Obamacare’s Hierarchy of Privilege

On his radio show the other day, Hugh Hewitt caught me by surprise and asked me about running for the United States Senate from New Hampshire. My various consultants, pollsters, PACs, and exploratory committees haven’t fine-tuned every detail of my platform just yet, but I can say this without a doubt: I will not vote for any “comprehensive” bill, whether on immigration, health care, or anything else.

“Comprehensive” today is a euphemism for interminably long, poorly drafted, and entirely unread — not just by the people’s representatives but by our robed rulers, too (how many of those Supreme Court justices actually plowed through every page of Obamacare when its “constitutionality” came before them?). The 1862 Homestead Act, which is genuinely comprehensive, is two handwritten pages in clear English. “The Patient Protection and Affordable Care Act” is 500 times as long, is not about patients or care, and neither protects the former nor makes the latter affordable.

So what is it about? On Wednesday, the Nevada AFL-CIO passed a resolution declaring that “the unintended consequences of the ACA will lead to the destruction of the 40-hour work week.” That’s quite an accomplishment for a “health” “care” “reform” law. But the poor old union heavies who so supported Obamacare are now reduced to bleating that they should be entitled to the same opt-outs secured by big business and congressional staffers. It’s a very strange law whose only defining characteristic is that no one who favors it wants to be bound by it.

Meanwhile, on the very same day as the AFL-CIO was predicting the death of the 40-hour week, the University of Virginia announced plans to boot working spouses off its health plan beginning January 1 because the Affordable Care Act has made it unaffordable: It’s projected to add $7.3 million dollars to the university’s bill in 2014 alone.

As Nancy Pelosi famously said, “We have to pass the bill so that you can find out what’s in it.” But the problem with “comprehensive” legislation is that, when everything’s in it, nothing’s in it. The Affordable Care Act means whatever President Obama says it means on any particular day of the week. Whether it applies to you this year, next year, or not at all depends on the whim of the sovereign, and whether your CEO golfs with him on Martha’s Vineyard. A few weeks back, the president unilaterally suspended the law’s employer mandate. Under the U.S. Constitution, he doesn’t have the power to do this, but judging from the American people’s massive shrug of indifference he might as well unilaterally suspend the Constitution, too. Obamacare is not a law, in the sense that all persons are equal before it, but a hierarchy of privilege; for example, senators value their emir-sized entourages and don’t want them to quit, so it is necessary to provide the flunkies who negotiated and drafted the Affordable Care Act an exemption from the legislation they imposed on the citizenry. Once again, the opt-out is not legal. As the Wall Street Journal trenchantly observed, “OPM has no authority to pay for insurance plans that lack FEHBP contracts, nor does the Affordable Care Act permit either exchange contributions or a unilateral bump in Congressional pay in return for less overall compensation.”

GOP: In the Weekly Republican Address, Gov. Mike Pence of Indiana discusses how Obamacare is “costing jobs, discouraging investment, and making the future bleak for too many families” nationwide. Unlike the Washington-knows-best mandates in Obamacare, Gov. Pence explains how his state has “lowered costs and improved outcomes” by “letting freedom and personal responsibility work together” through “a nationally–recognized program called the Healthy Indiana Plan.”

Sebelius Says Amnesty Needed to Increase Obamacare Enrollment

Speaking Thursday at an event in Philadelphia, hosted by a Latino community service group, Secretary of Health and Human Services (HHS) Kathleen Sebelius revealed that the success of ObamaCare is dependent upon the passage of comprehensive immigration reform and amnesty.

Susan Jones at CNS News reported Friday that, when asked if the Affordable Care Act (ObamaCare) will help “undocumented individuals,” Sebelius responded that it would not, and that this is the reason why immigration reform is so important.

“Well, the (Obamacare) bill is crafted in such a way that those who are undocumented will not have access to the tax credits or shopping in the (health insurance) marketplace,” Sebelius told Latinos at an event sponsored by Congreso. “That has been limited, which is, frankly, why — another very keen reason why we need comprehensive immigration reform.”

Sebelius went on to say, “Unfortunately, you can’t fix – we won’t fix the immigration system, unfortunately, through the health care bill, but I think having the immigration bill that passed the Senate, pass the House, would be a huge step.”

The immigration bill that passed the Senate would allow at least 11 million illegal immigrants a path to citizenship. First, however, they would gain provisional legal status.

Delta Warns ObamaCare Will Drive $100 Million Spike in Health Care Costs

Delta Air Lines has issued an urgent warning about the impact of ObamaCare, claiming the law’s implementation will contribute to a roughly $100 million increase in health care costs next year alone.

The astonishing figure was included in a letter from Delta executive Robert Kight to officials in the Obama administration. The website RedState.com was the first to obtain and publish the letter earlier this week.

A representative with Delta confirmed the authenticity of the letter to FoxNews.com.

“Like many large companies, Delta faces significantly increased healthcare costs in 2014 and beyond,” the company said in a statement on Friday. “Delta will absorb the vast majority of those increased costs so that we can continue providing a high value, high quality health plan. Consistent with our culture, Delta will always keep the best interests of our people in mind in connection with the healthcare and other benefits we provide.”

In the original letter, Kight disputes the notion that the law — the biggest parts of which take effect at the start of 2014 — will mean “business as usual” for big employers. A combination of factors, he claimed, will “mean that the cost of providing health care to our employees will increase by nearly $100,000,000 next year.”

Employers Dropping Coverage for Thousands of Spouses Over ObamaCare Costs

Republican lawmakers are raising new concerns about ObamaCare after several large employers announced they are dropping health coverage for some employee spouses due to rising costs under the new law.

Both the University of Virginia and UPS told their employees recently they are no longer offering spousal coverage to those able to obtain insurance elsewhere; meaning thousands of Americans will no longer be able to choose the benefits they prefer.

UVA said Wednesday this is only one of many “major changes” coming to their health plans as a result of ObamaCare. The university says the changes are necessary because the law is projected to add $7.3 million to the cost of the university’s health plan in 2014 alone.

“The modified plan will provide new options and reward those who participate in wellness programs,” UVA’s Vice President and Chief Human Resources Officer Susan Carkeek said in a press release. “But we must make adjustments or face millions of dollars in rising costs, fees and taxes that would be passed along to employees.”

Similarly, UPS partially blamed the new health law for the change, which is estimated to affect roughly 15,000 employee spouses.

Feds are Building a Detective Squad to Target Consumers and Companies that Don’t Follow Obamacare’s Rules

More than 1,600 new employees hired by the U.S. Department of Health and Human Resources in the aftermath of Obamacare’s passage include just two described as ‘consumer safety’ officers, but 86 tasked with ‘criminal investigating’ – indicating that the agency is building an army of detectives to sleuth out violations of a law that many in Congress who supported it still find confusing.

On the day President Obama signed the Affordable Care Act into law in 2010, HHS received authority from the Office of Personnel Management (OPM) to make as many as 1,814 new hires under an emergency ‘Direct Hiring Authority’ order.

The Obama administration ordered that employment expansion despite a government-wide hiring freeze.

A total of 1,684 of those positions were filled. An analysis by MailOnline shows that at 2010 federal government salary rates, the new employees’ salaries alone cost the U.S. at least $138.8 million every year.

Had the agency filled all its available jobs, that cost would have been a minimum of $159 million.

UPS Drops Health Insurance for Employee Spouses, Blames Obamacare

United Parcel Service, the nation’s largest package delivery company, plans to drop health insurance coverage for thousands of employees’ spouses in a cost-cutting move it blames partially on President Obama’s health care law.

Of 33,000 spouses on UPS’s plan, about 15,000 are eligible for health coverage through their own employers and won’t be covered by the company beginning next year, according to a memo to employees published by Kaiser Health News.

Since the Affordable Care Act requires employers to provide affordable coverage, the shipping giant says those 15,000 spouses should be covered by their own employer “just as UPS has a responsibility to offer coverage to you, our employee,” the memo said. “Limiting plan eligibility is one way to manage ongoing health care costs.”

UPS said the coverage shift is “consistent with the way many large employers are responding to the costs associated with the health-care reform legislation.”

Cruz: Ignore Media, GOP ‘Can Win’ Defunding Obamacare Argument

ted cruz immigrationAt a spirited town hall today, Senator Ted Cruz pushed for Obamacare to be defunded in the upcoming spending bill.

“Our friends in the media like to tell us this is not a fight we can win,” Cruz told attendees at the event which was sponsored by Heritage Action. “Let me tell you how we win this fight. The house of representatives will pass a continuing resolution that funds everything, everything in its entirety, except Obamacare.”

“What happens next is President Obama and Harry Reid are going to scream and yell ‘Those mean nasty Republicans are threatening to shut down the federal government,’” Cruz continued. “What has to happen after that is we’ve got to do something conservatives haven’t done in a long time. We’ve got to stand up and win the argument.”

DeMint: Republicans Unwilling to Defund ObamaCare ‘Need to be Replaced’

Jim DeMintFormer Sen. Jim DeMint (R-S.C.) on Monday night urged voters to replace any Republican lawmaker unwilling to vote to defund ObamaCare during next month’s budget showdown.

DeMint, the president of the Heritage Foundation, dismissed fears that Republicans would be blamed for a government shutdown, as they were in the 1990s.

“The risk of that is so much less than the risk to our country if we implement ObamaCare, and so I’m not as interested in the political futures of folks who think they might lose a showdown with the president,” DeMint said at a town-hall meeting hosted by Heritage Action, the think tank’s political arm, in Fayetteville, Ark., the first stop on a nine-city tour.

DeMint said President Obama believes he has the upper hand in the coming fight.

“I think he knows that Republicans are afraid, and if they are, they need to be replaced,” DeMint told NPR in an interview after the event.

Former Florida Congressman Allen West blasts President Obama’s assertion that health insurance is every American’s right. He adds that the President’s selective enforcement of the law not only in implementing the provisions of Obamacare, but other laws according to his whim is a dangerous threat to the existence of America as a constitutional republic.

West points out ultimately our rights come from God and not government, a truth enshrined in the Declaration of Independence. If government is the source of our rights, it can grant and take them away at will.

West also discusses how problematic it is that Obamacare’s “navigators” will have full access to people’s medical background and financial information. He hits on many other interesting issues in this interview with Greta Van Susteren.
