Here’s Why OSHA Has No Legal Power to Enforce a Vaccine Mandate

On November 12, 2021, the U.S. Court of Appeals for the Fifth Circuit stayed the effect of the OSHA mandate pending a final ruling on its validity. But all of the appeals have been consolidated in a different appellate court, the U.S. Court of Appeals for the Sixth Circuit. OSHA later announced that it has “suspended activities related to the implementation and enforcement of the ETS pending future developments in the litigation.” . . .

Yet one thing is perfectly clear: OSHA lacks the legal authority to force a COVID-19 vaccine on Americans who do not want it. Small wonder that more than half the states are suing to stop the Biden administration’s vaccine mandate. . .

First, federal agencies have only the authority that Congress has granted them by statute. Agencies cannot vest themselves with additional power by issuing rules.

Second, agencies cannot undertake unauthorized action even in an emergency. As the Supreme Court explained last summer, “our system does not permit agencies to act unlawfully even in pursuit of desirable ends,” which includes “combatting the spread of the COVID-19 Delta variant.”

Third, vaccinations are materially different from personal protective equipment (PPE), like goggles, gloves, or masks. PPE offers a protective external shield to fend off harmful substances, preventing them from piercing the human skin, a shell that can be shed at the end of the workday. By contrast, vaccinations are not something we wear, they are something that is injected into our bodies to spur the immune system to generate antibody responses to pathogens. Infighting Grows Among House Republicans Amid Fight Between GOP and Dem Reps

Infighting among House Republicans is only growing after a verbal fight between Reps. Lauren Boebert, a Republican from Colorado, and Ilhan Omar, a Democrat from Minnesota, broke out last week.

The feud sparked after Boebert suggested that a Capitol Police officer appeared concerned that Omar was a terrorist, to which the Republican replied that “[Omar] doesn’t have a backpack,” so “we should be fine.” Boebert’s comments were widely seen as Islamophobic, and Omar shot back, saying that the entire story was false.

In response to Boebert’s comments, House Democrats pressured Minority Leader Kevin McCarthy to discipline her, with several floating censure and committee removal. But after Boebert apologized, the feud quickly grew after she posted a video Monday detailing how she and Omar demanded public apologies from one another, resulting in Omar hanging up on her.

Explosion Leaves Mysterious Crater on Shores of Long Island, Authorities Investigating for Potential Terrorism

An explosion that left behind a crater on the shores of Long Island has sparked concerns of potential terrorism, Fox News reported.

The four-foot wide, two-foot deep crater was allegedly created by an illegal explosion on the north side of Fox Island, detonated by an unspecified device, CBS 2 reported.

“Obviously our department is concerned as to why someone would detonate a device of this size and magnitude on an uninhabited island,” Suffolk County police acting commissioner Stuart Cameron told reporters on Monday, Fox News reported. He said a 23-foot-long boat with stripes was seen fleeing the area around the time of the explosion.

“We do know that when people produce homemade explosives, very often they want to test those explosives to make sure they function as intended,” Cameron said. “That is one of our concerns, and that is why we want to determine what transpired yesterday morning.”

Prosecutor Tells Jury Ghislaine Maxwell Groomed Minors for Epstein’s Sexual Abuse

By NBC News. The much-anticipated trial of Ghislaine Maxwell got underway Monday in New York City with a prosecutor and defense attorney painting conflicting portraits of the accused enabler of convicted sex offender Jeffrey Epstein.

Assistant United States Attorney Lara Pomerantz, who gave the federal prosecutors’ opening statement, said Maxwell identified and targeted vulnerable young women and then “served them up” to Epstein.

“She put them at ease and made them feel safe, all so that they could be sexually abused by a middle-aged man,” Pomerantz said. “There were times when she was in the room when it happened.”

Maxwell was no mere Epstein employee, Pomerantz said. She was “the lady of the house” who made sure that what happened behind closed doors stayed behind closed doors. And she and Epstein “had a playbook.”

Ghislaine Maxwell’s Lawyer Reveals Defense Strategy: The Bible, ‘Manipulated’ Victims and a ‘Scapegoat’

By New York Post. Ghislaine Maxwell’s defense attorneys on Monday portrayed her as a scapegoat being accused because of “the bad behavior of men,” — one in particular — since prosecutors never had a chance to put late pedophile Jeffrey Epstein on trial.

Her lawyer, Bobbi Sternheim, invoked the Bible at the start of her opening statement, arguing that women have been condemned for crimes committed by men since the beginning of time.

“Ever since Eve was accused of tempting Adam with the apple,” said Sternheim. “Women have been blamed for the bad behavior of men.”

“Ghislaine is on trial here and you heard about the conduct of Jeffrey Epstein. She is filling that hole. And filling an empty chair,” said Sternheim, adding that her client was a “convenient stand-in” for the dead sex offender.

Sternheim also took aim at the four alleged victims in the case, claiming they had been taken advantage of by aggressive civil defense attorneys and, in some cases, are searching for a payday. Hospital Struggles to Treat 18 Waukesha Parade Victims Because of Vaccine Mandate

The largest children’s hospital in Wisconsin has been struggling to care for patients in injured in the Waukesha Christmas parade attack on Nov. 21 in large part because of staffing shortages stemming from its COVID-19 vaccine mandate, multiple sources say.

Eighteen children were brought to the Children’s Wisconsin Milwaukee Hospital with injuries suffered when a driver plowed into parade-goers that Sunday afternoon. Several remain in critical or serious condition, and an eight-year-old boy died of his injuries Tuesday. As of Monday morning, the hospital was still treating seven victims. . .

Sources at Children’s Wisconsin indicate that when victims first started to be transported to the hospital, it did not have enough nurses or support staff to adequately handle the sudden rush.

“It was a nightmare,” said one nurse, who spoke on condition of anonymity because she is not authorized to speak on the record. “We just don’t have enough people and [supervisors] were frantically calling in everyone they could, but it wasn’t enough. We are taking care of everyone the best we can, but it’s hard.”

A high-ranking official at Children’s, who also spoke on condition of anonymity, said the hospital currently has hundreds of open positions and attributes much of the staffing shortage to the COVID-19 vaccine mandate. The Children’s Wisconsin website lists 239 open positions at its Milwaukee hospital and more than 450 across all of its campuses. BLM Launches Christmas Campaign Against ‘White-Supremacist Capitalism’

Over the Thanksgiving holiday, Black Lives Matter (BLM) accused Americans of “eating dry turkey and overcooked stuffing on stolen land” and bashed Christmas, linking to a story that says the holiday promotes “white-supremacist-capitalism.”

The group’s official Twitter account — where they call themselves a “collective of liberators” — posted a message on Thanksgiving saying, “YOU ARE ON STOLEN LAND,” with a subhead of “Colonization never ended, it just became normalized.” . . .

And the day after Thanksgiving, BLM posted what it called a “new profile pic.”

Iran Declares: ‘We Will Not Back Off From the Annihilation of Israel’

With the Biden administration set to restart a new round of nuclear talks with the Islamic Republic of Iran, the spokesperson for Iran’s military stated over the weekend that they will not give up their pursuit of wiping Israel off the face of the earth.

“We will not back off from the annihilation of Israel, even one millimeter,” Brig.-Gen. Abolfazl Shekarchi, spokesman for the Islamic Republic of Iran’s armed forces, told the Iranian Students News Agency. “We want to destroy Zionism in the world.”

The Jerusalem Post added:

The Iranian general also blasted Bahrain and the United Arab Emirates for normalizing diplomatic relations with Israel, terming the diplomacy “intolerable” for Iran’s clerical regime. “Saudi Arabia, Bahrain, UAE and other countries considered as Muslims, for us they part of the Zionist regime and this is very important,” said Shekarchi.

Federal Govt to Run Out of Money in 4 Days

The federal government will run out of money on Friday amid a jammed Senate schedule in December that may further delay the passage of the $1.9 trillion reconciliation package into next year.

Along with funding the government in December, the Democrat-controlled Senate must raise the debt ceiling before December 15 and pass the National Defense Authorization Act (NDAA), a typically bipartisan piece of legislation for 60 years.

The reconciliation package is also in the mix to be pushed through the chamber, though the clogged Senate calendar may delay the passage until January.

Funding the government, however, is the most immediate crisis for the Senate Democrats. Democrats’ strategy may be to introduce a stopgap funding bill potentially on Wednesday. The stopgap funding would need approval from Senate Republicans and Sen. Mitch McConnell (R-KY), “but that isn’t expected to be a major problem,” Punchbowl News reported.

Ellis, who is Christian, made her comments as she shared an image of a remark by someone with the user name of Lars McMurtry, who boldly stated: “The CDC should roll out a new program: Get the shot or get shot.

“America has had enough of their virus. We need to get back to normal life.

Kyle Rittenhouse No Longer Enrolled at Arizona State University

Kyle Rittenhouse is no longer enrolled at Arizona State University’s online program as of Monday. . .

The news of Rittenhouse not being enrolled at ASU follows a coalition of liberal student groups calling on school administrators to expel him . The four groups announced Friday they would hold a rally on Wednesday to protest Rittenhouse attending the college.

The groups made four demands of campus leadership, including withdrawing Rittenhouse from enrollment, releasing a statement condemning Rittenhouse and white supremacy, reaffirming support for the Multicultural Center, and redirecting funding from ASU’s police department to the Multicultural Center.
