What You Need to Know About the Obamacare Program Criticized as a ‘Bailout’ for Insurers

In their lists of demands for the $1.- trillion omnibus spending bill, Republican lawmakers and leaders of conservative groups are calling on House and Senate leadership to stymie the federal government’s ability to use taxpayer dollars to pay insurance companies through Obamacare’s risk corridor program.

But what exactly is the risk corridor program, and how does it work?

Implemented under the health care law and in effect until 2017, the risk corridor program is one of the “three Rs”—alongside risk adjustment and reinsurance—designed to provide protections for insurers and spread the potential risk some may encounter by insuring more unhealthy patients than in the past.

The program’s goal is to limit excess losses and gains incurred by insurance companies selling plans on the federal and state-run exchanges. Insurers that profit each year above a certain threshold pay into the program, while those that lose money receive payments from the federal government.

The crafters of the Affordable Care Act modeled the risk corridor program after a plan set up under Medicare Part D prescription drug coverage, and though the programs differ, they both seek to accomplish the same goal of spreading out the risk for insurers.

Under the risk corridor program, insurance companies selling plans on the exchanges determine the actual cost of claims compared to their expected cost of claims, which are reflected in premium prices. And that difference determines whether an insurer will share some of its profits with the federal government or receive money from the government.

According to the Centers for Medicare and Medicaid Services, if an insurer’s actual claims are within 3 percent of its expected claims, the insurer will either keep the profits or bear the full losses.

However, if an insurer’s actual claims are more than 3 percent of its expected claims, the federal government will reimburse the company for at least half of what it lost.

By contrast, if an insurer’s actual claims are less than expected plans by more than 3 percent, the insurer pays the Department of Health and Human Services at least half of the excess profits.

In the event that the federal government fails to collect enough from profitable insurers to cover others’ losses, the taxpayers will be forced the cover the difference.

Though the program implemented under Medicare Part D has been called successful, Republican lawmakers, led by Sen. Marco Rubio, R-Fla., have criticized Obamacare’s risk corridor program, calling it a taxpayer-funded “bailout” for insurance companies.

Since 2013, Rubio has been working to limit the use of taxpayer dollars for the risk corridor program, first by introducing legislation to repeal the Obamacare provision that established and administered it.

Though Rubio’s bill stalled in the Senate, Republicans negotiated a policy rider included in a must-pass government spending bill last year that limited the amount of money available for the program. Under the measure, the Centers for Medicare and Medicaid Services was prohibited from using taxpayer dollars for the risk corridor program and instead had to rely solely on fees collected from the insurance companies themselves.

In October, the Centers for Medicare and Medicaid Services announced it took in just $362 million from profitable insurers. Insurance companies that lost money, meanwhile, requested $2.87 billion.

Because the government received far less from successful insurers than what was requested by those who were less profitable in 2014, the Centers for Medicare and Medicaid Services informed insurers they would receive 12.6 percent of their requested risk corridor payments.

Rubio is still working to repeal the risk corridor program and introduced legislation in the Senate once again doing so. Additionally, he and conservative House members are calling on House and Senate leadership to limit the use of taxpayer dollars for the risk corridor program in this year’s omnibus spending bill, which Congress has until Dec. 11 to pass. 9 Harmful Policies GOP Must Block in Budget Bill

“This power over the purse may, in fact, be regarded as the most complete and effectual weapon with which any constitution can arm the immediate representatives of the people, for obtaining a redress of every grievance, and for carrying into effect every just and salutary measure.” James Madison, Federalist #58

This week will serve as the harbinger for how dramatically Obama will be able to “fundamentally transform” America during his final year in office — coinciding with a time of unprecedented domestic and international security threats.

When the voters elect a divided government, the expectation is that each side will have to implement some policies that the other dislikes. With Republicans in control of Congress and the purse strings that come with that power, the December budget bill will be the last opportunity to redress the grievances from which the American people seek relief. This is a time for Republicans to fight for a number of policies that, if not rescinded, will cause irrevocable damage to either our security or our economy. Particularly in Obama’s final year it is vital that Republicans preemptively curb him from consummating the great fundamental transformation.
While there are endless liberal policies conservatives would love to block in the budget bill, there are certain items that must be defunded now and cannot wait for the next president.

Stop Obama’s Dangerous Refugee Program

Republicans are floating the idea of attaching their phony refugee bill to the omnibus. Their bill will not shut down the program; the best way to prevent future radical Islamists from entering our nation. It’s time Republicans harness the overwhelming public opposition to refugee resettlement and defund the entire program for the rest of the fiscal year until the Government Accountability Office conducts a full audit of the program’s security problems and fiscal cost. As Sen. Jeff Sessions noted, if Republicans fund refugee resettlement in the omnibus, December 11 will truly be a date that will live in infamy. The details of the San Bernardino terror attack demonstrate just how dangerous our immigration policies can be. The budget bill will provide Congress with the last chance to block the new immigration of radical sharia-adherent Muslims from Syria and potential terrorists like Tafsheen Malik.
Republicans should force Democrats into the awkward position defending terrorists.

Defund Amnesty

The release of tens of thousands of dangerous criminal aliens into our communities is undoubtedly the biggest threat to our security for the remainder of this presidency.

But the problem is not only limited to sanctuary cities. It’s localities, such as Frederick County, Maryland, that want to cooperate with ICE but are stymied from doing so. Why? Because Obama has essentially repealed the Secure Communities and 287(g) programs designed to coordinate and train local law enforcement in helping with immigration enforcement. Republicans must condition funding for DHS to the reinstatement of Secure Communities and 287(g). They must also defund DACA, which is still incentivizing a massive border surge to this very day. And obviously, they must defund sanctuary cities. We cannot afford another year of mass illegal immigration. Yet, at present, as Sen. Jeff Sessions (R-AL) noted, Republicans are planning to fund every aspect of Obama’s amnesty agenda in the Omnibus.

At a time when we have record immigration from the Muslim world, in conjunction with no deportations, no visa tracking, and an open border, we have never been more vulnerable to a terror attack. This cannot stand another year.

Defund Planned Parenthood

Republicans will never have as much momentum behind defunding Planned Parenthood as they do now. Given the shocking video exposés of their harvesting and selling of baby organs and the fact that the organization is under criminal investigation, there is no excuse for Republicans to grant them new taxpayer funds. Besides, there is never a bad time to defund taxpayer-funded murder.

Stop Arming Syrian Rebels and Iraq Army

We should not spend another dime and another year arming rebels in Syria that are either infiltrated or over-run by Al Qaeda. Ditto for the Iraqi army, which is either inept or a proxy for Iran. Let’s stop arming our enemies and save ourselves hundreds of millions while we are at it. What is so disconcerting is that Syed Farook, the San Bernardino terrorist, had contacts with Al Nusra, the very terror group that has received light and heavy arms from our very own CIA. This cannot be allowed to continue.

Stop Aid to the Palestinian Authority

It’s never a bad time to stop funding the Palestinians. But with the sick stabbing intifada under way in Israel, and now under way in some U.S. cities, isn’t it time we end the $500 million in U.S. aid to this decedent and corrupt organization? Republicans should also defund the United Nations Relief and Works Agency. Every year, the U.S. contributes roughly $275 million a year to this multinational group that has long harbored Palestinian terrorists under the guise of humanitarian aid. Republicans should force Democrats into the awkward position defending terrorists.

Block Obama’s Jailbreak

In addition to setting criminal aliens free, Obama has made it the top priority of his final year to let out as many violent criminals from the federal prison system as possible. Instead of fighting his jailbreak, Republicans at all levels, including Paul Ryan, are seeking to codify his agenda with legislative jailbreak. Republicans would be wise to reverse course and defund any additional prison release for the remainder of this presidency.

Block Gun Control

Given everything that is transpiring with the aforementioned issues — record Islamic immigration, rampant criminal aliens, and mass prison releases — there is no time of greater danger for the American people than now. Consequently, the Second Amendment is more important than ever. Yet, in all likelihood Obama will pull the trigger on gun restrictions via administrative fiat during his final year. Republicans must insert a provision prohibiting any new administrative regulation on firearms or ammo during the next fiscal year.

Block Environmental Regulations

Even if by some miracle Obama is thwarted from implementing his societal changes and threatening our security, he is inexorably committed to remaking our economy through last minute energy regulations. He already announced his intention to cut carbon emissions of power plants by 32%, essentially ensuring that not a single new power plant will be built on our soil. Give that energy is the lifeblood of our economy and Obama’s final year in office will likely be spent targeting that lifeblood, Republicans must preempt this plan by prohibiting the promulgation of any new regulations on power plants for the rest of his presidency.

Block Obama’s Social Engineering in the Military

Last week, Obama’s Defense Secretary announced a shocking plan to coerce all military service branches into opening every single combat position to women. Even if this wasn’t a time of war, such a move is absurd, dangerous, and further degrades the morale and combat readiness of our military.

The Marine Corp conducted a painstaking study on this issue and found conclusively that placing women in direct ground combat unity, much less Special Forces, would harm their effectiveness. A recent survey showed near unanimity of opinion among special operators in opposition to women joining their ranks. By allowing this new edict to slide, as most Republicans plan to do, they will be complicit in causing irrevocable damage on our military at a time of grave national security concerns. They must attack a provision to defense funding blocking the Pentagon from implementing their women in combat plan against the wishes of the commanders in the field.

Don’t hold your breath for Republicans to fight in a meaningful was on any of the aforementioned issues. But it’s important to reflect upon the common sense actions a legitimate opposition party in control of the congressional purse strings would take in defense of the nation’s sovereignty, security, and society. Security Committee Chair: Hillary, Obama to Blame for ISIS

The Republican chairman of the House Homeland Security Committee, claiming that the U.S. faces its highest security threat since 9/11, on Wednesday put the blame for it and the rise of the Islamic State squarely on President Obama and his former secretary of state, Hillary Clinton.

“I would say that she and the president are responsible for ISIS rearing its ugly head. They have not effectively dealt with it and that’s going to be a huge campaign issue,” said Rep. Michael McCaul.

The Texas lawmaker said that Clinton failed early in her term as the nation’s top diplomat to handle the Iraq war and stem the resulting terrorism. He said that her policies “imploded Iraq and creates ISIS.” He spoke to reporters at a breakfast sponsored by the Christian Science Monitor.

Welcome to Barack Obama’s America

In the wake of an Oval Office speech which went over so terribly that it has Politico openly wondering whether the entire form of presidential address is dead, yesterday’s announcement from Donald Trump that he believes the U.S. must block all Muslims from entering the country, “until our countries’ representatives can figure out what’s going on”, finally resolves the question about President Obama’s greatest political legacy.

It is no accident that President Obama’s America has given rise to Donald Trump. It is an America that is more tribalist, where people feel more racially and religiously divided; more politically correct, where people feel less free to speak their minds; and it is an America where trust in the nation’s elites, whose skills are credentialed but unproven, are at historic lows.

These are the wages of progressivism at the end of the day. Big government inevitably leads to government incompetence. That incompetence leads to growing and now dominant distrust – both in government’s basic competence, and in the values of the people who still insist upon it. Our modern elites respond to that rational distrust by smearing it as vile hatred, which further divides and toxifies our politics. And Trump is a perfect personality to exploit these divides, offering the promise of an authoritarian who represents the people in place of an authoritarian who represented the elites.

Consider the news that 965,000 migrants have sought asylum in Germany over the past year. Are jihadists using these refugee flows? Walter Russell Mead:

Products of meritocratic selection who hold key positions in the social machine, the bien-pensant custodians of post-historical ideology—editorial writers at the NY Times, staffers in cultural and educational bureaucracies, Eurocratic functionaries, much of the professoriat, the human rights priesthood and so on—are utterly convinced that they see farther and deeper than the less credentialed, less educated, less tolerant and less sophisticated knuckle-dragging also-rans outside the magic circle of post historical groupthink. Fox Suspends Retired Army Officer for ‘Profane’ Response to Obama Speech

Two Fox News contributors were suspended Monday for using inappropriate language about President Barack Obama while discussing his speech on terrorism the night before in two separate episodes.

The analysts, former U.S. Army Lt. Col. Ralph Peters and actress Stacey Dash, were each ordered off the air for two weeks . . .

Obama Now Wants Guns from These 47,000 People

If the federal government doesn’t want the 47,000 people on its No-Fly List to board airplanes, those individuals should be banned from ever owning guns, President Obama argued in his Sunday address from the Oval Office – but if his proposal ever becomes law, America could see U.S. Marines, congressmen, journalists and even federal air marshals mistakenly stripped of their firearms.

“To begin with, Congress should act to make sure no one on a No-Fly List is able to buy a gun,” Obama said Dec. 6. “What could possibly be the argument for allowing a terrorist suspect to but a semi-automatic weapon? This is a matter of national security.”

But while San Bernardino, California, terrorist Syed Rizwan Farook managed to fly to Pakistan and Saudi Arabia under the radar of federal authorities in 2014, thousands of innocent people have been mistakenly linked to U.S. terror watchlists. Some experts and critics contend the federal list process contains many errors and relies on an overly broad standard of reasonable suspicion . . .

Under Obama’s standard, even the late-Sen. Ted Kennedy, an ardent advocate of gun control while he served in Congress, would be blocked from purchasing a firearm.

Open Borders Policies Reveal Obama More Interested in Power than Protecting Americans

As Americans awaken to dangers to our homeland, they are losing confidence in President Obama. A new poll shows Americans’ confidence in President Obama’s efforts to keep us safe after the Paris jihadist attacks is dropping.

Jim Simpson, author of “Red-Green Axis: Refugees, Immigration and the Agenda to Erase America,” has no confidence in the screening or border security policies of the Obama administration. To Simpson, a host of open border policies — including the Refugee Resettlement Program — provide a fertile ground for terrorists to enter the United States. . .

Simpson suggests the rallying cry for congressional Republicans should be a rider offered by Alabama Senator Jeff Sessions on the coming omnibus spending bill. It would, for once, cancel the “blank check” President Obama has for refugee resettlement in the coming government funding bill, giving us “a genuine pause” to ensure our government can protect us. . .

As for the narrative war being waged by President Obama and others against critics of refugees, Simpson reminds us that the Left’s primary counter-argument is always to vilify and destroy their opposition.

The progressives’ goal with open borders, Simpson says, is to overwhelm America with problems while creating a huge new pool of Democrat voters who will only be needed to achieve left-wing goals. Many believe the Left’s efforts to stop voter ID laws, cast as “racist,” is related to the influx of potential new immigrant voters. Choosing National Suicide

As Winston Churchill noted in his indictment of appeasement of Nazi Germany in the 1930s, “there is a great danger in refusing to believe things you do not like.”

Barack Hussein Obama is succeeding in his fundamental transformation; that is, dismantling the United States as a capitalist republic, based on Judeo-Christian democratic principles.

Obama is dangerous as a President because his ideologies, Marxism and sympathy for Islam, drive him to pursue policies that run counter to the national interest, the well-being of the American people and, quite frankly, the survival of the country. His mendacity is compounded by his arrogance and narcissism that prevent him from accepting responsibility and learning from his mistakes. He is not on our side.

People ask – How can this be happening to our country? What can we do to stop it?

It can happen because the political-media establishment does not consider the United States “our” country. The political-media establishment considers the United States “their” country, in which ordinary Americans are permitted to live as long as we elect those they want elected and continue to pay taxes to support their lavish life styles and to maintain the corrupt status quo. Welcome to feudal America.

It can happen because, like Obama, the Democrat Party, the liberal media and academia are populated with the same Islamo-Marxists, a totalitarian marriage of convenience, distinguished by the traits they share – their hatred of Western civilization and a belief that the United States is the embodiment of evil on earth. While Islamic radicals seek to purge the world of heresies and of the infidels who practice them, leftist radicals seek to purge society of the vices allegedly spawned by capitalism — those being racism, sexism, imperialism, and greed. Through unregulated immigration, Democrats seek to alter the demographics of the United States to create a permanent one-party state to implement their far-left totalitarian agenda. Islamists have something similar in mind, albeit even more brutal and oppressive.

It can happen because America’s domestic enemies promulgate notions that attack the basis of Western Judeo-Christian civilization, which emphasizes the uniqueness and sacredness of the individual. They also promote policies that weaken our ability to transmit to the next generation the values and traditions upon which the United States was built e.g. the Common Core assault on American education. Anti-American, messianic political movements can only succeed when the individual believes that his or her actions are determined, not by personal freedom endowed by the Creator, but by the destiny of the community, endowed by a ruling elite of commissars or mullahs.

In can happen in any otherwise sophisticated society that loses a sense of its own history, succumbs to a present-tense culture and embraces the false promises of a leftist utopia in order to generate the truly blissed-out and vacant servitude required by the Obama strategy. Using media deception and historical revisionism, the low-information voter will slouch towards Obama’s utopia by a combination of governmental coercion as in George Orwell’s “Nineteen Eighty-Four” and the hedonist nihilism of a painless, amusement-sodden, and stress-free consensus managed by the nanny-state found in Aldous Huxley’s “Brave New World.

It can happen because the Republican establishment and its propaganda arm, Fox News, choose not to expose and oppose Obama to any extent that it might place in jeopardy their position as junior partners in the corrupt political-media status quo. They are funded by and serve the Chamber of Commerce and a broader class of wealthy global financiers, locusts, who view America as just another landmass and people to exploit. Republicans are not in Congress to represent their constituency or solve the nation’s problems, but to perpetuate themselves in office. As the Republican establishment’s grip on power becomes ever more tenuous, they will more aggressively oppose internal political challenges, whether it is from Donald Trump or the Tea Party and they more eagerly work together with Obama and the Democrats.

Case in point is the cynical piece of legislative window dressing, but appropriately-named SAFE ACT (American Security Against Foreign Enemies), recently passed by a bipartisan “veto-proof” 289-137 majority in the Paul Ryan (R-WI)-led House of Representatives. It is being heralded by the political-media establishment as a bill that would “erect high hurdles for Syrian and Iraqi refugees coming to American shores” and “require new FBI background checks and individual sign-offs from three high-ranking U.S. officials before any refugee could come to the U.S. from Iraq or Syria.” Those descriptions are nonsensical at best, outright lies at worst. FBI Director James Comey already testified before the House Committee on Homeland Security that the federal government does not have the ability to conduct thorough background checks for terrorist ties on all Syrian refugees. The legislation does not cover potential terrorists coming from countries other than Iraq and Syria. Finally, the SAFE ACT gives final approval authority for entry solely to the Obama Administration, which has vowed to flood the country with refugees i.e. to facilitate a Muslim invasion of the U.S. similar to that we are witnessing in Europe, all financed by George Soros. The SAFE ACT does not provide physical safety for the American people, but it does provide political safety for the Republican establishment in the form of disinformation and legislative legerdemain.

In essence, the Republican establishment, in choosing to collaborate with Obama and the Democrats, is choosing national suicide. They prefer that option to representative government.
What can we do to stop it?

More than anything else, the political-media establishment does not want the American people to take back our country. The legislation, executive orders and judicial decisions emanating from Washington D.C. are geared to maintain the status quo or enhance the power of the federal government over the American people.

More than any other time in our history has the separation between the rulers and the ruled been as great and it bears comparison to the events leading up to the American Revolution. Whenever the interests of government officials are in such stark conflict with those of the people, tyranny ensues.

Frederick Douglass wrote: “Power concedes nothing without a demand. It never did, and it never will. Find out just what people will submit to, and you have found out the exact amount of injustice and wrong which will be imposed upon them; and these will continue until they are resisted with either words or blows, or with both. The limits of tyrants are prescribed by the endurance of those whom they oppress.”

Watch: Top U.S. Military Officer Just Broke Ranks to Expose Obama in a Huge Way

The nation’s top ranking military officer contradicted his commander-in-chief, while testifying on Tuesday before the House Services Committee.

Chairman of the Joint Chiefs of Staff Gen. Joseph Dunford stated, “We have not contained ISIL currently.”

His answer to a question by Rep. Randy Forbes, R-Va., runs contrary to what Pres. Obama said last month in an interview with ABC News the day before the Nov. 13 Paris attacks.

“I don’t think they’re gaining strength. What is true is that from the start our goal has been first to contain, and we have contained them,” Obama told George Stephanopoulos. “They have not gained ground in Iraq. And in Syria, they’ll come in, they’ll leave, but you don’t see this systematic march by ISIL across the terrain.”

The White House’s Ben Rhodes–deputy national security adviser for strategic communication–clarified that the president meant that ISIS had been contained from geographic expansion. “They had been on the march in both Iraq and Syria for some time but starting a year ago, we were able to halt that expansion,” Rhodes said according to Fox News.

Forbes asked Dundford if ISIS has been contained at any time since 2010. Democrat: Obama Could Cause Devastating Nuclear War with Russia

President Obama is sending an “expeditionary force” of U.S. military special operators to carry out raids against ISIS in Iraq and Syria, a move that expands on their decision to send about 50 special operators to Syria to coordinate air strikes.

“In full coordination with the Government of Iraq, we’re deploying a specialized expeditionary targeting force to assist Iraqi and Kurdish Peshmerga forces and put even more pressure on [ISIS],” Defense Secretary Ash Carter told the House Armed Services Committee in announcing the new deployment on Tuesday.

Although the term “expeditionary force” evokes large-scale mobilizations such as those seen in World War II or the Iraq War, Carter outlined a more limited deployment. But his announcement still provoked questions about the legal basis for the move, and caused one Democrat to warn of the specter of nuclear war with Russia.

In arguing for the additional force, Carter invoked the recent rescue of ISIS prisoners in Iraq and the raid in Syria that killed a top commander in charge of the terrorist group’s oil and gas operations. “Imagine . . . on a standing basis, being able when occasions arise . . . to conduct raids like that anywhere in the territory of Syria and Iraq. That is what we’re talking about.”

He couldn’t, however, claim the legal authority to make such a deployment under the terms of the 2001 legislation that authorized the use of military force (AUMF) in Afghanistan and Iraq — the only such congressional authorization on the books. “I can’t speak to [that],” Carter told Representative Bradley Byrne (R., Ala.).
