Anchorage, Alaska. December 10, 2010 — In response to the state superior court’s ruling today, campaign spokesman Randy DeSoto issued the following statement:
“The purpose of the legal action is to ensure that the integrity of the vote is upheld. The Miller Campaign believes that every valid write-in ballot should be counted, but not those that fail to meet the standard established by the state legislature. Additionally, the core American values of equal protection under the law and fundamental fairness in this election require that the Miller ballots are counted and reviewed in the same fashion as Lisa Murkowski’s, by hand, and that the count includes only those who are eligible to vote. When we’ve ensured that these issues have been addressed, then we’ll have an accurate count, and if Lisa Murkowski’s tally is greater than Joe’s, then he will certainly honor that result.”

Lisa Murkowski and her friends in the media have misled you. They want you to believe that Joe has lost this election. Below, we dismantle 5 common myths going around:
MYTH 1: Joe Miller is forcing the state of Alaska to count ballots.
Lisa Murkowski is forcing the count in Alaska – by ignoring the primary process (after promising to stand by the results) and conducting a write-in campaign costing millions of dollars, Lisa ensured a drawn-out counting process would be required to determine a victor.
MYTH 2: Lisa Murkowski is beating Joe Miller
After 7 days of write-in ballot counting, Republican nominee Joe Miller still leads incumbent Lisa Murkowski in the uncontested write-in ballot count. As of Monday night, nearly all write-in votes have been counted. Joe Miller has 90,448 uncontested votes and Murkowski only has 84.563. If current trends hold, Miller and Murkowski will likely end up in a dead heat in the uncontested ballot count.
MYTH 3: Joe Miller is indiscriminately throwing out ballots
By law, Alaska statute mandates that the candidates name be spelled correctly. Joe Miller is challenging ballots based on that statute. As a strong believer in the rule of law and constitutional values, Joe believes in this high standard of proof required for write-in ballots to be considered.
Given that the counting process alone has cost the state significant time and resources, a strict interpretation of ballots is necessary to ensure election results are determined in a fair and timely manner. This is crucial for Alaskans to receive proper congressional representation.
MYTH 4: The law leaves it up to ballot counters to determine what ballots are legitimate
Lisa Murkowski’s campaign has spent considerable funds attempting to ensure that her name is properly spelled on the write-in ballots, proving that she anticipated and prepared for a strict interpretation of law. The law allows no room for personal interpretation. You spell it correctly, or you don’t.
MYTH 5: There are no reports of fraud or voting irregularities
The Joe Miller campaign has documented numerous instances of voting irregularities.
While nothing can be done about these cases now that the election has already been held, the Joe Miller campaign believes that these cases prove why it is all the more necessary to ensure that there is strict interpretation on the ballot counting process.

Anchorage, Alaska. November 9, 2010 — The Joe Miller for US Senate Campaign has reviewed the Alaska Federation of Natives (“AFN”) request for federal observers during the vote count. Joe Miller agrees that the Department of Justice should have observers to prevent an unconstitutional usurpation of the Elections Clause and the public right to due process. “We have requested from the outset a fair and lawful electoral process,” said Joe Miller. “If the State needs to be supervised by the federal government because of violations of Federal Election Law, as AFN suggests, then it is unfortunate but apparently necessary,” said Miller.
The Miller Campaign disagrees, however, with the implicit and explicit assumptions fostered by the AFN that rural Alaskans, and Alaska Natives in particular, don’t know how to spell. Said Miller, “I think rural Alaskans deserve a lot more credit than the AFN is willing to give.”
In addition, Harold Rudolph, an Alaskan Native and military veteran stated “I find the AFN presumption about Alaska Natives to be condescending, paternalistic and just plain offensive. This group does not speak for me and thousands of Alaska Natives like me.” Fellow Native Phil Kugzruk added, “All Joe wants to do is make sure the ballots are counted according to the laws on the books. The AFN board subverted due process among the Native Alaska population a few weeks ago when the other two candidates, Miller and McAdams, were not given equal time at their annual convention. I believe that AFN is playing politics once again, as it did during the campaign, and acting like it speaks for all of Alaska’s natives. To imply that ‘their’ constituency does not know how to spell, and given that thousands of Murkowski wristbands detailing AFN’s chosen candidate were made available, all this amounts to a complete disrespect for me and my fellow Alaskans. AFN will do whatever it takes to get ‘their’ candidate elected!”

One week after claiming support of prominent Democrats, Lisa fails to address lie about NRA endorsement
Anchorage, Alaska. October 27, 2010 — In a display of political double-speak that only eight years in Washington DC can perfect, Senator Lisa Murkowski seemingly defended her campaign’s recent false use of an endorsement from the NRA of her write-in bid for the Senate.
Just days after Lisa’s campaign was called on the carpet by the Democrats for falsely claiming the support of Alaska Democrat nominee for Governor Ethan Berkowitz and Washington Senator Patty Murray (a member of the Democrat leadership), she defended her campaign’s use of an endorsement that, in reality, does not exist. Murkowski said she apologized to Berkowitz, but the burning question is, why has she not apologized to the Alaskan people, whom she has misled?
According to the November edition of the NRA’s American Rifleman, the flagship publication of one of the nation’s premier organizations in support of gun rights, the group is NOT endorsing Lisa Murkowski in her write-in campaign for Senate as she has claimed in campaign literature and mailings (mailer side 1, mailer side 2). To extend her pattern of saying anything to get elected, Senator Murkowski today tweeted, “I am the only Alaska Senate Candidate to Receive an NRA Endorsement.” She did…in the primary – the same primary in which Joe Miller garnered an ‘A’ rating just as he received in the the general election. The NRA’s own publication contradicts her…again
“This is yet another example of Lisa saying anything and everything in her desperate attempts to keep the Senate seat her father gave her. She had a ‘D’ rating in the state house and voted in favor of Eric Holder’s nomination for U.S. Attorney General. There is only one candidate running for Senate that is a true supporter of the 2nd Amendment and I am that candidate,” Joe Miller said.
