Dems in Check: Ruling Clears Way for GOP to Defund Illegal Amnesty

Late Monday night, U.S. District Judge Andrew Hansen issued a preliminary injunction on every aspect of Obama’s November 20, 2014 executive amnesty pending the outcome of the lawsuit brought by 26 states against the Department of Homeland Security. This ruling makes the decision of Senate Democrats to filibuster a clean funding bill – one that funds all lawful aspects of the department – even more indefensible. Republicans should now go for the kill.

The ruling itself was not on the underlying merits of the case, rather on the need to grant temporary relief in the likelihood that the states win the case. As Judge Hansen noted, by not granting an injunction, states would “suffer irreparable harm” because “once these services are provided, there will be no effective way of putting the toothpaste back in the tube should Plaintiffs ultimately prevail on the merits.”

However, in addition to the injunction, there are two noteworthy points in this 123-page decision. First, Hansen clearly believes states have standing and sufficient grievances to sue the federal government over executive amnesty, unlike previous judges who have held that state grievances are “speculative.” Second, it’s quite obvious Hansen believes the states will indeed prevail on the merits.

Before granting the injunction, Judge Hansen launches into an extended deconstruction of all the arguments made by the administration and makes it clear they have no authority to pass their own statutes. (Read more about the attempt to defend illegal amnesty HERE)

Union Mob Protests Scott Walker’s House Where His Parents Live

Rallying against Gov. Scott Walker’s proposed state budget, more than 100 protesters gathered outside of his Wauwatosa home from about 5:10 to 5:25 p.m. Monday.

Repeating many of the chants heard at the State Capitol when Walker instituted Act 10 in 2011, the winding line of protesters called out, “Hey hey, ho ho, Scott Walker’s got to go,” “The students united will never be defeated,” and “Students are not for sale,” as they circled outside Walker’s home on 68th Street.

The protesters started at Juneau Park Play Field, 6500 W. Mount Vernon Ave., at 4:30 p.m. As they walked toward 68th Street, Wauwatosa and Milwaukee police blocked off westbound Bluemound Road. At Walker’s house, police blocked northbound 68th Street while Wisconsin State Patrol officers were stationed in the driveway.

Shouting through a megaphone, Wisconsin Jobs Now Director Jennifer Epps-Addison said although some might call it “invasive” to go to the governor’s home, she said Walker’s proposed cuts were invading their own homes. . .

Interior Secretary Jewell Visits Eroding Alaska Village

In temperatures slightly higher than Washington, D.C.’s, Interior Secretary Sally Jewell got a firsthand look Monday at the effect of climate change on an Alaska coastal community.

Jewell visited Kivalina, a village of 370 on a barrier island just off Alaska’s northwest coast, the Fairbanks Daily News-Miner reported.

Once protected from early winter storms by a natural barrier of sea ice, Kivalina has been ravaged in recent decades by erosion because climate warming prevents ice from forming until later in the winter.

“You can see the impact of coastal erosion in the village,” Jewell said. “You can hear the fear in people’s voices about what’s happening with climate change. Things are changing up here, and that’s part of what I’m on this trip to learn about.” (Read more about the visit to the Alaska village HERE)

BREAKING: ISIS Savages Just Burned 45 To Death As Obama Pursues ‘Strategic Patience’

Only a few miles from an Iraqi air base where hundreds of U.S. Marines are stationed — and only two weeks after they publicly burned to death a caged Jordanian pilot — ISIS militants have reportedly killed 45 people in the western Iraqi town of al-Baghdadi. The victims are said to have met their deaths by being burned alive.

Fox News reports that some of the dead in the latest mass atrocity committed by Islamic State barbarians are believed to have been members of security forces battling ISIS for control of the town.

Details of the slaughter by fire are still sketchy, though no U.S. personnel are said to have been killed. According to Fox News,

The reports come days after ISIS released a video purportedly showing the beheadings of 21 Egyptian Coptic Christians along a beach in Libya, sparking an international outcry, including commendation from Pope Francis, who called the killings “barbaric.”

Federal Judge Orders Obama to Immediately Stop His Executive Amnesty

Texas Federal Judge Andrew Hanen issued a temporary injunction halting the Executive Amnesty program announced last year by President Barack Obama. Texas Governor Greg Abbott and Attorney General Ken Paxton responded to the late night decision by the judge.

The ruling came in response to a lawsuit filed on December 3rd, 2014, by then Texas Attorney General Greg Abbott (now Governor Abbott) on behalf of the State of Texas. At the time of the filing, Texas was joined by sixteen other states. That number has increased to twenty-six states, more than half of the country.

In the ruling (attached below), Judge Hanen wrote, “The ultimate question before the Court is: Do the laws of the United States, including the Constitution, give the Secretary of Homeland Security (DHS) the power to take the action at issue in this case?” The judge laid out three issues to answer in this ruling: “(1) whether the States have standing to bring this case; (2) whether the DHS has the necessary discretion to institute the DAPA (Deferred Action for Parents of Americans and Lawful Permanent Residents) program; and (3) whether the DAPA program is constitutional, comports with existing laws, and was legally adopted.”

The Judge ruled that “at least one plaintiff has satisfied all the necessary elements to maintain a lawsuit and to obtain a temporary injunction.” This means that, not only can the lawsuit continue, but the judge has ordered that the President or the Secretary of Homeland Security cannot take action on the DAPA program. . .

Governor Abbott responded to the ruling handed down late Monday night. “President Obama abdicated his responsibility to uphold the United States Constitution when he attempted to circumvent the laws passed by Congress via executive fiat, and Judge Hanen’s decision rightly stops the President’s overreach in its tracks . . .” (Read more from “Federal Judge Orders Obama to Immediately Stop His Executive Amnesty” HERE)

Obama Should Have Been Publicly Ridiculed During the White House’s Cybersecurity Summit at Stanford [+video]

President Obama held a much-publicized White House Summit on Cybersecurity and Consumer Protection at Stanford last Friday, culminating with his signing onstage a new executive order calling for “collaboration” between government and technology companies to fight cyber crime.

Tech executives from Google, Yahoo, and Facebook to their credit declined invitations to attend, while Apple CEO Tim Cook took the stage to advocate for privacy rights.

A far cry from days past when President Obama used Silicon Valley as an ATM machine to refill his campaign coffers. Regardless of how much Obama’s now being a lame duck may account for the change, we can but hope this shift in sentiment in the Valley remains permanent.

The audience attending the summit apparently saw no irony in Mr. Obama’s declaration that, “When people go online, they shouldn’t have to forfeit the basic privacy we’re assured as Americans.”

A noble sentiment, agreed, but Mr. Obama bears much of the responsibility for this forfeiture himself, having authorized the government programs under which these basic rights are violated—not once, but repeatedly, including annual re-authorizations of the NDAA, and multiple other programs that result in the wholesale capture and indefinite storage of every detail of every innocent American’s life. Every email, phone call, everyone’s location at any given time, every internet transaction, online search, etc.: you name it, Mr. Obama’s administration is purposely depriving every American of privacy rights every minute of every day—with tech and telecom companies duly “collaborating.” (Read more about the cybersecurity summit HERE)

Apple CEO Tim Cook Defends Privacy at Cybersecurity Summit

Apple CEO Tim Cook spoke at last Friday’s cybersecurity summit where he made a strong push to protect user privacy instead of handing over access to our digital worlds to the government. The event was orchestrated by the White House as a way to bring together tech industry leaders, academic experts, and government leaders to find a common ground for dealing with law enforcement and national security desires for easy access to our personal data.

No other big tech company CEOs were willing to take the stage and share their thoughts, but Mr. Cook didn’t hesitate. He said, “Everyone has a right to privacy and security,” making it clear he does not support the idea of giving government agencies back doors into our personal data.

Instead of creating new security threats that governments and hackers alike could exploit, Mr. Cook called for strong privacy and security measures to protect technology users. He said,

If those of us in positions of responsibility fail to do everything in our power to protect the right of privacy, we risk something far more valuable than money—we risk our way of life. Fortunately, technology gives us the tools to avoid these risks, and it’s my sincere hope that by using them and by working together, we will.

Apple has already taken steps to keep its customer’s data safe from prying eyes by refusing to store our personal information in a way it can decipher. Text-based chats are encrypted, too, and Apple doesn’t have the software keys needed to read their contents—those are held only by the conversation participants. (Read more from this story HERE)

Sister of Slain Chapel Hill Muslim Blames ‘American Sniper’ for Creating “Open Season on Islam” [+video]

By Tom Tillison. The grieving sister of one of three Muslim students killed in North Carolina this week blamed the “American Sniper” movie for contributing to the slaying, saying it is “open season against Islam” in America.

Deah Barakat, his wife, Yusor Mohammad Abu-Salha, and her younger sister, Razan Mohammad Abu-Salha, were shot execution-style in Chapel Hill on Tuesday, and neighbor Craig Stephen Hicks was arrested on murder charges, multiple media outlets have reported.

While police are still investigating, they have said a dispute over a parking space may have sparked the killings. But echoing the beliefs of the victims’ family, Dr. Suzanne Barakat told CNN’s Jake Tapper that her brother’s death was a hate crime motivated by anti-Muslim sentiments.

“It has been tremendously heartwarming to see the outpouring of love and support” in the shootings’ wake, Barakat said, though she lamented what she called a pervasive climate of hate and fear in America.

“It’s currently an open season, a time where it is an open season against Islam, Muslims in Washington, Muslims in the general media, dehumanizing Muslims in movies like ‘American Sniper.’” (Read more about the slain Chapel Hill student HERE)

After Claiming She Was Threatened at Gunpoint for Being a Muslim, UT-Arlington Student Admits She Lied

By Matt Peterson. A UT-Arlington student who claimed she was threatened at gunpoint on campus this week admitted Friday that she’d lied, a university spokeswoman said.

The student told police she hadn’t even been at the school the day she said the incident occurred.

UT-Arlington had been investigating the complaint with Arlington, Denton and University of North Texas police, school spokeswoman Kristin Sullivan said . . .

The university had issued an alert Friday that the student told police she had been followed six miles by a man in a pickup before she reached the campus. She had reported that when she parked at the university, the man threatened her and pointed a gun at her before he left.

The student also posted on social media that the man might have targeted her because she is Muslim. In a Facebook post, she referred to the killings of three Muslim students this week in Chapel Hill, N.C. (Read more from “Muslim Blames American Sniper” HERE)

Utah Legislature Considers Bringing Back an Outlawed Method of Execution, but Not Everyone Agrees

After remaining deadlocked in a four hour debate last Friday, the Utah Legislature is now one step closer to resurrecting the firing squad as a death penalty option. The use of firing squads in the state of Utah was halted in 2004 and current law states it is only to be used if lethal injection is unavailable.

Proponents of the bill cite recent cases in Arizona and Colorado, where botched lethal injections have led to potential Supreme Court challenges to the method.

The bill’s sponsor, Rep. Paul Ray (R-Clearfield), has voiced concerns over the unavailability and potential future legal issues with lethal injection as a mode of carrying out the death penalty:

“Back in 2004, we had no idea that at some time we would not have the drug cocktail available…we are facing a situation where we are going to have to go to court…to defend what we’re doing.”

Reverend Graham: ‘Imagine the Outcry if 21 Muslims Had Been Beheaded By Christians’

By Michael W. Chapman. The Islamic State beheaded 21 Egyptian Christians over the weekend, propping the severed heads on the victims’ backs, a barbaric slaughter that led Reverend Franklin Graham to ask, “Can you imagine the outcry if 21 Muslims had been beheaded by Christians?”

“Where is the universal condemnation by Muslim leaders around the world?” he asked.

The brutal killing of the 21 Egyptian Coptic Christians, who had been abducted in Libya by members of the Islamic State, was videotaped and the entire death film was posted online on Sunday, Feb. 15. Beheading of 21 Christians Brings ISIS to the Doorstep of Europe

By Lizzie Dearden. The beheading of 21 Coptic Christians on a beach in Libya has brought Isis to the doorstep of Europe.

The mass murder, which provoked a volley of Egyptian air strikes on the group’s Libyan stronghold of Derna, realised long-held fears of militants reaching the Mediterranean coast.

Isis started in Iraq and now controls swathes of adjoining Syria, including along the Turkish border, as part of its so-called Islamic State.

Its ideology has spread much further, with pledges of allegiance from terrorist groups in Egypt, Gaza, Jordan, Lebanon, Saudi Arabia, Tunisia, Yemen and now Libya.

Days before Isis released its gory video depicting the Egyptians’ beheadings, Libya’s former Prime Minister warned that the group would soon reach the Mediterranean and even Europe if order was not restored in the country. (Read more from this story HERE)
