The Immigration Scandal No One Is Talking About

Among the least talked about scandals in Washington is how immigration officials spent decades misleading Congress about the number of migrants evading court. I discussed that scandal at length in my last article.

In advancing this decadeslong effort, no accounting trick and no false narrative was out of bounds. Never in any year did these officials tell the real story of a court system in crisis. Brave rhetoric and bleached numbers consistently camouflaged the courts’ disarray.

“The fight against terrorism,” the Bush and Obama administrations boldly declared from 2005 through 2012, “is the first and overriding priority of the Department of Justice. … A key component of this effort is the securing of our nation’s borders and the repair of the immigration system as a whole. The application and enforcement of our immigration laws remain a critical element of this national effort.”

Both administrations insisted that immigration courts serve “as the front-line presence nationwide in immigration matters.”

Yet court officials’ words and actions didn’t match up with a “front-line presence.” While nearly a million people ran from court over the last 22 years — meaning 37 percent of all those free pending trial failed to appear for their hearings — no alarm was sounded by those in charge.

The courts’ 2007 annual report is just one example of the misleading numbers court officials pushed out for congressional oversight and public consumption each year.

“The overall failure-to-appear … rate decreased,” officials stated, “to 19 percent in 2007 from the five-year high of 39 percent in 2006.” This was pure whitewash. Accurate accounting showed the failure-to-appear rate in 2006 was 59 percent — 51 percent higher than court executives admitted. Nor was the real failure-to-appear rate in 2007 a lowly 19 percent. It was 36 percent, nearly double what the courts reported to Congress.

But gaming failures to appear in court was just one dynamic that officials suppressed to the point of dishonesty. Others, like unexecuted deportation orders, received scant official mention, but got out anyway.

“All should be troubled,” wrote immigration appeals Judge Edward Grant in 2006, “by the fact that only a small fraction of final orders of deportation … are actually executed.”

Records confirm this. Of the 1,254,152 aliens who were ordered deported from 1996 through 2016, 76 percent of them — 953,506 to be exact –remained in the U.S. They not only remained, but grew.

From a total of 557,762 unexecuted removal orders in 2008 were added 395,744 through August 2016 — a 71 percent increase in less than eight years. Despite expanded enforcement since 2017, court records say failures to appear in court will only increase and with them, experience shows, unexecuted removal orders.

None of this is new — yet nothing has been done. Failures to appear in court have predicated evasion of removal orders for years and are chronic symptoms of an immigration system turned upside down.

A 1989 Government Accountability Office audit on immigration courts foreshadowed today’s extremes. It concluded that “aliens have nothing to lose by failing to appear for hearings” and noted that over the preced­ing 30 years illegal entry into the United States increased by 2,200 percent — from 45,000 in 1959 to 1.2 million in 1989 — and, as illegal entry grew, so did failures to appear in court.

The Government Accountability Office’s audit also addressed cause and effect — and it didn’t blame illegal aliens. “Disregard for the courts,” it stated, stemmed from a “lack of repercussions.” Few aliens, it said, faced any “adverse consequences,” deportation included.

A 2006 Justice Department inspector general’s report agreed, stating the “program for deporting illegal aliens had been largely ineffective” and that “89 percent of nondetained aliens released into the U.S. who were subsequently issued final orders of removal were not removed.”

For a watchful public, these failures prove the gross inadequacy of federal response to problems now years in the making. All involve frail courts, feeble enforcement, and the willingness of government executives to hide embarrassing truths that worsen the causes underlying them.

What’s more is that in human terms, these trends also bring tragedies.

Algerian-born immigrant Ahmed Ferhani was arrested by New York City police on robbery and narcotics charges in 2010. Facing deportation, he remained free pending trial, then fled court in 2011. He was later arrested — but not before plotting attacks on Manhattan synagogues and the Empire State Building.

Jose Alfaro, a Salvadoran national, was ordered deported in 2002. Despite two later arrests, he remained at-large for nine years before murdering three people in Manassas, Virginia, on Feb. 10, 2011.

Kesler Dufrene, a Haitian national and twice-convicted burglar, was ordered deported upon completing his Florida prison sentence in 2010. Still, Immigration and Customs Enforcement released him, and on Jan. 2, 2011, he gunned down two adults and a 15-year-old in North Miami.

From these self-inflicted failures that now tarnish our immigration institutions, a simple lesson emerges: The nation that can elevate the immigrant must likewise sanction the violator.

Immigration done right — by attracting the talented, redeeming the persecuted, and removing the offender — dignifies and enriches us all. The systemic disorder America now faces does neither. (For more from the author of “The Immigration Scandal No One Is Talking About” please click HERE)

‘Children’ at Border Included Murderers, Rapists

Official government incident reports obtained by Judicial Watch after three years of delay provide a clearer profile of the “unaccompanied alien children” who flooded the U.S. border during the Obama administration and continue to arrive, documenting that among them were admitted murderers, rapists, drug smugglers, prostitutes and human traffickers. . .

Significantly, he said, the incident reports “also support the Trump administration’s contention that the UAC crisis, which continues, includes murderers, rapists, drug smugglers and human traffickers being routinely allowed into the United States.”

Trump – who has faced fierce criticism for enforcing a policy in effect under Presidents Bush and Obama requiring that children of parents being prosecuted for illegal entry be temporarily put in the custody of HHS – has argued gangs such as MS-13 have “exploited the loopholes in our laws to enter the country as unaccompanied alien minors.”

Judicial Watch began investigating the matter in 2014 when a wave of “unaccompanied alien children,” or UACs, overwhelmed the government’s capacity at the southwest border. The documents from the Health and Human Services Department’s Administration for Children and Families were submitted to the Office of Refugee Resettlement from May to November 2014.

Eyeroll: Democratic Senator Makes Idiotic Comparison Between Immigrants and Thai Soccer Team

Sen. Dick Durbin (D-IL) is always someone you can count on to make a completely idiotic remark on matters that really have no connection to politics or history. In other words, they’re all whackjob remarks and the Illinois Democrat wasted no time trying to tie the frenetic rescue mission of the Thai soccer team trapped in caverns to…immigrant families “trapped in a bureaucratic cave.”

In Thailand, 12 members of a soccer team and their coach became trapped in a cavern system that is rapidly flooding due to the monsoon season. They’re about a mile or so underground, it’s pitch black, and the journey to extract them is no picnic either. Some reports say it’s around a 12-hour round trip from the extraction point to the site where rescue crews discovered the boys. One ex-Thai Navy Seal died when he ran out of oxygen. This is not related to our immigration policy, but in comes Durbin with this nonsense on “Meet The Press” over the weekend (via Mediaite):

Before even answering the first question of his Meet the Press interview, Sen. Dick Durbin (D-IL) took a moment to call attention to the soccer team stuck in a flooded Thailand cave, comparing the trapped boys to detained migrants in the U.S.

“Hearts and prayers are with those boys in Thailand, trapped in the cave,” he told NBC’s Chuck Todd. “I hope our hearts and prayers are also with thousands of children, toddlers and infants, removed from their parents by the Trump Administration, under zero tolerance. They’re trapped in a bureaucratic cave, too, so let’s not forget them.”

Folks, this is the Left. They will make you care. Even on things like a rescue mission, they try to attach a political rider. Yes, hope for the best. And so far, eight of the team members have been rescued. Four more, including the coach, remain, so this is good news. But this is just complete and utter nonsense. These kids were in the dark, with limited food and drinking water. Detained children, who are in this position because their parents were caught breaking federal immigration law, are in air conditioned tents, beds, with access to medical treatment, and three meals a day. Wait–How Many Immigrants Are on Welfare Again?

By Townhall. This is the land of opportunity, and anyone who wants the come here can…legally. That’s not the issue. For the Trump White House, it’s been their stated position to shift our immigration policy toward allowing more high-skilled workers into this country.

As for the families of the low-skilled working immigration population in the country, 51 percent (76 percent counting immigrant-led households with children) are collecting some sort of check from our welfare services. Is that good? No. Does that mean we shut it all down? No. That figure comes from the Center for Immigration Studies, who noted the need for the immigration process to be more “selective.” At the same time, there are a lot of American households with children that are also getting some form of government assistance (via USA Today):

About 51% of immigrant-led households receive at least one kind of welfare benefit, including Medicaid, food stamps, school lunches and housing assistance, compared to 30% for native-led households, according to the report from the Center for Immigration Studies, a group that advocates for lower levels of immigration.

Those numbers increase for households with children, with 76% of immigrant-led households receiving welfare, compared to 52% for the native-born.

The findings are sure to fuel debate on the presidential campaign trail as Republican candidates focus on changing the nation’s immigration laws, from calls for mass deportations to ending birthright citizenship.

Homeland Security Extends Special Immigration Status for Some Yemenis

By NBC News. The Trump administration said Thursday that Yemenis granted special immigration status in the U.S. after an escalating civil war can keep the designation, making them among a shrinking group of people from countries wracked by violence and natural disaster to have permission to remain in the country.

Yemen was first designated for the special status in 2015. The civil war reached new levels last year — the United Nations said at least 10,000 civilians were killed and more than half the country had a serious food shortage. Homeland Security Secretary Kirstjen Nielsen said in a statement that the armed conflict and extraordinary conditions support the need for continuing the designation. But the administration will not take on new applicants.

Those already with the status — nearly 1,250 — will be able to remain in the U.S. and will be allowed to work until at least March 3, 2020.

International Rescue Committee, a humanitarian group, called it a relief that the Trump administration was extending the designation for some Yemenis but said that placing an “arbitrary date on eligibility” could force some Yemenis to return to deadly conflict. ‘Army Discharging Immigrants’ Story May Not Be the Outrage It’s Cracked up to Be

On Thursday, The Associated Press published a story with a headline that read, “US Army quietly discharging immigrant recruits.” That headline was quickly met with outrage — but the story itself isn’t anything new. . .

But as retired Army Col. Kurt Schlicter predicted, there was more to the story.

NPR’s Tim Mak offered a little more context, pointing out the fact that the real question — whether or not recruits are being discharged because they are immigrants — is never answered in the article.

Getting It Done the Right Way — 14k Legal Immigrants Will Become Americans on Independence Day

About 14,000 legal immigrants … officially [became] American citizens on Independence Day, participating in naturalization ceremonies at 27 different locations nationally.

“When oath ceremonies are tied to the Fourth of July, it’s a message that immigrants believe in this country,” Joshua Hoyt, executive director of National Partnership for New Americans (NPNA), told ABC News. “It’s a beautiful and emotional thing.”

Hoyt added that NPNA supports naturalization as being “good for the immigrants, their communities, and our nation,” while contributing to “higher incomes” and “social cohesion,” according to ABC News.

The Fourth of July falls less than a month after multiple immigration-based incidents have occurred among policy changes. President Donald Trump’s zero-tolerance policy on illegal immigration has caused protests, online campaigns and even personal attacks on administration officials, even though Trump signed a June 20 executive order to keep families of illegal border-crossers together as they await prosecution.

Legal immigrants, however, after going through all the lawful motions to achieve citizenship, are able to participate in the patriotic ceremonies where new Americans are officially sworn in together. A U.S. Church Created This Controversial Display as a Protest Against Trump

An Indiana church is using church imagery in order to protest against President Donald Trump and his immigration policies.

Christ Church Cathedral in Indianapolis, Indiana, posted a picture of the display meant to protest the separation and detention of migrant families by the department of Immigration and Customs Enforcement under Trump.

“So we have the holy family in a chain link enclosure, much like the detention facilities that are being prepared and currently exists for families being detained indefinitely,” explained Reverend Stephen Carlsen of Christ Church Cathedral.

“And we’re hoping to draw attention to the fact that indefinite family detention is wrong and that this holy family, that were refugees seeking asylum in Egypt,” he said, “are representative of every family in detention.” . . .

Sexton Fred Andrews said that they hope the display will influence people at the ballot box when they vote.

Washington Post Hides Correction After Embarrassing Error on Time Cover Story

The Washington Post stealth-edited an article incorrectly claiming the young child on the cover of Time Magazine was separated from her mother, only adding a “clarification” after The Daily Caller reached out for comment.

The original article — written by Eli Rosenberg — asserted that the image of the crying immigrant girl staring up at President Donald Trump was a powerful statement about family separations on the border. . .

The article itself repeated the now-debunked claim that the child was taken away from her mother, reading, “Time magazine ran a cover that used one of the images that has been most resonant in this past week, taken of a young girl crying as her mother was patted down by a Border Patrol agent before the two were separated.” [Emphasis added] . . .

As the father of the young girl, border patrol agents and eventually Time indicated, at no point were the mother and daughter ever separated. The child was briefly set down for the mother’s pat-down, but the pair were quickly reunited after the search.

The Washington Post edited Rosenberg’s article to fix the error, but they issued no editor’s note, correction, or clarification that anything had been changed despite the fact that the original article was on the website for at least 12 hours. Forgotten Child Detainee Photos From Obama Administration Revealed

They are images of misery, of bureaucratic neglect, of the fate of children who through no fault of their own were brought across the American border by a parent.

They are images that conservative crusader Ben Shapiro reminded America Monday are the legacy of the Obama administration.

“The media is suggesting President Trump is cruelly tearing children out of the arms of their illegal immigrant parents,” Shapiro said Monday, noting that the “media have decided to jump with both feet on the bandwagon.”

But as shown on a video of “The Ben Shapiro Show” broadcast on YouTube, Shapiro noted that since 1997, it has been federal policy to separate children from illegal immigrant parents.

Accommodations for detained children “may be awful, but they were just as awful under President Obama,” Shapiro said as he highlighted scenes of despair and neglect that were first shared in 2014 by Breitbart.

Shapiro further lit into the media in a column published on The Daily Wire.

“The media coverage of this issue has been patently irresponsible. Trump isn’t forcing children away from parents. He’s enforcing the law on the books. The legislature can fix that law at any time. The facilities he’s using are the same facilities Obama used,” he wrote.

Shapiro castigated those who have spread lies about the issue.

“Pretending that this is Japanese internment (as Laura Bush suggested) or the Holocaust (as Gen. Michael Hayden suggested) is ridiculous. This policy ought to be fixed. But lying about it isn’t designed to fix it. It’s designed to prevent a fix by allowing Democrats to play political football with children, believing they’re winning a victory by holding Trump’s feet to the fire with pictures of crying children,” he wrote.

Shapiro then traced the legal precedents that have shaped federal policy about detaining children, noting that the courts gave federal officials a choice.

“The government either had to release whole families, or that the government had to separate parents from children,” he wrote.

Illegal immigrants also have a choice, he said.

“Immigrants who come to points of entry to seek asylum aren’t actually illegally in the country. They’re not arrested. They’re processed through ICE, and their children stay with them,” he said.

” If, however, illegal immigrants cross the border illegally, the Trump administration now treats them as criminals. If they choose deportation, they aren’t separated from their kids. If they choose to apply for asylum, they stay in the country longer than 20 days, and their kids have to be removed by operation of law,” he noted.

As to the facilities themselves, a CNN reporter recently toured the Casa Padre shelter in Brownsville, Texas, and gave it a mixed review.

“The massive shelter retains a warehouse vibe — noisy but highly organized, with scores of staffers leading skeins of boys to various activities,” the CNN report said.

“In recreation rooms, some boys watched a soccer match on TV, some took part in a tai chi class, others played pool or foosball (in one case with a cue ball). Still others sat in classrooms. Because of the crowding, the boys attend school in six-hour morning or afternoon shifts, five days a week. The bedrooms reporters were shown seemed antiseptically clean,” CNN reported.

Crowder’s Latest ‘Change My Mind’ Features Shocking Story of Legal Immigrant Fearful of Illegal Alien Crime

In the latest video in CRTV host Steven Crowder’s popular “Change My Mind” series, Crowder takes on border security, asking people to sit down for a conversation and change his mind about immigration reform and building a border wall.

“We didn’t get many sit-down interviews in this one; we got a lot of drive-by yellings,” he says, including one person telling him to “build the wall with your a**.”

But one individual who sat down with Crowder had an amazing story to tell. She says she is a Mexican-American immigrant, and while she told him she doesn’t support the wall, she did explain her fear of illegal immigrants committing crimes in her neighborhood. Her face was blurred for her safety.

“I know a lot of people that are, like, um, are criminals!” she said, adding that they haven’t been deported. She even asked Crowder how she can report these people to the authorities.

Crowder spoke with her further off-camera. “It breaks your heart, it really does,” he says. “Keep in mind, this lady was a legal immigrant subdued into fear by illegal immigrants in her neighborhood.”

Crowder says her story shows how the liberal narrative on sanctuary cities can hurt people.
