Photo Credit: WNDAn Arizona college is being sued for labeling a student a “bigot” and punishing her with a long-term suspension after she requested that English be used in her nursing studies class so she could learn the subject.
The action was filed against Pima Community College on behalf of student Terri Bennett, who alleged that school officials created a “learning environment [that] was hostile to her as an English-language speaker.”
The complaint alleges that Bennett repeatedly was thwarted in her work listening to lectures, finishing group studies and participating in skills labs, clinicals and other learning activities by fellow students who spoke Spanish, which she did not understand. Study groups and labs in which she participated, an essential part of her nursing training, were being conducted in Spanish.
In response, she asked the college – which operates, ironically, under Arizona’s English-only legal requirement – to help enforce the use of English in her class so she could continue to pursue her educational goals. However, according to the complaint, Bennett was targeted by the school with ridicule, attacks, threats and, eventually, a nine-month suspension.
The group ProEnglish is helping Bennett with legal support.

This raises a question. At what point does the continuous growth and intrusiveness of government make people wake up? This is not just a matter of theory or philosophy. People are hurting — as a direct result of President Barack Obama, his party and the inability of the GOP to make the case for a smaller, less expensive and less intrusive government.
For five years, we have watched as President Barack Obama successfully pushed the following redistributionist agenda for building an economy: Take from the most productive to “stimulate” the economy by redistributing money, often with political consideration involved or attached; allow bureaucrats to pick winners and losers in the market; issue feel-good, top-down regulations that cost jobs and do little to improve conditions; and dictate the terms of health care with ObamaCare, a monstrosity that places one-seventh of our economy under the control of the federal government.
The results are in.
This is the worst economic recovery since World War II. Unemployment remains high. So many able-bodied people are dropping out of the labor force that the “labor force participation rate” remains near a 30-year low.

The Justice-for-Trayvon crowd keeps pretending there hasn’t been a trial where the evidence overwhelmingly showed that Trayvon committed the first (and only) crime that night by assaulting Zimmerman. Instead, the race agitators are sticking with the original story peddled by the media, back when we had zero facts. To wit, that Zimmerman had stalked a young black child and shot him dead just for being black and wearing a hoodie.
Dozens of these hair-on-fire racism stories are retold in my book, “Mugged: Racial Demagoguery From the Seventies to Obama.” In the golden age of racial demagoguery, they came at a pace of about one a year. Al Sharpton was usually involved.
A normal person would hear some of the more outlandish allegations and think, “I can’t believe it!” not meaning, “Wow! What a blockbuster story!” but rather, “I would like to hear the facts because I literally don’t believe it.” (That was much of America’s reaction to the media’s claim last year that a neighborhood-watch captain in Florida had hunted down a black teenager and shot him dead just for wearing a hoodie.)Whenever a much-celebrated claim of racism turned out to be false — which was almost always — you’d just stop hearing about it. There would never be a clippable story admitting that the media’s harrumphing had been in error:

“America has no functioning democracy,” Carter said at a meeting of The Atlantic Bridge in Atlanta, Georgia on Tuesday.
Carter also claimed there was currently no reason for him to be “optimistic” about Egypt’s internal conflicts and mused whether the standards The Carter Center applies to foreign elections could be fulfilled by U.S. elections, which he believes are plagued by confusing campaign rules and a lack of restrictions on free speech in the wake of the Supreme Court’s Citizens United ruling.
The former president continued that democratic developments — fueled by sites such as Facebook and Twitter — might be damaged by the NSA revelations, essentially strangling emerging democratic revolutions in the cradle by casting doubt on the social media juggernauts’ independent credibility. By Hadas Gold. The jury made the “right decision” in the George Zimmerman murder trial, former President Jimmy Carter said Tuesday.
“I think the jury made the right decision based on the evidence presented, because the prosecution inadvertently set the standard so high that the jury had to be convinced that it was a deliberate act by Zimmerman that he was not at all defending himself, and so forth,” Carter told Atlanta news channel WXIA. “It’s not a moral question, it’s a legal question and the American law requires that the jury listens to the evidence presented.”

By Wall Street Journal. We’re starting to understand why Lois Lerner took the Fifth about her role in the IRS targeting of conservative groups. The testimony of at least three more employees in the IRS Washington office is now making clear that Ms. Lerner and other Washington IRS officials had a direct hand in slow rolling the tax-exempt applications of conservative groups in an election season.
The House Oversight Committee holds another hearing Thursday that will showcase some of these witnesses. According to Washington IRS tax law specialist Carter Hull, his supervisor Ronald Shoemaker and Manager of Exempt Organizations Technical Michael Seto, tea party applications were intentionally singled out for extra layers of review and put through an unusual process.
Mr. Hull told House investigators that normally his judgment about applications would have been enough to approve or deny their tax-exempt status. Instead of sending those applications through the normal channel, however, conservative applications were sent through Ms. Lerner’s office for review, and also directed to the IRS chief counsel. That process was highly unusual and created a vetting system in which applications were interminably delayed.
According to Mr. Hull, starting in April 2010, he was told by a supervisor to give extra attention to some tea party applications as a trial run for how the agency might handle such cases going forward. As part of that process, he was instructed to send the applications through Ms. Lerner’s office and the office of IRS Chief Counsel William Wilkins for additional scrutiny.

By Patrick Howley. Top IRS officials in Washington, D.C. planned and oversaw the agency’s improper targeting of conservative groups, according to the 72-year old retiring IRS lawyer who will testify Thursday before the House Oversight Committee.
Retiring IRS lawyer Carter C. Hull implicated the IRS Chief Counsel’s office, headed by Obama appointee William J. Wilkins, and Lois Lerner, the embattled head of the IRS’ exempt organizations office, in the IRS targeting scandal and made clear that the targeting started in Washington, according to leaked interviews that Hull granted to the Oversight Committee in advance of Thursday’s hearing.
Treasury Inspector General J. Russell George will return to Republican chairman Darrell Issa’s committee Thursday along with two central characters in the IRS saga: Hull and Cincinnati-based IRS employee Elizabeth Hofacre, who previously gave Hull’s name to congressional investigators, fingering him as her Washington-based supervisor. By Bob Unruh. The IRS, which has been in trouble for weeks now for targeting conservative, Christian and Jewish organizations seeking tax-exempt status with invasive and probably illegal questions, still is stalling, charges a legal team in the battle.
The federal tax agency had offered an “expedited review” if the groups would agree to “an arbitrary 60/40 standard” requiring them to devote 60 percent of their time and expenditures to activities promoting social welfare and limit their political activity to 40 percent or less.
“The IRS created this standard out of thin air in an effort to placate Americans who have been unlawfully and unconstitutionally targeted by the IRS because of their political beliefs,” said Jay Sekulow, chief counsel of the American Center for Law and Justice.
“This so-called solution is deeply flawed and does nothing to address and correct the real problem at the IRS: a pervasive and systematic assault on conservative organizations. The IRS remains an agency incapable of self-governance or self-correction. Our federal lawsuit is moving forward to stop this abusive targeting scheme and to hold those responsible for this disturbing conduct accountable,” he said.
The IRS discrimination has been well-documented. One IRS official pleaded the Fifth and declined to respond to questions from Congress, but others in the agency have admitted to cases cited by conservative groups who were told, for example, they had to reveal the content of members’ prayers or make promises about what they would or would not say. By Spencer Ackerman. The National Security Agency revealed to an angry congressional panel on Wednesday that its analysis of phone records and online behavior goes exponentially beyond what it had previously disclosed.
John C Inglis, the deputy director of the surveillance agency, told a member of the House judiciary committee that NSA analysts can perform “a second or third hop query” through its collections of telephone data and internet records in order to find connections to terrorist organizations.
“Hops” refers to a technical term indicating connections between people. A three-hop query means that the NSA can look at data not only from a suspected terrorist, but from everyone that suspect communicated with, and then from everyone those people communicated with, and then from everyone all of those people communicated with.
Inglis did not elaborate, nor did the members of the House panel – many of whom expressed concern and even anger at the NSA – explore the legal and privacy implications of the breadth of “three-hop” analysis.
But Inglis and other intelligence and law enforcement officials testifying before the committee said that the NSA’s ability to query the data follows rules set by the secret Fisa court, although about two dozen NSA officials determine for themselves when those criteria are satisified. By Stephen Dinan. The lawmaker who wrote the USA Patriot Act said Wednesday that, as it stands, the House will never renew the provisions that the Obama administration uses to collect Americans’ phone records, meaning the government’s surveillance program will be cut off some time next year.
Both Democrats and Republicans told top administration officials that they reject President Obama’s claim that the law allows the intelligence community to collect the phone numbers, time, date and duration of calls made by Americans, and they said Mr. Obama needs to change the way he is running the program if he wants to keep it intact.
Rep. F. James Sensenbrenner Jr., the Wisconsin Republican who was chief author of the Patriot Act in 2001, said Congress specifically tried to limit the law’s uses when it renewed the provisions under Section 215 of the act that allow the government to collect data from businesses without obtaining a warrant.
In that renewal Congress added in the word “relevant” to try to limit what the government was pursuing. But Mr. Sensenbrenner said the intelligence community has expanded, not limited, its data-gathering efforts after Congress tried to reel them in.
“Section 215 expires at the end of 2015 and unless you realize you’ve got a problem, that is not going to be renewed. There are not the votes in the House to renew Section 215,” he said. “It’s got to be changed and you have to change how you operate Section 215. Otherwise, in a year or a year and a half, you’re not going to have it anymore.” Read more from this story HERE.
By Brian Hughes. Russian President Vladimir Putin insisted on Wednesday that an already frosty relationship between his government and the United States would not be damaged if Russia granted asylum to National Security Agency leaker Edward Snowden.
“Bilateral relations, in my opinion, are much more important than the squabbles around the activities of the security services,” Putin told reporters in eastern Siberia.
“We warned Mr. Snowden that any of his activities that cause damage to U.S.-Russian relations are unacceptable to us.”
Snowden, the former government contractor who disclosed details about U.S. phone and Internet surveillance programs, applied for temporary asylum in Russia on Tuesday. A lawyer representing Snowden told Russia’s Interfax news agency on Wednesday that the ex-CIA official could leave Moscow’s Sheremetyevo Airport in the next few days.
The Obama administration has repeatedly warned the Putin regime not to give Snowden refuge since he faces a trio of espionage charges back on U.S. soil. If his application were approved, Snowden could stay in Russia for up to a year. Read more from this story HERE.

The information potentially allows authorities to track the movements of everyone who drives a car.
The ACLU documented the police surveillance after reviewing 26,000 pages of material gathered through public records requests to almost 600 local and state police departments in 38 states and the District of Columbia.
Police are gathering the vehicle information with surveillance technology called automatic license plate readers, and it’s being stored — sometimes indefinitely — with few or no privacy protections, the ACLU said.
“The documents paint a startling picture of a technology deployed with too few rules that is becoming a tool for mass routine location tracking and surveillance,” the ACLU said in a written statement.

By James Nye. Chances are, your local or state police departments have photographs of your car in their files, noting where you were driving on a particular day, even if you never did anything wrong.
Using automated scanners, law enforcement agencies across the country have amassed millions of digital records on the location and movement of every vehicle with a license plate, according to a study published Wednesday by the American Civil Liberties Union.
Affixed to police cars, bridges or buildings, the scanners capture images of passing or parked vehicles and note their location, uploading that information into police databases. Departments keep the records for weeks or years, sometimes indefinitely.
As the technology becomes cheaper and more ubiquitous, and federal grants focus on aiding local terrorist detection, even small police agencies are able to deploy more sophisticated surveillance systems.
While the Supreme Court ruled in 2012 that a judge’s approval is needed to track a car with GPS, networks of plate scanners allow police effectively to track a driver’s location, sometimes several times every day, with few legal restrictions. Read more from this story HERE.

A new report from the American Civil Liberties Union has found an alarming proliferation of databases across the US storing details of Americans’ locations. The technology is not confined to government agencies – private companies are also getting in on the act, with one firm National Vehicle Location Service holding more than 800m records of scanned license plates.
“License plate readers are the most pervasive method of location tracking that nobody has heard of,” said Catherine Crump, ACLU lawyer and lead author of the report. “They collect data on millions of Americans, the overwhelming number of whom are entirely innocent of any wrongdoing.”
Crump said that the creeping growth of license plate scanners echoed the debate over the National Security Agency. “It raises the same question as the NSA controversy: do we want to live in a world where the government makes a record of everything we do – because that’s what’s being created by the growth of databases linked to license plate readers.”
ACLU based their research on the results of freedom of information requests to 300 police departments and other agencies nationwide that generated 26,000 pages of documents. The ACLU study, based on 26,000 pages of responses from 293 police departments and state agencies across the country, also found that license plate scanners produced a small fraction of “hits,” or alerts to police that a suspicious vehicle has been found.
In Maryland, for example, the state reported reading about 29 million plates between January and May of last year. Of that amount, about 60,000 — or roughly 1 in every 500 license plates — were suspicious. The No. 1 crime? By Tracy Jarrett. Rolling Stone magazine sparked a heated social media debate Wednesday after releasing a cover image promoting an upcoming profile of alleged Boston Marathon bomber Dzhokhar Tsarnaev.
The Twitter and Facebook firestorm resulted in calls for boycotts and drugstore chains Walgreens and CVS announcing they would not carry the issue in their stores. Together, the pharmacies have more than 15,000 locations nationwide.
“As a company with deep roots in New England and a strong presence in Boston, we believe this is the right decision out of respect for the victims of the attack and their loved ones,” a statement from CVS said. CVS is headquartered in Woonsocket, R.I. Tedeschi Foods, a New England-based grocery chain with 200 outlets, also announced Wednesday that it would not carry the issue of the magazine.
The cover, released online as a preview to Friday’s edition with an in-depth article chronicling Tsarnaev’s life leading up to the Boston Marathon bombing, features a “selfie” — or self-taken photo– by Tsarnaev with the teen’s hair falling across his face. Read more from this story HERE.
In a statement, the magazine said its thoughts were “always with” the bombing victims and their families.
“The cover story we are publishing this week falls within the traditions of journalism and Rolling Stone’s long-standing commitment to serious and thoughtful coverage of the most important political and cultural issues of our day,” it said. “The fact that Dzhokhar Tsarnaev is young, and in the same age group as many of our readers, makes it all the more important for us to examine the complexities of this issue and gain a more complete understanding of how a tragedy like this happens.”
While primarily a music magazine, the journal also has forged a reputation for hard-hitting pieces on national affairs, politics and popular culture. For example, journalist Michael Hastings wrote a 2010 profile of Gen. Stanley McChrystal that led to the officer’s abrupt retirement. In his profile, Hastings quoted McChrystal and his staff criticizing and mocking key administration officials.
Washington Post media critic Erik Wemple said Rolling Stone should be out defending its article, because it’s “a pretty easy thing to defend.”
“What you have here is a story about a guy who was very integrated and well-balanced, by all accounts, member of our society until something happened,” Wemple said. “We don’t know precisely what happend and that was the whole point of this Rolling Stone story — to account for how he slid off the rails.”

Tommy Vietor, the former spokesman, said he thought the Rolling Stone magazine cover glamorized Dzhokhar Tsarnaev, who is suspected of plotting and carrying out the bombing earlier this year that killed three people.

Barton reportedly admitted to deputies that he fired his weapon while chasing away people who he thought were breaking into his vehicles at 5804 NE 124th St. in the early morning hours Monday.
Deputies are investigating whether a large teen party that got out of control at a neighbor’s home may have been linked to the shooting. However, at this point, deputies have said there was no evidence of prowlers on Barton’s property.
Outside the courtroom Wednesday, Barton cited the vice president in defense of his actions.
“I did what Joe Biden told me to do,” Barton told KOIN. “I went outside and fired my shotgun in the air.”
