The law firm Becker & Poliakoff has taken “immediate and severe” action against a lawyer who condemned gay marriage in an email sent to the entire firm, according to one of the firm’s leaders. . . He voiced his opinions on Monday in a “reply all” email to a firmwide announcement about a decision striking down Florida’s ban on gay marriage . . .

Kubitz’s email says the ruling was based on an improper reading of the Constitution. He then goes on to say that homosexuality is condemned by scripture. “Today’s reckless trashing of morality has been damaging on many fronts,” he wrote. “For one, there has been a significant increase in sexually transmitted disease over the past few decades, with the gay plague of AIDS being a classic example” . . .

The email began this way: “The issue having been raised, permit me the liberty to reply, lest my usual silence be taken as assent.” The decision by U.S. District Judge Robert Hinkle said the gay-marriage ban violated due process and equal protection clauses, but “there is not a shred of historical evidence that either of those clauses was ever intended to legitimize homosexuality,” Kubitz said.

“Judge Hinkle and others like-minded have effectively amended the Constitution by judicial fiat. This is a blatant usurpation of power reserved to the states and to the people in violation of the 10th Amendment. … Adding insult to injury, Judge Hinkle invokes our founding fathers as though they would have approved of his ruling. Not so. In his 1796 farewell address then-president George Washington spoke of morality as being indispensable to our societal well-being.

FBI National Domestic Threat Assessment Omits Islamist Terrorism

The FBI’s most recent national threat assessment for domestic terrorism makes no reference to Islamist terror threats, despite last year’s Boston Marathon bombing and the 2009 Fort Hood shooting—both carried out by radical Muslim Americans.

Instead, the internal FBI intelligence report concluded in its 2013 assessment published this month that the threat to U.S. internal security from extremists is limited to attacks and activities by eight types of domestic extremist movements—none motivated by radical Islam.

They include anti-government militia groups and white supremacy extremists, along with “sovereign citizen” nationalists, and anarchists. Other domestic threat groups outlined by the FBI assessment include violent animal rights and environmentalist extremists, black separatists, anti- and pro-abortion activists, and Puerto Rican nationalists.

The coal industry has been dealt another blow after a state agency in Oregon denied a key permit for a controversial terminal, marking the latest salvo in an escalating fight between coal exporters and fossil-fuel loathing environmentalists on the West Coast.

The permit, for the Coyote Island Terminal in Oregon, was denied on Aug. 18 by the Oregon Department of State Lands (DSL). Though opponents rejoiced, the company building the dock, which would be used to transport tons of coal down the Columbia River, cited it as a potential economic boon – and questioned whether politics were at play in the permit rejection.

The terminal would serve as the starting point in a shipping operation that would eventually stage and ship upwards of 8 metric tons of coal over land and river, and then onto buyers in Asia.

After the rejection by the state, the company is holding out hope that the feds will side with them as part of a separate review.

“We’re disappointed, but it’s not the end,” said Liz Fuller, spokeswoman for the Australia-based Ambre Energy, which wants to build the terminal as part of its $242 million Morrow Pacific project.

The progressive socialists and the Obama administration keep finding new ways fundamentally transform (destroy?) America. As our kids head back to school, Obama has found another way to flood our country with more illegal immigrants from Central America. Many of our school districts are receiving tens of thousands of “unaccompanied minor children”– aka illegal aliens — all at the cost of hard working American families. And now, a new tactic from these master deceivers.

As reported by The Daily Caller, “The Department of Justice’s board of immigration appeals has decided to let Guatemalan women win asylum in the United States if they claim to be victims of domestic violence. The decision was announced in an Aug. 26 decision from the Board of Immigration Appeals at President Barack Obama’s Department of Justice. It creates a huge new incentive for Guatemalan women to cross the U.S. border, because if their asylum claim is accepted, their children get U.S. citizenship, plus the use of federal health, education and retirement programs, regardless of their initial education and work skills. The new decision also means that many of the Guatemalan women who have already crossed the border this year have a new claim for asylum.”

Yes they can and yep, they did — they found a way to backdoor our immigration system and do it in a manner which would make anyone challenging it seem, well, “uncompassionate.” So if you are a Guatemalan woman here already, guess what you’re going to claim now? And you can walk this dog back and I bet you’ll find ACLU, LULAC, and La Raza influence and their accompanying support in developing this new course of action.

As a matter of fact, check out this quote: “Under this breaking decision from the Board of Immigration Appeals, many [migrant] women [detained at the detention center] Artesia may be eligible for asylum,” said Ben Winograd, a lawyer who is paid to help foreigners win residency and citizenship. “This (long overdue) BIA decision should make many [foreign] victims of domestic violence eligible for asylum,” said Winograd, a liberal advocate who is based in Alexandria, Va.

Obama: Media Makes You Think ‘World is Falling Apart’

President Obama on Friday said social media and the nightly news are partly to blame for the sense that “the world is falling apart.”

“I can see why a lot of folks are troubled,” Obama told a group of donors gathered at a Democratic National Committee barbecue in Purchase, N.Y.

But the president said that current foreign policy crises across the world are not comparable to the challenges the U.S. faced during the Cold War.

Acknowledging “the barbarity” of Islamist militants and Russia “reasserting the notion that might means right,” Obama, though, dismissed the notion that he was facing unprecedented challenges.

Mitch McConnell’s Campaign Manager Resigns

Senate minority leader Mitch McConnell’s campaign manager, Jesse Benton, is resigning from the campaign.

Benton, who previously held high-level roles in Ron Paul and Rand Paul’s campaigns, confirmed his resignation Friday evening, explaining that he is stepping down after his name surfaced in news reports about a scandal involving the 2012 presidential campaign.

Earlier this week, a former Iowa state senator pleaded guilty to charges related to receiving money from the Ron Paul presidential campaign in return for his endorsement.

Benton, who was Paul’s political director, denies any wrongdoing but admits it has become a distraction for McConnell.

Judge Dismisses Lawsuit Challenging Cochran Win

A Mississippi judge dismissed a lawsuit Friday that seeks to overturn six-term Sen. Thad Cochran’s victory in a Republican primary runoff, but the losing candidate in the prolonged election fight could still appeal the decision to the state Supreme Court.

Judge Hollis McGehee said state Sen. Chris McDaniel, who lost to Cochran in the June 24 runoff, failed to start an election challenge on time. McDaniel’s lawsuit claims irregularities spoiled the runoff, and it asks the judge to declare McDaniel the winner or order a new runoff.

“The court is faced with the undisputed facts that Sen. McDaniel filed his complaint with the state Republican executive committee 41 days after the date of the election,” McGehee said Friday as he announced his ruling from the bench in Gulfport.

“The law requires that it be done in 20 days,” McGehee said. “It’s not a question of whether I think that’s good law or whether I think it should be that way or not be that way. The question is, what is the law? And when you don’t meet that requirement, then you’re not entitled to come in the door of the courthouse, so to speak, with a lawsuit.”

New Challenge for HealthCare.gov: Tax Forms

The federal agency that had trouble launching a health insurance website last fall has a massive new project. Any glitches on this one could delay tax refunds for many Americans.

Because of complicated connections between the new health care law and income taxes, the Department of Health and Human Services must send out millions of new tax forms next year. They’re like W-2s for people getting health insurance tax credits under President Barack Obama’s law.

The forms are called 1095-As, and list who in each household has health coverage, and how much the government paid each month to subsidize those insurance premiums. Nearly 5 million people have gotten subsidies through HealthCare.gov.

If the forms are delayed past their Jan. 31 deadline, some people may have to wait to file tax returns — and collect their refunds.

A delay of a week or two may not sound like much, but many people depend on their tax refunds to plug holes in family finances.

Judge Denies Activist’s Request To Stop Government From Transporting Illegal Immigrants To Other States

A federal judge in Texas denied Wednesday a conservative activist’s request for an emergency stay to stop the government from transporting immigrants who entered the country illegally in South Texas to other states or releasing them on their own recognizance.

In a complaint filed in July, Orly Taitz argued that by sending immigrant children and families to various states while South Texas was overwhelmed by an immigration surge, the U.S. government created a public health risk. She called for a two-month quarantine and medical screening for all immigrants detained after entering the country.

U.S. District Judge Andrew Hanen on Wednesday told the dentist and lawyer from Rancho Santa Margarita, California, that she could refile an amended complaint. He said he was denying her request for an emergency stay because he was not convinced the lawsuit would succeed with Taitz as the plaintiff.

“The only way I see this going forward beyond this next step is that you’re going to have some expert support for your damages,” Hanen said.

Speaking from the White House Briefing room on Thursday, President Obama touched on a whole host of foreign challenges facing the nation.

Most significantly, perhaps, he noted that Secretary of State John Kerry will soon be heading to the Middle East to “build a coalition” to help meet the growing threat of ISIL.

“I am confident that we can and we will,” he intoned.

He also noted that he had asked Secretary of Defense Chuck Hagel — and his joint chiefs of staff — to furnish him with “a range of options” to finally deal with these violent and bloodthirsty terrorists.

“Clearly ISIL had come to represent the very worst elements in the region that we have to deal with collectively,” he said.
