Judge Issues Stay Against Vaccine Mandate for Navy Seals Seeking Religious Exemption

A federal judge granted a temporary injunction Monday against a federal vaccine mandate for Navy SEALs, who sued President Biden because they were seeking a religious exemption.

Judge Reed O’Connor, the U.S. District Court Judge for the Northern District of Texas, issued the stay in response to a lawsuit filed by First Liberty Institute in November on behalf of 35 active-duty SEALs and three reservists seeking a religious exemption, as first reported by Fox News Digital.

“The Navy service members in this case seek to vindicate the very freedoms they have sacrificed so much to protect. The COVID-19 pandemic provides the government no license to abrogate those freedoms. There is no COVID-19 exception to the First Amendment,” O’Connor wrote in his ruling. “There is no military exclusion from our Constitution.”

The SEALs represented in the lawsuit were all members of various Christian denominations and objected to the vaccine mandate based on “their sincerely held religious beliefs,” claiming the military was violating their constitutional rights.

Businesses, 27 States to Supreme Court: Strike Down Biden OSHA Vaccine Mandate

Numerous business groups, organizations, and even 27 states recently filed emergency requests asking the U.S. Supreme Court to resolve the split between federal appeals courts on the legality of President Joe Biden’s vaccine mandate for businesses with 100-plus employees.

Supreme Court Justice Brett Kavanaugh on Monday asked the federal government to respond to each of the petitions by December 30 at 4:00 pm, creating the possibility that the completed applications could be circulated to the other eight justices in time to issue a decision before Christmas.

The applicants are asking the justices for a stay while litigation is ongoing challenging Biden’s coronavirus vaccine mandate, which goes into effect on January 4. The 27 states and several other applicants are additionally requesting their filings be considered a petition for writ of certiorari, meaning they are asking the Supreme Court to take up the case this term.

“In addition and in the alternative, the Court should treat this application as a petition for certiorari before judgment and grant immediate review of the Vaccine Mandate’s legality,” the states’ emergency application reads. Report: Los Angeles Firefighter Allegedly Pulled Down His Pants and Wiped His Butt With a Vaccine Mandate Order

A Los Angeles firefighter allegedly pulled down his pants at a fire station and wiped his butt with a vaccine mandate order, and many are calling for him to be dismissed. . .

A spokesperson for the Los Angeles Fire Department said they were investigating what they said was an inappropriate response from the firefighter.

“The department is aware of the seriousness of the allegations and took immediate action upon learning of this incident,” said LAFD spokesperson Cheryl Getuiza, who confirmed the alleged incident occurred on Nov. 18.

OSHA Suspends Biden Vaccine Mandate After Legal Pushback

The U.S. Labor Department’s Occupational Safety and Health Administration has suspended the implementation and enforcement of its controversial vaccine mandate just days after a federal court temporarily blocked the rule, citing “grave statutory and constitutional issues.”

OSHA announced it would “suspend activities related to the implementation and enforcement of the [Emergency Temporary Standard] pending future developments in the litigation,” according to OSHA’s website.

The administration’s backdown comes less than a week after the U.S. Court of Appeals for the Fifth Circuit issued and reaffirmed an explosive motion to freeze the vaccine mandate prompted by the Biden administration. On Nov. 12, the court ordered that OSHA “take no steps to implement or enforce” the mandate “until further court order.”

The rule affects more than 80 million working Americans, 31.7 million of whom are unvaccinated, and requires employers with 100 or more workers to mandate the vaccine or weekly testing. Biden Admin to Employers: Ignore Court Order and Proceed With Vaccine Mandate

A federal appeals court has ordered a halt to President Biden’s vaccine mandate on larger private businesses, but the White House is telling businesses to move ahead with the plan anyway.

“People should not wait,” Biden Deputy Press Secretary Karine Jean-Pierre told reporters at the White House briefing Monday.

“What we continue to advocate from here is to push businesses to move forward with their policies now.”

She described the mandate as “an obligation that the Department of Labor has to protect workers who face grave danger.”

The U.S. Court of Appeals for the 5th Circuit ordered a temporary halt on Saturday, ruling the complaint gives “cause to believe there are grave statutory and constitutional issues with the Mandate.” (Read more from “Biden Admin to Employers: Ignore Court Order and Proceed With Vaccine Mandate” HERE)

Dozens of Seattle city police officers and firefighters traipsed up steps to City Hall on Tuesday and turned in their boots after being discharged from service for their refusal to take the COVID-19 vaccine, as they were mandated to do.

Video footage posted online shows several people, many with boots in hand and some donning firefighting helmets, walking up steps to the building.

Southwest Cancels Hundreds More Flights — Is Vax Mandate To Blame?

Southwest Airlines canceled hundreds more flights Monday after the airline was forced to ground nearly 2,000 flights over the weekend, blaming the issues on weather and staffing amid speculation that the debacle is tied to the company’s recent COVID-19 vaccine mandate.

The world’s largest low-cost carrier canceled almost 350 flights — or one in ten scheduled departures — as of Monday at 7 a.m. ET, according to data from Flight Aware. That marks the highest cancellation rate of any major US airline by far, according to the site.

More than 300 other Southwest flights were facing delays, the site’s data showed.

The airline’s latest woes come after it had to ground more than 25 percent of its scheduled flights on Sunday. . .

The mass cancelations and delays on the busy Columbus Day weekend come after the airline announced last week that it would require all of its employees to get the COVID-19 vaccine, as called for by President Biden earlier this year. Employees must get vaccinated before Dec. 8 or face termination. The Dallas, Texas-based airline has approximately 56,000 employees.
