Jack Smith Wants Trump Trial to Start Jan. 2, 2024 — Right Before Iowa Caucuses

Special Counsel Jack Smith told a federal court in Washington, D.C., on Thursday that prosecutors want to start the trial of former President Donald Trump on January 2, 2024, right before the Iowa caucuses launch the Republican presidential primary.

Fox News reported:

Special Counsel Jack Smith proposed to begin former President Donald Trump’s trial in January 2024 for the charges he’s facing in relation to the events of Jan. 6, 2021.

“The Government proposes that trial begin on January 2, 2024, and estimates that its case in chief will take no longer than four to six weeks,” the filing on Thursday states.

As Breitbart News has noted, Trump faces four charges related to his challenges to the 2020 election result, and the resulting riot at the U.S. Capitol on January 6, 2021. Judge Skeptical of Constitutionality of Grand Jury in Trump Classified Documents Case in Florida

A federal judge pressed special counsel Jack Smith on Monday to explain why he used a D.C. grand jury to investigate the Florida-based case against former President Donald Trump for mishandling of classified documents.

U.S. District Judge Aileen Cannon is based in South Florida, where Mr. Smith filed an indictment against the former president and where the trial is expected. But the charges were brought based on the recommendation of a grand jury in Washington, causing Judge Cannon to question whether the move was constitutional.

In a brief order, Judge Cannon ordered prosecutors to “address the legal propriety of using an out-of-district grand jury proceeding to continue to investigate and/or seek post-indictment hearings on matters pertinent to the instant indicted matter in this district.”

Judge Cannon’s order was in response to the special counsel’s request for a hearing to examine a potential conflict of interest for an attorney for Walter Nauta, a Trump aide who has also been charged in the case. Trump Indicted by Special Counsel Jack Smith Over Bid to Overturn 2020 Election; Trump Lands Obama Judge Known for Harshest Jan. 6 Sentences

By New York Post. Former President Donald Trump was indicted Tuesday by special counsel Jack Smith, who charged the president with four counts in connection with his attempts to overturn the 2020 election.

According to Smith, the 77-year-old “pursued unlawful means of discounting legitimate votes and subverting the election results” in a desperate bid to stay in power after his defeat by Joe Biden.

Prosecutors charged that the 45th president’s incessant claims of election fraud costing him re-election “were false and [Trump] knew they were false.

Donald Trump Indicted: Assigned Judge Tanya Chutkan Known for Longest Jan. 6 Sentences

By Washington Examiner. Former President Donald Trump will face a federal judge in his alleged election subversion case who has a noted history of giving some of the lengthiest sentences to defendants involved in the Jan. 6 Capitol riot.

The case will be overseen by Judge Tanya Chutkan, an appointee of former President Barack Obama who has presided over several cases involving the Jan. 6 Capitol riot and is known to hand down sentences longer than what was recommended by prosecutors who brought the charges.

Out of a series of 11 riot-related cases Chutkan presided over, she imposed tougher sentences than those sought by federal prosecutors in seven instances and matched Department of Justice requests four times. All defendants wound up behind bars, according to an Associated Press review of sentences handed out to rioters.

For example, during a sentencing hearing in October 2021 for Texas resident Matt Mazzocco, who pleaded guilty to a misdemeanor charge for unauthorized entry into the Capitol building, the judge described the recommended sentence as too lenient. Irony: Jack Smith’s Team Admits Incorrectly Telling Court DOJ Turned Over All Materials

Special Counsel Jack Smith’s team admitted in a federal court filing in Miami this week that the government had not, in fact, given all of its evidence to the court for President Donald Trump’s defense team to review — the same thing Trump is alleged to have done.

Smith has charged Trump with 40 counts in the so-called “documents” case. Among them is the accusation that Trump caused his lawyers to tell the government that they had handed over all of the documents the government wanted, when in fact they had not.

The indictment against Trump alleges that he conspired with his staff to move boxes of documents, and to attempt to delete some video footage, without telling his attorneys, so that the final delivery of documents and video to the government was incomplete.

But in an ironic twist, Smith’s team had to admit to the court in a July 31 filing that it had not, in fact, uploaded all of the video footage that it had taken from Trump’s residence in Mar-a-Lago, Florida, to a platform established by the court for the defense to review it.

Special Counsel Adds New Charges Against Donald Trump; DOJ Adds Charges to Trump a Day After Sweetheart Hunter Biden Deal Exposed

By Breitbart. Special Counsel Jack Smith on Thursday brought new charges against former President Donald Trump in the Mar-a-Lago White House documents case.

Smith charged Trump with one count of willful retention of national defense documents and two counts of obstruction.

Trump’s valet, Walt Nauta, who was previously charged in the first indictment, also received two new obstruction-related charges.

The superseding indictment also charged Carlos De Oliveira, Mar-a-Lago’s head of maintenance, with altering, destroying, mutilating, or concealing a document, making false statements, and conspiracy to obstruct justice. (Read more from “Special Counsel Adds New Charges Against Donald Trump” HERE)

DOJ Adds Charges to Trump a Day After Sweetheart Hunter Biden Deal Exposed

By Breitbart. The Department of Justice (DOJ) added three charges to the prosecution against President Joe Biden’s main political opponent, one day after the DOJ’s sweetheart plea deal with the president’s son was exposed in court.

While critics of former President Donald Trump celebrated, the juxtaposition of these two events is certain to lend weight and urgency to the charge that the DOJ is rife with political bias and continues to be weaponized.

As Breitbart News reported, the plea bargain that DOJ prosecutors reached with Hunter Biden’s lawyers fell apart on Wednesday after Judge Maryellen Noreika questioned its terms. Specifically, she queried a clause in an annex to the agreement — which she was apparently only shown right before the hearing — that would have given Hunter Biden immunity from any further prosecution related to his lucrative foreign business dealings. . .

The following day, Special Counsel Jack Smith filed a superseding indictment against Trump that added three new charges, plus a new defendant, Mar-a-Lago property manager Carlos de Oliveira, to the original case.
