Former Troops Seek Billions in Damages: Lawsuits Against U.S. Government Over Military Vaccine Mandate

In a significant legal development, former service members have initiated legal action against the U.S. government, seeking billions of dollars in damages due to the military vaccine mandate imposed by the Biden administration. Attorney Dale Saran, a retired Marine, along with fellow attorneys Andy Meyer and Brandon Johnson, is representing the former troops in three separate lawsuits filed in the U.S. Court of Federal Claims. The legal team plans to consolidate these cases into a class-action lawsuit on behalf of a substantial number of service members affected by the mandate, alleging various infringements, including lost pay and benefits.

Saran, who successfully litigated against the Anthrax vaccine in the past, estimates the damages to be in the billions, stating, “It’s worth billions. That’s just flat-out. That’s what it is in backpay. It’s billions of dollars.” The lawsuits specifically address cases where service members were either discharged or given illegal orders to cease drilling activities, resulting in financial setbacks.

The legal proceedings shed light on the estimated 80,000 to 100,000 service members, encompassing both active-duty and reservists, who were impacted by the military vaccine mandate. Saran highlights the lack of due process in many instances, with no administrative separation boards, hearings, or federal recognition boards being conducted. This approach raises concerns about the abrupt dismissal of service members without proper procedural safeguards.

Among the affected individuals is Zach Loesch, a former Coast Guard member, who was personally thanked by President Joe Biden for his heroic efforts during Hurricane Ian. Ironically, Loesch was on the verge of being discharged from the Coast Guard for not complying with the vaccine mandate.

The legal actions focus not only on lost backpay but also on the repayment of enlistment bonuses. Saran explains that individuals who enlisted for a specific period and received bonuses are now being penalized for refusing the experimental vaccine. The cases underscore the complexities arising from the abrupt dismissal of service members without fulfilling their obligations and the subsequent demand for the return of enlistment grants.

Furthermore, Saran contends that the Pentagon already possesses the funds required to award backpay for those who lost active-duty or drill time. He alleges that the Department of Defense (DOD) has unlawfully withheld this money, characterizing it as stolen funds.

Reflecting on his past experience with the Anthrax vaccine, Saran expresses a sense of déjà vu. Having defended individuals who refused the Anthrax vaccine in the late ’90s and early 2000s, he draws parallels to the present situation, emphasizing that mass vaccination of unlicensed vaccines seems to indicate a lack of learning from past mistakes.

The lawsuits, identified as Bassen v. USA, No. 23-211C, Botello v. USA, No. 23-174C, and Harkins v. USA, No. 23-1238C, are currently pending in the U.S. Court of Federal Claims, where Saran believes these claims of illegal discharges will be thoroughly examined. The legal proceedings highlight the ongoing challenges and controversies surrounding the military vaccine mandate, underscoring the financial and procedural implications for affected service members.

Former Soldiers Discharged for Vaccine Refusal Receive Rejoining Instructions Amid Army Recruiting Challenges

Soldiers who were forced out of the Army for refusing the COVID-19 vaccine have received letters with instructions on how to rejoin, as the service faces its toughest recruiting environment in a generation.

“As a result of the rescission of all current COVID-19 vaccination requirements, former soldiers who were involuntarily separated for their refusal to receive the COVID-19 vaccination may request a correction of their military records,” according to a letter signed by Brig. Gen. Hope Rampy, Army Director of Personnel Management.

It also instructs soldiers looking to return to service to contact an Army, Army Reserve, or National Guard recruiter. It was not immediately clear to an Army spokesperson if soldiers who rejoin would return to their former unit or MOS.

The letter, circulated on social media and confirmed by the Army as authentic to Task & Purpose outlines the steps soldiers can take to correct their military records through the Army Discharge Review Board or the Army Board for Correction of Military Records.

In October, CNN reported that only 43 of over 8,000 troops across the entire military had been discharged for refusing the vaccine and showed interest in rejoining. As of September, 19 soldiers returned to active duty, according to the Army. ‘Never Seen This Before’: Explosion of Miscarriages After COVID Shots

. . .A report from Steadfast Nation documents the testimony from multiple individuals at U.S. Rep. Marjorie Taylor Greene’s hearing on the issue.

“How many of your patients or pregnant women that you know of experience miscarriages after taking the COVID-19 vaccines — or injections?” Greene asked Dr. Kimberly Biss, an OB-GYN who has been involved in 8,000 pregnancies.

“I’ve never seen this before,” she responded. Besides a multitude of miscarriages, she said, what’s concerning is that while patients got their injections in 2021 or 2022, “we’re still seeing lingering effect.”

She noted that ordinarily a miscarriage rate would be in the range of 4%, as it was in 2020.

Elderly Who Got COVID and Flu Shots in Same Visit May Have Higher Stroke Risk, FDA-Funded Study Suggests

Elderly people may have an increased risk of stroke caused by blood clots in the brains if they receive both the COVID booster and a flu shot in the same visit, a new study suggests.

Older adults who received both shots in the same visit last year had a 20-35% increased stroke risk, according to the study, which was funded by the Food and Drug Administration (FDA).

The results showed about three strokes for every 100,000 doses given.

The study suggested the increased stroke risk may be primarily driven by the flu shots rather than the COVID vaccines. Nevertheless, the results have sparked concerns.

Only 3 Percent of Americans Have Gotten the New COVID Shot

The Biden administration’s campaign to convince Americans to get an annual Covid shot is off to a very slow start.

Even so, the nation’s top disease-fighting official says the U.S. remains “on track” to hit last year’s uptake levels, which crested at just 17 percent of the U.S. population.

So far, 12 million people, or about 3.6 percent of the population, have gotten the shot in the five weeks since it hit pharmacy shelves — though reporting lags mean it’s likely a bit higher, Centers for Disease Control and Prevention Director Mandy Cohen said.

Disaster: Only 43 Out of 8K Troops Discharged Over Biden’s Vax Mandate Have Sought to Rejoin

Only 43 out of more than 8,000 service members who were discharged from the military over the Biden administration’s COVID-19 vaccine mandate have sought to rejoin, according to a recent report by CNN.

According to the report, 19 have rejoined the Army, 12 have rejoined the Marine Corps, one has rejoined the Air Force, and two have rejoined the Navy.

The report suggested that the low numbers prove that Republicans who say the mandate hurt recruiting and retention were wrong.

However, some troops who fought the mandate while they were in the military told Breitbart News that they disagree.

Retired Air Force Master Sergeant Nick Kupper, who recently retired after successfully fighting his discharge, told Breitbart News that troops are not seeking to rejoin because they feel betrayed. CDC Recommends Updated COVID-19 Booster Shots for All Americans

The Centers for Disease Control and Prevention on Tuesday recommended updated COVID-19 boosters for all Americans ages 6 months and older.

CDC Director Mandy Cohen said anyone who hasn’t received a shot for the coronavirus in the past two months should take the updated booster before the fall and winter, when respiratory diseases tend to proliferate.

The shots from drugmakers Pfizer and Moderna should be available later this week.

“We have more tools than ever to prevent the worst outcomes from COVID-19,” Dr. Cohen said. “CDC is now recommending updated COVID-19 vaccination for everyone 6 months and older to better protect you and your loved ones.”

FDA Adviser: Most Don’t Need New COVID Boosters

Dr. Paul Offit, a pediatrician, vaccine and infectious diseases expert, and vaccine adviser to the Food and Drug Administration, said most healthy young Americans do not require an additional COVID-19 booster shot.

This assertion comes after the emergence of the new B.A.2.86 variant, contributing to an uptick in COVID-19 virus transmission rates.

Offit told the Daily Mail that middle-aged and younger Americans without underlying chronic conditions already possess robust immunity derived from prior COVID-19 vaccinations and infections, effectively safeguarding them against severe illness during the impending winter.

According to Offit, the updated boosters from Pfizer-BioNTech and Moderna are probably best reserved for people at high risk of severe illness or death from COVID-19: older adults, people with multiple coexisting conditions, and the immunocompromised.

“Specifically, those over 75 years of age, those who have health problems that put them at highest risk of severe disease (such as obesity, chronic lung disease, chronic heart disease, and diabetes, among others) [and] those who are immune-compromised, and those who are pregnant” are the people who need the booster, he advised, as reported by the Daily Mail. Half of Vaccinated People Never Stop Producing Spike Protein, Study Found

Remember how we were told that “the vaccine stays in the arm” and that “harmless spike protein is only produced for a couple of days.” They said they were sure of that, despite no data to confirm their statements.

Well, sadly, it turns out that they lied to us. The data is now in, and it proves such claims wrong!

A clever scientific study by Brogna et al., just published, detected the presence of spike protein in COVID-vaccinated people six MONTHS after vaccination – and excluded the possibility of cross-contamination of experimental data with wild-circulating COVID infections.

The study’s authors used a sensitive test, called mass-spectrometry to detect a specific amino-acid sequence that exists only in the vaccine-induced spike protein.

To remind my readers, mRNA COVID vaccines contain genetic code to produce the so-called “spike protein,” a component of the SARS-CoV-2 virus that allows the virus to penetrate and infect human cells. During the penetration process, called “fusion,” the viral spike protein changes shape, becoming a spear of sorts, penetrating the cell surface. Why Did the CDC Remove the COVID Vaccine Adverse Event Reports From Their Website?

The Centers for Disease Control and Prevention (CDC) website appeared to have quietly stopped collecting COVID-19 vaccine adverse events on the federal agency’s V-safe website earlier this summer.

“Thank you for your participation. Data collection for COVID-19 vaccines concluded on June 30, 2023,” the V-safe website reads.

Instead of displaying data collected from the mRNA vaccine, the CDC website redirects users to the Food and Drug Administration’s (FDA) Vaccine Adverse Event Reporting System (VAERS) website for adverse event reporting.

Dr. David Gortler, a Brownstone Institute Fellow who formerly served as a senior official and advisor for the FDA, first reported the change in the CDC’s website, questioning why the federal agency removed the data.
