By CBSLA.com. An eyewitness recorded cellphone video of a Santa Ana police officer shoot and kill an unarmed 22-year-old homeless man at a shopping center earlier this week.

The witness, who wished to remain unidentified, was standing in the parking lot of the Harbor Place Shopping Center on South Harbor Boulevard around 3 p.m. Tuesday when he said he saw a confrontation in front of Jugo’s La Tropicana between an officer, later identified as a 13-year veteran, and victim Hans Kevin Arellano.

“She exited her patrol car, gun drawn, and asked the gentlemen to get on the ground. The gentlemen didn’t get on the ground, he was still inside the restaurant. She asked again. The man then exited the restaurant, and as he was exiting the restaurant, he said, ‘What are you gonna do, b—-?’ About a second later, she shot him in the chest,” he said.

CBS2’s Michele Gile showed officers the footage. In the video, Arellano is seen running into the juice shop and quickly reemerging outside before a shot is fired.

“Obviously this is the first time we’ve seen this,” said Cpl. Anthony Bertagna of the Santa Ana Police Department. “This is something that is going to be a key piece of evidence. It’s something that we encourage people, if they have, to bring forward, this needs to get in the hands of the D.A. and our detectives. Like the chief said yesterday, we’re trying to be open and honest. There’s three separate investigations that are going on simultaneously. This portion, as the chief said, I can’t comment on.”

Abuse of Power and Deceit: Obama Imposed Rules as Early as 2009 to Defeat Government Transparency

Even as the freshly minted Obama administration was pledging a “new era of open government” in 2009, officials were quietly adding new rules that had the potential to slow down public requests for documents.

Those rules, detailed in memos reviewed by FoxNews.com, could even trip up present-day efforts to dig into the IRS’ practice of targeting conservative groups. The rules detailed in the memos largely emanated from the Treasury Department and, specifically, the IRS.

“It would seem to repudiate this notion that this is going to be the most transparent government in history,” said Dan Epstein, executive director of Cause of Action, the group that first obtained the memos.

The memos follow reports about the administration’s use of private email accounts, and coincide with ongoing debate about government transparency — particularly with recent disclosures about widespread surveillance programs.

Epstein said the document request procedures are “troubling” since the media are “really concerned about the limits of government power.”

Former Counsel to World Bank Claims that US Government has been Co-opted by Corrupt Global Corporations

A former insider at the World Bank, ex-Senior Counsel Karen Hudes, says the global financial system is dominated by a small group of corrupt, power-hungry figures centered around the privately owned U.S. Federal Reserve.

The network has seized control of the media to cover up its crimes, too, she explained. In an interview with The New American, Hudes said that when she tried to blow the whistle on multiple problems at the World Bank, she was fired for her efforts. Now, along with a network of fellow whistleblowers, Hudes is determined to expose and end the corruption. And she is confident of success.

Citing an explosive 2011 Swiss study published in the PLOS ONE journal on the “network of global corporate control,” Hudes pointed out that a small group of entities — mostly financial institutions and especially central banks — exert a massive amount of influence over the international economy from behind the scenes. “What is really going on is that the world’s resources are being dominated by this group,” she explained, adding that the “corrupt power grabbers” have managed to dominate the media as well. “They’re being allowed to do it.”

According to the peer-reviewed paper, which presented the first global investigation of ownership architecture in the international economy, transnational corporations form a “giant bow-tie structure.” A large portion of control, meanwhile, “flows to a small tightly-knit core of financial institutions.” The researchers described the core as an “economic ‘super-entity’” that raises important issues for policymakers and researchers. Of course, the implications are enormous for citizens as well.

Hudes, an attorney who spent some two decades working in the World Bank’s legal department, has observed the machinations of the network up close. “I realized we were now dealing with something known as state capture, which is where the institutions of government are co-opted by the group that’s corrupt,” she told The New American in a phone interview. “The pillars of the U.S. government — some of them — are dysfunctional because of state capture; this is a big story, this is a big cover up.”

Federal Court Slams Obama’s Use of Recess Appointment Power

It’s been a bad week for Barack Obama, and things just got worse. On top of the growing scandals over the I.R.S. targeting conservative groups and the Justice Department snooping on journalists, the president has just received a major constitutional reprimand from the federal courts over his dubious exercise of executive power.

According to the Constitution, the president must seek the “advice and consent” of the Senate when filling certain government positions. The president may only bypass this confirmation requirement in those rare cases where a temporary appointment is needed to “fill up all vacancies that may happen during the recess of the Senate.” This is known as the president’s recess appointment power.

In a decision handed down Thursday morning, the U.S. Court of Appeals for the 3rd Circuit ruled that Obama violated the Constitution by making a recess appointment to the National Labor Relations Board when the Senate was not actually in recess, but was instead holding pro forma sessions for the precise purpose of denying him the lawful ability to make a recess appointment. In an unprecedented move in January 2012, Obama simply ignored this legal impediment and made four purported recess appointments anyway, including the addition of three members to the NLRB.

In its decision, the 3rd Circuit strongly rejected Obama’s unilateral action. “Nothing in the text of the Clause or the historical record suggests that it is intended to be a type of pressure valve for when the president cannot obtain the Senate‘s consent, whether that be because it has become dysfunctional or because it rejects a president‘s nominations,” the court held. Indeed, the opinion continued, under the government’s interpretation, “If the Senate refused to confirm a president‘s nominees, then the president could circumvent the Senate‘s constitutional role simply by waiting until senators go home for the evening.” So much for the separation of powers.

Here’s what I know: While they pretend to champion privacy rights, top left-wing operatives have routinely ransacked and plundered through the private documents and personal records of conservative groups, business owners and public figures. Through it all, those on the right standing against government tyranny have refused to stand down.

During the Clinton years, senior IRS official Paul Breslan revealed that the administration’s auditors specifically targeted conservative critics. On the hit list: Judicial Watch, Paula Jones and Gennifer Flowers, the National Rifle Association, The National Review, The American Spectator, Freedom Alliance, National Center for Public Policy Research, Citizens Against Government Waste, Concerned Women for America, and the San Diego Chapter of Christian Coalition.

Steven Miller, one of the Clinton IRS agents who helped conduct those witch hunts in the 1990s, is currently the head of the Obama IRS department that has now admitted it discriminated against tea party groups. Jackboot history repeats itself.

In 1997, far-left Congressman Jim McDermott obtained and leaked an illegally taped phone call involving House GOP leaders to The Atlanta Journal-Constitution and The New York Times. Far from a low-level underling, McDermott was the top Democrat on the House Ethics Committee at the time. Ohio GOP Rep. John Boehner won a $1 million civil lawsuit against McDermott. McDermott’s leak was condemned by U.S. District Court Judge Thomas Hogan as “willful and knowing misconduct (that) rises to the level of malice in this case.”

Sen. Cruz: Obama Wants Power to Choose Ministers at Churches

Sen. Ted Cruz (R-Texas) released a report documenting attempted abuses of federal power by the Obama administration on Tuesday, saying the administration “knows virtually no bounds.”

Cruz points to Obama’s own Supreme Court appointees, Elena Kagan and Sonia Sotomayor, to make his case:

“When President Obama’s own Supreme Court nominees join their colleagues in unanimously rejecting the Administration’s call for broader federal power six times in just over one year, the inescapable conclusion is that the Obama Administration’s view of federal power knows virtually no bounds,” the senator’s report said.

The Obama administration’s over-reaching includes attempts to electronically track Americans without cause and deny churches the right to choose their own ministers…

In one case, Hosanna-Tabor Evangelical Lutheran Church & School v. EEOC, the Justice Department argued it “had the right to oversee a church’s choosing of ministers,” which even Supreme Court Justice Elena Kagan called “amazing.”

Abuse of Power: Court Says Obama Appointments Violate Constitution

WASHINGTON (AP) – President Barack Obama violated the Constitution when he bypassed the Senate last year to appoint three members of the National Labor Relations Board, a federal appeals court ruled Friday in a far-reaching decision that could severely limit a chief executive’s powers to make recess appointments.

The decision of the U.S. Court of Appeals for the D.C. Circuit marked a victory for Republicans and business groups critical of the labor board. If it stands, it could invalidate hundreds of board decisions over the past year, including some that make it easier for unions to organize.

When Obama filled the vacancies on Jan. 4, 2012, Congress was on an extended holiday break. But GOP lawmakers gaveled in for a few minutes every three days just to prevent Obama from making recess appointments. The White House argued that the pro forma sessions – some lasting less than a minute – were a sham.

The court rejected that argument, but went even further, finding that under the Constitution, a recess occurs only during the breaks between formal year-long sessions of Congress, not just any informal break when lawmakers leave town. It also held that presidents can bypass the Senate only when administration vacancies occur during a recess.

White House press secretary Jay Carney said the administration strongly disagrees with the decision and that the labor board would continue to conduct business as usual, despite calls by some Republicans for the board members to resign.

And this a man who’s been pushing the edge of the envelope as far as I’m concerned, whether it’s the appointment clause, whether it’s his unilateral on immigration, whether it’s his trashing the commerce clause and tax clause under ObamaCare. Now they’re talking about executive orders on the Second Amendment. They’ve issued regulations on the First Amendment attacking religious liberty. This notion that he might be able to lift the debt ceiling, you know, unilaterally under the 14th amendment.

WARNING – Graphic Language and Content: Texas Trooper Being Sued in Irving Body Cavity Search Case Suspended (+ video)

The officer being sued for a body cavity search has been suspended, according to the Texas Department of Public Safety.

DPS spokesman Tom Vinger said trooper Kelley Helleson is suspended with pay pending the outcome of the investigation.

The Dallas County District Attorney’s Office says the case is being investigated by the office’s public integrity division and will go before a grand jury in January.

Two Irving women are suing two state troopers and the head of their department in federal court, alleging they were subjected to an illegal and humiliating “roadside body cavity search” during a traffic stop.

Obama’s Second Term: More Congress End-Run?

The clearest signal may come before the year-end fiscal cliff: Obama said Friday he was “open to compromise,” but insisted on tax hikes on the rich. That may hurt chances for cooperation.

Obama’s last two years butting heads with the GOP House led him to increasingly focus on executive branch actions that cut Congress out of the loop.

Some analysts predict another end-run soon with a recess appointment that would open the door to principal write-downs on government-insured mortgages.

Two moves, in particular, this year have stretched executive power and touched off disputes as to whether Obama had exceeded his constitutional authority.
