Alabama Chief Justice Removed From Bench for Advising Lower Courts to Uphold Alabama Marriage Laws

Alabama Supreme Court Chief Justice Roy Moore’s defense of traditional marriage has cost him his seat on the bench.

Moore was suspended today without pay through the end of his term following a hearing by the Alabama Court of the Judiciary (COJ) today on six ethics violations charges.

The judiciary court ruled that Moore defied law already clearly settled by the Supreme Court’s June 2015 Obergefell vs. Hodges same-sex marriage decision when he told Alabama’s probate judges six months later that they were still bound by a 2015 state court order to deny marriage licenses to gays and lesbians.

“Beyond question, at the time he issued the January 6, 2016, order, Chief Justice Roy Moore knew about Obergefell and its clear holding that the United States Constitution protects the right of same-sex couples to marry,” the court wrote in the unanimous decision.

Things weren’t so clear, his lawyers say. At the time Moore sent the administrative orders to the probate judges, the Alabama Supreme Court had yet to consider the effect the Obergefell decision would have on an ongoing Alabama case; thus the case was, in effect, still pending.

“The 2016 Administrative Order was merely a status report of the pending case before the Alabama Supreme Court,” said Mat Staver, Founder and Chairman of Liberty Counsel and representing Moore. “The order did not change the status quo. It did not create any new obligation or duty. To suspend Chief Justice Moore for the duration of his term is a miscarriage of justice and we will appeal this case to the Alabama Supreme Court. This case is far from over,” said Staver.

The COJ found Moore guilty of all six charges and suspended him through the end of his term. However, since he is 69 years old, he will be ineligible to run for office once his term ends in 2019. The order of suspension effectively removes him from the bench, which is a violation of COJ rules without a unanimous 9-0 vote, Staver said.

In a statement Friday, Moore said that the COJ “had no authority” over administrative orders to probate judges. He said the Judicial Inquiry Commission chose to listen to the LGBT community, and the decision “clearly reflects the corrupt nature of our political and legal system at our highest level.

“This was a politically motivated effort by radical homosexual and transgender groups to remove me as chief justice of the Supreme Court because of outspoken opposition to their immoral agenda. … We intend to fight this agenda vigorously and expect to prevail.” (For more from the author of “Alabama Chief Justice Removed From Bench for Advising Lower Courts to Uphold Alabama Marriage Laws” please click HERE)

Roy Moore Just Made a Bombshell Announcement About Same-Sex Marriage Bans… People Need to Know This

Chief Justice Roy Moore issued an order today saying that a ruling issued last March by the Alabama Supreme Court remains in effect and that probate judges “have a ministerial duty not to issue any marriage license contrary” to Alabama’s law and constitutional amendment banning same-sex marriage.

In a four-page administrative order, Moore said the conflict between the state court ruling and the U.S. Supreme Court ruling in June has caused “confusion and uncertainty” among probate judges.

Moore said he issued the order today in his role as administrative head of the state court system. He quoted a state law that says the chief justice is empowered to “take affirmative and appropriate action to correct or alleviate any condition or situation adversely affecting the administration of justice within the state.”

Moore wrote that since the U.S. Supreme Court ruling that many Alabama probate judges are issuing marriage licenses to same-sex couples, while others are issuing licenses only to opposite-sex couples or not issuing licenses at all . . .

Rep. Patricia Todd, D-Birmingham, state director of the Human Rights Campaign, which advocates for civil rights for gays, lesbians and transgender people, said Moore is the one who has caused confusion for probate judges.

The Comeback Kid: Roy Moore leading candidate for Alabama’s Chief Justice

Nine years after a battle over a stone monument listing the Ten Commandments inside a state court building in Alabama, the state Supreme Court chief justice who was removed from office by a state judiciary panel is the leading candidate – to be the state Supreme Court chief justice.

Judge Roy Moore had installed the 5,280-pound stone monument as part of an acknowledgement of God’s sovereignty over American life, and when he refused to haul it away as a federal judge wanted, a state judicial panel removed him from office.

But after a stunning upset victory over two better-funded competitors for the GOP nomination for the office, incumbent Chuck Malone and former state Attorney General Charlie Graddick, Moore now is leading in the statewide race in Alabama, where voters choose the chief justice.

According to a poll taken just days ago, Moore leads Democrat Harry Lyon by 21 points, 54 percent to 33 percent. The poll surveyed 600 Alabama voters.

He’s built that stunning support with endorsements that include one even from the Democratic Alabama AFL-CIO.

State President Al Henley told Real Clear Politics it’s the first time the union group has backed Moore, and Moore was the only Republican picked by the group this year.

Henley cited Moore’s record as a circuit judge in Gadsden and as a Supreme Court justice from 2001-2003 of treating the average person fairly in court.
