You Can’t Fix Stupid… Or Crazy

Repeat after me—there is no Obamacare fix.

Obamacare is not an epic failure simply because of its incompetent implementation best symbolized by a $94 million website that doesn’t work. Rather, Obamacare’s incompetent implementation is a symptom of its real disease.

That real disease is this: Obamacare cannot possibly work because it operates outside the natural laws of economics, and it’s another ham-fisted attempt by government to do something that is outside of its God-given (or Constitutional) jurisdiction.

In other words, Obamacare is magical thinking. It’s tilting at windmills, or the legislative equivalent of howling at the moon. It’s an attempt to ignore reality, which is to say its sheer lunacy. And you can’t fix crazy anymore than you can fix stupid. This was never going to work. It was always going to start and end like this, and therefore any earnest or well-intentioned attempts to put lipstick on this turd will just make the foul stench surrounding it all the worse.

Obama’s Lawlessness

Obama claims a power to enforce laws selectively under the doctrine of “prosecutorial discretion.” This is merely an allocation doctrine, however: a commonsense acknowledgment that finite resources make it impossible to enforce every law equally. An administration, for example, might say, “DEA has finite resources, so we’re going to focus on heroin trafficking rather than marijuana possession.” This does not mean the administration is saying marijuana possession is no longer a crime; just that it has higher enforcement priorities and a limited budget. To the contrary, Obama has distorted the doctrine to claim, in effect, that illegalities he unilaterally chooses not to police are somehow no longer illegal — at least until the “waivers” he grants expire. (I would call the waivers capricious, but there really is a rigor to them — they expire after Election Day to protect Democrats from political accountability.)

Prosecutorial discretion is the fig leaf Obama uses to rationalize his noxious decision to relieve corporations, political cronies, and members of Congress from their Obamacare burdens while the rest of us are crushed under ours. It is also the hocus-pocus behind his latest fix. Panicked by millions who’ve lost coverage, sinking poll numbers, and jittery Democrats, the president is now purporting to allow insurance companies to ignore the law and reissue the policies Obamacare’s mandates forced them to terminate.

But here is the problem: This “waiver” is irrelevant. Even if it were constitutionally proper for a president to flout Congress in the executive branch’s enforcement practices, all that means is that the Obama administration will give insurers a pass until 2014. The Obama “waiver” does not change what Congress’s law actually says, and therefore it has no bearing on the legal obligations attendant to the relationship between the insurer and the insured.

As a practical matter, it is nearly inconceivable that insurance companies would be able to reissue the canceled health-care plans. The process, as Avik Roy expertly explains, is too extensive and complex to complete in the few weeks between now and Obamacare’s coverage deadline — something that an administration that can’t, after three years, get a functioning website running should know. But even if it could be done, the insurance companies would be insane to offer plans that failed to comply with the letter of the Obamacare statute. Similarly, the state insurance commissioners would be insane to permit them, and Americans would be insane to buy them. The policies would be legally unenforceable.

Obamacare ‘Fix’ Affirms Obama as Absolute Dictator with Power to Change Laws as he Pleases

Photo Credit: naturalnews.comIn a desperate bid to save the rapidly collapsing Obamacare socialized medicine program, President Obama announced a “fix” yesterday that would “allow” health insurance companies to avoid cancelling whatever plans haven’t already been cancelled due to Obamacare itself.

In doing so, Obama effectively declares himself absolute dictator over all laws across the country, assuming the power to enforce, ignore or alter laws at he pleases.

The problem with this is that such powers do not exist in the Office of the President. Like everything else surrounding Obamacare, Obama himself is simply inventing new powers as he goes along and hoping no one will question his assumed (illegal) authority.

“The unexpected compromise was announced amid growing revolt within Mr. Obama’s own party over his broken promise that Americans who liked their insurance could keep it. But it sparked another backlash as some legal scholars questioned whether the president had the authority to create the loophole,” reports the Washington Times.

It also, by the way, thrust the insurance industry into a state of chaos where insurance companies now have no idea what’s going to be “law” tomorrow, next month or next year. Apparently Obama can simply change his mind at any time and decide that insurance companies are suddenly engaged in mass criminal activities which can then be prosecuted under the law as it is written.

It’s the Democrats, Not the GOP, Facing a Looming Civil War

Photo Credit: Pablo Martinez MonsivaisDespite what the hysterical media will tell you, those distant blasts you heard last week rolling from New York City to Richmond were not cannon fire from the ongoing civil war within the Republican Party. They were the first shots fired in the civil war that is about to break wide open within the Democratic Party.

The hyperventilating media have gone from simply jaundiced sideline observers to outright cheerleaders, breathlessly fanning the flames of discord within the GOP at every turn. Who knew The New York Times cares so much about Republican politicians from Texas and Utah? Of course, they don’t. Unless those conservative Texans and Utahans are in a knife fight with establishment Republicans in Washington.

Last Tuesday’s Democratic routs in Virginia and in New York City, the media squealed with delight, was final proof that the Republican Party is finished. Not only in sophisticated places like New York City, but also important battleground states like Virginia.

Now it is certainly true that Republicans have suffered some humiliating defeats of late. Chief among them has been their inability in three elections to win the argument against Obamacare. Now that Americans have met Obamacare, we realize just how pathetic Republicans had to have been to lose that fight.

All of that pain caused in recent years by the tea party and the conservative purists throwing overboard so many of the whorish politicians in their own midst who came to Washington only to be corrupted will pay off down the road. The growing new voices in the Republican Party sound more and more reasonable and principled by the day, especially with the hot disaster that has become of centralized socialist medicine.

Will the Supreme Court Rule That Treaties Override the Constitution?

On its outcome would depend the continued liberty of the American people. For if our elected officials can force the public to purchase government-approved health insurance, what can they NOT demand the American people acquire?! The full effects of the unconscionable betrayal of the Constitution and the American public by Chief Justice John Roberts are only beginning to be realized.

If the NFIB decision pronounced an end to our liberty, the Court’s upcoming ruling in Bond vs U.S. has the potential to literally end the 240 year history of the United States. For at issue in this case is the following question: When the United States joins an international treaty, may Congress pass laws toward its implementation that violate the Constitution? The Obama Regime, through Solicitor General Donald Verrilli, says YES. For during oral arguments on November 5th, Verrilli told the Court that “…once a treaty is signed by the president and ratified by the Senate, Congress has the power to pass any law necessary and proper to implement the treaty.” ANY law! The constitutional limits on Congressional power may be ignored at the whim of lawmakers.

As a result, the United Nations would effectively make the laws by which the American people are governed. The UN Small Arms Treaty would, for example, wipe out the 2nd Amendment as international police acquire authority to order–even carry out–the disarming of the American people.

What In the World Is Happening to Our Senior Military Officers?

It seems that every week since President Obama took office in 2009, we’ve been hearing that another top leader has been summarily fired, despite his decades of loyal service and valuable experience in protecting the nation. Statistically speaking, it’s actually closer to one every 8.8 days, a staggering 200 military brass shown the door in less than five years.

The Pentagon has offered up a grab bag of reasons for these dismissals — from a simple “loss of confidence,” to more descriptive “insensitive remarks,” “sexual misconduct,” and even “counterfeit poker chips.”

The latest two to fall from grace, Navy Vice Adm. Ted “Twig” Branch, director of naval intelligence, and Rear Adm. Bruce Loveless, director of intelligence operations, were stripped of their security clearances last week, effectively ending their careers. They allegedly engaged in “inappropriate conduct” over a Navy contracting scandal related to scheduling port visits in Southeast Asia during the past decade. According to Navy officials, the probe into Singapore-based Glenn Defense Marine Asia is expected to widen — meaning, we’ll likely see other senior officers terminated in the weeks ahead.

Though firing senior military leaders was routine in different eras, including World War II and the Civil War, it was mostly related to lack of success on the battlefield. The battlefield has changed considerably since then, though, and those same metrics are harder to measure today.

Barack Obama is No John Kennedy or Ronald Reagan

Two presidents during the last 50 years captured the hearts and imagination of the American people like no others: John Kennedy and Ronald Reagan. Their rhetoric and their vision stirred people to believe and to act; they helped define the eras in which they lived.

In 2008, then candidate Barack Obama identified both as presidents worthy of his emulation in terms of changing the “trajectory” and the atmosphere of the country. After five years, he has failed to capture the magic of our 35th and 40th Presidents and the reason is becoming perfectly clear. Though he is a gifted orator, the vision he has offered does not comport with reality, nor resonate with the true American spirit.

Some of the most memorable phrases of Kennedy’s and Reagan’s presidencies capture the essence of the vision each cast.

Of course Kennedy’s most famous words were his summoning call from his Inaugural Address, “Ask not what your country can do for you, but what you can do for your country.” The vision Kennedy offered was primarily focused on a belief in the American people as the source of change and hope and strength, and not the government.

The Kennedy Administration became known as the “New Frontier,” a phrase taken from his speech accepting the Democratic nomination in 1960. “The New Frontier of which I speak is not a set of promises, it is a set of challenges. It sums up not what I intend to offer the American people, but what I intend to ask of them. It appeals to their pride, not to their pocketbook…My call is to the young in heart, regardless of age – to all who respond to the Scriptural call: “Be strong and of good courage; be not afraid, neither be thou dismayed.”

What Obama and I Learned at Columbia: How to Destroy America From Within

I’m about to break “the Obama code.” I’m about to tell you everything about the way Obama, and the people around him, really think. I’m about to rip open the true Obama plan to destroy our country. Because I was there when the plan was hatched.

How do I know all this? Because I was Barack Obama’s college classmate at Columbia University, Class of 1983. I was easy to recognize – the lone outspoken conservative in a class of 700 students. I knew I was in trouble when my first political science class at Columbia was “Communism 101″ taught by Professor Trotsky in the Fidel Castro Building, at the corner of Marx Blvd. and Lenin Drive.

I’m only half-kidding. My experiences at Columbia were not far off.

Everyone needs to hear my story because what Obama and I learned at Columbia explains EXACTLY what Obama is doing to America today.

The economy in deep decline; the disappearance of jobs; the annihilation of the middle class; the demonization of business owners; the destruction of small business with onerous regulations and taxes; the overwhelming debt and spending of out-of-control government; the millions of Americans losing their health insurance; and the unimaginable increase in dependency through welfare, food stamps, unemployment, disability, and now free health care.

GOP’s Response if Obama Delays the ACA Individual Mandate

Suppose the software programming wizards at CGI Federal are not able to fundamentally transform their Frankenstein-like monster into an integrated seamless system where multiple independently developed software applications are stitched together like sundry body parts gathered from several crony capitalism graveyards.

What happens, then, if the ACA website continues to channel Dr. Frankenstein’s monster? “My person was hideous and my stature gigantic. What did this mean? Who was I? What was I? Whence did I come? What was my destination? These questions continually recurred, but I was unable to solve them.”

First, isn’t it likely that Democrat senators up for re-election in 2014 will be joined by outspoken Democrat members of the House in an effort to pressure President Obama into postponing the individual mandate portion of ACA?

Democrats would like nothing more than to take Obamacare off the table as a red hot campaign issue in the run-up to the November 2014 elections. Its potential toxicity is an existential threat to their political careers.

If the monster continues struggling to sit-up, stand-up and walk deep into December, the cumulative pressure on the President from members of his own party could find outspoken Democrats angrily parroting Senators Cruz and Lee’s call for a postponement in the individual mandate — until after the November ’14 elections.
But they probably won’t be called names like “terrorists” by Harry Reid.

Meanwhile, factor this into the possible equation: The next episode in the continuing saga of the “Debt Ceiling Deadline Crisis” is set to run January 15, 2014 — in about two months.

Imagine that the ACA website by mid-December is still rigidly stumbling forward as the villagers continue to scream. Frankenstein’s monster said, “I remembered Adam’s supplication to his Creator. But where was mine? He had abandoned me, and in the bitterness of my heart I cursed him.” At some point, it’ll be prudent for Obamacare’s creator to temporarily abandon his namesake.

When that happens, watch for the G.O.P. leadership to herald an opportunity for magnanimous bipartisan cooperation as they graciously acquiescent to a one-year postponement for Secretary Sebelius’ geek squads to perform major surgery on the ACA in exchange for some nominal, inconsequential, transitory Democrat concession attached to the debt ceiling…solution.

Why this possible outcome? Because, should all this evolve, do we really expect Boehner and McConnell to stand firm and say, “No deal. This is your monster, Mister President. Plus, it’s the ‘law of the land.’ So let him walk on, and let all the villagers see where he goes.”

Establishment GOP vs Grassroots: Civil War or Growing Pains?

2) People who come from families that internalize everything rather than fight it out and get it over with.

3) People who are Mitch McConnell.

The last several weeks have brought to the fore some ugly realities that the establishment GOP was hoping it could deal with using its go-to conflict resolution strategy: put it off, hope the problem goes away and then perhaps a nap.

Led by a host of Republican senators whose most notable achievement is getting elected a lot, the old guard has been busy publicly admonishing the more Tea Party-minded additions to the fold that they don’t know anything.
