While in the midst of a wholesale reevaluation of the right to private property, it is timely to reexamine the history of US property rights. What exactly caused America’s unparallelled level of prosperity and freedom? Certainly our economic success then created unparallelled global influence and military might. But what factors allowed America’s stunning growth in economic power in such a short period of time? This economic success was driven by a firm Rule of Law regime which supported the Constitution’s unique defense of private property.

What is the relationship between property, Rule of Law and prosperity? In a nutshell, history shows that unless private property is protected by a firm, unyielding and unbiased Rule of Law, markets will not flourish. Therefore, wealth will not grow and all the other things associated with a prosperous society will also fall by the wayside. The reasons for this are ultimately based in human nature. People are not automatons who simply go about doing “what we are supposed to do.” Instead, human motivation and productivity are very much tied into the rewards and risks found in any undertaking. Yet, if the government takes away the rewards of ambition, leaving behind only the risks, then productivity will fall precipitously.

It is one of the hallmarks of Marxist-influenced thinking to insist human nature does not exist. This single presumption has caused more chaos than probably any other leftist idea. It’s a direct result of assuming God is a fiction, ie religion as the Opiate of the Masses. But, if there is no God, then mankind cannot be made in His likeness—Imago Dei. Further, if humans evolved from a random series of directionless events, and there is no inherent core in people, then anything goes and nothing is out of bounds for ethics, morality, or any other human undertaking. Or, as Dostoevsky believed—Without God, everything is possible. So, the presumption mankind is just a soulless, material being is the single most destructive element in the progressive worldview, and the root cause of all subsequent economic failure.

I. History & Importance of Rule of Law

The Rule of Law as a concept is tied historically to such thinkers as Aristotle, and legal developments such as the Ten Commandments, a foundational legal code. The American Constitution is a concrete example of Rule of Law theorizing, creating a bedrock set of precepts. As a concept, the Rule of Law is a necessary addendum to the Natural Law theory of jurisprudence. It was Scottish divine and university professor Samuel Rutherford who most eloquently described the concept of the Rule of Law in his Lex Rex, or The Law is King. This work influenced the Founders, as well as philosopher John Locke’s writings on constitutionalism and property rights. Locke’s contribution to a Rule of Law republic can be seen in his chapter Section 202 of Chap. XVIII “Of Tyranny” in Book II of the Two Treatises of Government :

“Where-ever law ends, tyranny begins, if the law be transgressed to another’s harm; and whosoever in authority exceeds the power given him by the law, and makes use of the force he has under his command, to compass that upon the subject, which the law allows not, ceases in that to be a magistrate; and, acting without authority, may be opposed, as any other man, who by force invades the right of another. This is acknowledged in subordinate magistrates. He that hath authority to seize my person in the street, may be opposed as a thief and a robber, if he endeavours to break into my house to execute a writ, notwithstanding that I know he has such a warrant, and such a legal authority, as will impower him to arrest me abroad. And why this should not hold in the highest, as well as in the most inferior magistrate, I would gladly be informed.”

Individual Health Insurance Premiums Skyrocket After Obamacare

Health insurance companies across the country are seeking and winning double-digit increases in premiums for some customers, even though one of the biggest objectives of the Obama administration’s health care law was to stem the rapid rise in insurance costs for consumers.

Particularly vulnerable to the high rates are small businesses and people who do not have employer-provided insurance and must buy it on their own.

In California, Aetna is proposing rate increases of as much as 22 percent, Anthem Blue Cross 26 percent and Blue Shield of California 20 percent for some of those policy holders, according to the insurers’ filings with the state for 2013. These rate requests are all the more striking after a 39 percent rise sought by Anthem Blue Cross in 2010 helped give impetus to the law, known as the Affordable Care Act, which was passed the same year and will not be fully in effect until 2014.

In other states, like Florida and Ohio, insurers have been able to raise rates by at least 20 percent for some policy holders. The rate increases can amount to several hundred dollars a month.

Nuclear Security Helicopters Testing Radiation Levels Above DC Area

WASHINGTON – Helicopters have been conducting radiation tests above portions of the Washington, D.C. area using remote gamma radiation sensing technology.

The National Nuclear Security Administration (NNSA) has been flying the radiation missions since Dec. 27, 2012 and they will continue until next Friday, Jan. 11. The flights have been conducted during daylight only, and the pilots fly about 80 miles per hour at 150 feet above the approximately 70-square mile radiation assessment area.

Naturally-occurring radiation is measured so that baseline levels can be established and used in security and emergency preparedness, reads a statement from the NNSA.

In addition to monitoring radiation levels and responding to radiological emergencies on the home front, the agency provides the U.S. Navy with nuclear propulsion and works to reduce the global danger of weapons of mass destruction, according to a release issued by the agency.

Karl Rove’s Super PAC Promised IRS It Would Spend ‘Limited’ Money on Elections

In a confidential 2010 filing, Crossroads GPS — the dark money group that spent more than $70 million from anonymous donors on the 2012 election — told the Internal Revenue Service that its efforts would focus on public education, research and shaping legislation and policy.

The group’s application for recognition as a social welfare nonprofit acknowledged that it would spend money to influence elections, but said “any such activity will be limited in amount, and will not constitute the organization’s primary purpose.”

Political insiders and campaign-finance watchdogs have long questioned how Crossroads, the brainchild of GOP strategist Karl Rove, had characterized its intentions to the IRS.

Now, for the first time, ProPublica has obtained the group’s application for recognition of tax-exempt status, filed in September 2010. The IRS has not yet recognized Crossroads GPS as exempt, causing some tax experts to speculate that the agency is giving the application extra scrutiny. If Crossroads GPS is ultimately not recognized, it could be forced to reveal the identities of its donors.

The tax code allows groups like Crossroads to spend money on political campaigns — and to keep their donors private — as long as their primary purpose is enhancing social welfare.

After Destroying the Country, the RINO-Establishment Now Fixes its Sights on the GOP

According to a story from Politico this weekend, the 2012 election cycle has convinced establishment RINOs that, more than ever before, they have a “primary problem.”

Apparently, the post-election topic for these RINOs is how to influence primaries to get rid of those pesky constitutional conservatives who are mysteriously winning primaries but losing general elections. They’ve concluded that they’re going to return to their 2010 playbook of openly being involved in GOP primaries.

In other words, active intervention “in selected 2014 races to ensure preferred candidates win.” The RINO leaders intend to “clear fields” through “aggressive” primary involvement.

They intend to use “big-money establishment Republican super PACs like [Karl Rove’s] American Crossroads” to attack conservative candidates backed by groups like Jim DeMint’s Senate Conservative Fund and the Club for Growth.

Senator John Cornyn, the last National Republican Senatorial Committee chairman who helped orchestrate the NRSC’s hit on Joe Miller in Alaska’s 2010 general election battle against liberal Lisa Murkowski, agreed that establishment PACs would be taking a more active role in GOP primaries. He predicted the involvement of multiple super PACs: “This is too important to leave to [just Karl Rove’s] organization. You’re going to see other super PACs getting involved.”

Unfortunately for these disconnected ruling elites, the grassroots of the GOP is no longer playing along. Constitutional conservatives recognize that the RINO-establishment is responsible right along with the Democrats for the growth and bankruptcy of the federal government. They also see the establishment’s fingerprint on attacks against their candidates in multiple general election races.

So knock yourself out, RINO’s. The more you mettle, the sooner your unholy, big government alliance with the Democrats is forced out of the closet.

Pakistan Government in Jeopardy? 21 Soldiers Killed by Taliban in Brazen Attack

WASHINGTON – The latest killing of 21 captured Pakistani troops by the Pakistani Taliban, or TTP, has indicated a rising threat to the very authority of the Pakistani government, according to a report in Joseph Farah’s G2 Bulletin.

This followed an attack in early December on Peshawar Air Force Base which raised serious questions on the security of the country’s nuclear arsenal. While the attack proved unsuccessful, the brazenness raised further security and public concerns about the commitment of the militants to take down the government.

The air base itself is located close to the northwest tribal areas where Pakistani and U.S. forces have continuous firefights with the Taliban, who are attempting to threaten Pakistan’s capital, Islamabad.

The attack on the Peshawar Air Force Base isn’t the first such attack on a military facility. There also have been attacks on Minhas Air Force Base in Kamra where a squadron of U.S.-supplied F-16 fighter jets is located.

Ironically, publicity of the attacks apparently has encouraged the TTP to launch even more brazen attacks, with the idea of seeking to undermine the stability of the government and its military and create doubt in the public’s mind on both institutions maintaining order.

On First Day, Democrats Propose Eight Anti-Gun Bills

With the left looking for its next big cause, Congressional Democrats have latched onto the Sandy Hook massacre as an opportunity to push gun control. Yesterday alone, eight new bills were introduced relating to gun control. Two conservative bills were introduced relating to ending “gun free zones” under federal law.

Rep. Carolyn McCarthy (D-NY) led the way with four bills introduced. Her husband was shot to death in 1993 and her son was severely injured when Colin Ferguson, a mentally unstable black militant (he spent time in his apartment chanting, “all the black people killing all the white people”), shot up a Long Island commuter train.

She has been a longtime gun control advocate. In 1997, she tried to push a federal law that would have mandated trigger locks on all firearms. She introduced legislation that would have forced gun companies to produce firearms that were “child-resistant.” In 2007, she tried an “assault weapons” ban that would have targeted some 65 types of firearms.

The measures McCarthy introduced include:
•Significant restrictions on gun show transactions, which would in effect end gun shows;
•No online purchases of ammunition, and licensing of ammunition dealers, as well as reporting to the federal government all bulk ammunition purchases;
•Prohibition on the transfer, sale, or possession of ammunition clips beyond a certain size.

But McCarthy wasn’t alone.

Obamacare Layoffs, Hiring Freezes Begin

Obamacare opponents warned that forcing companies employing 50 or more full-time workers to buy healthcare would prompt employers to slash jobs and worker hours. And that’s exactly what’s happening, says one of President Barack Obama’s favorite economists, Mark Zandi of Moody’s Analytics.

“It will have a negative impact on job creation” this year, says Mr. Zandi.

The Obamacare employer mandate doesn’t go into effect until January 1, 2014, but the government requires businesses to track worker schedules for three to 12 months in advance. That means many employers plan to get a jump start on avoiding Obamacare’s $2,000 per-worker fine by firing workers now, reducing employee hours, or replacing full-time employees with part-time workers.

A survey by the International Franchise Association finds that 31% of franchisees say they plan to cut staff to duck under Obamacare’s 50-employer mandate. And another study by Mercer consulting firm found that half of businesses who don’t presently offer health insurance plan to reduce employee hours to avert triggering Obamacare’s penalties.

As Breitbart News has reported, Pennsylvania Community College of Allegheny County has already slashed the hours of 400 adjunct instructors, support staff, and part-time teachers to sidestep the Obamacare fines. Doing so will save the already cash-strapped college an estimated $6 million.

Non-Believers on Rise in Congress

The number of members of Congress who don’t identify with any particular religion is on the rise, according to an analysis by the Pew Forum on Religion & Public Life.

In the 96th Congress (1979-80), not a single member of the House or Senate said they didn’t belong to any particular faith, didn’t know or refused to disclose their religion. But in the new 113th Congress, 10 members fall under that category.

That’s twice as many as in the 111th Congress (2009-10).

Pew notes there’s still a great disparity between the percentage of U.S. adults and the percentage of members of Congress who don’t identify with any particular religion.

From Pew’s fascinating report on the religious composition of the 113th Congress:
“About one-in-five U.S. adults describe themselves as atheist, agnostic or “nothing in particular” – a group sometimes collectively called the “nones.” But only one member of the new Congress, Kyrsten Sinema (D-Ariz.), is religiously unaffiliated, according to information gathered by CQ Roll Call. Sinema is the first member of Congress to publicly describe her religion as “none,” though 10 other members of the 113th Congress (about 2%) do not specify a religious affiliation, up from six members (about 1%) of the previous Congress. This is about the same as the percentage of U.S. adults in Pew Research Center surveys who say that they don’t know, or refuse to specify, their faith (about 2%).”

Obama’s ‘Cash For Clunkers’ Unleashed ‘Environmental Nightmare’

In a classic tale illustrating the “law of unintended consequences,” a new report concludes that President Barack Obama’s $3 billion “Cash for Clunkers” taxpayer-funded boondoggle artificially drove car prices up, not down, and unleashed an “environmental nightmare” through shredding, not recycling, many of the 690,000 cars people traded in for an up to $4,500 car credit.

In 2009, Mr. Obama proudly declared that his Cash for Clunkers program, officially known as the Car Allowance Rebate System (CARS), was a stunning success. “There were skeptics who weren’t sure that this ‘Cash for Clunkers’ program would work,” said Mr. Obama. “But I’m happy to report that it has succeeded well beyond our expectations and all expectations, and we’re already seeing a dramatic increase in showroom traffic at local car dealers…So I’m very pleased with the progress that’s been made in the House today on the “Cash for Clunkers” program.”

But as Yahoo News notes, the program’s decision to shred, not recycle, many of the trade-in vehicles unleashed an “environmental nightmare”:

“Shredding vehicles results in its own environmental nightmare. For each ton of metal produced by a shredding facility, roughly 500 pounds of “shredding residue” is also produced, which includes polyurethane foams, metal oxides, glass and dirt. All totaled, about 4.5 million tons of that residue is already produced on average every year. Where does it go? Right into a landfill.

E Magazine states recycling just the plastic and metal alone from the CARS scraps would have saved 24 million barrels of oil. While some of the “Clunkers” were truly old, many of the almost 700,000 cars were still in perfectly good condition. In fact, many that qualified for the program were relatively “young,” with fuel efficiencies that rivaled newer cars.”
