SCOTUS Dockets Emergency Application Over ‘Assault Weapons’ Ban

The Supreme Court of the United States received and docketed an emergency application seeking an injunction against enforcement of Illinois’ “assault weapons” ban while the appeal process is ongoing.

The case is National Association for Gun Rights v. City of Naperville, Illinois. The plaintiffs include the National Association for Gun Rights, Robert C. Bevis, and Law Weapons, Inc. d/b/a Law Weapons and Supply.

The plaintiffs seek an en banc hearing before the United States Court of Appeals for the Seventh Circuit and an injunction against enforcement of the Protect Illinois Communities Act until the hearing is held.

The Supreme Court’s Office of the Clerk of Court responded to the emergency application by noting that Justice Amy Coney Barrett has ordered a briefing. (Read more from “SCOTUS Dockets Emergency Application Over ‘Assault Weapons’ Ban” HERE)

Joe Biden Asks Americans To Pressure Congress To Ban ‘Assault Weapons’

President Joe Biden urged Americans to figure out which members of Congress do not support an “assault weapons” ban and pressure them to do so in another push for gun control Tuesday.

“The majority of the American people think having assault weapons is bizarre, it’s a crazy idea,” he said, per the Hill.

Biden noted that he could not do any more on “assault weapons” via executive action, so he urged Americans to figure out where their representatives stand on the issue and pressure them.

He said, “Because I want you to know who isn’t doing it, who isn’t helping. Put pressure on them.”

Biden asserted there is “a moral price to pay for inaction.” (Read more from “Joe Biden Asks Americans To Pressure Congress To Ban ‘Assault Weapons’” HERE)

Two House Republicans Join Most Democrats in Passing ‘Assault Weapons Ban of 2022′

The House of Representatives on Friday passed the “Assault Weapons Ban of 2022,” a bill that would ban various semi-automatic guns, though the measure would grandfather in firearms that people already own.

“It shall be unlawful for a person to import, sell, manufacture, transfer, or possess, in or affecting interstate or foreign commerce, a semiautomatic assault weapon,” the text of the bill states. “Paragraph (1) shall not apply to the possession, sale, or transfer of any semiautomatic assault weapon otherwise lawfully possessed under Federal law on the date of enactment of the Assault Weapons Ban of 2022.”

Republican Reps. Chris Jacobs of New York and Brian Fitzpatrick of Pennsylvania joined most Democrats in voting for the bill, but Democratic Reps. Kurt Schrader of Oregon, Henry Cuellar of Texas, Jared Golden of Maine, Ron Kind of Wisconsin, and Vicente Gonzalez of Texas voted against the bill.

The measure will almost certainly fail to clear the Senate chamber, where 60 votes would be needed to surmount a filibuster. (Read more from “Two House Republicans Join Most Democrats in Passing ‘Assault Weapons Ban of 2022′” HERE)

Poll Shows a Shocking Lack of Trust in the US Government That’s Fueling the Gun Debate

A poll published on Wednesday by ABC News showed that despite a rash of high-profile shootings, 53% of Americans reached in the survey opposed a ban on assault weapons.

That was the highest percentage in 20 years of the poll. Just 45% percent of respondents said they supported the ban.

The latest Democratic gun-control push in Congress is essentially a renewal of the 1994 Federal Assault Weapons Ban under President Bill Clinton . . .

Critics argue that an assault-weapon ban would be an ineffective fix to the mass-shooting problem, and that the definition of an “assault weapon” is superficial rather than substantive. But gun-control advocates argue that a ban would limit the mass-killing potential of shooters. . .

ABC’s polling data showed that just 22% of respondents felt confident in the government’s ability to protect them from lone-wolf shooters, such as Charleston’s Dylann Roof, or Adam Lanza of Sandy Hook. In contrast, 77% percent of respondents said they felt the government cannot protect them. Crime Study: Handguns, Not ‘Assault Rifles,’ Used in Most Mass Shootings

Media hype about mass shootings in America has fostered a myth that the killings are on the rise and that an assault weapon ban, expanded background checks and greater attention to the mentally ill will curb a rampaging epidemic, according to an authoritative and exhaustive study by a noted criminologist.

Instead, according to James Alan Fox, author and criminology professor at Northeastern University, mass shootings have remained stagnant over 34 years, averaging 20 a year, and few were committed by the type of berserk psychos portrayed by the media.

“Public discourse is grounded in myth and misunderstanding about the nature of the offense and those who perpetrate it,” he writes in the journal “Homicide Studies.” He added: “Without minimizing the pain and suffering of the hundreds of those who have been victimized in recent attacks, the facts clearly say that there has been no increase in mass shootings and certainly no epidemic.”

The study debunks several proposals aired from President Obama, Vice President Joe Biden and Senate Democrats after the December 2012 Sandy Hook Elementary School shooting aimed at stopping mass killings. While he said any plan is worth trying, he concluded that short of abolishing the Second Amendment, there is little that can be done.

“Mass murder just may be a price we pay for living in a society where personal freedom is so highly valued,” he wrote in the study coauthored Northeastern criminology student Monica DeLateur.

Obama: Assault Weapon Industry’s No. 1 Customer, Buys 600,000 AK-47 Magazines

There he goes again. President Obama’s anti-gun administration, which recently pushed legislation banning assault weapons and large ammo magazines, is proving again that it is the industry’s No. 1 customer.

On the heels of major purchases of AR-15-styled weapons for agencies like the IRS and millions of bullets used by assault-weapons and similar semi-automatic arms owned by federal forces, the Army has just announced that it is buying nearly 600,000 high capacity AK-47 Kalashnikov rifle magazines.

The gun is popular among collectors and target shooters, and was the weapon of choice used by this week’s Georgia school shooter. But while fans of the gun help keep small weapon accessory companies in business, the Army’s purchase is a major boost for an industry the president and his grassroots campaign, Organizing for Action, has spent the summer attacking.

It’s just one purchase in a string of AK-47 equipment buys from the Feds.

Army officials told Secrets that the 30-round magazines, which would be banned under Obama’s gun control proposals, are going to Afghanistan. But unlike the Pentagon’s controversial purchase of Russian helicopters for Afghan special forces, the Soviet-Russian-styled AK-47 magazines are likely to be purchased from an American firm.

‘We’re Ready for Battle’: Sheriff Joe Arpaio Arms Officers With AR-15-Style Rifles After Comrade Was Killed in Driveway (+video)

PHOENIX (TheBlaze/AP) — A detention officer with the Maricopa County Sheriff’s Office died Thursday after being shot in the driveway of his Arizona home while he prepared to head to work. Now, all officers in the department are being armed with rifles by the direction of Sheriff Joe Arpaio for added protection.

Jorge Vargas, 27, was rushed to a hospital after the 4 a.m. attack and died a short time later, Phoenix police Sgt. Trent Crump said.

No one was in custody yet and there was no information on a motive.

“It’s really a whodunit,” Crump said, adding that investigators are looking into whether the shooting was connected to the victim’s job.

“Anytime we have a homicide and the suspect is unknown, we start with our victim,” Crump said. “But we can’t rule out a random act.”

New York's Assault Weapon Registration Begins

Key measures of New York’s tough new gun law kicked in Monday, with owners of firearms now reclassified as assault weapons required to start registering the firearms and new limits on the number of bullets allowed in magazines.

As the new provisions took effect, New York’s affiliate of the National Rifle Association planned to file a court request for a federal injunction to immediate halt to the magazine limit.

Gov. Andrew Cuomo calls those and other provisions in the state’s new gun law common sense while dismissing criticisms he says come from “extreme fringe conservatives” who claim the government has no right to regulate guns.

“Yes, they are against it, but they are the extremists and the extremists shouldn’t win, especially on this issue when it is so important to the majority,” Cuomo said in a radio interview last week. “In politics, we have to be willing to take on the extremists, otherwise you will see paralysis.”

New York’s new gun restrictions, the first in the nation passed following December’s massacre at a Connecticut elementary school, limit state gun owners to no more than seven bullets in magazines, except at competitions or firing ranges.

Video: Dem. Rep On Candid Camera Admits ‘Assault Weapons’ Ban Just The Beginning, Handgun Ban May Be Possible

A new video released by conservative activist Jason Mattera will surely have gun rights advocates up in arms. In an exchange with Rep. Jan Schakowsky (D-IL) that was caught on camera last month but only released Monday, the Democratic politician spoke openly about her gun control views, noting that current proposals are only the beginning…

Perhaps the most contentious portion of the dialogue, which purportedly took place at a women’s rights rally, is the section in which she seems to indicate that a much larger push against firearms could inevitably take aim at handguns.

At the beginning of the exchange, Mattera identifies himself but tells Schakowsky that he “appreciated her remarks” (he does not indicate his conservative worldview and she appears not to recognize him). Considering these tactics, his introduction potentially gained her trust, leading the congresswoman to candidly share her views. He also repeatedly addressed her using “we” and it appears as though Schakowsky doesn’t realize she’s being recorded.

DHS Buying Armored Vehicles

Photo Credit: DonkeyHoteySecurity: In addition to stockpiling over a billion bullets and thousands of semiautomatic weapons the feds would deny U.S. citizens, the vehicle of choice for fighting the counterinsurgency war in Iraq is appearing on U.S. streets.

The sequestration question du jour is why the Department of Homeland Security, busy releasing hundreds, if not thousands, of deportable and detained illegal aliens due to budget constraints, is buying several thousand Mine Resistant Armored Protection (MRAP) vehicles?

And just who are they intended to be used against? This acquisition comes on top of the recent news of the stockpiling by DHS of more than 1.6 billion (with a ‘b’) bullets of various calibers, enough by one calculation to fight the equivalent of a 24-year Iraq War, and the ordering of some 7,000 5.56x45mm NATO “personal defense weapons” (PDW) — also known as “assault weapons” when owned by civilians.

Additionally, DHS is asking for 30 round magazines that “have a capacity to hold thirty (30) 5.56x45mm NATO rounds.”
The Department of Homeland Security (through the U.S. Army Forces Command) recently retrofitted 2,717 of these MRAP vehicles for service on the streets of the U.S. They were formerly used for counterinsurgency in Iraq.

These vehicles are specifically designed to resist mines and ambush attacks. They use bulletproof windows and are designed to withstand small-arms fire, including smaller-caliber rifles such as a .223 Remington. Does DHS expect a counterinsurgency here?
