Supreme Court Blows Up DOJ’s Biggest Charges Against Donald Trump

The Supreme Court ruled Friday that the government cannot prosecute January 6 defendants under 1512(c)(2), the “Enron” statute, for generally obstructing “an official proceeding” unless they interfered with objects or documents.

The bombshell decision could result in hundreds of convictions against non-violent January 6 defendants being overturned — and could result in at least some charges being dropped against President Donald Trump as well.

1512(c)(2) was passed after the Enron scandal, when it was discovered that federal law had a loophole: it was illegal to instruct others to destroy evidence, but not illegal to destroy evidence oneself. Consequently, Congress passed a law prohibiting tampering with witnesses or evidence that is to be used in an “official proceeding.” The Department of Justice used that law to prosecute participants in the Capitol riot based on the idea that they had “obstructed” an official proceeding — i.e. the certification of the Electoral College vote in the 2020 presidential election. But critics said that 1512(c)(2) had never been intended to apply to protests or other First Amendment-connected activities.

In a 6-3 decision, with the majority opinion written by Chief Justice John Roberts, the Court overruled the (heavily anti-Trump) D.C. Circuit and said that 1512(c)(2) could not be used as broadly as the Department of Justice had done.

“To prove a violation of Section 1512(c)(2), the Government must establish that the defendant impaired the availability or integrity for use in an official proceeding of records, documents, objects, or as we earlier explained, other things used in the proceeding, or attempted to do so,” Roberts wrote. The term “otherwise” — as in “otherwise obstructs, influences, or impedes any official proceeding” — could not be used so broadly as to include trespassing. Reporters Say Biden Campaign Staff Tried to Stop Them From Interviewing Critical Voters

Reporters claimed Friday that President Joe Biden’s campaign staffers tried to halt their interviews with voters once they started to turn critical of the president following a rough debate showing.

Biden faced off against former President Donald Trump in a rather unprecedented debate format, as the two appeared in the CNN studio on Thursday with no live audience and mics with the ability to be cut off on Friday. Panic set in among Democrats all but 30 minutes into the debate, as the president stumbled through answers, even once appearing to freeze before moderator Jake Tapper bailed him out. The panic became so full-fledged that Democrats even began to call on the president to bow out of the 2024 presidential race.

In the aftermath of the first presidential debate, several reporters claimed that while at campaign events with voters on Friday, Biden campaign staffers tried to cut off the conversation as they moved in a negative direction.

“As I spoke to voters at a Las Vegas rally for Vice President Harris, a Nevada Biden campaign staffer followed me and twice asked that voters end their interviews when their comments turned critical of President Biden,” Simon Levien, a New York Times reporter, wrote.

“You can’t tell me that there’s not anyone better —” a voter told Levien, expressing the desire for a different Democratic presidential candidate.

Biden Just Put on the Most Disastrous Debate Performance in Presidential History

Sure, it might sound like hyperbole, but I can’t think of a more devastating presidential debate performance than the one Joe Biden had in his first meeting with Donald Trump. Indeed, even with abnormally low expectations, Biden tripped over them as if they were sandbags. After watching post-debate reaction, it’s safe to say no presidential debate has ever rattled a political party quite like this one.

The scratchy and frail voice. The speedy mumbling — it was like watching a TV at 2x speed. The overall incoherence. The confused and angry stares. The jumbling of thoughts —“I was recently in, in, in, um, France for D-Day, and I spoke to — all about those heroes that died …” and so on — was relentless. It was difficult to watch.

Recall that Biden’s team, down in the polls, pushed for this debate. Remember that video the president cut mocking and challenging Trump to face him? The Biden team reportedly fought for the strict rules implemented by CNN. Then the president took an entire week off from his job just to prepare for the contest. Letting him debate was political malpractice. Letting him run for the presidency is a dereliction of basic decency.

You remember all that solemn talk about 25th Amendment during Trump’s presidency? Where are these patriots now?

Incidentally, CNN’s debate format was — whether the former president liked it or not — good for Trump. It reined in many of his worst inclinations, while leaving Biden to wander off into verbal dead ends. And though CNN’s Jake Tapper tried to save Biden once or twice, it’s fair to say, on balance, the questions weren’t terrible. Biden Peddles ‘Very Fine People’ Hoax After Even ‘Fact-Checkers’ Admitted It Was a Lie

During Thursday’s presidential debate, Biden accused Trump of calling neo-Nazis “very fine people,” repeating a long-debunked claim regarding Trump’s remarks following a white supremacist rally in Charlottesville.

“[Trump] said, ‘I think there are fine people on both sides,’” Biden claimed at Thursday’s debate. “What American president would ever say Nazis coming out of fields carrying torches, saying the same antisemitic bile, carrying swastikas, are fine people?”

Biden’s claim centers on Trump’s remarks following a 2017 Charlottesville rally, which involved protests and counter-protests over the removal of a Robert E. Lee statue from a park. The protests ended violently when a self-proclaimed “white nationalist” drove his car into the crowd, killing one and injuring 19.

With the help of corporate media, the claim that Trump called neo-Nazis “very fine people” spread shortly after the events, despite Trump condemning them outright.

“But you also had people that were very fine people, on both sides,” Trump said of the Charlottesville protesters and counter-protesters in a news conference days after the events. “I’m not talking about the neo-Nazis and the white nationalists, because they should be condemned totally.”

‘He Failed’: Biden’s Debate Performance Sparks Serious Concern Among Democrats

Some Democrats expressed disappointment about President Joe Biden’s performance in Thursday’s debate against former President Donald Trump—even suggesting he should step down as their 2024 nominee.

A lack of energy, a raspy voice, stuttering, and rambling answers to questions plagued the 81-year-old president, who faces widespread voter concerns about his age.

Media figures reported that Democrat campaign operatives, strategists, and fundraisers considered the debate a blow to Biden’s chances in November.

House Democrats Are Still Going After the Trump Family With Baseless Attacks

Even though Donald Trump left the White House years ago, Democrats still relentlessly go after him and his family for what they perceive to be some sort of influence in a desperate attempt to distract from the influence of the Biden crime family, especially when it comes to First Son Hunter Biden’s shady business dealings.

During Wednesday’s House Oversight Committee on “Defending America from the Chinese Communist Party’s Political Warfare,” Rep. Robert Garcia (D-CA), a particularly relentless member when it comes to attacking Trump and his family, brought up Ivanka Trump and her supposed involvement in China.

“The Trump Crime family took foreign bribes and illegal gifts while in the White House – and now post-presidency,” Garcia claimed in an X post, where he also included a clip of his use of time during the hearing. He even used harsh language, asking, “Where’s that damn investigation?”

“In April of 2017, with Trump’s White House in chaos, many people, including the Chinese government, were all trying to gain influence,” Garcia claimed. “During this time, Ivanka Trump was working in the White House, got preliminary approval for three Chinese trademarks on the same day that Donald Trump had dinner with XI Jinping at Mar-A-Lago. And remember, Ivanka never divested her company while she was working in the White House,” he continued, specifically targeting the former president’s oldest daughter.”

Trump Enters Debate With 18-Point Net Favorable Advantage Over Biden

Gallup shows former President Donald Trump with an 18-point net favorable rating advantage over His Fraudulency Joe Biden.

The last 24 hours have been deliciously and gloriously brutal for Biden supporters, especially those in the corporate media. Two left-wing pollsters show Trump pulling away nationally. Then Nate Silver comes along with a forecast of doom for Hunter’s Dad. Then another left-wing pollster shows Americans believe Trump will do more to defend democracy than President Sundowning.

As far as favorability, talk about a failed Establishment Hate Campaign…

“Both Biden and Trump are viewed unfavorably by majorities of Americans, but Trump’s favorability shows improvement, while Biden’s has worsened,” reports Gallup. “Trump’s favorable rating (46%) has increased by four percentage points since the prior reading in December and is the highest for him since April 2020.”

CNN Touts Debate Rules; Muted Mics at Biden’s Request

CNN is touting the rules for Thursday night’s debate between former President Donald Trump and President Joe Biden, showing how the microphones will work, with one candidate’s mic muted as the other is speaking, per Biden’s direct request.

CNN had a segment on Wednesday showcasing how the microphones will work during the debate. Each candidate has two green lights, and when they are on, it signals to the candidate that his microphone is on and ready to go. When they are off, the microphone is off.

CNN demonstrated what it will look like when one candidate tries to talk over the other, making the interruptions of the other “difficult to understand.”

The New York Times revealed that the muted mics were “another Biden request, intended to guard against Mr. Trump’s penchant for interrupting and speaking over debate opponents.”

That is not the only Biden request. As was previously reported, there will be no live audience at this debate. This is also a request from the Biden campaign, as it made it clear the 81-year-old is not interested in dealing with reactions from a live audience. Upcoming Debate: CNN Ignores Biden Lies While Hammering Trump

As the first presidential debate approaches, CNN’s glaring disparity in fact-checking between President Joe Biden and former President Donald Trump has raised serious concerns about media bias. A review of CNN’s fact-checking page reveals that the network has not conducted a single fact-check of President Biden since announcing their role as the debate host on May 15. In stark contrast, CNN has fact-checked Trump 11 times during the same period.

The last fact-check CNN conducted on Biden was on May 14, when he falsely claimed that inflation was at 9% when he took office. Since then, despite numerous opportunities, CNN has turned a blind eye to several of Biden’s false statements. Notably, Biden has made several claims that warranted scrutiny but were ignored by CNN’s fact-checking team.

In May, Biden erroneously stated that he was vice president during the COVID-19 pandemic. He said, “My dad was an automobile manager. Detroit put food on our table every night. Oh, not a joke. Not a joke. And when I was vice president, things were kinda bad during the pandemic. And what happened was, Barack said to me, ‘Go to Detroit! And help fix it.’ Well, [the] poor mayor, he spent more time with me than he ever thought he was gonna have to.”

More recently, at an NAACP event in Michigan, Biden falsely claimed he joined the NAACP as a teenager. “As a matter of fact, the first organization I ever joined was the N.A.A.C.P. Didn’t get to vote until you were 21 in those days, but I got involved in civil rights when I was 15,” Biden said. However, according to a 2019 Washington Post report, Biden joined the NAACP during his first political race for New Castle County Council in 1970, when he was in his late 20s.

CNN’s lack of fact-checking on Biden raises questions about their commitment to fair and unbiased journalism. The network’s responsibility is to provide balanced and accurate information to the public, especially during a crucial election period. By selectively targeting Trump while giving Biden a pass, CNN fails to uphold the standards of objective reporting.

As the nation gears up for the first presidential debate, it is imperative that all media outlets, including CNN, adhere to principles of fairness and impartiality. The American people deserve a media landscape where truth is pursued relentlessly, regardless of political affiliation. It is time for CNN to step up and ensure that both candidates are subjected to the same level of scrutiny.

Election Model Gives Trump a Strong 2-in-3 Chance of Winning 2024 Presidential Race

Renowned statistician Nate Silver has released an election model forecasting a significant advantage for former President Donald Trump in the upcoming 2024 presidential election. Silver, who founded and formerly led FiveThirtyEight, now predicts Trump has a robust 65.7% chance of reclaiming the White House.

Silver’s model, entitled “The presidential election isn’t a toss-up,” was published on his Substack at natesilver.net. According to the model, Trump is projected to secure 287.2 electoral votes, surpassing the 270 needed to win, while President Joe Biden is forecasted to win 250.4 electoral votes. This projection positions Trump as the frontrunner in a race that many have seen as highly competitive.

In the predicted popular vote share, Biden and Trump are essentially tied, with Biden at 47.2% and Trump at 47.1%. Independent candidate Robert F. Kennedy Jr. is expected to receive 4.3% of the vote, though Silver’s model gives him no chance of winning the election.

Silver’s independent forecast stands in stark contrast to the model from FiveThirtyEight, now owned by ABC, which currently gives Biden a 51% chance of winning compared to Trump’s 49%. This significant difference highlights the contrasting methodologies and perspectives between Silver and the organization he once led.

Silver himself acknowledged the unexpected nature of his findings, writing, “The candidate who I honest-to-God think has a better chance (Trump) isn’t the candidate I’d rather have win (Biden).” He further emphasized that the close national popular vote between Biden and Trump translates to a significant advantage for Trump in the Electoral College, echoing trends seen in previous elections.

Silver’s analysis suggests that even a near tie in the popular vote could spell trouble for Biden, noting, “If the Electoral College/popular vote gap looks anything like it did in 2016 or 2020, you’d expect Biden to be in deep trouble if the popular vote is roughly tied.” This insight underscores the importance of battleground states and the nuances of the Electoral College system.

Currently, FiveThirtyEight’s average shows Biden and Trump neck and neck at 40.9% and 40.8%, respectively, with Kennedy at 9.3%. In contrast, Silver’s polling average places Trump slightly ahead at 42.3%, Biden at 41.3%, and Kennedy at 8%.

Silver describes his model as “the direct descendant of the… FiveThirtyEight election forecast,” maintaining that the methodology is largely unchanged, though he has omitted the coronavirus provisions introduced in 2020. This continuity in methodology lends credibility to Silver’s forecast, even as it diverges significantly from his former platform.

Trump’s path to victory seems more plausible than many in the establishment media might admit.
