Veteran Arrested And Charged For Legally Open Carrying AR-15

Photo Credit: MW / ExaminerA decorated Air Force veteran pleaded not guilty this morning to a charge of “trespassing with a weapon capable of producing bodily harm,” after being arrested by police in Vancouver, Washington, for legally open carrying an AR-15 rifle.

Last Saturday, Mack Worley, eager to exercise his second amendment, open carried his rifle while grabbing a soda and viewing a fireworks stand before attempting to walk back to his car.

“No one had said anything negative to me. A few people came up to me and asked a few questions about what I was doing and I just explained that I was asserting my second amendment right. I was explaining to people that it’s not against the law or a crime to open carry a firearm,” said Worley.

While walking on a public sidewalk toward his vehicle, Worley noticed an officer waiting down the street in a police car. Worley, assuming the police wanted to speak with him, continued walking down the sidewalk.

“As I started walking to them, I hear on a loudspeaker to my left a police officer telling me to put my hands up,” said Worley.

Actor Joe Mantegna NAILS It With His Recent Comments About Guns and the Second Amendment

“We will be profiling what we consider fire arms that have an impact on the world – newsworthy historical significance. We do things from looking at the Walther PPK (‘James Bond’ gun) to the Teddy Roosevelt guns that he used in Africa. We cover sniper rifles and the cold pipe bomb,” Mantegna told FOX411.

“It’s like wine. There is such a variance in firearms – different manufacturers, different models and different types. Even vintages if you want to call it that.”

The Second Amendment Should Trump State Lines

My state-issued driver’s license allows me to get into a car and drive to visit friends in other states. If I decide to drive to visit my friend Pablo in Arizona, or Jacqueline in New York, my North Carolina-issued license will be honored by every law enforcement agency I may encounter along the way.

If I were to visit Pablo, I would not need to obtain additional driver’s licenses to drive through Tennessee, Arkansas, Oklahoma, Texas, New Mexico, and Arizona. If I were to visit Jacqueline, I would not need to obtain additional licenses for Virginia, Maryland, Delaware, New Jersey, and New York. No matter where I drive in the United States, I have reciprocity with my driver’s license, under the presumption that if I am deemed competent to drive in one state, then I am competent enough to drive in every state.

If I even brought up the idea that I might need a driver’s license in each individual state, reasonable people would look at me as if I might need my current license revoked, at least until I’m checked over thoroughly by mental health professionals.

The other kind of state-issued permit that I have in my wallet is my North Carolina concealed carry permit, which enables me to carry a concealed handgun in the state of North Carolina, and a number of other states, but not all of them. While North Carolina has logically and automatically recognized the concealed carry permits of every other state issuing a concealed carry permit since 2011, only 36 states have reciprocity with North Carolina.

Charles Murray: If Liberals Change Second Amendment, It Will Backfire And Militias Will Rise Up (+video)

BILL MAHER: One last issue because we were talking about the Supreme Court, and a retired Supreme Court Justice made some big news this week. John Paul Stevens, remember him on the Court? He talked about the Second Amendment and it’s interesting because this week, Georgia passed this guns everywhere law. And Stevens said something that really warmed my heart because this is what I have been saying. Which is Democrats have to separate themselves in big way from the position in the Republican party, which they don’t.

In fact, the Democrat in Georgia, who is Jimmy Carter’s grandson agreed with the governor who signed the guns everywhere bill, and this is the problem with the Democrats. In many issues, but especially on this one. It’s like, we love guns too. How can you not? You look at a gun, it’s like a puppy or a baby, you just got to love it.

So, John Paul Stevens suggested adding five words to the Second Amendment. So it would read: A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms — here are the five words — when serving in the militia shall not be infringed.

This is original intent of the Second Amendment. It was about militias, not about militias.

John Paul Stevens’ ‘Six Amendments’ shows why elections matter

Honestly, unless you are a big government liberal, how many people think the federal government should have more power than it already exercises over its citizens?

Former Supreme Court Justice John Paul Stevens, 94, thinks the Constitution needs at least six amendments in order to bring the country more in line with what he believes is good for us. He outlines them in his new book, Six Amendments: How and Why We Should Change the Constitution. It is a revealing look into liberal thinking and the ideological opposite of radio talk show host Mark Levin’s book, The Liberty Amendments: Restoring the American Republic. More about that in a moment.

Stevens elaborated on his book in an interview with USA Today.

One of his priorities would be to change the Second Amendment. As he writes in his book, “[T]he Second Amendment, which was adopted to protect the states from federal interference with their power to ensure that their militias were ‘well-regulated,’ has given federal judges the ultimate power to determine the validity of state regulations of both civilian and militia-related uses of arms. That anomalous result can be avoided by adding five words to the text of the Second Amendment to make it unambiguously conform to the original intent of its draftsmen. As so amended, it would read:

‘A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms WHEN SERVING IN THE MILITIA shall not be infringed.'”

Does the Right to Self-Defense Have Boundaries?

Photo Credit: WNDThe U.S. Supreme Court repeatedly has sided with defenders of the Second Amendment, ruling that the Constitution protects an individual’s right to bear arms and that states cannot unreasonably restrict that right.

There’s also a case pending before the U.S. Supreme Court considering whether or not states can limit the right to self-defense to a citizen’s private home.

Now, in a related move, U.S senators have proposed a law to establish that the right to bear arms cannot be restricted by political boundaries. The bill would establish that a permit to carry a concealed weapon in one state is valid in all states that allow concealed-carry.

Mississippi Republican Sens. Roger Wicker and Thad Cochran recently signed on as co-sponsors of the Concealed Carry Reciprocity Act of 2014.

The bill, they explain, “is intended to defend the 2nd Amendment rights of individuals with conceal carry permits, allowing them to carry those privileges from their home state to other states that also have conceal carry laws.”

Texas Law Professor Tells Symposium: Time ‘To Repeal and Replace Second Amendment’

Photo Credit: AFP Speaking in a gun violence symposium at University of Connecticut’s School of Law, Texas A&M law professor Mary Margaret Penrose said it’s time “to repeal and replace [the] Second Amendment.”

Penrose said this after expressing her frustration with the fact that President Obama has failed to pass more gun control in the eleven months since the heinous crime at Sandy Hook Elementary.

Meet the Man who Caught Cop on Camera Forcibly Removing his Pro-Gun Sign… And why his Attorney Says it Could be a ‘Really Big Deal’

The man who caught a police officer on camera removing his pro-Second Amendment sign from his front yard says his “First Amendment rights are being stifled” — and he takes his constitutional rights very seriously.

Jon Gibson, of Lake Lincolndale, N.Y., told TheBlaze in an exclusive interview on Tuesday that he has retained an attorney and they are “considering our options moving forward.” His attorney, Richard Bombardo, said there is a potential case for “criminal trespassing, vandalism and larceny,” pending additional findings.

As TheBlaze reported on Monday night, Gibson was fed-up after his pro-gun sign was removed from his front yard for the third time. In response, he set up a hunting “trail camera” to catch the suspected thief when he or she came to take the sign for the fourth time.

He was shocked when he reviewed the images and discovered that a police officer with the Somers Police Department was responsible. Somers, N.Y., is a town located about 5 miles from Gibson’s home. However, the Somers police and fire departments serve his area.

Starbucks CEO: If You Have a Gun, We Don’t Want Your Business

dump starbucksThe day after the mass shooting at the Naval Yard in Washington, D.C., Starbucks CEO Howard Schultz announced that guns aren’t welcome at Starbucks. With Schultz’s unfortunate comment to a traditional marriage supporter just six months ago, many conservatives will undoubtedly regard this as yet another slap against them by the world’s largest coffee retailer.

In his “Open Letter,” the CEO acknowledged that Starbucks’ past approach to open-carry was to “follow local laws [and] permit it in states where allowed and we prohibit it in states where these laws don’t exist.” Then, without citing any specific instance, Schultz said the open-carry debate was becoming “increasingly uncivil” and “even threatening.”

Although Schultz suggests that the “presence of a weapon in our stores is unsettling and upsetting for many of our customers,” he doesn’t explain how a concealed weapon would bother anyone. Nor does he examine whether gun-free zones – like the Naval Yard in DC – actually encourage the type of violence and bad press he is trying to avoid.

Schultz concludes that he is proud of our nation and its first amendment heritage. With the likely fall-out from his announcement, Schultz may regret not giving more consideration to the very amendment that guarantees that heritage.

Wait Until You See How A High Textbook Summarizes The Rights Guaranteed in the 2nd Amendment

Picture - Bill of RightsControversy is brewing around a school district in Denton, Texas, that is said to be using a United States history book that seems to summarize the Second Amendment inaccurately. However, the Denton Independent School District maintains it only uses the book as “supplemental” material and is “disseminating the correct information on the Second Amendment” from other texts.

But there are several other schools that appear to be using the book, too.

“The people have the right to keep and bear arms in a state militia,” the definition in the book, “United States History: Preparing for the Advanced Placement Examination,” which acts as a study guide for the Advanced Placement U.S. history test, reads.

The amendment as ratified by the U.S. reads [emphasis added]: “A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.”

Based on the book’s interpretation, citizens only retain the right to bear arms in a “state militia,” a case where citizens are called upon during emergencies to protect the state. Not surprisingly, many would take issue with that interpretation.

It could certainly be an accidental misinterpretation by the textbook’s author, but people are clearly unhappy with the language and there is already an effort underway to make school officials at Guyer High School aware of the discrepancy. A Texas blogger has also pointed out that the Denton ISD Board of Trustees meets on Sept. 24 at 6 p.m. and is encouraging parents to show up and demand answers.

Why is there Less Violent Crime Against Women in the US than in Britain? Guns. (+video)

CNN host Piers Morgan said he did not want to see all the women in America armed with guns in a spirited debate on Piers Morgan Tonight with Breitbart News author A.W.R. Hawkins on Tuesday.

Hawkins told Morgan that there were less violent crimes in America than in England and Wales per 100,000 people because women in American can defend themselves regardless of any inequality in physical strength.

“My problem is I don’t want to see all the women in America armed with guns,” Morgan said.

Morgan said he believed “where there are guns,” there is a “much higher incidence” of suicide and domestic violence with firearms. Earlier in the segment, Hawkins told Morgan that in England and Wales, for every 100,000 people, there are 775 violent crimes, including sexual assaults—which primarily are perpetrated on women. Hawkins said that in America, there are 383 violent crimes for every 100,000 people.

“The difference is here, women can shoot back,” Hawkins said. “You chase them into an attic, they are going to shoot at you to protect their own lives and the lives of their children.”
