Brat: 5 Ways the Next Congress Can Protect Gun Rights

President Obama’s famous words on executive actions, “I’ve got a pen and I’ve got a phone” was not reflective of a temporary mindset. No, this is how all future liberal presidents plan to govern. Hillary Clinton, if elected president, will need to be checked by a Republican Congress in every issue area. She will especially need to be checked on the issue of firearms.

Hillary Clinton sadly misunderstands our fundamental right to keep and bear arms. Earlier this year, Mrs. Clinton remarked, “I do support comprehensive background checks, and to close the gun show loophole, and the online loophole, and what’s call the Charleston loophole, and to prevent people on the no-fly list from getting guns.” Americans are rightfully concerned that if Congress continues to miss opportunities to pass pro-gun related policy, one president can forever change our Second Amendment.

The president’s increasingly large share of power, through agencies and departments, threatens our very republic. In order to safeguard our liberties against not only future presidents, but against the rulemaking process, Republicans in Congress need to have an agenda.

“A well-regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.” The Second Amendment to the United States Constitution is one of the many great ideas our country was founded upon. Our founders envisioned the right for we the people to privately keep and bear arms.

Most on the Left, and some on the Right, hold contempt for the Second Amendment and would love to see it further restricted. The Left finds it inconceivable that citizens should be able to own firearms.

I hold the view that the individual right to own a firearm is protected by our Second Amendment. The founders were specific in their language when the words “…the right of the people to keep and bear Arms, shall not be infringed.”

As the Left continues to beat the drum of gun control, few on the Right have laid out an agenda to further protect and advance gun rights. If the Republican-controlled House wants to continue to fight for gun rights and prohibit the next presidential administration from over stepping their Constitutional restraints, the House should move forward on a plan to do so. Here are just some of the ways Congress can take back their Constitutional obligation of legislating.

First, the House should take up and pass Concealed Carry Reciprocity. There were two such bills in the House this Congress, H.R. 923 the “Constitutional Concealed Carry Reciprocity Act” sponsored by retiring Rep. Marlin Stutzman, R-Ind. (B, 80%) and H.R. 986 the “Concealed Carry Reciprocity Act” sponsored by Rep. Richard Hudson, R-N.C. (D, 61%). Both bills, of which I am a cosponsor, would dramatically expand the right of concealed carry permit holders. Gun owners should not have to seek permission to exercise their constitutionally protected rights.

Second, the House should take up and pass H.R. 2001, the “Veterans 2nd Amendment Protection Act” sponsored by Jeff Miller, R-Fla. (C, 73%), similar legislation that provides Veterans due process protections, or restrict federal funds from being used by the Veterans Administration (VA) to categorize individuals as “mentally defective”. The VA has been using legal definitions to disarm lawful veteran firearm owners. Under current law, when a veteran has a fiduciary appointed to manage their benefits, the VA deems those to be “mentally defective.” The VA has been reporting to the National Criminal Background Check System (NICS) this list of veterans which makes it illegal for them to own a firearm. The practice of stripping veterans from owning firearms is inconceivable and should be stopped.

Third, Congress should reel in the administrative state by passing H.R. 2710 the “Lawful Purpose and Self Defense Act” sponsored by Rob Bishop, R-Utah (D, 65%). According to the sponsor, “This bill will reign in the Obama Administration and the ATF [Bureau of Alcohol, Tobacco, Firearms and Explosives]. The ATF has attempted to ban ammunition used in the popular AR-15 rifle. The bill will eliminate the ATF’s illegitimate authority to prohibit this .223 caliber ammunition. This legislation will also eliminate ambiguity in current code that could allow the ATF and the Administration to restrict certain types of shotgun shells that are used for self-defense.” Any presidential administration should not be using executive orders or directives from agencies to circumvent Congress. Passing legislation to reign in Article 1 powers and protect the Second Amendment should be a no brainer.

Fourth, block any and all attempts to pass legislation that could jeopardize individual’s due process through secret government watch lists. There has been a substantial push from some in Congress to ban the ownership of firearms for those on terrorist watch lists. Terrorists should not be allowed to purchase or possess firearms. Terrorists caught trying to purchase a firearm should be immediately taken to court, the transfer of the firearm should be blocked, and the terrorist arrested — end of story. At the same time, wrongfully listed Americans, like Representative Tom McClintock, R-Calif. (B, 85%) should not be denied their right to purchase a firearm. Banning people who are on secret government watch lists from owning firearms is not the solution. American’s right to due process needs to be protected.

Fifth, the Office of the Inspector General for the U.S. Department of Justice just recently released a report titled, “Audit of the Handling of Firearms Purchases Denials Through the National Instant Criminal Background Check System.” As the title suggests, the report identifies just how the DOJ handles occurrences where a firearm transfer has been delayed or denied. The report brings to light something pro-gun supporters have been saying for a while: the DOJ has the tools to prosecute criminals, it’s just not interested in using them. If, according to anti-gun politicians and organizations, everyone who is denied the transfer of a firearm as a result of a NICS denial is a dangerous person, why is the DOJ not interested in enforcing current law? Anti-gun politicians and presidential administrations can’t call for the expansion of the NICS system, but then neglect their duty to enforce current law. Anti-gun politicians simply want to make it harder for lawful citizens to own firearms. The House should be encouraging the administration and the Attorney General to faithfully execute the laws on the books.

It’s long past time for Republicans in Congress to advance an agenda that is not dictated by K-Street and wealthy elites. Americans are hungry for Republicans to stand up and fight on issues that they care about. It is without question that our fundamental Second Amendment right is one of those issues. She Was Raped at 22. Now She Advocates for Women to Have Choice to Carry a Gun.

Amanda Collins had never planned on becoming a Second Amendment advocate. But on Oct. 22, 2007, when she was just 22 years old, her life would change forever. “I lived through the worst fear that I had had up until that point,” Collins, who’s now a mother of three, told The Daily Signal. “What happened was that while I was a student at the University of Nevada Reno, I was brutally raped.”

At the time, Collins said she obtained her concealed carry permit, but wasn’t allowed to carry a gun on campus. Had she been carrying a firearm that day, Collins believes the outcome could have been different.

Nine years later, with Collins’ convicted rapist now sitting on death row for raping and killing another victim in Nevada, she advocates for women’s right to choose. But when Collins’ talks about “choice,” she isn’t referring to the issue of abortion. Instead, Collins is referring to the right to choose how to defend herself. Katie Couric Sued for $12 Million for Defamation in Anti-Gun Documentary

Film producer Katie Couric and her director Stephanie Soechtig edited their anti-gun documentary Under the Gun in order to make a gun rights group in Virginia look as if they couldn’t answer a simple question.

They’re now facing a $12 million defamation lawsuit, according to documents provided to Bearing Arms.

Second Amendment rights advocacy organization the Virginia Citizens Defense League (VCDL), along with two of its members, today filed a $12 million defamation lawsuit against Katie Couric, director Stephanie Soechtig, Atlas Films, and Studio 3 Partners LLC d/b/a Epix for false and defamatory footage featured in the 2016 documentary film Under the Gun. The film portrays a fictional exchange in which members of the VCDL appear silent, stumped, and avoiding eye contact for nearly nine seconds after Katie Couric asks a question about background checks. An unedited audio recording of the interview reveals that—contrary to the portrayal in the film—the VCDL members had immediately begun responding to Couric’s question.

In the filing, the VCDL, Daniel L. Hawes, Esq., and Patricia Webb allege that the filmmakers knowingly and maliciously manufactured the fictional exchange by splicing in footage that the filmmakers took surreptitiously after telling the interviewees to be silent for ten seconds so that recording equipment could be calibrated. The filing also contains side-by-side screenshots of the film’s footage of the VCDL members and anti-gun advocates, alleging that the filmmakers manipulated lighting to cast shadows on the VCDL members and to make them appear sinister and untrustworthy. “We were horrified to see how Couric and her team manipulated us and the video footage to make us look like fools who didn’t stand up for the Second Amendment,” said Mr. Philip Van Cleave, President of the VCDL. “We want to set the record straight and hold them accountable for what they’ve done. You shouldn’t intentionally misrepresent someone’s views just because you disagree with them.”

The lawsuit, filed in federal court (United States District Court for the Eastern District of Virginia– Richmond Division), seeks $12 million in compensatory damages, plus punitive damages. The VCDL, Mr. Hawes, and Ms. Webb are represented by Tom Clare, Libby Locke, and Megan Meier of Clare Locke LLP, a boutique law firm specializing in defamation litigation.

In 2016, Buy a Gun

It’s time to double down in defense of the U.S. Constitution and the Bill of Rights, in defense of the personal liberties that make our country so extraordinary. So this is my New Year’s Resolution.

I am going to buy a gun.

Maybe this sounds almost trivial coming from a committed libertarian. Big government types love to characterize us small government types as hunkered down in our basements, armed to the teeth, waiting for the End of Days, and clinging to our guns…. Not me. I’ve never felt particularly compelled to own a gun, although I have shot plenty of them over the years.

Now, I feel a responsibility.

I have spent a lifetime learning about, organizing a community around, and mobilizing in defense of, the non-negotiable right of each one of us to be left alone by government; free as long as we don’t hurt other people, or take their stuff. If you’re reading this, you likely have plenty of battle scars and deeply-held commitments just like mine. Together we have done so much in defense of Liberty.

But it’s just not good enough any more. I am particularly worried that we will lose what makes America so exceptional, as politicians grab more of our liberties from us in the name of “security.” Hillary Clinton is going after First Amendment speech and encryption. “Neo-Conservatives” like Senator Lindsey Graham think that the Fourth Amendment is antiquated; that your right to be secure in your person, home, papers, and effects against unreasonable searches and seizures, no longer applies. Bipartisan congressional collusion has empowered an unaccountable mass surveillance state, and the Legislative Branch has abdicated its responsibility to authorize war, shifting ever more power to the Executive Branch.

And the President of the United States, who swore an oath of office to defend and protect the Constitution, shows open distain for its key provisions protecting our liberties, particularly the Second Amendment. Barack Obama seems to genuinely believe that he can staunch the threat of homegrown Islamic terrorism simply by taking away the right of every law-abiding American to own a weapon — the right to defend yourself from attack from those who would want to hurt you and your family.

If you want to understand what’s at stake, take a look at the French government’s response since terrorists brutally murdered so many innocents inside the Bataclan Theater last November. “Imagine a Bush or Obama administration unchecked by the Bill of Rights or by Article 5 — which sets the bar high for altering the Constitution — and you’ll begin to understand the situation in France today,” writes Matt Welch in the Los Angeles Times. He continues:

After the November attacks, the French government approved extraordinary measures constraining civil liberties. To extend these measures permanently in the constitution, all the government requires is a three-fifths majority when Parliament meets again in February. France’s current state of emergency is already a doozy — warrantless searches, preemptive house arrests (more than 300 so far, without any convictions or involvement by a judge), plus the authority to shut down websites…. To this illiberal list, Prime Minister Manuel Valls on Dec. 23 added a controversial new item: the ability to strip French citizenship from dual nationals ‘who have been sentenced by a judge for committing crimes against the nation….’”

“What, exactly,” Welch asks, “is a crime against the nation?” One can imagine future *crimes* that have nothing to do with real acts of terrorism — or crime for that matter – a “constitutional” blank slate for some future tyrant to further centralize control.

In France, it is virtually impossible to legally obtain a gun.

The natural, inexorable tendency of governments to grab power from the citizenry is exacerbated during times of crisis by the political imperative to “do something.” I have no doubt that some of this authority-grabbing is done with the best of intentions – “to make us safe,” as more than one of the presidential candidates have recently put it. Leftists prefer to grab guns, and NeoCons prefer to grab your metadata and your due process, but the urge for control seems to infect almost everyone in a position of power.

But in defending the homeland from a decentralized, and increasingly homegrown, threat, more centralized power has a bad track record. All of the unconstitutional expansions of the surveillance state implemented since 9/11 failed to identify, let alone stop, jihadists Syed Rizwan Farook and Tashfeen Malik from gunning down fourteen innocent coworkers in a meticulously planned act of terror. “The governmental failure at San Bernardino,” writes Judge Andrew Napolitano, “was the confluence of a state government with antipathy and animosity toward the natural right of self-defense and a federal government attempting to devour far more data than it can handle.”

The fundamental challenge faced by increasingly centralized federal law enforcement apparatus was anticipated by Ori Brafman and Rod Beckstrom in their 2007 book The Starfish and the Spider: The Unstoppable Power of Leaderless Organizations. Starfish organizations decentralize information and decision-making, and are leaderless in the sense that there is no central command center or bureaucracy that dictates things from the top down. A terrorist network fits the model, driven by a radical ideology that holds it together. Cut off an arm of a starfish, the analogy goes, and you don’t kill the organization, you just make it stronger by creating more starfish organizations.

How do we defeat a leaderless movement that has tapped into the power of decentralized information and decision-making? Is there a more potent, shared set of values that bind us as a community? Doesn’t this all remind you of the genius of America and the shared values enshrined in our Constitution? Why not double down on the Bill of Rights as a first response to terrorism?

It seems to me that our essential liberties are least pliable during times of crisis.

So, I’m going to buy a gun. I want to be prepared to defend myself and my family, and my community if necessary. I have been putting this off for years, but now it feels like free riding. Sure I have my excuses, because obtaining a gun in the District of Columbia where I live is particularly, purposefully, difficult.

But that’s not good enough anymore. Here’s more from Judge Napolitano:

“Can the civilian use of guns keep us safe? Of course it can. The police simply cannot be everywhere. Anything that diminishes the shooting-fish-in-a-barrel environment of no-gun zones is an improvement over the carnage we have witnessed in them.”

If you don’t own a gun, you should consider joining me. It used to be our choice. Now it feels like a responsibility.

Florida Gunmaker Produces Assault Rifle ‘Never to Be Used by Muslim Terrorists’

crusader gun imageA new assault rifle being manufactured in central Florida has drawn fire after the gunmaker branded it the “Crusader” and said it was designed “to never be used by Muslim terrorists.”

Spike’s Tactical in Apopka etched its new $1,395 AR-15 with a Bible verse that says “Blessed be the Lord my Rock, who trains my hands for war, my fingers for battle,” MyFoxOrlando reported.

Company spokesman Ben Thomas, a former Navy SEAL, said the scripture is something of an insurance policy to keep it out of the hands of terrorists. The idea came to him during the weapon’s development. At the time, the U.S. government was preparing to arm rebel groups in Syria . . .

The gun went on sale this week and was quickly denounced by the Council on American-Islamic Relations of Florida, according to MyFoxOrlando.

A Dad Wanted to Open Carry at His Daughter’s School but Was Denied – Then a Judge Stepped In

According to recent reports, a Michigan father has come out on top following a legal battle he said began when he was denied access to his daughter’s elementary school.

Kenneth Herman took his local school district to court after repeated efforts to enter the school while openly carrying his handgun in compliance with local law. The issue, he was told, centered around the school’s designation as a gun-free zone.

“I think schools being gun-free zones is not a wise idea,” he explained to reporters. “I think having law-abiding armed citizens in there provides some measure of protection that isn’t a glass door that can be broken out.”

The district argued that the policy exists to promote the “safety and protection of students,” though its defense did not hold up under Circuit Judge Archie Hayman’s scrutiny.

Citing state law that permits legal concealed carry on public school campuses, Hayman ruled in Herman’s favor.

Michigan Open Carry, which provided legal representation in the case, released a statement applauding the ruling, noting the speed with which it was decided suggested it was “clearly an easy decision” for Hayman. Actress: Owning a Firearm “Was Life-Changing for Me” [+video]

Kelly Carlson is a proud, gun-touting gal, and she’s not afraid to speak about it.

“Owning a firearm … was life-changing for me because women for sure, but even men too can be in a very, very vulnerable position with no options if you have intruders or any scenario where you’re being dominated physically,” Carlson told FOX411 about buying a gun after experiencing traumatizing security breaches. “[A firearm] is the only equalizer you have. … It’s crucial for people to look at it from a logical standpoint and take the emotions out of it because one needs to have that option to save them.”

The Nip/Tuck actress recalled how a person in her past had stalked her in 2012, going as far as hiring people to break into her home repeatedly and tap her phones. Hillary Clinton: We Must Address the Uncontrollable Use of Guns in America

By Awr Hawkins. Speaking at a house Party in Ottumwa, Iowa, on July 7, Democrat presidential hopeful Hillary Clinton said we must address the “uncontrollable use of guns” in America.

Furthermore, Mrs. Clinton said Democrats need not let fear of the “gun lobby” get in the way of doing this.

According to the Associated Press, Clinton said that “she believes most Americans … support universal background checks,” which is something she will pursue if elected. She added, “Let’s not be afraid of the gun lobby, which does not even really represent the majority of gun owners in America.”

These statements are in addition to others Clinton made least year at a June 17 townhall meeting, in which she claimed gun owners “terrorize the majority of people.” In that speech, Clinton also renewed her support for an assault weapons ban and a ban on “high capacity” magazines. Seattle To Explore Gun & Ammo Tax

By Michael Strickland. Seattle city council president Tim Burgess has concocted the latest scheme to stem “gun violence”, and it has gun rights supporters upset.

Burgess has put together a plan that involves implementing a city wide tax on firearms and ammunition purchases. A gun purchase would get a $25 tax added to the cost, and ammo would be charged an additional 5 cents per round.

His official press release includes the following:

The revenue proceeds from the gun violence tax would be dedicated to prevention programs and research intended to reduce the burden of gun violence on Seattle residents and neighborhoods.

“Taxpayers in Seattle pay for millions of dollars in emergency medical care every year for people who have been shot,” said Council President Burgess. “It’s time for the gun industry to chip in to help defray these costs.”

In Some U.S. Churches, Guns Are the Answer to a Prayer

The Sunday service was winding down, but before it ended, Bishop Ira Combs led the congregation of 300 at the Greater Bible Way Temple in prayer. The shootings that killed nine people in a Charleston church could not happen here, he reassured his flock.

“If they had security, the assailant would not have been able to reload,” Combs declared. “All of us here are not going to turn the other cheek while you shoot us.”

As he preached, Combs was flanked by a man on each side of the pulpit, each armed with handguns beneath their suit coats. Other members of the church’s security team were scattered among the crowd. Congregants did not know who was armed and who was not – an undercover approach that is part of the security plan.

“We aren’t looking to engage people in violence, but we are going to practice law enforcement,” Combs told Reuters before the service. “And we are going to interdict if someone comes in with a weapon.”

Huge Hollywood Actor Is as Pro Gun as It Gets

World famous comedian and movie star Vince Vaughn came out with a double barrel defense of gun rights during a recent interview, calling for guns in schools and arguing the Second Amendment is intended to defend against “the supreme power of a corrupt and abusive government.”

The star of the new season of the hit HBO series “True Detective,” outlined his pro-gun views during an interview with British GQ, which released excerpts of the sit down June 1. Vaughn — who has outlined his distinctly libertarian views in recent press sit-downs — stands in sharp contrast to many of his Hollywood colleagues who call for bans on firearm ownership.

“We have the right to bear arms to resist the supreme power of a corrupt and abusive government,” Vaughn told British GQ. “It’s not about duck hunting; it’s about the ability of the individual. It’s the same reason we have freedom of speech. It’s well known that the greatest defense against an intruder is the sound of a gun hammer being pulled back” . . .

“Take mass shootings. They’ve only happened in places that don’t allow guns,” Vaughn explained, mirroring arguments from noted gun crime researcher Dr. John Lott. “In all of our schools it is illegal to have guns on campus, so again and again these guys go and shoot up these f***ing schools because they know there are no guns there.” (Read more from “Huge Hollywood Actor Is as pro Gun as It Gets” HERE)
