majority.

Fox News Poll: Sanders Knocks Biden out of First, Majority Thinks Trump Wins

By Fox News. Bernie Sanders pushes Joe Biden out of the frontrunner spot for the Democratic nomination, capturing a record 31 percent support among primary voters in a new Fox News Poll. This is the first 2020 Fox national poll that finds Biden not leading the Democratic race.

The survey also finds a marked increase in the number of voters who think President Trump will win the election.

Sanders has gained 8 percentage points since January in the nomination race, while Biden drops into second with 18 percent, down 8 points. Close behind is Mike Bloomberg at 16 percent, up 6 points since last month and triple his 5 percent in December. Pete Buttigieg comes in at 12 percent (up 5), Elizabeth Warren at 10 percent (down 4), and Amy Klobuchar at 5 percent (up 2).

This is the first Fox News poll with five candidates in double digits. It was conducted Sunday through Wednesday. Sanders, notably, was the most attacked candidate during Tuesday’s contentious presidential debate in South Carolina. Chinese Destroyer Shoots Weapons-Grade Laser at U.S. Navy P-8A Plane Operating Near Guam

A U.S. Navy P-8A Poseidon maritime patrol aircraft was lased by People’s Republic of China (PRC) navy destroyer 161 on Feb. 17 while flying in airspace above international waters approximately 380 miles west of Guam.

The P-8A was operating in international airspace in accordance with international rules and regulations. The PRC navy destroyer’s actions were unsafe and unprofessional.

Additionally, these acts violate the Code for Unplanned Encounters at Sea (CUES), a multilateral agreement reached at the 2014 Western Pacific Naval Symposium to reduce the chance of an incident at sea. CUES specifically addresses the use of lasers that could cause harm to personnel or damage to equipment.

The destroyer’s actions were also inconsistent with a Memorandum of Understanding (MOU) between U.S. Department of Defense and the Ministry of National Defense of the PRC regarding rules of behavior for safety of air and maritime encounters.

The laser, which was not visible to the naked eye, was captured by a sensor onboard the P-8A.
Weapons-grade lasers could potentially cause serious harm to aircrew and mariners, as well as ship and aircraft systems.

The P-8A is assigned to VP-45, based out of Jacksonville, Florida, and is forward-deployed to Kadena Air Force Base in Okinawa, Japan. The squadron conducts routine operations, maritime patrol and reconnaissance in the U.S. 7th Fleet area of operations.

U.S Navy aircraft routinely fly in the Philippine Sea and have done so for many years. U.S. Navy aircraft and ships will continue to fly, sail and operate anywhere international law allows.

U.S. 7th Fleet is the largest numbered fleet in the world, and with the help 35 other maritime-nation allies and partners, the U.S. Navy has operated in the Indo-Pacific region for more than century, providing credible, ready forces to help preserve peace and prevent conflict. House Democrats Block Resolution Condemning Bernie Sanders’s Praise of Fidel Castro

By Daily Caller. Democratic lawmakers Thursday successfully blocked a GOP resolution condemning Vermont Sen. Bernie Sanders’s laudatory comments about the Castro regime.

By a vote of 224-189 that fell along party lines, the House of Representatives on Thursday voted to block a resolution that not only condemned numerous human rights abuses that took place under the Castro regime, but also condemned recent instances where Sanders refused to fully denounce the late Fidel Castro’s dictatorial rule over Cuba.

The resolution was introduced by GOP Florida Rep. Mario Diaz-Balart, who represents a district in the state that has 335,000 residents of Cuban descent — roughly half his entire constituency.

During a “60 Minutes” interview that aired Sunday, the Vermont senator said it was “unfair” to say everything about the Castro regime was negative, noting how Castro launched a “massive literacy program” upon assuming power. Bernie Sanders Supporters React to Report Saying Democratic Party Trying to Sabotage Him: ‘It’s Trash’

By Fox News. Fox News contributor and “Hannity” 2020 correspondent Lawrence Jones spoke to Bernie Sanders supporters in North Carolina Thursday about a New York Times report with the headline “Democratic Leaders Willing to Risk Party Damage to Stop Bernie Sanders.”

“There’s a New York Times report today that is talking about the party leadership actively working against Bernie Sanders and willing to break up the party as a result of that, how do you feel about that?” Jones asked Sanders supporters.

“I mean, unfortunately, it’s really kind of what we could see coming to a head since 2016,” One supporter said. Adding that he hoped members of the Democratic Party would rally behind Sanders.

One supporter told Jones she thinks “the Democratic Party is isolating their base.”
