By Yahoo News. Brass Against, a band known for performing brass versions of rock songs, has issued an apology after its lead singer peed on a fan’s face at a festival in Daytona Beach last week.

Yes, you read that right. During a set at Welcome to Rockville on Thursday night, singer Sophia Urista pulled down her pants on stage and peed on a (surprisingly willing) fan mid-song. On Friday, the band posted an apology on Twitter, assuring fans that it wasn’t a planned stunt. . .

During the performance, Urista grabbed a bottle of water, and noted that the show would be closed out with her relieving herself on someone in the audience once she drank it all.

“Get my man with the can on his head ready, ’cause we’re going to bring him onstage and I’ma piss in this motherf—er’s mouth,” she said.

A few minutes later, the man indeed climbed onto the stage, with an apparently empty can attached to his forehead. He laid down flat on his back on stage, prompting Urista to straddle his head, slide her pants down, and pee into the can — or at least, aim for it. Band Won’t Be Charged for Incident at Welcome to Rockville in Daytona

By The Daytona Beach News-Journal. When Brass Against singer Sophia Urista urinated on a willing fan onstage during the Welcome to Rockville music festival, the incident generated worldwide publicity for the band, but it appears that it won’t result in any charges being filed by police.

“No incident report was created because we didn’t actually speak to the reporting party,” said Messod Bendayan, Daytona Beach Police spokesman. According to police records, a call to a dispatcher about the incident was received at 9:49 a.m. Saturday morning.

The caller, who identified herself as Nicole Shields, advised dispatchers that the singer had urinated on the fan on stage and wondered “if there are ramifications for this,” as her 16-year-old daughter was there to witness the event, according to dispatch records.

Washington Post Columnist Ripped to Shreds for Suggesting Unvaccinated Be Prosecuted: ‘This Is Demented Beyond Words’

Longtime Washington Post columnist Gene Weingarten was castigated online for suggesting that those who are not vaccinated against COVID-19 should be prosecuted.

Throughout the COVID-19 pandemic, Weingarten has expressed disdain to Americans who did not receive the coronavirus vaccine.

“It is hard but not impossible to refrain from hating the stupidly unvaccinated, people who are dragging us back into pandemic,” the WaPo columnist wrote on Twitter in July. “It is impossible, however, to refrain from feeling contempt for them.” . . .

Weingarten even attacked those who are “vaccine-hesitant” in a Sept. 9 column titled: “I have a better term for the ‘vaccine-hesitant.’” In the piece, Weingarten denigrates vaccine-hesitant individuals as “ignorant people,” “idiots,” and “incredibly stupid people.”

On Thursday, Weingarten took it to another level by asking, “Is there a point at which the ‘unvaccinated’ need to be prosecuted?”

Rittenhouse Trial: Prosecution Big Win on “Provocation” Jury Instruction Saves Chance at Conviction

Much of the [Friday’s] argument over jury instructions centered on the instructions dealing with the legal doctrine of provocation—and that’s because an attack through the doctrine of provocation is the only desperate hope the State has for overcoming Kyle’s powerful claim of self-defense and obtaining convictions on the use-of-force charges against him.

Of the six counts brought against Kyle Rittenhouse in this trial, five are use-of-force felonies (the other is the misdemeanor gun possession charge already discussed). To each of those felony charges, Kyle has raised the legal defense of self-defense. To convict on any of those, then, the State must disprove self-defense beyond a reasonable doubt. How might the State do this, given that it has introduced little if any evidence attacking the core elements of Kyle’s self-defense? By attacking Kyle’s claim of self-defense through the doctrine of provocation. . .

Simple provocation occurs when the defendant engages in unlawful conduct likely to provoke a violent response. When that violent response occurs, the simple provoker cannot claim self-defense for resistance until they exhaust every possibility of avoiding the need to use force, including retreat–where a duty to retreat would not exist in an otherwise lawful act of self-defense.

Provocation with intent occurs when the defendant deliberately provokes a violent response, with the intent of then having an excuse to use deadly force against the person provoked. Importantly, the provoker with intent cannot regain self-defense by withdrawal and communication—on the other hand, the State must prove that malicious intent beyond a reasonable doubt. . .

For example, the State may argue that Kyle was a simple provoker who committed an unlawful act by pointing his rifle at Joshua Ziminski, thus provoking a reasonably foreseeable violent response from Rosenbaum. Although Kyle then fled, the prosecution would argue that he could have fled further than he did, and thus failed to exhaust every possible means of avoiding having to use defensive force. This would mean he had not regained the privilege of self-defense that he lost by his simple provocation. Report: Unvaccinated Senior NIH Doctor Told Fauci Forced Vaccinations Are ‘Extraordinarily Problematic’, Plans to Fight Biden’s Mandate

A top infectious disease doctor, director of a research team at the National Institutes of Allergy and Infectious Disease — which Dr. Anthony Fauci heads — has reportedly been outspoken in his opposition to forced vaccinations. Dr. Matthew Memoli, a 16-year veteran at the National Institute of Health, allegedly informed Fauci in the summer that vaccine mandates are “extraordinarily problematic.”

Memoli – who recently received a 2021 NIH director’s award for his supervision of a national study into undiagnosed COVID-19 cases early in the pandemic – purportedly emailed Fauci on July 30 regarding the COVID-19 vaccines, according to the Wall Street Journal.

“I think the way we are using the vaccines is wrong,” Memoli allegedly told Fauci, adding that vaccine mandates are “extraordinarily problematic.”

Memoli believes that the COVID-19 vaccines should be reserved for the most vulnerable, such as obese people and the elderly. He reportedly said that widespread inoculations against coronavirus could hamper people’s ability to develop natural, robust protection against the virus through infection. . .

Elizabeth Warren Is Sued for Violating First Amendment Over Amazon Book Censorship Calls

A lawsuit has been filed against Sen. Elizabeth Warren (D-MA) because of a letter she sent to Amazon, accusing the Big Tech giant of “peddling misinformation.”

The lawsuit claims she violated the First Amendment by sending the letter.

In September, Sen. Warren sent a letter to Amazon accusing it of peddling misinformation by promoting books spreading “falsehoods” about COVID-19. She said that the retailer’s algorithms had been recommending books promoting what she thinks is the wrong type of treatment.

“This pattern and practice of misbehavior suggests that Amazon is either unwilling or unable to modify its business practices to prevent the spread of falsehoods or the sale of inappropriate products—an unethical, unacceptable, and potentially unlawful course of action from one of the nation’s largest retailers,” Warren wrote in the letter. . .

The publishers and authors of the book, along with Robert F Kennedy Jr, have jointly filed a complaint at the Western District of Washington court, accusing Warren of violating their free speech rights. Their complaint cites a past ruling in the Supreme Court in the Bantam Books v. Sullivan case, where state officials were found in violation of the First Amendment by sending letters to sellers warning them not to sell certain books. MSNBC Host: Trucking Industry Full of ‘Aggressive’ White Men Who ‘Overwhelmingly Voted for Trump’ (VIDEO)

MSNBC host Tiffany Cross characterized the truck driving industry as populated by “a lot of white men” who she says “overwhelmingly voted for” former President Donald Trump.

Cross, who is the author of Say It Louder! Black Voters, said Sunday on Cross Connection that she is worried because her brother is a truck driver . She said it “feels like a dangerous industry.”

Cross questioned her guest, CrossCountry Truck Driving School owner and president Pamela Day, about how the industry can become more “welcoming” to drivers of color. . .

“This is an industry populated by a lot of white men over the age of 55,” Cross said. “This group of people overwhelmingly voted for Trump. Mom, Toddler Survive Over 100-Foot Fall From Popular US Landmark

A mother was planning to spend a nice day with her 2-year-old daughter at popular Multnomah Falls in Oregon on Sunday, but they ended up getting the scare of a lifetime.

The hiking trail they were on was slick, as it had been raining, and at some point the toddler slipped, according to KGW-TV. Mom reacted — grabbing the toddler and trying to pull her up — but mom lost her footing, too, and both tumbled to the creek below.

Initial reports put the distance at 50 feet, but later reports stated the pair likely fell 100 to 150 feet. Good Samaritans leaped into action, providing assistance immediately while others gathered blankets and jackets from the gift shop.

Poll: GOP Holds Largest Lead in Early Midterm Election Preferences in 40 Years

Republicans currently have the largest lead in the generic congressional ballot they have had since 1981, according to an ABC News/Washington Post poll released Sunday.

“As things stand, if the midterm elections were today, 51 percent of registered voters say they’d support the Republican candidate in their congressional district, 41 percent the Democrat,” reads a press release from Langer Research, which conducted the poll for ABC News/Washington Post. “That’s the biggest lead for the Republicans in 110 ABC/Post polls to ask this question since November 1981. Indeed, it’s only the second time the GOP has held a statistically significant advantage (the other was +7 points in January 2002) and the ninth time it’s held any numerical edge at all.”

Independents, who are often considered the swing vote in elections, would support the GOP candidate by a 50-32 percent margin. This is notable considering they voted +12 points for the Democratic Party in the 2018 elections, which were the most recent midterm election. FBI Hacked, Emails Sent From Official FBI Account to 100,000 Inboxes

The FBI has acknowledged illegitimate emails were sent from an official FBI email account Saturday morning before the agency took the hardware offline. Breitbart has learned the email is estimated to have reached at least 100,000 inboxes.

“The FBI and CISA [Cybersecurity and Infrastructure Security Agency] are aware of the incident this morning involving fake emails from an @ic.fbi.gov email account,” the FBI explained in a press release.

“This is an ongoing situation, and we are not able to provide any additional information at this time,” the statement continues. “The impacted hardware was taken offline quickly upon discovery of the issue. We continue to encourage the public to be cautious of unknown senders and urge you to report suspicious activity to ic3.gov or cisa.gov.”

Spamhaus has confirmed to Breitbart News that it estimates at least 100,000 accounts received the email.

Creepy Cuomo for NY AG?

Andrew Cuomo (D) is reportedly considering a run for the state attorney general position he had before he served as governor, sources told the New York Post.

The outlet reported Friday:

In the last 24 hours, several of Cuomo’s confidants have mentioned — to both elected Democratic officials and party insiders — that Cuomo could run for attorney general in 2022. Current AG Letitia James has announced her candidacy for governor, leaving the role of AG wide open, these people contend.

“People in Cuomo’s orbit are tossing it out there,” a person with direct knowledge told The Post. “They’re floating it … and gauging people’s reactions.”

Even as Cuomo’s reputation sunk further, after being forced to resign amid an Albany impeachment probe and findings of an investigation by James’ office that claimed he sexually harassed several female staff members, “his campaign coffers remain high,” the article noted.
