Could Trump Get a Third Term? Law Professor Explains

President Donald Trump could not run for a third term, but he could be president a third time, according to Cornell law professor Bill Jacobson.

The 22nd Amendment to the U.S. Constitution is clear that no one can be elected to the office of the president “more than twice.”

“But there’s nothing in the Constitution that prohibits someone from serving a third term,” said Jacobson, founder and publisher of Legal Insurrection. If another candidate won the presidential election, and Trump was his or her vice presidential running mate, that candidate could step aside after winning the race and allow Trump to take over, according to Jacobson, who was quick to add he doesn’t endorse such an action.

While a deal made with a running mate for Trump to serve a third term “does not violate the Constitution,” Jacobson says, it “might violate the spirit of the Constitution.”

The intent of the 22nd Amendment is “that we not have a permanent president,” Jacobson said, adding that because of that, serving a third term “might be subject to challenge,” adding:

It might be subject to what was the original meaning of these terms. But on its face, there’s no barrier.

Matt Taibbi Files $10 Million Libel Lawsuit Against Democratic Congresswoman

Independent journalist Matt Taibbi filed a $10 million libel lawsuit against a Democratic congresswoman on Thursday for allegedly falsely accusing him of sexual harassment and amplifying her claim on her social media accounts.

Taibbi sued Representative Sydney Kamlager-Dove (D., Calif.) in New Jersey federal court for calling him a “serial sexual harasser” during a House Foreign Affairs subcommittee hearing Tuesday about online censorship.

“These statements are demonstrably false and were made with actual malice—either with knowledge of their falsity or with reckless disregard for their truth,” Taibbi’s lawsuit reads.

“The allegations echo prior false claims that have been the subject of legal action and multiple public corrections, of which Defendant was undoubtedly aware, evidencing her actual malice.”

Kamlager-Dove criticized Republicans at the start of the hearing for “elevating a serial sexual harrasser as their star witness.” Her statements at the hearing are protected by the Speech and Debate Clause of the Constitution, but Taibbi’s lawsuit argues that her online amplification of those statements is not, because it falls outside her legislative duties. DOGE Discovers Outlandish Contract to Maintain VA’s Website

The Department of Veterans Affairs (VA) paid hundreds of thousands of dollars a month for website changes before canceling the contract and having an internal staffer take over, according to the Department of Government Efficiency (DOGE).

While combing through loads and loads of data, DOGE discovered a previous contract by the VA for its website maintenance.

“Good work by @DeptVetAffairs,” DOGE said in a post on X on Wednesday. “VA was previously paying ~$380,000/month for minor website modifications. That contract has not been renewed, and the same work is now being executed by 1 internal VA software engineer spending ~10 hours/week.”

Fox News Digital has reached out to the VA for comment about the former contract.

Trump Treasury Secretary Has a Message for Countries Hit With Reciprocal Tariffs

Treasury Secretary Scott Bessent offered a three-word reply on Wednesday to countries looking to respond to the United States’ broad tariffs: “Do not retaliate.”

President Donald Trump announced on his self-proclaimed “Liberation Day” a 10% baseline tariff across the board and retaliatory tariffs on some of the country’s closest allies, who he says are taking advantage of the U.S.

Among some of the notable tariffs are 34% on China, 20% on the European Union, 24% on Japan and 32% on Taiwan.

The tariffs on China increased to 54% due to an existing 20% tariff.

“My advice to every country right now is do not retaliate. Sit back, take it in, let’s see how it goes. Because if you retaliate, there will be escalation,” Bessent said Wednesday in an interview on “Special Report” shortly after the announcement. “If you don’t retaliate, this is the high-water mark.”

Another Leak: Mike Waltz’s Staff Set Up at Least 20 Signal Chat Groups

. . .President Trump’s National Security Advisor Mike Waltz’s staffers set up at least 20 other Signal chat groups to discuss Ukraine, China, Russia and more.

At least four people added to the Signal groups anonymously told Politico about the chats.

Politico reported:

National security adviser Mike Waltz’s team regularly set up chats on Signal to coordinate official work on issues including Ukraine, China, Gaza, Middle East policy, Africa and Europe, according to four people who have been personally added to Signal chats.

Two of the people said they were in or have direct knowledge of at least 20 such chats. All four said they saw instances of sensitive information being discussed.

Mike Waltz is already under fire for adding The Atlantic editor Jeffrey Goldberg to a Signal chat group with high-ranking Trump Administration officials discussing the successful attack on Houthi terrorists in Yemen. FBI Whistleblower Pushed Out Under Biden Wins Battle To Publish Documents That Ended His Career

By Daily Caller. A Federal Bureau of Investigation (FBI) agent who was forced out for refusing to sign off on a warrant into a right-wing “domestic extremist group” has won a fight to unseal documents related to that case.

Zach Schoffstall, a former supervisory agent in the FBI’s Salt Lake City division, was forced out of the FBI during the Biden administration for not going after the Patriot Front organization, the Daily Caller previously reported.

Empower Oversight, a group that represents whistleblowers, filed a motion to request the government unseal the warrant. After 90 days, the government finally acquiesced and released the document, Schoffstall said. The only information redacted was the name of the supervisory agent.

Thirty-one members of the group Patriot Front were arrested after protesting an LGBT event in Idaho and charged with conspiracy to riot in 2022.

The U.S. Attorney’s Office (USAO) in Idaho and the FBI pressured Schoffstall to sign off on the warrant, but he refused. The government attempted to find agents who would comply, including one without knowledge of the investigation, he previously told the Caller. FBI Whistleblower Charged with Disclosing Confidential Records After Accusing Agency of Political Bias

By Whistleblower Network News. Describing himself as one of the “most significant whistleblowers in FBI history,” 15-year veteran FBI Special Agent Johnathan Buma was arrested at John F. Kennedy International Airport on March 17, 2025, as he was attempting to board an outbound international flight. Roughly a day later, a criminal charge was filed in the California Central District Court claiming that Buma disclosed classified information about FBI investigations and confidential informants.

According to a court-filed affidavit, Buma had allegedly sent emails and messages that contained excerpts of a prospective book about his career at the FBI. Some of the sensitive information that Buma reportedly disclosed related to “the FBI’s efforts and investigations into a foreign country’s weapon of mass destruction (‘WMD’) program.” Buma had also purportedly given “authorization” to the recipients to share the restricted details.

During the first Trump Administration, Buma blew the whistle on alleged political bias by the FBI. In a 2024 interview with Business Insider, Buma revealed that in 2019, he provided different sets of unverified information to his supervisor at the FBI field office in Los Angeles for potential action. The first possible case involved Hunter Biden and potential criminal activity regarding the Ukrainian energy company Burisma. According to Buma, his supervisor was “interested and adamant about…transferring [the case] to the appropriate case agent right away.” In the same meeting, Buma offered potentially lucrative information about former Trump legal associate Rudy Giuliani, but his supervisor allegedly “shut [him] down immediately.” The information alleged that Giuliani had been compromised by Russian counterintelligence and organized crime operations.

After this, Buma claimed his work became more scrutinized, sometimes calling his workplace treatment “intolerable.” In January 2022, he filed a whistleblower complaint and testified before the Senate Judiciary Committee, alleging “numerous acts of intelligence repression.” Buma then explained that “no actions were ever taken to correct ongoing reprisals and suppression of intelligence” and that he experienced even harsher repression once he filed to become a whistleblower. Additionally, he was reassigned from working with confidential human sources (CHS) to a surveillance squad, which he called “the Alaska of L.A.” due to its isolation and uncontroversial nature compared to Buma’s previous position. Trump ‘Not Joking’ About Third Term — and Notes This Apparent Loophole: ‘There Are Methods’

Trump, 78, told NBC’s Kristen Welker in a Sunday morning phone call that “a lot of people want me to do it.”

Trump claimed that “there are methods which you could do it,” including having Vice President JD Vance, 40, run for president with Trump as his vice president. Vance would then resign to allow Trump to regain the top job.

“But there are others too,” Trump said, without elaboration.

The 22nd Amendment, ratified in 1951, says “no person shall be elected to the office of the President more than twice” — allowing for the potential loophole of Vance resigning in Trump’s favor.

The New York Times editorial board just discovered what conservatives have been saying for years: the Democratic Party is completely out of touch with everyday Americans.

Party leaders insist their policies are popular but that voter apathy—rather than a genuine shift toward Trump—led to their losses. DNC Chairman Ken Martin claims Democrats simply need to “connect” their message better, while Minnesota Gov. Tim Walz dismisses the idea of winning over Trump voters, instead focusing on mobilizing those who stayed home.
