The Next President Must Flush out Administrative State

Picture your dream scenario for 2016: your favorite Republican candidate becomes president and the more conservative candidates win Senate seats. For good measure, let’s continue dreaming and toss in the resignation of Mitch McConnell and Paul Ryan as a viable political outcome for 2016. We are all set and ready to restore our republic, right?

Not so fast.

First, as we’ve noted before, the courts will continue to illegally grab power from the other two branches and invalidate many of our priorities, especially as it relates to immigration.

But more fundamentally, the next president will immediately be confronted by the “fourth branch of government” — the administrative state. Even when Republicans win the White House, the various departments and agencies that actually run government serve as a collective fourth branch and a fifth column countermanding any semblance of the conservative agenda.

Let’s consider the issue of immigration as one example of this dynamic.

Ian Smith, a friend of mine and an expert on immigration law, wrote an eye-opening column at the Washington Times detailing the extent of control the radical open borders lobby wields over immigration “enforcement”:

After receiving through a public records request the resumes of every immigration judge approved by the Justice Department since 2012, around half were found to have past ties to open-borders groups. Fifteen of the 34 hires whose resumes IRLI received worked for either open-borders advocacy groups, such as the Soros-funded Catholic Legal Immigration Network, or had been in private immigration law practice, an industry whose remuneration is tied to open borders. Several of the appointed judges were affiliated with both groups, while others were actual AILA chapter board members.

A note on the particularly cynical field of immigration law: Although it is true that immigration attorneys understand immigration law and, therefore, may appear best suited for a role in the immigration courts, it’s not an exaggeration to say that their work hinges on impeding those very laws and pushing for ever more-porous borders. AILA, for instance, attacks states that try to pass their own immigration laws and it claims publicly that the president’s unilateral amnesty programs are, in fact, legal.

Ideological imbalance at the Department of Justice was once made the subject of an investigative series by PJ Media. Within the Office of Special Counsel, the section tasked with enforcing the anti-discrimination provisions of the Immigration and Nationality Act, PJ Media found that most Obama hires in the department had a background involving open-borders fanaticism.

Not only do the fanatical open borders groups control the legal profession and influence the Article III courts, they serve as the foxes guarding the immigration enforcement hen house within the administrative courts. Consequently, even a president who wants to enforce immigration law will be stymied with every last deportation unless he has the resolve to flush DHS and DOJ of every last vestige of open border influence. This is no easy task because, as Ian Smith notes, there is an entrenched and inherent ideological balance in these agencies that has accumulated over the years. These groups have a monopoly on the relevant departments because they have long been regarded as the only people with core competency and expertise on the subject matter.

This is true of almost every department. It is the Sierra Club-style groups that control the EPA; the Acorn-types who control HUD, the race hustlers who control DOJ; the open borders lobbyists who control DHS; the Muslim Brotherhood and liberal Islamist sympathizers who influence the State Department.

These are the questions that are never asked at the debates. Where a candidate “stands on the issues” in the abstract is meaningless unless he or she has the principled foundation, the moral resolve, and a cadre of movement conservative staff around who are willing to clean out every one of these agencies and install intrepid constitutionalists to run them.

Democratic presidents never have these problems because, as noted above, the inherent ideological balance in most of these public policy fields is already oriented towards implementing their priories. And after eight years of Obama, every nook and cranny of the executive branch will be contaminated with hostile elements. Obama has left no stone unturned in orienting each department, agency, and office towards the execution of a cross-sectional portfolio of liberal priorities. For example, he has the U.S. embassies in Central America not only promoting open borders but promoting national transgender day.

With Donald Trump as the front-runner, these are some of the questions he needs to answer. He has recently extolled his ability to work with people and cut deals. He has decried the gridlock in Washington. The problem with that mentality is that if you are looking for efficiency instead of principle, as many businessmen are often inclined to do, the path to least resistance is to work with the administrative state instead of going to war with it. And that would render the presidency worthless, especially following Obama’s fundamental transformation of an already-imbalanced administrative state.

Trump has captured the minds of many conservatives with his promises to enforce our immigration laws and sovereignty. But if he is committed to cutting deals in order to avoid gridlock, nowhere will his agenda be rendered more worthless than in the realm of immigration enforcement. Students Boycott High School’s Required Racial Identity Day

At least one thousand students skipped New Trier High School’s mandatory day of “racial identity” classes on Dr. Martin Luther King, Jr. Day.

The suburban Chicago high school, which ranks among the top public high schools in the country, held class on the public holiday, and scheduled seminars on “systemic racism” that sought to increase students’ awareness “of their own racial identities and the identities of others” . . .

One parent, whose daughter is biracial, told Breitbart News that her daughter had deliberately avoided the program for fear of being singled out and forced to define herself by her skin color . . .

Though she generally disapproved of missing school, she allowed her daughter to skip the day. “I felt bad for her…I’ve never felt race has been a factor in our lives,” she said.

“It’s one thing to study Dr. King’s ‘I Have a Dream’ speech,” she added. “But to talk about feeling guilty because you are white?…These kids today are so far beyond it. WOW: Ted Nugent Watches 13-Hours, You Won’t Believe What He Said (The Secret Service is Probably Investigating)

In a startling reaction to the blockbuster 13-Hours Benghazi movie, Ted Nugent demanded that Hillary Clinton and Barack Hussein Obama should be tried for treason and hung. He also contends that it was our “unholy rotten soulless criminal America destroying government” that “killed 4 Americans in Benghazi.”

Here’s Nugent’s raw post in his characteristically brutal, racially-tinged form:

A preview by Benghazi security officer Kris “Tanto” Paronto of 13 Hours, the block-buster Michael Bay film that premieres on Thursday, raises dramatic new questions about the refusal by Secretary of State Hillary Clinton to authorize a military rescue of the besieged U.S. diplomatic facility and the nearby CIA Annex on Sept 11-12, 2012.

In a presentation at a conference organized by the Maryland Citizen Action Network last weekend, Paronto revealed that two AC-130H “Spectre” gunships were “on call” that night, both within range of Benghazi.

One of them was a six-hour flight away, co-located with a U.S. special operations team in Djibouti.

The other was at Naval Air Station Sigonella, in Sicily. “That’s a 45-minute flight,” Paronto said. [OPS note: AC-130H flight time for that distance is somewhat longer than 45 minutes. The end result is identical to what the author intends].

The Spectre gunship with its 25mm rapid-fire gatling guns, its 40 mm precision Bofors gun, and its 105mm canon is “good in urban warfare because you have little collateral damage,” Paronto explained.

In fact, it was just what the beleaguered security team needed. They could see the jihadis advancing on the Annex compound throughout the night and lit them up with lasers, which the airborne crew could have used for precision targeting purposes. On-line videos of the Spectre gunship in operation show that it can walk its cannons up narrow streets, killing fighters while leaving the surrounding buildings intact and people inside them unharmed.

“I asked for the Spectre and ISR [an armed Predator drone] at 9:37 pm,” Paronto said, certain that the attacks actually started at 9:32 pm local time, not 9:42 pm as previously reported. “At midnight, they told us they were still working on getting us that Spectre gunship. Not that it was not available, but that they were still working on it.”

And there were more forces immediately available for a rescue effort, in particular, the European Command (EUCOM) Commander’s In-Extremis Force, which was then on a counter-terrorism training mission in Croatia, a 3 hour flight from Benghazi.

Paronto knew people in that unit, and remembers calling them after he and his security team got back to the CIA Annex from the diplomatic compound, where they had just rescued the surviving U.S. personnel. “They were loading their gear into their aircraft and ready to go,” he recalled.

Later, his friends in the unit told him they had been shut down sometime after midnight.

All evidence now points to a specific stand-down order issued by Secretary Clinton, since the Libyan facilities came under her direct authority. Without a specific request for assistance from the State Department, the Pentagon was powerless to act.

Last month, the State Department released a critical email, sent at 7:09 pm Washington time (1:09 am Benghazi time) from Jeremy Bash, a top aide to Secretary of Defense Leon Panetta, informing Mrs. Clinton’s office of various military assets that were “spinning up as we speak” to deploy to Benghazi.

Among those assets were C-110 in Croatia, two U.S. Marine Corps Fleet Antiterrorism Security Team (FAST) platoons based in Rota, Spain, the Spectre gunships, armed Predator drones, and possibly elements of Marine Expeditionary Units in the Mediterranean and the Red Sea.

In preparation for deploying C-110 directly to Benghazi from Croatia, General Carter Ham, commander-in-chief of Africa Command (AFRICOM), issued orders transferring authority for C-110 to him from European Command (EUCOM).

General Ham was doing what any smart U.S. military officer would have done, by laying the ground work for a formal order he expected to come down an hour or two later.

“Assuming Principals agree to deploy these elements, we will ask State to secure the approval from host nation,” Bash wrote. “Please advise how you wish to convey that approval to us.”

When Bash sent that email, Paronto and his team-mates had just fought off an assault on the Annex by twenty or more well-armed jihadis. They would continue to fight throughout the night, as larger and increasingly brazen groups of jihadis gathered in dark areas beyond the Annex the security officers referred to as “Zombieland.”

They certainly could have used the support from the Spectre gunship, or the arrival of forty or so well-armed Special Operations combat specialists from C-110.

To date, the State Department has not released any reply from Mrs. Clinton’s office to Bash’s 7:09 PM request. However, we know from the testimony of the top U.S. diplomat in Tripoli at the time, Greg Hicks, that the State Department never requested country clearance from Libya for any U.S. forces that night.

And when the orders finally went out from Panetta’s office an hour later, they included a retransfer of C-110 from AFRICOM back to EUCOM, along with orders for the unit to move to Sigonella the next day and hold in place, instead of flying to Benghazi.

In other words, because Mrs. Clinton refused to authorize those forces to deploy into Libya to assist State Department personnel and State Department facilities, Panetta had no other choice but to put them on hold.

“The State Department was concerned that an overt U.S. military presence in Libya could topple the government,” a senior AFRICOM commander involved in that night’s events told me. “They were in denial. They wanted a narrative that al Qaeda was on the run. Instead, four Americans died.”

With the release of the Bash email and 13 Hours, Mrs. Clinton’s cover has been blown.

I also asked Paronto last weekend if he had heard reports of an Iranian Quds Force presence in Benghazi, as I had been hearing from numerous U.S. military intelligence sources, including senior AFRICOM commanders.

“Everyone knew the Iranians were there,” he replied. “Especially once the Red Cross [Red Crescent] team from Iran was ‘kidnapped’ in Benghazi [on July 31] by Ansar al-Sharia, we knew about them and were tracking them.”

As I reported in Dark Forces: the Truth About What Happened in Benghazi, U.S. military and civilian intelligence agencies produced between 50 to 60 reports on the Iranian presence in Benghazi and Derna in 2012, and Iran’s deep involvement with Ansar al-Sharia, the group that claimed responsibility for the Benghazi attacks. Multiple FOIA requests seeking copies of these reports from the National Director of Intelligence and from AFRICOM have gone without response.

It’s time to remove the wraps of secrecy from those reports as well, so the American public can finally learn the truth about who plotted, organized and paid for the Benghazi attacks.

Ted Cruz Just Announced Something Major About Trump’s Support System: ‘The Establishment Is…’

By Rosie Gray. Ted Cruz dismissed Iowa governor Terry Branstad’s opposition to his campaign on Tuesday, implying that Branstad is part of the same “cronyism” establishment as Donald Trump.

“It is not a surprise that the establishment is in full panic mode,” Cruz told BuzzFeed News in an interview on his campaign bus. “We predicted from the very beginning that the Washington cartel would fire every tool in its arsenal to prevent a conservative victory in this primary.”

“The cartel exists to make deals and to pick winners and losers through cronyism and corporate welfare,” Cruz told BuzzFeed News. “And so it’s no surprise that more and more of the establishment is beginning to support Donald Trump. Because Donald has promised to make deals and to continue the cronyism and corporate welfare of Washington. That’s what the cartel does. They make deals with Democrats.”

Branstad told reporters at the Iowa Renewable Fuels Summit on Tuesday that Cruz “hasn’t supported renewable fuels, and I think it would be a big mistake for Iowa to support him.” Cruz opposes the Renewable Fuel Standard, a government standard requiring transportation fuel to include a certain amount of ethanol, which is a touchstone of Iowa politics.

Branstad confirmed to reporters that he doesn’t want Cruz to win the Iowa caucuses. He had previously said he remain neutral. Bob Dole on Ted Cruz: ‘Nobody Likes Him’

By Josh Hafner. Bob Dole said Wednesday that Ted Cruz at the top of the GOP ticket would mean “wholesale losses” for the party in Washington and across the country.

“I don’t know how he’s going to deal with Congress,” Dole said in an interview with The New York Times. “Nobody likes him.”

Dole, a former Kansas senator, was the Republican Party’s presidential nominee in 1996.

Donald Trump would “probably work with Congress,” though, Dole mused, because he’s “kind of a deal maker.”

Dole characterized Cruz as an “extremist” unwilling to work with his own party. The Times’ Maggie Haberman notes that Dole’s comments reflect a larger tension that establishment Republicans feel with Cruz, who portrays himself on the campaign trail as their antithesis. ‘We’re Going to Go to Hell in a Handbasket!’: Palin Wows Trump Rally by Calling Obama ‘Weak-Kneed Capitulator-In-Chief’

Sarah Palin got a rock star’s welcome in Tulsa, Oklahoma on Wednesday as she told a crowd of 10,000 that America is ‘going to go to hell in a handbasket’ and urged them in her trademark twang to vote on ‘Soooper Tooooosday.’

Palin endorsed Trump in a stream-of-consciousness stemwinder Tuesday during a rally in Ames, Iowa.

The 2008 Republican vice presidential nominee was a no-show Wednesday morning at a smaller campaign stop in Norwalk, Iowa, as rumors swirled that a one-day political romance might already have turned sour.

But she spoke for nearly 20 minutes in Tulsa at the Mabee Arena at Oral Roberts University, calling the Republican front-runner ‘ballsy enough to get out there’ and challenge politicians on both the left and the right.

Almost Half a Million Overstayed Business/Tourist Visas Last Year

Just how many people overstayed their visas in fiscal year 2015 and where have they gone? There’s no way to know for sure because the federal government has refused to implement visa tracking ever since Congress mandated it 20 years ago. But according to a new report from the border patrol, 482,781 individuals who entered on tourist or business visas were still believed to be illegally present in the United States at the end of FY 2015.

The number of total visa overstays for past year is likely far more than 482,000. The scope of the Department of Homeland Security report only covered data on B-1 (those visiting on business) and B-2 (those visiting on pleasure) visas. There are numerous categories of visas, such as F-1 visas for student visas, the multiple H and L foreign worker visas, and the J-1 exchange visas. We’ve admitted almost one million foreign students during the last academic year alone.

The scattered data is incomplete and leaves us with no sense of how many people overstay their visas on a given year and where they reside.

Moreover, this DHS report does not cover those who entered on various visas through land ports. This means there are likely endless numbers of Latin Americans who’ve entered through our southern border check points and have disappeared into our country. Consequently, not only has Obama’s amnesty engendered a massive surge of illegal aliens at the border, it has resulted in countless millions overstaying their visas.

Just a quick glance at the report shows that 219 B-visa holders overstayed from Afghanistan, 681 from Iraq, 564 from Iran, 1,397 from Jordan, 913 from Kuwait, 56 from Libya, 1,435 from Pakistan, 440 from Syria, 965 from Saudi Arabia, 2,227 from Turkey, and 219 from Yemen. From Nigeria, which is roughly half Muslim, that number is a whopping 6,781. Who knows how many of the roughly 157,000 foreign students from predominantly Muslim countries overstayed their visas? In 2014, ABC news discovered that 58,000 foreign nationals had overstayed their student visas, of which 6,000 represented a “heightened concern.” Again, those numbers only include foreign students.

That Congress has failed to force the administration’s hand on implementing Visa exit-entry, despite the ubiquitous public fear of Islamic terrorism, speaks volumes of their impotence.

It’s also important to note this is another reason the courts can’t save us from Obama’s amnesty. Even though the 5th Circuit Court of Appeals enjoined the issuance of work permits to some illegal aliens, they cannot practically force Obama to begin deporting those who overstayed their visas.

UnitedHealth Says Obamacare Is Costing It Billions

UnitedHealth Group warned nearly two months ago that new customers from the Affordable Care Act exchanges would hurt the insurer’s bottom line, but it looks like it misestimated by how much as enrollments exceeded expectations.

UnitedHealth, the U.S.’s largest insurer, says it will incur as much as $100 million more in losses associated with 2016 ACA plans than previously forecast. That brings total ACA plan loss projections for its new fiscal year to more than $500 million, up from previous estimates of $400 million to $425 million.

The company said it would reconsider its participation in the government-mandated exchanges, according to statements made during UnitedHealths earnings Tuesday . . .

UnitedHealth reported losses of $720 million last year related to exchange enrollees, including $245 million for advance recognition of 2016 losses that aren’t included in the total estimated losses for this year. NICS Performed 23 Million Gun Background Checks in 2015

U.S. Attorney General Loretta Lynch told the Senate Appropriations Committee on Wednesday that the National Instant Criminal Background Check System (NICS) performed over 23 million gun background checks in fiscal year 2015 and a record 3 million requests in December alone – the highest number of monthly requests since after the Sandy Hook shooting massacre in December 2012.

Sen. Christopher Murphy (D-Conn.) asked Lynch what appropriations will be necessary for the Department of Justice (DOJ) to complete its goals as it relates to NICS and the growing number of applications as well as “the increased coordination that we want to see to make sure that we have all of the records uploaded on that system.”

Lynch said the DOJ estimates it would need $121 million to run NICS for fiscal year 2016 and an additional $35 million for fiscal year 2017 “on top of that base figure.”

“That would allow us to maintain the additional positions we hope to add this year. We may not be able to add all of them right away. Ethanol Is the Anchor Baby of Our Economic System

“They won’t be able to be slurping off the gravy train.” ~ Sarah Palin, during her speech endorsing Donald Trump.

Throughout the debate over birthright citizenship last year, we were told by the liberal elites in both parties that foreign nationals have the right to violate our sovereignty, drop an anchor baby in our country, assert jurisdiction, and unilaterally demand citizenship and welfare on the taxpayer dime. At its core, the anchor baby strategy is designed to legitimize an illegitimate entitlement to other people’s sovereignty and money, absent their consent.

In the same respect, we can say the ethanol mandate is the anchor baby of our economic system. Energy is the lifeblood of a free economy. Much like immigration stands at the nexus of our culture, security and fiscal solvency, energy stands at the nexus of the bread and butter economic issues – jobs, income, and cost of living. Rather than allowing Americans to use our freedom to purchase the best form of fuel, the Washington cartel ethanol lobbyists have violated our sovereignty as individual consumers and used the boot of government to mandate that we only purchase fuel blended with their ineffective product.

To paraphrase Donald Trump, only the pathetic losers and dummies in the political establishment could think it’s a good idea to take 40% of the corn crop and shove it into our engines, thereby raising the cost of food and fuel—the two staples of middle class households in America.

Just how devastating is the ethanol mandate?

According to a study cited by the Heartland Institute, families are forced to pay $2,055 more for food every year because 40% of the corn crop – the antecedent of the food chain – is used for fuel. A study from PricewaterhouseCoopers found that restaurants pay $18,000 more per year.

Ethanol is so impotent as a fuel for automobiles that when Rep. Ron DeSantis offered an amendment to repeal the mandate, he was told by the Congressional Budget Office that it would increase the deficit by decreasing tax revenue. How? By alleviating consumers from purchasing diluted fuel and allowing them to actually fill up their tanks with unvarnished gasoline, motorists wouldn’t have to refill their tanks as often as they do now. That would result in less revenue for the government!

Hence, we have an entire venture socialist, government/corporate racket embedded in our economy that relies upon coercing individuals to purchase a terrible product. Much like Obamacare has wreaked havoc on affordable insurance plans, we have an energy mandate that bankrupts food producers, restaurants, and consumers, all so a few cronies can slurp off the gravy train.

The ethanol mandate was foisted upon the American people by the establishment in both parties. Not surprisingly, Iowa Gov. Terry Branstad, who is the textbook definition of the GOP establishment, is trashing Ted Cruz for opposing the anchor baby of energy policy. Evidently, Donald Trump loves the establishment so long as they support the ethanol anchor baby.

Over the past few months, I’ve criticized some of the “D.C. conservative movement types” for focusing on small-potato issues while ignoring the issues pertaining to our sovereignty, security, and society. But ethanol is not some in-the-weeds fiscal issue. It pollutes the lifeblood of our free economy and represents the most tyrannical venture socialist policies of the political establishment. To force Americans to purchase the defective product of well-connected cronies to service our most vital needs is a violation of our individual sovereignty the same way unconditional birthright citizenship violates our national sovereignty.

Nobody can call themselves a conservative, much less a populist conservative, and associate themselves with the ethanol gravy train. To quote Joe Biden: the ethanol mandate is a “big…deal.”

Sarah Palin is absolutely right to rail against the crony capitalists and those who slurp off the gravy train. Hopefully she will convince Donald Trump to change his mind and ignore the gravy-slurping Terry Branstad and deport the anchor baby of our economy – once and for all. Shocking Truth About Trump and 9/11 Charities Revealed – He Wants This Kept Quiet

By Randy DeSoto. Donald Trump, who played the “9/11 card” against Sen. Ted Cruz during last week’s Republican debate, reportedly was not very charitable in the aftermath of the attacks towards his fellow New Yorkers–but the campaign disputes these findings.

As reported by Western Journalism, when Cruz accused Trump of having New York values that do not resonate in Iowa, the candidate responded, “New York is a great place. It’s got great people. It’s got loving people, wonderful people. When the World Trade Center came down, I saw something no place on earth could have handled more beautifully, more humanely than New York.”

According to RedState, though the billionaire candidate spoke eloquently about New York values, he did not open up his wallet to give to charities supporting the victims of Sept. 11.

RedState cites the Foundation Center, which released a report in 2003 chronicling the “unprecedented outpouring of charitable support that followed the September 11, 2001, terrorist attacks.” The conservative blog found that the Donald J. Red State’s Eric Erickson Weighs in on Trump

By Eric Erickson. I like him personally. I’ve been to his office. I’ve observed him privately dealing with his staff and people coming inside his building. He is personally, when the cameras are turned off, an incredibly gracious person. I know many people who do not believe that because all they see is the public Trump, but when the lights are down, the cameras are turned off, and Donald Trump, not “The Donald”, is present, he’s a good guy.

Not only that, but as I’ve mentioned before, Trump Hotels are some of the best I’ve ever stayed in. I try never to miss an opportunity to stay in the Trump Chicago and the Trump Hotel on Central Park has generated fond memories for my family.

Donald Trump is not my cup of tea as a candidate. I’m more into candidates who try to lift us to the better angels of ourselves and I do not think his campaign is doing that right now. Before I started writing about politics, I worked in politics. As a rule of thumb, I think anger burns out and it is tough to sustain over time. If Donald Trump really has become a conservative, I take St. Paul to heart that we should not put new converts in charge. He needs some time helping the movement before he leads the movement.

At the same time, so many of us, myself included, have been wrong about Trump’s appeal. I have tried to steer clear of the rank condescension towards Trump supporters because a lot of people have legitimate grievances against the government and Trump resonates with them.
