Former FBI Deputy Director Acknowledges Errors in Trump FISA Scandal

Andrew McCabe, the former FBI Deputy Director, admitted on Thursday that the bureau made “many mistakes” in its handling of Foreign Intelligence Surveillance Act (FISA) applications related to Carter Page, an aide to former President Donald Trump’s 2016 campaign.

During a CNN interview, McCabe, who now serves as a CNN law enforcement analyst, defended FISA’s Section 702 while responding to Trump’s criticism of the program. Trump had called for the termination of FISA, alleging that it was used to spy on his campaign.

McCabe acknowledged the errors in the FISA application targeting Carter Page, stating that there were “many mistakes” in the process. He emphasized the distinction between Section 702 and the specific FISA application related to Page, which faced criticism for its reliance on an unverified dossier.

In 2018, McCabe was fired from the FBI by the Trump Department of Justice, just hours before his retirement, over allegations of “lack of candor” regarding disclosures to the media. McCabe filed a lawsuit contesting his firing, claiming it was politically motivated, and ultimately reached a settlement in 2021 that restored his pension and benefits.

The debate over FISA’s reauthorization has intensified in Congress, with some lawmakers pushing for reforms to protect the privacy of U.S. citizens. FBI Director Christopher Wray has defended Section 702 authorities as “critical” for national security, while House Speaker Mike Johnson argued that the proposed reforms would address past abuses.

Despite opposition from a bipartisan group of lawmakers, the House blocked consideration of a reauthorization bill for Section 702 just days before its expiration.

Senators Slam FBI Director for ‘Unacceptable’ Delay Over McCabe Texts

Senate Republican leaders on Tuesday slammed FBI Director Christopher Wray for a “simply unacceptable” delay in providing access to text messages sent by former FBI Deputy Director Andrew McCabe.

Senate Homeland Security Committee Chairman Ron Johnson and Senate Finance Committee Chairman Chuck Grassley wrote to Wray that they have received just 24 pages of texts, despite the FBI making available to the Justice Department more than 300 pages.

“It is simply unacceptable that we have waited so long to receive so little,” Johnson (R-Wis.) and Grassley (R-Iowa) wrote.

The letter says Johnson’s committee “subpoenaed the FBI for all records related to” a probe of possible Trump campaign links to Russia and “[w]e have waited nearly 70 days to receive these text messages, and when records were actually produced, we received only eight percent of what we know exists.” . . .

President Trump has been pushing for additional disclosures about the FBI’s Russia probe ahead of the Nov. 3 election. Last week, the Justice Department indicated that a long-awaited report from Connecticut US Attorney John Durham would not be released before the election, a bitter disappointment to Republicans. Judge Allows Andrew McCabe’s Wrongful Firing Lawsuit Against DOJ to Move Forward

A federal judge ruled fired FBI Deputy Director Andrew McCabe’s wrongful termination lawsuit against the Justice Department should be allowed to move toward discovery, rejecting the Trump administration’s efforts to dismiss the case brought by the key Russia investigation leader.

Judge Randolph Moss, who has served on the U.S. District Court for the District of Columbia since a 2014 nomination by then-President Barack Obama, issued a 45-page ruling on Thursday rejecting the Justice Department’s motion to dismiss McCabe’s lawsuit and moving it toward summary judgment. Moss argued that it was too soon to decide whether the government or McCabe was right, and therefore, the case should proceed for now.

“The Complaint asserts five claims based on alleged violations of the First Amendment and the due process clause of the Fifth Amendment,” Moss wrote. “Defendants move to dismiss, in part, for lack of subject matter jurisdiction and, in part, for failure to state a claim upon which relief can be granted and move, in the alternative, for summary judgment, in part. In Defendants’ view, the Court lacks jurisdiction over Plaintiffs’ statutory and regulatory claims, while his constitutional claims fail on both the law and the facts. Most significantly, Defendants contend that Plaintiff was not fired because of his perceived political affiliation, vote in the 2016 presidential election, or refusal to pledge personal loyalty to the President but because he lacked candor (including under oath) in an investigation conducted by the FBI’s Inspection Division and the DOJ’s Office of Inspector General.”

Moss added: “In short, it is too early in the case to determine which, if either, of the parties’ competing versions of the relevant facts is correct. Justice Department Drops Criminal Investigation Into Andrew McCabe

In a turn of events that will only shock those unfamiliar with the Washington, D.C. swamp, the Department of Justice announced Friday that it would drop its criminal investigation into ex-FBI Deputy Director Andrew McCabe.

In a letter sent from J.P. Cooney, head of the DOJ’s Fraud & Public Corruption Section and Molly Gaston, assistant U.S. attorney, the department said that the government has decided to drop the investigation and charges”

We write to inform you that, after careful consideration, the Government has decided not to pursue criminal charges against your client, Andrew G. McCabe, arising from the referral by the Office of the Inspector General (OIG) to our Office of conduct described in OIG’s April 13, 2018, report entitled, “A Report of Investigation of Certain Allegations Relating to Former FBI Deputy Director Andrew McCabe.” Based on the totality of the circumstances and all of the information known to the Government at this time, we consider the matter closed. Please do not hesitate to contact us if you have any questions.

McCabe was fired in 2018. One month before, the OIG released the aforementioned report, which found that McCabe “lacked candor, including under oath, on multiple occasions in connection with describing his role in connection with a disclosure to the [Wall Street Journal]”

As The Daily Wire wrote last year, such dishonesty is a violation of FBI policy. The U.S. Attorney in DC Just Gave Andrew McCabe Some Bad News

United States Attorney for the District of Columbia Jessie K. Liu has recommended moving forward with charges for fired Deputy FBI Director Andrew McCabe after he lied under oath multiple times to federal investigators.

Last year McCabe was referred to the U.S. Attorney for criminal charges by the Department of Justice Inspector General Michael Horowitz. After a lengthy investigation, Horowitz found McCabe lied to FBI agents, Inspector General agents and improperly leaked sensitive information the media. At the time of that referral, McCabe’s lawyers were confident their client wouldn’t be pursued.

“We were advised of the referral within the past few weeks. Although we believe the referral is unjustified, the standard for an IG referral is very low,” McCabe’s attorney released in a statement at the time. “We have already met with staff members from the U.S. Attorney’s Office. We are confident that, unless there is inappropriate pressure from high levels of the Administration, the U.S. Attorney’s Office will conclude that it should decline to prosecute.”

From the IG report:

We found that, in a conversation with then-Director Comey shortly after the WSJ article was published, McCabe lacked candor when he told Comey, or made statements that led Comey to believe, that McCabe had not authorized the disclosure and did not know who did. This conduct violated FBI Offense Code 2.5 (Lack of Candor – No Oath).

Federal Prosecutors Reportedly Considering Charges Against Newest CNN Hire, Andrew McCabe

Federal prosecutors are considering filing charges against newly hired CNN contributor and former FBI Deputy Director Andrew McCabe, according to a Monday report in the New York Times.

McCabe, who was appointed by former President Barack Obama, was fired by former Attorney General Jeff Sessions on March 16, 2018, the day before he would have retired. This move delayed his retirement benefits for seven years. . .

McCabe is also currently suing the Department of Justice, claiming that he was unfairly targeted by President Donald Trump and that his firing was politically motivated. McCabe wants the department to reinstate him so that he can collect his benefits, which included a pension and health care coverage. . .

According to the report from the Times, which was based on “interviews with people familiar with recent developments in the investigation,” McCabe is in danger of being charged with “lying to federal agents.”

McCabe’s lawyers reportedly met twice last week with Deputy Attorney General Jeffrey Rosen. The Times suggested that this could be an indication that McCabe’s lawyers were trying to convince the Department of Justice not to go through with the prosecution. Disgraced Former FBI Deputy Director: I’m Suing Trump

Former FBI Deputy Director Andrew McCabe has sued the Trump administration for what he calls his “unlawful” termination, arguing that his firing last year was the result of improper political interference by the president.

“It was Trump’s unconstitutional plan and scheme to discredit and remove DOJ and FBI employees who were deemed to be his partisan opponents because they were not politically loyal to him,” the complaint alleges.

Then-Attorney General Jeff Sessions dismissed McCabe in March 2018, only hours before his 50th birthday, when his full law enforcement pension would have vested. McCabe’s filing argues that he is “entitled to his full law enforcement pension and all other benefits, privileges, and rights currently being withheld.”

In explaining the firing in April 2018, the Justice Department cited a “lack of candor” in McCabe’s interviews with investigators looking into a 2016 media leak in the waning weeks of the presidential campaign. . .

McCabe has said those allegations were a pretext to get rid of him after months of abuse from President Trump, who had singled him out as a political scapegoat in the 2016 campaign. The Real Andrew McCabe: Liar, Leaker, Coup Plotter

Former FBI Deputy Director Andrew McCabe is making the rounds on the legacy media circuit promoting his now-bestselling book, “The Threat,” while simultaneously attempting to repair his damaged image, after he was fired last year following an internal Department of Justice investigation into his conduct.

Much of the media has happily embraced the Andrew McCabe cable television book tour as a means to target the legitimacy of President Trump. In several of his TV interviews, McCabe has claimed that opening up an FBI investigation into the president’s supposed “ties” to Russia was absolutely warranted. Although not a single piece of evidence has surfaced to justify the FBI investigation, McCabe, an apparent conspiracy theorist, still insists that there is a chance the president is entirely beholden to Russia. Worse, he has entertained the possibility that the Russians ordered President Trump to fire former FBI Director James Comey. Taking that idea to its logical conclusion means that the Russians wanted McCabe to lead the FBI.

Media networks have hardly bothered to challenge the credibility of the disgraced official’s farcical, evidence-free presidential accusations. This is largely because the very same media enterprises that have produced softball interviews with McCabe have also run with the same preposterous Russian collusion claims for almost three years.

The legacy media fail to inform you about Andrew McCabe because they are just as intellectually and morally compromised as the former FBI deputy director. Here’s what you need to know about the fired McCabe.

McCabe was fired for misconduct, not for launching Russia probe

McCabe continues to insist that he was ousted from the FBI as a matter of political retribution after he launched the Russia probe.

“I believe I was fired because I opened a case against the president of the United States,” McCabe said in an interview with CBS’ “60 Minutes.”

This could not be further from the truth.

McCabe was fired after both the Department of Justice Office of the Inspector General (OIG) and the FBI’s Office of Professional Responsibility (OPR) found that he had engaged in misconduct.

“Both the OIG and FBI OPR reports concluded that Mr. McCabe had made an unauthorized disclosure to the news media and lacked candor − including under oath − on multiple occasions,” former Attorney General Jeff Sessions said in March 2018, discussing his decision to fire Andrew McCabe after reviewing recommendations from the Department of Justice.

He lied under oath multiple times

An internal Department of Justice Inspector General investigation found that McCabe lied under oath three separate times. In addition, McCabe misled investigators about his media disclosures. As FBI deputy director, he was given clearance to speak to the media. However, he lied to FBI agents about his role in disseminating stories to the press.

Sabotaging FBI colleagues

McCabe not only lied to his own colleagues about his media leaks. He attempted to pin the blame on others in the Bureau to cover his tracks.

The DOJ Inspector General report found that McCabe placed blame for his own leaks on two FBI officials in Washington and New York, “admonishing them for leaks” that were actually McCabe’s own doing. In doing so, he was willing to threaten the reputation, and perhaps careers, of colleagues so that he could escape blame for his wrongdoing.

The Steele dossier

The FBI investigation into President Trump appears to have relied in part or entirely on the infamous Trump-Russia dossier that was produced by opposition researchers (including former British spy Christopher Steele) who were paid directly or indirectly by the Hillary Clinton campaign. McCabe has not been forthcoming about the role of the Steele dossier in launching the FBI probe. However, its political ties did not stop the Comey-McCabe FBI from using it as evidence to obtain a FISA warrant to spy on the Trump campaign.

Grand jury investigation

Andrew McCabe is on a book and public relations tour, even as the former FBI official is currently under an ongoing criminal investigation. In September, a grand jury was impaneled to investigate McCabe and decide whether charges will be filed against him.

Russia, Russia, Russia

McCabe has essentially admitted that there was no secret intelligence that gave the FBI a reason to investigate President Trump’s supposed Russian ties. It appears that McCabe justifies the investigation based almost solely on President Trump’s campaign advocacy for a detente with Russia.

Moreover, McCabe, a veteran intelligence official who should know better, has described Russia as “our most formidable adversary.” Yet any sound analyst would tell you it’s China, by a mile.

Coup plotter

No one in the media appears interested in examining the idea that McCabe was simply hell-bent on destroying this president, and he grossly abused the law enforcement powers of the FBI to attempt to throw out the results of the 2016 election. His excuses for investigating the president and his campaign are continuously changing, to the point where they hardly make any sense. Perhaps the real reason for his “investigation” was simple: Andrew McCabe and others wanted to remove President Trump from office and weaponized their positions of power to attempt a soft coup. Andrew McCabe Can’t Keep His Story Straight

Former deputy FBI director Andrew McCabe was fired for lying to the FBI inspector general on multiple occasions, and faces potential legal trouble for his many abuses of power. But he’s still the leftwing media’s new darling, as he’s on a media tour to preempt any prosecution, and promote his new book—which he surely hopes will fund his pending legal troubles.

But poor McCabe can’t keep his story straight. McCabe was let go from the FBI for lying in March of 2018. Then, in September of last year, someone leaked to The New York Times that Deputy Attorney General Rod Rosenstein had sought to trap the president in a crime or attempt to remove the president, by proposing to wear a wire for his conversations with the president, and by attempting to recruit cabinet officials to invoke the 25th Amendment, respectively.

This was a hit on Rosenstein from someone who wanted to spread the blame away from himself or herself, and from someone in the FBI who sought to excuse his or her actions by pointing fingers at the Department of Justice (DOJ). That’s why many assumed it was McCabe and his people orchestrating this leak. . .

But then McCabe went in front of the cameras for his soft-ball “60 Minutes” interview. McCabe was asked about Rosenstein recruiting cabinet members to invoke the 25th Amendment, and Rosenstein offering to “wire-up.” McCabe proceeded to go into great detail to affirm the September 2018 New York Times story. All this, despite the Rosenstein issues not being included in McCabe’s book. . .

In other words, it is becoming obvious that McCabe is probably the leak orchestrator against Rosenstein, and has the inside view of an illegal and certainly improper plot on the president of the United States, undertaken by unelected intelligence officials who were all involved in abuses of power that occurred before, during, and after the 2016 election. President Trump UNLOADS After News Hits That Andrew McCabe Tried to Oust Him in a Coup

On Thursday, President Donald Trump reacted to the news that former Acting Director of the FBI Andrew McCabe discussed invoking the 25th Amendment to oust the president from office after Trump fired then-FBI Director James Comey, who had been widely criticized by partisans in both parties. . .

“Disgraced FBI Acting Director Andrew McCabe pretends to be a ‘poor little Angel’ when in fact he was a big part of the Crooked Hillary Scandal & the Russia Hoax – a puppet for Leakin’ James Comey,” mocked Trump.

A report from the Justice Department Inspector General “was devastating” for McCabe, added Trump. “Part of ‘insurance policy’ in case I won….”

“The Justice Department Inspector General alleges that former FBI Deputy Director Andrew McCabe inappropriately authorized the disclosure of sensitive information to a reporter and then misled investigators and former FBI Director James B. Comey about it on several occasions,” reported The Washington Post.

Trump continued: “Many of the top FBI brass were fired, forced to leave, or left. McCabe’s wife received BIG DOLLARS from Clinton people for her campaign – he gave Hillary a pass. McCabe is a disgrace to the FBI and a disgrace to our Country. MAKE AMERICA GREAT AGAIN!”
