New Gun Crime Numbers Are Bad News for the Gun Control Lobby

Earlier this month, the Department of Justice published updated numbers on how guns used and found at the scenes of state and federal crimes were obtained, and the American people will be shocked to know that criminals still don’t like to follow gun laws.

The Bureau of Justice Statistics (BJS) survey was conducted in 2016 and reported that an estimated 287,400 prisoners possessed a gun in 2016 while they committed the crimes for which they were imprisoned.

Overall, it turns out that the vast majority of them didn’t obtain their firearms from a retail source, and fewer than one percent of them got them at a gun show. And a lot of them got their weapons illegally. Who could have guessed?

Here’s what the DOJ found:

Among the prisoners who had a firearm when they committed their crimes, 90 percent did not get their gun from a retail source, and less than one percent got theirs at a gun show.

Only seven percent of state and eight percent of federal prisoners “had purchased it under their own name from a licensed firearm dealer at a retail source.”

About one fifth of those who possessed a gun during their offenses bought it with the intention of committing the crime.

A plurality of prisoners, 43.2 percent, got their guns off of the black market, off the street, or through theft.; 25.3 percent got the gun from a family member or friend, either through purchase, rental, trade, or as a gift; 6.9 percent said they found the gun at the scene of the crime, and 4.6 said the gun was brought by someone else.

These numbers will come as little surprise to Second Amendment advocates who are well aware that gun control laws only keep guns out of the hands of those willing to abide by them. Illegal transactions, black market purchases, and theft all remain as pipelines to get hardware into the hands of criminals.

But anti-gun crusaders keep pushing draconian gun laws (see: Chicago), enhanced background check regulations, and banning specific types of firearms based on mostly cosmetic criteria.

Democratic Governor’s Anti-Gun Package Is Straight-Up Confiscation

Elections have consequences and all elections matter, especially at the state and local level. For nearly ten years, the Virginia Republican Party has yet to win another statewide race; the 2009 gubernatorial election was the last time they won. In 2017, Democratic Lt. Gov. Ralph Northam beat Ed Gillespie, and they virtually wiped out the GOP in the state. The GOP maintains two-seat majorities in both the House of Delegates and the state Senate. It’s not pretty, given that Republicans use to control over 60 seats. That sizable majority was the reason why former Gov. Terry McAuliffe, another Democrat, couldn’t push a far left agenda. He even signed into law a deal on the state’s concealed carry reciprocity laws, which were about to be shredded by state Attorney General Mark Herring, who is considering running for governor in 2021; Virginia bars consecutive terms for governors.

With the tide changing in the state, Northam is going all-out on this anti-gun blitz. He smells blood. And even if he isn’t successful this session, he’s laying the groundwork to pass this gun control package that includes a so-called assault weapons ban and universal background checks. The latter is a prelude to a national registry. The former is grounded in total confiscation. Stephen Gutowski of the Washington Free Beacon has more:

The plan to ban the sale and possession of certain kinds of firearms proposed by Virginia governor Ralph Northam (D.) could affect millions of gun owners, an industry group said on Friday.

The National Shooting Sports Foundation (NSSF), which represents gun manufacturers and dealers, said the vague description of the legislation released by Northam on Jan. 4 would apply to most firearms currently on sale in the commonwealth.

Dems’ New ‘Assault Weapons’ Ban Is About as Gun-Illiterate as You’d Expect

Not to be outdone by gun control promoters in the House, a group of anti-gun senators released a new “assault weapons” ban earlier this week.

“Americans across the nation are asking Congress to reinstate the federal ban on military-style assault weapons and high-capacity magazines,” reads a press release from sponsor Sen. Dianne Feinstein, D-Calif. “If we’re going to put a stop to mass shootings and protect our children, we need to get these weapons of war off our streets.”

Legislative text still wasn’t available at the time of this writing, but a first look at some of the outlined portions of it shows that it would be about as effective at curbing gun violence as Feinstein’s 1994 weapons ban (which wasn’t).

Since the term “assault weapon” has no intrinsic meaning either in the gun world or the legal world, the definition means whatever the anti-gun politician using it wants it to mean. So what makes something an “assault weapon” in this case?

The bill “bans any assault weapon that accepts a detachable magazine and has one or more military characteristics including a pistol grip, a forward grip, a barrel shroud, a threaded barrel or a folding or telescoping stock.”

So the bill wouldn’t outright ban all semi-automatic weapons (as some have already suggested); rather, it would just affect semi-automatics that have certain features, most of which are aesthetic or ergonomic in nature and none of which affect how the gun itself fires. They’re all also features typically found on a modern sporting rifle (known as an AR-15), which has been the anti-gun crowd’s big boogeyman for the last few years.

But those features can look pretty scary if you don’t know what you’re looking at. That’s why we put together the Firepower 101 series last spring.

According to the press release, the legislation would also ban so-called “assault pistols,” which are defined as handguns that weigh over 50 ounces unloaded. If that sounds obtuse and silly, it’s because it is. Weight itself doesn’t necessarily make a gun more dangerous. A violent gangbanger or armed robber can do a lot more damage with a light, compact semi-automatic handgun than an antique flintlock pistol.

It also would ban pistol stabilizing braces that magically “transform assault pistols into assault rifles” because they allow shooters to “fire more accurately.” Of course, if accuracy was what made something an “assault weapon,” stabilized pistols aren’t really where someone would want to start banning. Hunting and competition rifles are designed to be far more accurate.

It also bans magazines and other “ammunition feeding devices that hold more than 10 rounds,” but current owners would be able to keep their existing magazines. This, of course, would do little more than put law-abiding gun owners at a disadvantage against non-compliant criminals who still won’t have to reload as often when committing violent crimes.

However, to give credit where credit is due, the bill would exempt all guns and magazines affected by the legislation that are lawfully owned at the time of passage. That would seem like a fairly obvious exception to include, but the Trump administration’s recent bump stock ban didn’t even allow that.

Feinstein has introduced this bill into a Senate with a 53-47 Republican majority, so it’s pretty much just for show until either that math changes or something motivates 13 Republicans to go along with it. Republicans Join Dems to Push for New Gun Control Law

We’re just days into the 116th Congress, and congressional Democrats have already gotten the ball rolling on gun control with H.R. 8, also known as the “Bipartisan Background Checks Act of 2019,” which mandates so-called “universal” background checks for gun purchases.

Who made it “bipartisan”? A handful of Republicans: Reps. Brian Mast, Fla., Chris Smith, N.J., Peter King, N.Y., Fred Upton, Mich., and Brian Fitzpatrick, Penn.

In short, the legislation would require background checks to be performed for almost all firearms transactions with narrow exceptions for things like sales or transfers to family members. Proponents of the legislation claim that expanding the kinds of purchases that require a background check would keep guns from falling into the wrong hands, but the facts don’t really back that up in any meaningful way.

The first problem with that assumption is that the law is only going to affect the law-abiding to begin with. Around 80 percent of gun-related crimes are committed with illegally obtained hardware. Criminals with black-market or stolen guns already operate outside the constraints of the existing system and would continue to do so.

When at least 80 percent of the problem that you’re trying to solve wouldn’t be touched by the law you’re pushing as a solution, it isn’t really a workable solution to the problem; it’s legislative window dressing.

In addition, federal law already requires that background checks be conducted whenever a licensed dealer transfers a gun to someone who isn’t. Federal law also prohibits private sales across state lines unless they go through a federal licensee. This, too, will come with a background check.

(And before anyone brings up that oft-discussed “gun show loophole,” that’s a misnomer and a myth that only serves to show how little the gun control crowd understands gun laws and gun shows.)

Indeed, the only lawful gun sales where background checks do not occur are between private citizens of the same state in states that do not already require background checks for private sales. And these would be the only new territory to be targeted by making background checks “universal,” as the proposed legislation makes exceptions for intra-family transfers.

States have also been historically lax when it comes to reporting information to be added to the NICS database.

Last November, the National Rifle Association estimated that some seven million records were missing from the national database, based on past studies. A number that big probably includes records of felony convictions, illegal aliens, and diagnoses of severe mental illnesses and other such disqualifications.

Furthermore, no government action can predict future behavior. Background checks cannot catch someone who has never done anything to end up in the database, even if previous disqualifying events are properly reported, since they have no disqualifying events.

Instead, all it would do is create an added barrier for law-abiding citizens who wish to exercise their Second Amendment rights by selling or purchasing firearms to other law-abiding citizens.

But why not try it anyway? After all, if the law isn’t inherently unconstitutional and might possibly stop just one person from getting a gun that they shouldn’t, then what harm would it do, aside from making private sales extremely difficult if not impossible?

This is where we have to address the cultural animus behind the proposed legislation. There’s always a push to “do something” about guns. That demand is always (or at least usually) followed the assurance that that “something” isn’t outright gun confiscation, though some lawmakers have become bold enough to suggest even that in recent years.

But what happens when the next version of “commonsense gun safety” fails to stop another bloody murder in Chicago or another mass shooting? Well, then we’ll just have to use the next atrocity to push for the next law, and so on and so forth until we’ve reached the actual endgame of the anti-gun activist cadre, which is a society in which private firearm ownership goes the way of the flintlock pistol.

Background check legislation would be incredibly ineffective at countering gun crime in the United States, but it would be very effective at making things more difficult for law-abiding gun owners. Brace Yourselves: House Democrats Gear up to Introduce Their First Gun Control Bill of the New Congress

Democrats have wasted little time shaking up Washington, D.C. since they were sworn into office on Thursday. In fact, Democratic leadership in the House is planning to make a big splash on Tuesday, when Speaker Nancy Pelosi and Rep. Mike Thompson introduce legislation requiring universal background checks for firearm purchase. The duo decided to do it on Tuesday, Jan. 8th because it’s the eight anniversary of former Rep. Gabby Gifford’s shooting, which took place Jan. 8, 2011. And, to continue with the “eight” theme, the bill is also called House Resolution 8, POLITICO reported.

Giffords has worked with the pair to bring about this piece of legislation.

“Since the shooting at Sandy Hook, the Gun Violence Prevention Task Force has been fighting for a chance to pass legislation that will help save lives,” Thompson told POLITICO. “Finally, with our new majority that ran on helping to prevent gun violence, we will introduce a bipartisan, universal background checks bill. We will hold hearings, we will have a vote, and this legislation will finally pass the House.”

“In communities across America, courageous survivors, families and young advocates are showing outstanding courage and persistence in demanding an end to the horrific scourge of gun violence in our nation,” Pelosi told POLITICO. “It is an honor to join Congressman Mike Thompson and former Congresswoman Gabby Giffords to answer their call by taking the first step to pass commonsense background checks – which 97 percent of the American people support.”

Gun Control Fail: Thousands of Illegal Guns Flood Chicago’s Streets – and It’s No Surprise

By Townhall. For years, Chicago, Illinois has been the epicenter of the gun control movement. The city has some of the strictest gun control laws in the nation yet they continue to have some of the highest crime and murder rates. And it’s not coincidental.

In fact, police officers in Chicago have seized more than 9,100 illegal firearms this year alone. And it could easily surpass 10,000 by the end of the year. . .

What’s happening in Chicago is what Second Amendment advocates have talked about for a long time. It’s sad that we have to continually reference what’s taking place in the Windy City.

The perpetual cycle that takes place in Chicago is one that can be solved by allowing law-abiding citizens to protect themselves and their families. Gang members and criminals do not follow the law. That’s the very definition of being a criminal! Implementing gun control laws hurts the law-abiding, not the criminals. . .

Limiting who can own a legal firearm for self-defense empowers the gang members and criminals. They perpetuate fear because they know the only other people who are armed are also bad people. That gives them the ability to keep power and makes police officers’ job even harder than it already is. 9,000 Firearms and Counting: Illegal Guns Flood Chicago

By AP. . .Chicago police regularly recover more illegal firearms than officials in larger New York and Los Angeles. Last year, the citywide haul was 7,932 firearms. The 2018 tally exceeds 9,100, and police say it could surpass 10,000 by year’s end.

Police seize an illegal weapon about once every hour, most connected to gangs on the South and West sides. Authorities cite two reasons for the heavy gun traffic: Penalties for carrying these firearms aren’t considered a deterrent and, according to police spokesman Anthony Guglielmi, suspects tell officers they “would rather be caught by police with a gun … than caught by a rival gang without one.”

The department’s 6th District, one of 22 in all, leads the city in guns recovered, accounting for almost 15 percent so far in 2018. A Gun Carry Change Is Coming to This State

While the war on the Second Amendment has taken a more covert path in the sense that anti-gun activists are focusing on state-level initiatives that don’t get nearly as much attention, South Dakota could be a bright spot for those who support our Bill of Rights. New York is mulling applicants for gun permits present a social media and Google search history, New Jersey’s trash law on so-called high capacity magazines is about to go into full effect, and Detroit is about to mandate background checks for ammunition purchases. California already has that law on the books.

Vermont and Florida, both states with GOP governors, increased the age to purchase all firearms, including long guns, to 21. The anti-gun movement has clinched some wins, but South Dakota could be the next state to adopt a constitutional carry. Republican Congresswoman Kristi Noem won the state’s gubernatorial race this year and said that concealed carry without permits could be on the table. South Dakotans May Soon Be Able to Carry Concealed Handguns Without a Permit

By Fox News. After years of unsuccessful attempts, supporters of legislation that would allow people to carry concealed handguns without a permit in South Dakota anticipate revived prospects once GOP Gov.-elect Kristi Noem takes office in January.

The legislation languished under retiring Republican Gov. Dennis Daugaard, but Noem in her campaign offered support for a so-called constitutional carry law. GOP state Sen.-elect Lynne DiSanto, who as a member of the state House of Representatives sponsored a permitless concealed carry bill that Daugaard vetoed, said such legislation is likely in the upcoming session and she’s optimistic about its prospects.

Getting Rid of Guns Really Cost Dick’s Sporting Goods

By Daily Wire. Dick’s Sporting Goods is warning investors that its decision to remove certain “assault-style” weapons from its Field & Stream stores cost it dearly and may limit its future gains.

The sporting goods retailer was forced to confront angry shareholders late last week after its stocks tanked more than 4.5% and financial conglomerate J.P. Morgan Chase downgraded Dick’s shares, saying the company was “overweight.”

“Gross margin-driven upside appears less probable given 3Q’s performance, changing comparisons, and rising inventory levels,” an analyst for J.P. Morgan told CNBC. The same analyst noted that same-store sales for Dick’s outlets are expected to grow less than 1% even as the company’s inventory rises.

“The analyst pointed out that Dick’s same-store sales growth for 2019 is expected to be less than 1 percent after averaging 2.1 percent between 2011 and 2015. He also noted that while the company’s 25 percent Black Friday store discount will help boost sales, it will not boost margins,” the analyst continued. “Inventory levels, meanwhile, rose 1 percent in the third quarter after falling 5 percent in the first half of 2018 with inventory days estimated to return back to 2015-2017 levels.” (Read more from “Getting Rid of Guns Really Cost Dick’s Sporting Goods” HERE)

Dick’s Sporting Goods Ban on Some Guns Dented Sales. but Weaker Gun Market Also Took Toll

By USA Today. While a decision to stop selling assault-style weapons in the wake of the Parkland, Florida, school shooting dented its overall sales, Dick’s Sporting Goods says that the dip reflects a broader weakness in the world of firearms

The nation’s largest seller of sporting goods reported that consolidated same-store sales were down 3.9% in the third quarter, due in part to double-digit declines in the areas of electronics and hunting.

The weak numbers come in the wake of the Dick’s decision in February to not only halt assault weapon sales, but to no longer sell guns to people under the age of 21 in response to the mass shooting at Marjory Stoneman Douglas High School in Parkland, Florida, which left 17 dead.

But broader trends also appear to have had an impact. After breaking records each of the last three years, the number of background checks conducted by the FBI for gun purchases this Black Friday was down 10 percent from that day last year. Harvard Landlord Tells Domestic Violence Survivor to Move out Over Her Firearms

This story is just infuriating. It also should remind all conservative that it’s best to stick with your tribe. Leyla Pirnie is a graduate student at Harvard, where her terrible roommates searched her room while she was away because they felt she might have firearms. What gave her away? Well, she wore a Make America Great Again hat, and she’s from Alabama. It may surprise some liberals, but Democrats do livein Alabama. Also, they searched her room, invaded her privacy, and then ratted her out to their landlord over he legally owned firearms, which she obtained after surviving an abusive relationship. How dare she take steps to ensure her safety? . . .

“Since it’s clear that Leyla wants to keep her firearms, it would be best for all parties if she finds another place to live,” Dave Lewis, president of Avid Management, said in an email to the household obtained by the Washington Free Beacon.

The request that the student, Leyla Pirnie, move out came after her roommates searched her room while she was not home and found her firearms. That prompted one of the roommates to email Lewis requesting he verify that Pirnie was in compliance with applicable firearms laws.

“We discussed with Leyla that all of us are uncomfortable with having firearms in the house, and that their presence causes anxiety and deprives us of the quiet enjoyment of the premise to which we are entitled,” the roommate wrote to Lewis.

Liberal Gun Reporter Reveals Something Terrifying About Gun Control Solutions

. . .Yet, there are some reporters writing for left-leaning publications, like The Guardian, who are actually very good on this issue. Yeah, believe it or not, the Left has a couple, not many of course; dedicated reporters who follow the gun beat. The Washington Free Beacon’s Stephen Gutowski is one of the best for conservative media. Lois Beckett is one on the Left who you should follow. You may not always agree, but she’s fair. She wrote in The New York Times about the myth that the 1994 assault weapons ban was effective, while also dispelling the liberal lie that banning AR-15 rifles would reduce crime. Handguns commit the most gun violence, but there is zero political support for that initiative. . .

Yet, Beckett is more concerned about the media’s lack of coverage in the solutions to these types of horrible events. Gutowski has also commented about the media’s poor grasp of gun policy is probably because there is no dedicated staff tasked with reporting and researching at major newspapers and news organizations. Beckett added that Long could have been subjected to a gun violence restraining order law, which was passed in California, but no one knows it exists, not even law enforcement. . .

Beckett added that these horrible incidents never happen out of the blue. No one ever snaps; there is a trail of red flags. She also said that there are research-driven solutions that gun rights advocates do support, which coupled with some of the ones on the Left, that don’t veer into ‘take all the guns’ territory, there has to be solutions both sides can agree on to at least provide some framework to prevent more tragedies like Sandy Hook, Borderline, and Marjory Stoneman Douglas. For now, the aftermath is the same: mourn the dead for two seconds, blame the NRA, blame Trump, recycle straight trash reporting on gun laws that have been on the books since Kennedy was in office, and repeat. I don’t mind having conservations with pro-gun control, folks, but when they say I’m evil for supporting the Second Amendment, the conversation ends…quickly.
