The Case of the Jihadi Bride: How the U.S. Government Fails to Safeguard Our Citizenship

The New York Times is lamenting how the State Department is not letting a “jihadi bride” back into the U.S. now that she is on the losing side of her treason. But there is another point that everyone is missing from the case of Hoda Muthana: What is government doing to ensure that children of diplomats are not automatically, illegally granted citizenship?

Hoda Muthana is the daughter of one of the many millions of Middle Eastern immigrants we’ve admitted in recent decades who have developed radical jihadist views. She left this country in 2014, married a total of three ISIS fighters (her first two husbands were killed) and even posted a video of burning her U.S. passport. She tweeted messages calling for spilling the blood of veterans on Memorial Day. Now that the caliphate collapsed, she is begging to come back in and is claiming she has changed her views.

Why are children of diplomats being granted American citizen documents?

The presumption in the media when the case first broke was that she was a traditional American citizen, being born in the U.S. to legal permanent resident parents. But the State Department is contending that she was never a legitimate American citizen because she was born to a Yemeni diplomat to the U.N. living here on a special diplomatic visa, such as a G-2 visa.

While the details of this particular case are still murky, it raises a general concern about the thousands of kids born on our soil to diplomats of all stripes from all regions in the world. Even according to those who hold the misguided view that birthright citizenship is not only in the 14th Amendment but applies to people who violate our sovereignty and reside here without permission, that does not extend to children of diplomats. There is no dispute about that. Yet, as the Center for Immigration Studies reported several years ago, the government has been so lax in enforcing this that “children born to foreign diplomats on U.S. soil [are] receiving U.S. birth certificates and Social Security numbers (SSNs) — effectively becoming U.S. citizens.”

In extensive research, Jon Feere of the Center for Immigration Studies found that the lack of enforcement by the Social Security Administration, the U.S. Citizenship and Immigration Services, the State Department, and several other agencies has allowed all children

of foreign diplomats to become de facto citizens, with birth certificates and Social Security cards. While the issuance of a birth certificate and Social Security card doesn’t necessarily make someone a citizen, it has the effect of granting him de facto citizenship until the agencies clamp down on this practice.

This is an especially perverse outcome since foreign diplomats and their families are granted diplomatic immunity from prosecution of many laws. Illegally granting these citizenship, against the consent of the citizenry, makes them super-citizens — enjoying the rights of America and free from prosecution for many types of law-breaking.

In this case, if the State Department is correct that Muthana was born here when her father was a diplomat, then how did she hold a U.S. passport? Presumably, because hospitals are given no guidance in handing out birth certificates to anyone born here under any circumstance, and she was granted an official birth certificate and American SSN, which treated her as a citizen from day one.

Dan Cadman, a former ICE agent and fellow with the Center for Immigration Studies, expressed concern in an email to CR that this case of de facto stolen citizenship only came to light because of the terrorism angle:

As this case shows, there are no substantive procedural safeguards to prevent the children of diplomats from being vested with the trappings of citizenship, up to and including passports and Social Security cards, because key agencies of government such as the State Department and Social Security Administration don’t meaningfully interact with state vital statistics bureaus. It took the scrutiny of major international media organizations focusing on this three-time jihadi bride before our own government inquired deeply enough to reveal the facts — else she could have spent the remainder of her life living as a citizen.

Another example of why unqualified birthright citizenship is wrong

The jihadi bride case is just one more proof that the entire idea of birthright citizenship for those here illegally was not a deliberate decision born from the consensus understanding of the Wong Kim Ark decision, somehow applying also to those who break into our country, as Justice Brennan suggested in his infamous footnote in Plyler v. Doe.

The federal government has never deliberately decided to grant automatic citizenship to children born to illegal aliens. No national discussion occurred to apply the Wong case to illegal aliens, as indicated in the footnote of the Plyler case. And as I proved conclusively, nobody ever thought to actively grant such a right because it would have contradicted our immigration laws.

It likely evolved from sheer laziness and practicality. Given that all children born to legal immigrants were granted birthright citizenship before the influx of illegal aliens — either as a matter of practice or resulting from the 1898 court decision — the relevant agencies never bothered to enforce verification and give the hospitals forms that required one parent to show his or her Social Security card. It was easier to grant anyone born in an American hospital citizenship, especially because illegal immigration en masse did not occur until the mid-twentieth century.

According to Professor John Eastman of Chapman University School of Law, the passport office up until the late 1960s did not presume birth on U.S. soil meant you were entitled to a passport. “If you were born on US soil that wasn’t sufficient to prove your citizenship to get a passport, you also had to show the status of your parents when you were born on US soil,” said the legal scholar on a podcast in November. Indeed there is no evidence we ever handed out citizenship to children of guest workers during the 1920s.

It was only after the problem became so pervasive and conservatives began calling attention to it in the early 1990s that liberals retroactively created a convoluted legal rationale based on the Brennan’s footnote and a misunderstanding of the obscure Wong case to defeat popular and commonsense efforts to end the practice.

The proof is in the pudding: We all agree children of diplomats are excluded from citizenship, yet there is no enforcement mechanism to stop them other than the honor system.

So why doesn’t our government care to safeguard the crown jewel of our national citizenship? From our earliest days, we’ve always had a vetting process and a probationary period to see if we want to grant citizenship to a given family. The notion that anyone born on our soil, even those here illegally or on non-immigrant visas, which did not require strong vetting or an oath of allegiance, could somehow force their children upon us is absurd. The crafters of the 14th Amendment explained that “subject to the jurisdiction of” meant those who owed all “allegiance” to America.

This case is a superlative example of stolen sovereignty, because the U.N. is full of diplomats from nations who have disdain for our values. The idea that if Muthana’s father was on a diplomatic visa simply because we house the U.N. on our soil, that should entitle his kid to citizenship, even if Muthana’s CAIR lawyer is correct in asserting that she was born after her father was no longer a diplomat, is absurd. If her father did not have a green card at the time of her birth, she should not be a citizen. As Cadman says, “Whether or not her father violated the conditions of his admission or not, he was admitted as a diplomat, and accredited as such, and under the provisions of the U.S. Constitution and international law, he was never ‘subject to the jurisdiction’ of the United States and thus could not confer citizenship upon his child simply by virtue of birth here.”

We will have to wait for the details on this case as the lawsuit goes on, but it should force action in general to protect our citizenship from people who clearly are not entitled to it, beginning with children of diplomats and eventually including those who willfully steal our sovereignty as illegal immigrants. Nation of Islam Preacher Blames ‘WICKED JEWS’ for Attacks on Women’s March Leaders

Nation of Islam’s anti-Semitic leader, Louis Farrakhan, used his annual “Savior’s Day” speech to defend Women’s March leaders who forged a close relationship with his group, blaming the “wicked Jews” for driving a wedge between the Women’s March and leftist organizers, and for trying to “break up the women’s movement.”

The Nation of Islam hosted its annual national conference, Savior’s Day, at the United Center in Chicago over the weekend, and anti-Semitism was a priority among attendees. Speakers tore into the Jewish people, accusing them of everything from owning the Federal Reserve to instituting sharecropping to inventing pedophilia.

But Farrakhan reserved some of his sharpest anti-Semitic criticism for defending Women’s March leader Tamika Mallory and her colleagues, whom he claims are victims of a conspiracy.

“The most beautiful sight that I could lay eyes on [was] when I saw, the day after Trump was elected, women from all over the world were standing in solidarity, and a black woman is the initiator of it,” Farrakhan said about Mallory in his speech as a photo of Mallory popped up on the United Center’s scoreboard.

ISIS Brutality Leading Some Muslims to Convert to Christianity

By The Blaze. A new Christian church in Kobani, a city along the Syrian-Turkish border, is attracting converts who have seen and experienced brutality at the hands of the militant group ISIS. . .

Jasim attends the Church of the Brethren, one of the first Christian churches to appear in the area in decades. His move is a bold one, as those who abandon Islam are often shunned by their families and communities. . .

Jasim, a mechanic, told the news outlet he converted to Christianity late last year. In early 2016, he was jailed by ISIS for not knowing the basics teachings of Islam. According to Jasim, he was tortured by the militant group and forced to read the Quran.

The church’s priest declined to be interviewed and one church leader spoke only on the condition of not using his last name, NBC reported. They cited safety concerns as the reason. . .

Life Under ISIS Led These Muslims to Christianity

By NBC News. Four years have passed since the Islamic State group’s fighters were run out of Kobani, a strategic city on the Syrian-Turkish border, but the militants’ violent and extreme interpretation of Islam has left some questioning their faith.

A new church is attracting converts. It is the first local Christian place of worship for decades.

“If ISIS represents Islam, I don’t want to be a Muslim anymore,” Farhad Jasim, 23, who attends the Church of the Brethren, told NBC News. “Their God is not my God.”

Religious conversions are rare and taboo in Syria, with those who abandon Islam often ostracized by their families and communities. . .

WATCH: Democrat Rep Defends Past Anti-Semitic Statement on Exposing ‘Evil Doings’ of Israel

Far-left Rep. Ilhan Omar (D-MN) defended a past anti-Semitic remark she made on Twitter in an interview with PBS on Tuesday, saying those were “the only words I could think about expressing at that moment.”

“Can I just move on to something that’s generally a rite of passage for politicians in the United States, and that is to sort of profess a sort of fealty or at least pay homage to AIPAC, the pro-Israel PAC that is very, very prominent,” PBS’s Christiane Amanpour said. “Should Jewish Americans be worried about congresswoman Ilhan Omar or Rashida Tlaib because of the BDS movement, because of one of the tweets you made a long time ago, you were part of a new wave of Democrats not afraid to be critical of the government of Israel.”

“During the 2012 military offensive in Gaza, you tweeted, ‘Israel has hypnotized the world, may Allah awaken the people and help them see the evil doings of Israel,” Amanpour continued. “How do you put that into context now and what do you say to American Jews?”

“I remember when that was happening, watching tv and really feeling as if no other life was being impacted in this war and that really, those unfortunate words were the only words I could think about expressing at that moment,” Omar replied. “What is really important to me is that people recognize that there is a difference between criticizing a military action by a government that has exercised really oppressive policies and being offensive or attacky [sic] to particular people of faith.”

Omar then tried to justify her criticism of Israel by attacking another U.S. ally, Saudi Arabia, saying that she also calls for action against them.

Scary Times: Palestinian Rep. Sworn in on Jefferson’s Quran

Democratic Michigan Rep. Rashida Tlaib, one of the first Muslim women elected to Congress, was sworn into office Thursday using Thomas Jefferson’s copy of the Quran.

Tlaib, the first Palestinian woman to take congressional office, insisted on using the Quran, ostensibly to make a positive statement about Islam’s place in U.S. history and the diversity of American society. She also reportedly wore a traditional Palestinian gown, called a thobe, for the ceremony.

“My swearing in on the (Quran) is about me showing that the American people are made up of diverse backgrounds and we all have love of justice and freedom,” Tlaib told the Detroit Free Press. “My faith has centered me. The prophet Mohammed was always talking about freedom and justice.”

Jefferson purchased a copy of the Quran in 1765 while studying the law. He was a collector of books, and historians speculate he might have purchased the Quran because of his curiosity about world religions and because a significant number of the slaves taken from African countries to the U.S. followed Islam. . .

Tlaib also said she is “going to be a voice for” Palestinians. After winning her congressional primary race, she gave a victory speech with the Palestinian flag draped around her shoulders. Linda Sarsour, Unfazed by New Anti-Semitism Charges, Will Keynote Radical Islamist Gathering

Women’s March leader and Islamist activist Linda Sarsour is scheduled to speak at the end of the month at the Muslim American Society-Islamic Circle of North America (MAS-ICNA) annual conference in Chicago.

The announcement comes on the heels of a Tablet magazine profile that shined a light on Women’s March leaders, including Sarsour, who routinely engaged in anti-Semitic harassment of their Jewish colleagues.

“I talked to everyone, and I said it to every last one of them: Tamika [Mallory] needs to resign—not just because of her Farrakhan connection, but because of how she handled it afterwards. I said Linda [Sarsour] also needs to step down. Her controversy and the things she keeps saying and doing are detrimental to the movement,” Mercy Morganfield, a former Women’s March spokesperson, said in the interview with Tablet.

Tablet then asked Morganfield whether she believes Women’s March co-chairs, including Sarsour, are anti-Semitic. She responded: “There are no Jewish women on the board. They refused to put any on. Most of the Jewish people resigned and left. They refused to even put anti-Semitism in the unity principles.”

At the Chicago conference, Sarsour will be joined by a who’s who of America’s most fringe Islamist preachers, including:

Imam Omar Suleiman, a gay-bashing imam who has endorsed honor killings, the act of murdering a family member for her allegedly inappropriate behavior to restore “honor” within the community or household.

Nihad Awad, the executive director of the Hamas-tied Council on American Islamic Relations (CAIR), a U.S.-based group that was founded to build support for Hamas and the Muslim Brotherhood in the United States. Awad has previously declared that he is “in support of the Hamas movement,” which remains a U.S.-designated terrorist organization. The UAE recently listed CAIR itself as a terrorist organization.

Mazen Mokhtar, who was identified in a federal affidavit as the individual behind a website to raise funds for the Taliban and Chechen terrorists.

The groups that combined to host the confab share an extremist, anti-American agenda.

In a major terrorism financing case, federal prosecutors labeled the Muslim American Society (MAS) as an “overt arm” of the Muslim Brotherhood, a global Islamist organization that seeks to impose the primitive and barbaric Sharia law and a global Islamic caliphate.

The Islamic Circle of North America (ICNA) also has close ties to the Muslim Brotherhood. Terrorism analyst Yehudit Barsky has described the group as a network “composed of members of Jamaat e-Islami, a Pakistani Islamic radical organization similar to the Muslim Brotherhood that helped to establish the Taliban.”

Kyle Shideler, director of the Counter-Islamist Grid, an initiative of the Middle East Forum, spoke to Conservative Review about Sarsour’s activism. “Linda Sarsour’s antisemitism and support for Islamist causes have never been more apparent. Her relationships with progressive groups have exploded thanks to her role in hijacking the Women’s March, and her Islamist ties have been outed not just in niche media, but in mainstream and even international publications,” Shideler tells CR. “That MAS-ICNA still wants her to speak is a reminder that they are a group founded by Islamists for Islamists. Groups that align with them do so at their own peril.”

Sarsour has admitted that her progressive advocacy is largely a front to build a coalition around her anti-Israel, pro-Palestine agenda. She also has a habitual tendency to blame Jews and Israelis — harnessing anti-Semitic dog whistles to cloak her advocacy in human rights language — for problems occurring around the world.

France Terror Suspect Shouted ‘Allahu Akbar’ Before Attacking Christmas Market

Before he opened fire on a crowded Christmas market in Strasbourg, France on Tuesday, 29-year-old Cherif Chekatt yelled “Allahu Akbar,” Paris’ public prosecutor said Wednesday — the first official statement pegging the deadly shooting as an Islamic terror attack.

Though no groups have claimed responsibility for the attack, Islamic terrorists have a history of plotting assaults at Christmas markets — including one disrupted plot in which nearly a dozen militants sought to bomb the Strasbourg market around the millennium.

Chekatt escaped from the scene in a taxi, bizarrely bragging to the driver about being injured in a firefight with soldiers after killing 10 people, officials said. Police said three people were killed in the attack.

A wide-scale manhunt was underway near Strasbourg as the French government raised the security level and sent police reinforcements to the city, located about 305 miles east of Paris. But a top French official admitted Chekatt may no longer be in the city and could have slipped through the police dragnet into neighboring Germany, where he’d spent time in prison. . .

[Senior Interior Ministry official Laurent] Nunez said Chekatt had been radicalized in prison and was being monitored by French intelligence services since at least 2015 due to his suspected religious extremism. Authorities did not say which religion; however, supporters of the Islamic State terror group were celebrating the shooting online, according to the U.S.-based SITE Intelligence group, which monitors jihadi communications worldwide. Linda Sarsour Accuses Jews Who Oppose Anti-Semitic Muslim Congresswoman of Having Dual Loyalties

On Friday, Women’s March leader and anti-Semite extraordinaire Linda Sarsour, attacking Jews who pointed out the anti-Semitism of new Minnesota congresswoman Ilhan Omar, used a vicious and ancient anti-Semitic slur on Facebook, accusing Jews of having dual loyalties.

This week, Omar revealed in an interview with the “Muslim Girl” website that she supports the Boycott, Divestment and Sanctions movement (BDS) that targets Israel. As Jordan Schachtel of Conservative Review noted, “The statement marked a stark reversal from Omar’s previous position on BDS. Prior to the election, Omar told Minnesota Jews that she was opposed to the boycott movement. Aaron Bandler of The Jewish Journal reported Omar said that BDS wasn’t “helpful in getting that two-state solution … I think the particular purpose for [BDS] is to make sure that there is pressure, and I think that pressure really is counteractive. Because in order for us to have a process of getting to a two-state solution, people have to be willing to come to the table and have a conversation about how that is going to be possible and I think that stops the dialogue.”

Leading Pro-Abortion Activist Converts to Islam

Leading pro-abortion activist Sinead O’Connor has renounced Catholicism, converted to Islam and taken a new name.

“This is to announce that I am proud to have become a Muslim,” 51-year-old singer tweeted last week. “This is the natural conclusion of any intelligent theologian’s journey. All scripture study leads to Islam. Which makes all other scriptures redundant. . .

O’Connor was previously ordained as a Catholic priest by the Orthodox Catholic and Apostolic Church in the 1990s. In a Tuesday tweet, she shared a photo of herself dressed in the Muslim garb. . .

Last year, O’Connor underwent mental health treatment after speaking to Dr. Phil about her emotional struggles following suicide attempts.

“What kicked all of this off really was, I had a radical hysterectomy in Ireland two years ago and I lost my mind after that,” O’Connor shared. “And that’s what I think happened with my family, and we have to give my family credit. American Imam Deletes Post After Suggesting Sharia Law Should Apply in Weighing Dr. Ford Allegations

Imam Zaid Shakir, the Muslim-American co-founder of Zaytuna College in Berkeley, California deleted a post on his on his popular Facebook page after receiving backlash for suggesting Sharia law should be applied in judging if Dr. Christine Blasey Ford’s allegations against Judge Brett Kavanaugh are credible.

“I do not support the appointment of Judge Brett Kavanaugh to the Supreme Court of the United States,” he began. “My position, however, is based neither on the accusations nor the testimony of Dr. Christine Blasey Ford.” . . .

Shakir went on to explain that he believes Ford’s allegations “cannot be used as evidence against Judge Kavanaugh.” He based his reasoning on “Muslim teachings” from the Qur’an, citing verse 24:4 which says “Those who bring charges of sexual improprieties against chaste women, then fail to come forth with four corroborating witnesses, lash them eighty times and never again accept their testimony. Such are truly corrupt.” . . .

“The honor these verses are designed to protect is real, as are the condemnations they issue, as well as the punishments they threaten,” Shakir wrote. “If anyone can randomly produce vile accusations against anyone they please, and the only standard assessing the veracity of those accusations is our subjective feeling concerning the credibility of the accuser or the accused, none of us would be safe against the impugnment of his or her honor.”
