According to recent reports, a Michigan father has come out on top following a legal battle he said began when he was denied access to his daughter’s elementary school.
Kenneth Herman took his local school district to court after repeated efforts to enter the school while openly carrying his handgun in compliance with local law. The issue, he was told, centered around the school’s designation as a gun-free zone.
“I think schools being gun-free zones is not a wise idea,” he explained to reporters. “I think having law-abiding armed citizens in there provides some measure of protection that isn’t a glass door that can be broken out.”
The district argued that the policy exists to promote the “safety and protection of students,” though its defense did not hold up under Circuit Judge Archie Hayman’s scrutiny.
Citing state law that permits legal concealed carry on public school campuses, Hayman ruled in Herman’s favor.
Michigan Open Carry, which provided legal representation in the case, released a statement applauding the ruling, noting the speed with which it was decided suggested it was “clearly an easy decision” for Hayman. The portion of the federal debt that is subject to a legal limit set by Congress closed Monday, August 10, at $18,112,975,000,000, according to the latest Daily Treasury Statement, which was published at 4:00 p.m. on Tuesday.
That, according to the Treasury’s statements, makes 150 straight days the debt subject to the limit has been frozen at $18,112,975,000,000 . . .
On July 30, Treasury Secretary Jacob Lew sent a letter to the leaders of Congress informing them that he was extending a “debt issuance suspension period” through October 30.
In practice, that means that unless Congress enacts new legislation to increase the limit on the federal debt before then, the Treasury will continue for at least the next eleven weeks to issue Daily Treasury Statements that show the federal debt subject to the limit beginning and ending each day frozen just below that limit.
The Daily Treasury Statement for March 13 was the first to show the debt subject to the limit closing the day at $18,112,975,000,000. Every Daily Treasury Statement since then has reported the same thing: the debt closing the day at $18,112,975,000,000. An opinion piece decrying the POW/MIA flag as “racist” has sparked sharp backlash online.
The Washington Spectator published columnist Rick Perlstein’s piece “The Story of the Other Racist Flag” on Monday. It was later republished by Newsweek.
“You know that racist flag?” Perlstein writes. “The one that supposedly honors history but actually spreads a pernicious myth? And is useful only to venal right-wing politicians who wish to exploit hatred by calling it heritage? It’s past time to pull it down”. . .
These excerpts from the piece outline his argument:
“Richard Nixon invented the cult of the ‘POW/MIA’ in order to justify the carnage in Vietnam in a way that rendered the United States as its sole victim.
“Downed pilots whose bodies were not recovered…had once been classified ‘Killed in Action/Body Unrecovered.’ During the Nixon years, the Pentagon moved them into a newly invented ‘Missing in Action’ column. That proved convenient, for, after years of playing down the existence of American prisoners in Vietnam, in 1969, the new president suddenly decided to play them up.

According to Gallup, nearly one quarter of Hispanics do not favor a path to citizenship for illegal immigrants.
The Gallup poll, conducted June 15-July 10, is the latest update from Gallup’s 2015 Minority Rights and Relations poll and includes larger samples of blacks and Hispanics. “The 2006 survey was the last time Gallup asked the question in a poll that included an expanded sample of Hispanics. Whites’ and blacks’ views are largely unchanged since then” . . .
The more recent poll, however, suggests more than a slight drop. Now seventy seven percent (77%) of Hispanics, “about half of whom are immigrants themselves,” are more likely to favor a path to citizenship for immigrants who are in the U.S. illegally . . .
Indeed, fourteen percent (14%) of Hispanics polled in the survey said that they believed the government should “allow illegal immigrants to remain in the United States in order to work, but only for a limited amount of time.” Meanwhile, eight percent (8%) of Hispanics polled said that the government should “deport all illegal immigrants back to their home country.” (Read more from “Here’s the Amount of Hispanics Who Do Not Favor a Path to Citizenship for Illegal Aliens” HERE)

Rank-and-file GOP House members are now confronted with an important question: do they want to head into a presidential election with a leader who is unpopular with their own voters and hated by Independents?
Gallup released a poll today showing that just 23% of Americans view Speaker John Boehner favorably. A clear majority have an unfavorable view of him.
What is more revealing is that Boehner is under water in terms of approval with his own party.
Just 37% of Republicans have a favorable view of the Speaker, while 42% view him unfavorably. His numbers are atrocious among Independents – 17%-57%. Gallup notes that McConnell is also unusually unpopular with his own party. His only saving grace is that so many people have never heard of him. However, as witnessed by the spontaneous applause at the GOP debate when Sen. Ted Cruz called him a liar, the more Republicans know about him the more they dislike him.
When was the last time sitting GOP congressional leaders were this unpopular with their own party? When Gallup asked the same question about then-Speaker Nancy Pelosi in October 2010, although she was also very unpopular overall, only 22% of Democrats viewed her unfavorably compared to 42% of Republicans souring on Boehner this year.
Why are Republicans so dispirited about their leaders? What about Independents? Is it because they are too conservative and too aggressive in opposing Obama’s agenda? Clearly not. As indicated by the recent Pew poll, this Congress is rated much lower than the Gingrich-era Congress, even though the ’95 Republicans were more spirited in pushing a bold agenda against a more popular and less radical Democrat president.
Had this dynamic unfolded anywhere in the private sector, the corporate board would have fired a CEO like John Boehner long ago. Sadly, in the public sector, and particularly in the Republican Party, failure often seems to be a resume enhancer.
Those House conservatives who are reticent about the effort to fire Boehner are not only responsible for the devastating Obama policies that will go unchecked, they must now contend with the reality of losing the White House because of unpopular leadership. Two top aides to Hillary Clinton gave assurances to a federal judge Wednesday that they will not delete any emails or other records related to their work at the State Department during Clinton’s tenure as America’s top diplomat.
Lawyers for former Clinton Chief of Staff Cheryl Mills and Deputy Chief of Staff Huma Abedin told the State Department they would abide by U.S. District Judge Emmet Sullivan’s request that they not erase any copies of federal records in their possession.
In addition, Clinton lawyer David Kendall confirmed that a Colorado technology firm on Wednesday turned over to the Justice Department the private server which housed Clinton’s emails while she served as secretary of state. He also said he’d produced three thumb drives with Clinton’s digital copies of emails she gave State in paper form last December.
“We have voluntarily provided to the Department of Justice on August 6, 2015, the .pst file containing electronic copies of the 55,000 pages of emails on a thumb drive (along with two copies), which had been securely stored in my possession, after receiving from the Department of Justice an assurance that it would maintain this file in an appropriately secure manner and the Department’s opinion that such maintenance would satisfy any preservation obligations I am under,” Kendall wrote Wednesday to Undersecretary of State for Management Patrick Kennedy.
“Similarly, Platte River Networks is today providing to the Department of Justice the server and related equipment on which emails to and from Secretary Clinton’s clintonemail.com were stored from 2009-2013 and which PRN took possession of in 2013,” Kendall added. “This is following the Department of Justice’s assurances to us and to counsel for PRN that it would maintain this equipment in an appropriately secure manner.” (Read more from “Clinton Aides Vow Not to Destroy Emails” HERE)
By Elise Labbot. Hillary Clinton agreed to turn over her private email server to authorities on Tuesday, the same day an intelligence community inspector general told congressional committees that at least five emails from the server did contain classified information.
The decision to hand over the server, as well as a thumb drive of all her work-related emails to the Justice Department, represents an effort to blunt an expanding probe into the use of a private email account.
Clinton, now the Democratic presidential front-runner, “directed her team to give her email server that was used during her tenure as (Secretary of State) to the Department of Justice, as well as a thumb drive containing copies of her emails already provided to the State Department,” her spokesman, Nick Merrill, told CNN early Tuesday evening. “She pledged to cooperate with the government’s security inquiry, and if there are more questions, we will continue to address them.”
Merrill said in the meantime, Clinton’s team “has worked with the State Department to ensure her emails are stored in a safe and secure manner.”
The FBI, which is handling the matter, declined to comment Tuesday evening. David E. Kendall, Clinton’s lawyer, did not immediately return messages seeking comment. (Read more from “Hillary Clinton to Turn Over Private Email Server to Justice Department” HERE)
Hillary Clinton Swears: I Turned Over All My Required E-Mails
By Rosalind S. Helderman. Democratic presidential front-runner Hillary Rodham Clinton, facing questions over her use of a private e-mail system while secretary of state, signed a statement over the weekend declaring “under penalty of perjury” that she has turned over to the government all of the e-mails that were federal records.
The statement, which the State Department submitted to a federal court Monday, matches what she and her campaign have said for months about her exclusive use of a private e-mail account and server to conduct public business.
But it comes as Republicans have charged that Clinton may have withheld some correspondence that should have been part of the public record.
Clinton’s e-mail practices have also drawn scrutiny in recent days from the FBI, which is examining the security of the setup in the wake of a finding by government officials that classified material was sent through the system. Officials have said that Clinton is not a target of the investigation.
In a statement that begins, “I, Hillary Rodham Clinton, declare under penalty of perjury that the following is true and correct,” Clinton also acknowledges that her top aide, Huma Abedin, used an account on the same private domain for public business. She states that another aide, Cheryl Mills, did not use the domain, clintonemail.com. (Read more from this story HERE)

By Tom Tillison. Donald Trump fired a new salvo Monday in his ongoing feud with Megyn Kelly.
The real estate tycoon-turned-Republican-presidential-front-runner upped the ante against the popular Fox News host when he posted a link on social media to an interview Kelly participated in five years ago with smut-king Howard Stern. The interview is pretty raunchy, from Stern’s end, naturally, and touches on the size of Kelly’s breasts, her husband’s penis size and includes some graphic sex talk.
Trump also offered an opinion who’s more “innocent.”
Megyn Kelly Talks With Howard Stern, and It’s Repulsive
By Greg Richter. Megyn Kelly may have suggested that she was turned off by Donald Trump’s sexist remarks, but that didn’t stop her from rollicking with Howard Stern, discussing her breasts and her husband’s penis size and engaging in some graphic sex talk.
Stern has been accused of being tough on women, such as in 2013 when he called “Girls” actress Lena Dunham “a little fat girl who kinda looks like Jonah Hill, and she keeps taking her clothes off, and it kind of feels like rape.” He also is known for having women remove all their clothing during his radio broadcasts while he ogles and describes them.
In a 2010 interview, the Fox News star laughed with glee as Stern talked about her breasts.
“We used to call them ‘Killer B’s’ then when I got pregnant they became ‘Swimmin’ C’s’ and Doug was frolicking in the ocean,” Kelly said of her husband, author Douglas Brunt.
Stern asked whether she would have considered not marrying Brunt if his penis had been small. (Read more from “Megyn Kelly Talks With Howard Stern, and It’s Repulsive” HERE)

By Albuquerque Journal. Gov. Susana Martinez said New Mexico will declare a state of emergency this afternoon as a result of the 3-million-gallon yellow plume of toxic waste dumped into the Animas River and making its way through this state into the San Juan River toward Lake Powell in Utah on Monday.
The governor’s declaration, which she said would occur this afternoon, follows other emergency declarations in Colorado and on the Navajo Nation Monday.
Some drinking water systems on the Navajo Nation, which spans parts of New Mexico, Arizona and Utah, have shut down their intake systems and stopped diverting water from the river. Drinking water is being hauled to some communities.
Navajo President Russell Begaye said the tribe is frustrated with U.S. Environmental Protection Agency and he plans to take legal action. An EPA-supervised crew has been blamed for causing the spill while attempting to clean up the mine area.
Elsewhere, farms along the Animas and San Juan river valleys in northwestern New Mexico have no water to irrigate their crops after the spill. (Read more from “New Mexico Declares State of Emergency After Toxic Waste Spill” HERE)
State of Emergency: Colorado Wastewater Leak Far Exceeds First Estimates
By Erin McClam. Gov. John Hickenlooper of Colorado declared a state of emergency on Monday, five days after a spill that sent toxic water seeping from an abandoned gold mine and turned a river orange.
The Environmental Protection Agency said Sunday that 3 million gallons of wastewater had spilled, three times as much as earlier estimates, and that health risks to humans and aquatic life were not yet clear.
Hickenlooper said the disaster declaration would allow him to use $500,000 from the state’s disaster fund to pay for the response. Some of the money will go toward towns and businesses hurt by the spill.
“We will work closely with the EPA to continue to measure water quality as it returns to normal, but also to work together to assess other mines throughout the state to make sure this doesn’t happen again,” the governor said in a statement.
On Wednesday, an EPA-supervised cleanup crew accidentally breached a debris dam that had formed inside the Gold King Mine, shuttered since 1923, sending a yellow-orange sludge leaking into the Animas River. (Read more from this story HERE)

Perhaps the most enlightening, yet underreported moment during last Thursday’s debate was when the crowd started cheering at the mention of Texas Senator Ted Cruz calling Senate Majority Leader Mitch McConnell a liar. Yes, indeed the GOP base is more offended by the GOP establishment than any outrageous and offensive thing Donald Trump has said. It’s time for elected Republicans and the rest of the presidential field to follow their base.
At this point, there is nothing more important than using the power of the purse to stop Obama’s increasingly dangerous lawlessness. But that will never occur unless there is an immediate change in leadership. Mitch McConnell has made it clear to Obama that he will never force a budget fight – no matter what Obama chooses to do in the coming weeks. Not even the thousands of lost coal jobs in his state will prompt him to fulfill his campaign promises.
After several bloody weeks last month of murders at the hands of illegal aliens, nothing illustrates the crisis at hand more than the story of Marilyn Pharis. On July 24, Victor Aureliano Martinez Ramirez, an illegal alien from Mexico, broke into Pharis’ home at night with an accomplice and beat her with a claw hammer, raped her, and strangled her to death.
So who is Victor Ramirez? Fox reports:
Ramirez has been arrested six times in last 15 months, for crimes including sexual assault, possession of methamphetamine and weapons and driving without a license. His most recent arrest occurred just eight days before the attack on Pharis.
U.S. Immigration and Customs Enforcement admitted in a statement it did not issue an immigration detainer, which would have led to deportation, for Ramirez following the most recent arrest. The agency said its decision was “based on the agency’s enforcement priorities after a thorough review of his case history showed he had no prior deportations or felony criminal convictions.”
You read that correctly. Even an illegal alien with six arrests, for crimes including sexual assault, was not considered a priority under Obama’s amnesty and new “Priority Enforcement Program (PEP)” that Obama established to supplant the effective Secure Communities program. As Santa Maria Police Chief Ralph Martin candidly said, “I am not remiss to say that from Washington DC to Sacramento, there is a blood trail to Marilyn Pharis’ bedroom.”
There is a trail of blood flowing from the White House across America – the blood of thousands of aborted babies funded by taxpayers and the blood of Americans killed by illegal aliens who were set free by Obama’s lawlessness.
Both the GOP presidential candidates and congressional Republicans have a choice to make as it relates to this issue.
For presidential candidates, will they get sucked in to the “flowing blood” tabloid scandal between Trump and Megyn Kelly or will they focus on the blood trail of Obama’s amnesty and hold rallies with victims of illegal immigration?
It is truly a shame that every American has heard about Megyn Kelly but so few know about Marilyn Pharis and Margaret Kostelnik – the two most recent victims of illegal aliens. But here’s the good news: all of those candidates and elected officials trying to run as conservatives have the opportunity to change that.
For congressional Republicans, will they fight to defund Obama’s amnesty and tie all DHS funding to the restoration of the Secure Communities program or will they be complicit in this avoidable lawlessness? Will they continue to follow their failed leaders and the current course into an electoral abyss, as proven by the decline in Republicans favorability rating?
Last week, Mitch McConnell reiterated has fervent opposition to any budget battle with Obama, once again revoking the power of the purse from the hands of the people’s representatives. Unfortunately, there is no practical way, unlike in the House, to remove McConnell from power because he is appointed by the party, not the entire Senate body. This is why it is even more important to preserve the power of the purse in the people’s House and use it as the last remaining deterrent against Obama’s dangerous and lawless policies for the next 17 months. And in the House, where Speaker John Boehner is elected by the full body, conservatives have the ability to join with Democrats and vote him out any time, as Rep. Mark Meadows (R-NC) has demonstrated.
When Meadows introduced the resolution to toss out Boehner, some of his “conservative colleagues” trashed him to the liberal media, insinuating that he acted irresponsibly. But they are the ones who are irresponsible for keeping a leader who will be complicit in the literal bloodletting of Americans – both at the hands of illegal aliens and Planned Parenthood – by not using the congressional power of the purse in September. McConnell’s recent comments about ceding that power to Obama should make it clear that Meadows was right to go after Boehner so that there is at least one leader in one house of Congress committed to fighting this insanity.
