Insanity: Ninth Circuit Finds Constitutional Right for Some Aliens to Appeal Deportation Orders

On Thursday, a unanimous three-judge panel of the U.S. Court of Appeals for the Ninth Circuit found that asylum seekers at the U.S.-Mexico border who fail their initial threshold of showing a “credible fear” of persecution in their home countries are entitled to a judicial appeal before they can be deported. The decision could severely undermine the Trump Administration’s efforts at securing the border and expeditiously deporting frivolous would-be aslyees in California and Arizona, which are both border states under the jurisdiction of the Ninth Circuit.

The Ninth Circuit looked back at cases dating to the 1700s, determining that under review procedures set by the U.S. Supreme Court in a 2008 case known as Boumediene and by legal precedent set in several immigration cases dating back to the 1950s, Thuraissigiam should be covered by the suspension clause [of tbe U.S. Constitution] because he was arrested in the United States, according to the opinion.

The court went on to hold that a procedure that would not allow the California court to review the immigration judge’s determination in Thuraissigiam’s case would be unconstitutional, according to Thursday’s opinion.

“We … reject the government’s contention that because, in its view, Thuraissigiam lacks due process rights, there are no rights for the suspension clause to protect,” the opinion read. “Boumediene foreclosed that argument by holding that, whether or not due process was satisfied, the suspension clause might require more.”

Judge Pushes Back Deadline for Billionaire Pedophile Epstein Victims’ Case

By Breitbart. A federal judge has pushed back a deadline in a case against Jeffrey Epstein, a wealthy Florida financier convicted of prostitution charges who now may face new litigation from women who claim to have been a part of a sex trafficking operation of underage girls in the early 2000s.

U.S. District Judge Kenneth Marra allowed the extension on Thursday, the Association Press (AP) reported, and the report included Labor Secretary Alex Acosta’s connection to the case. . .

After President Donald Trump nominated Acosta, he said that the agreement was appropriate to make sure Epstein was convicted and spent some time behind bars. The deal also required Epstein, 66, to register as a sex offender.

“At the end of the day, based on the evidence, professionals within a prosecutor’s office decided that a plea that guarantees someone goes to jail, that guarantees he register generally [as a sexual predator] and guarantees other outcomes, is a good thing,” Acosta said at his 2017 Senate confirmation hearing. . .

The Herald, along with filmmaker Mike Cernovich, and Harvard law professor Alan Dershowitz — who was on Epstein’s defense team — have asked for the sealed documents in the case to be released to allow the truth about Epstein’s misdeeds, efforts to help him, and the nature of the abuse his victims suffered become public knowledge. Fresh court battle could expose more details in Acosta’s controversial Epstein plea deal

A federal appeals court panel signaled Wednesday that it is strongly inclined to set in motion a process likely to expose more sordid details in the politically charged scandal surrounding Jeffrey Epstein, the wealthy financier and philanthropist whose relatively cushy plea deal on underage-sex charges a decade ago has become a political liability for Labor Secretary Alex Acosta.

Sparks flew during arguments before the 2nd Circuit Court of Appeals in Manhattan as a lawyer for Virginia Roberts Giuffre, an Epstein accuser, repeatedly reiterated his client’s claim leveled several years ago that the Harvard law professor Alan Dershowitz not only defended Epstein but also had sex with some of the women Epstein victimized.

Giuffre’s attorney Paul Cassell, a former federal judge, told the three-judge panel that his client favored a “broad unsealing” of the records in a suit that Giuffre brought against Ghislaine Maxwell, an Epstein friend accused of helping procure girls for Epstein and others to engage in sexual activity.

Democrat Extremism Might Mean a 2020 Red Wave

In a sudden reversal of fortune, Democrat extremism is putting President Trump and congressional Republicans on sound footing for the 2020 elections.

Just a few months ago, Democrats were flying high after taking over the House of Representatives by making big strides with suburban voters, including key battleground states such as Pennsylvania.

Part of the winning strategy for Democrats running in moderate districts was to distance themselves from then-House Minority Leader Nancy Pelosi, D-Calif., to counter Republican messaging that a vote for a Democrat was essentially a vote for a left-wing speaker of the House.

Democrats understood that left-wing political extremism would not sell in swing districts, but now the discipline of the 2018 midterm election is being thrown out the window. The mask of moderation is being torn off, exposing Democrat extremism.

Thanks to newly elected representatives and recently announced 2020 presidential candidates, lurching too far Left is branding Democrats as the political party supporting socialism.

A Harvard CAPS/Harris Poll reported that 64 percent of registered voters believe the Democrat Party supports socialism. More concerning for Democrats, the poll also revealed 65 percent of the respondents backed a “mostly capitalistic” economic system, in contrast to 35 percent supporting a “mostly socialist” economic model.

It gets worse for Democrats. An NBC News/Wall Street Journal poll reported only 18 percent of Americans view socialism positively. The poll also reported only 25 percent of respondents were “enthusiastic/comfortable” with a socialist candidate, in contrast to 72 percent who had “reservations/very uncomfortable” with a socialist running for president.

The socialism label is extremely damaging to Democrats, and President Trump is using his communication skills and platform to drive the message home as part of the 2020 presidential race.

During his State of the Union address, President Trump drew a sharp line with Democrats by declaring, “America will never be a socialist country,” and the president repeated the anti-socialism message at CPAC. He zeroed in on socialism, defining it as a tool for the “power of the ruling class” and said “the future does not belong to those who believe in socialism.”

Democrats’ socialism is driven by media star freshman Rep. Alexandria Ocasio-Cortez, D-N.Y., who is advocating for taxing high-income Americans and pushing for government takeover of the economy under the cloak of addressing climate change through the Green New Deal.

2020 presidential hopefuls Sens. Elizabeth Warren, D-Mass., Kamala Harris, D-Calif., and the godfather of Democrat socialism, Bernie Sanders, I-Vt., are also calling for a huge expansion of government, ranging from Medicare for all to free college.

Socialist branding is only part of the emerging problem for Democrats. The fight over illegal immigration, border security, and construction of the border wall is putting Democrats on the wrong side of safety and security, a core human value.

For years, Democrats used the safety and security of Americans as justification for a range of environmental, food, and drug regulations, but during the President Trump era, that theme is cast aside.

A Zogby Analytics Poll reported that suburban women, whom Republicans lost during the 2018 midterm elections, support the wall. The poll reported 45 percent of suburban women supported the construction of the border wall through other sources of funds beyond the amount provided by Congress, while 40 percent opposed the alternative funding approach.

Extreme positions on immigration, such as defunding U.S. Immigration and Customs Enforcement (ICE), advocated by Ocasio-Cortez, her freshman colleague Rep. Rashida Tlaib, D-Mich., and Democrat 2020 presidential candidates, will alienate suburban women voters.

The media’s attention to the Democrat freshmen and presidential candidates guarantee the extremist position on ICE will be widely covered by news outlets. Democrat calls to abolish ICE ignore the role the agents play in removing MS-13 gang members who threaten suburban communities.

Finally, the latest information from U.S. Customs and Border Protection documents a surge of illegal crossings, with 66,400 arrests in February, the most for that month in almost a dozen years. In addition, Border Patrol agents have arrested 136,150 people in the last five months, more than the 107,212 arrested during government’s 2018 fiscal year.

According to CBP Commissioner Kevin McAleenan, the wave of people swarming into the U.S. threatens to collapse the system.

Trump Slams ‘Anti-Israel’ Democratic Party

President Trump spoke to reporters Friday before departing for Alabama and was asked about the “sham” resolution that was passed Thursday to protect Rep. Ilhan Omar, D-Minn., and the Democratic Party’s increasing anti-Semitism.

“I thought yesterday’s vote by the House was disgraceful. Because the Democrats have become an anti-Israel party. They’ve become an anti-Jewish party,” the president said.

The president is headed to Alabama to survey the damage after devastating tornadoes hit the state, resulting in 23 deaths and injuries to dozens more. Some 36 tornadoes touched down in Alabama last weekend, wreaking havoc across the state. The president has instructed FEMA to devote substantial resources towards recovery efforts. Ending U.S. War Games With South Korea Will Help Prevent War

“The reason I do not want military drills with South Korea is to save hundreds of millions of dollars for the U.S. for which we are not reimbursed,” President Trump tweeted Sunday of his administration’s decision to end large-scale war games with South Korean forces. “Also,” Trump added, “reducing tensions with North Korea at this time is a good thing!” In a follow-up tweet Monday, he redoubled the argument from thrift, insisting the move was not discussed during his recent second summit with North Korean leader Kim Jong-un and that anyone saying otherwise is “FAKE NEWS.”

The savings here are not inconsequential—the Pentagon estimates the two annual exercises in question cost about $14 million each—but are easily overshadowed by the more than $800 million the Defense Department spends annually to station U.S. troops in South Korea, to say nothing of the Pentagon’s $700 billion annual budget. But for all Trump downplayed it, the strategic rationale here is more important than the money: It is good to reduce tensions with North Korea, and ending these drills is a positive step toward that end.

That’s why this move comes with South Korean support—indeed, at Seoul’s request. It should be one piece of a broader strategy of Korean-led diplomacy which prioritizes concrete shifts toward peace and normalcy over creation of a tidy but unrealistic denuclearization deal.

This requires a sharp shift away from the rut in which U.S.-North Korean relations have floundered across multiple decades and presidencies. It rejects conceptualizing the United States as the “indispensable nation,” to borrow the Clinton administration’s infamous phrase, and hands the diplomatic reins to our South Korean partners. While Trump’s latest meeting with Kim seems to have done little to move negotiations along, ongoing conversations between Seoul and Pyongyang have racked up a steady stream of small but significant wins over the last year.

Guiding talks with North Korea is a task to which South Korea is uniquely suited in terms of cultural and physical proximity alike. The obscene destruction South Korea would suffer should war break out—far more serious than anything Kim could hope to inflict on the United States—necessitates an invaluable prudence and patience in Seoul’s negotiating which Washington seems incapable of reproducing. SHOCKER! Convicted Liar Michael Cohen Wasn’t Truthful in His Congressional Testimony About Trump; Attempts to Hit Trump In A BIG Way

By Townhall. President Trump’s former lawyer Michael Cohen testified before Congress last week. It was a clown show. The man is a convicted liar. He’s slated to start his four-year jail sentence shortly. It was a back-and-forth between Democrats who somehow think this guy is now Mr. Reformed and a credible witness in their ongoing crusade to impeach the president. Republicans kept brining up his convictions, which include lying to Congress (via NYT):

Michael D. Cohen, a former lawyer for President Trump, was sentenced to three years in prison on Wednesday after denouncing Mr. Trump and explaining that “I felt it was my duty to cover up his dirty deeds.”

Mr. Cohen gave an emotional apology to the court for his involvement in a hush-money scandal that could threaten the Trump presidency — a scheme to buy the silence of two women who said they had affairs with Mr. Trump to protect his chances before the 2016 election. Mr. Cohen said his blind loyalty to Mr. Trump led him to ignore “my own inner voice and my moral compass.”

The sentencing in federal court in Manhattan capped a startling fall for Mr. Cohen, 52, who had once hoped to work by Mr. Trump’s side in the White House but ended up a central figure in the inquiry into payments to an adult-film star and a former Playboy model before the 2016 election.

Michael Cohen Sues the Trump Organization

By CNN. President Donald Trump’s former personal attorney, Michael Cohen, sued the Trump Organization on Thursday, saying that after Cohen began cooperating with federal investigators, the company failed to fulfill its contractual obligations to indemnify him or pay his legal bills relating to his work for the firm.

Cohen — an executive at the Trump Organization until early 2017, when he left that post to work as Trump’s personal attorney — alleged in the lawsuit the company is obligated to pay both his legal bills, which now total at least $1.9 million, and another $1.9 million he owes as part of a criminal sentence he received late last year. According to This Fox Host, Trump Has Lost His Way: ‘Never Forget Who Your Friends Are’

One of Donald Trump’s most vociferous champions has turned on the president, accusing him of cosying up to corporate CEOs who are trying to “destroy him and his policies.”

Fox Business host Lou Dobbs was critical of the meeting Trump held on Wednesday with the American Workforce Policy Advisory Board, comprising of business big hitters like Apple chief Tim Cook and the head of the U.S. Chamber of Commerce, Tom Donohue.

The board is chaired by Trump’s daughter Ivanka and commerce secretary Wilbur Ross and is focused on issues like lowering unemployment and preparing for the shift toward automation and artificial intelligence in the workplace. . .

“In what should have been a reminder to the president’s counselors that in politics as in life it is important to never forget who your friends are,” Dobbs said.

Chinese-Style Infanticide Comes to the U.S.

Communist Party officials fanned out across the country arresting young mothers—some seven, eight, or even nine months along–for the crime of being pregnant. These were taken to clinics where their unborn babies were given “poison shots” while still in the womb. Cesarean sections to remove the now dead or dying infants followed. . .

I was deeply shocked by Beijing’s crimes against mothers and babies, and left China determined to call attention to their plight. Years of conferences, campus speeches, and media interviews followed. My testimony helped convince Congress to cut funding—through the U.N. Population Fund–to China’s horrific program. I am proud to say that funding cut-off remains in place today.

I had long been certain that the kinds of atrocities I had witnessed in China could never, ever happen here. In communist China, yes, but not in democratic America. Not in the land of the free and the home of the brave. . .

It was the Democrat governor of Virginia, Ralph Northam, who first alerted me to the possibility that I might be mistaken about the character of my country. In a bizarre radio interview, Northam extended the “right to choose” past the point of childbirth, saying that babies could be killed—by medical neglect—after they were born. . .

Watching the Senate endorse infanticide, I felt as though I had suddenly been transported to another country—a country with no history of respect for human rights, a country whose written constitution was just a piece of paper to be shredded at will by a handful of powerful men and women, a country where the strong trampled on the rights of the weakest members of society. Transgender — Who Was Impregnated by Gay Partner — Gives Birth

Wyley — who was born female — had been on testosterone treatments and sports a beard, deeper voice, and has had breast-removal surgery. But Wyley still possessed a vagina.

Stephan learned about Wyley’s female genitalia after the couple met on the gay dating app Grindr, and their relationship proceeded anyway — but the lingering question was, “Can Wyley become pregnant?” . . .

But then Wyley started experiencing “morning sickness” and then learned of the pregnancy at 11 weeks — a circumstance that “definitely was not planned,” Wyley said, adding that “I am a man, and I am actually pregnant.” . . .

Now Wyley Simpson and Stephan Gaeth — who revealed their last names for a KENS-TV report — have a baby they’ve named Rowan Fox. . .

Paul Manafort Was Sentenced. Here’s How Long He’ll Spend in Prison.

Former Trump campaign chairman Paul Manafort was sentenced to 47 months in prison at a hearing in an Alexandria, VA courthouse Thursday for bank and tax fraud.

As a part of special counsel Robert Mueller’s investigation into Russian collusion, investigators discovered that Manafort failed to report $16.5 million in income for political consulting work on behalf of Ukraine. They also found he dodged taxes on that income and failed to report foreign lobbying. The crimes were unrelated to his time serving in the Trump campaign.

“Manafort acted for more than a decade as if he were above the law, and deprived the federal government and various financial institutions of millions of dollars,” prosecutors wrote in a court filing. “The sentence here should reflect the seriousness of these crimes, and serve to both deter Manafort and others from engaging in such conduct.” (Read more from “Paul Manafort Was Sentenced.
