Jack Smith Wants Trump Trial to Start Jan. 2, 2024 — Right Before Iowa Caucuses

Special Counsel Jack Smith told a federal court in Washington, D.C., on Thursday that prosecutors want to start the trial of former President Donald Trump on January 2, 2024, right before the Iowa caucuses launch the Republican presidential primary.

Fox News reported:

Special Counsel Jack Smith proposed to begin former President Donald Trump’s trial in January 2024 for the charges he’s facing in relation to the events of Jan. 6, 2021.

“The Government proposes that trial begin on January 2, 2024, and estimates that its case in chief will take no longer than four to six weeks,” the filing on Thursday states.

As Breitbart News has noted, Trump faces four charges related to his challenges to the 2020 election result, and the resulting riot at the U.S. Capitol on January 6, 2021. Trump: I Won’t Sign RNC Pledge to Endorse GOP Nominee

Former President Donald Trump said Wednesday on Newsmax TV’s “The Balance” that he would not sign the Republican National Committee’s pledge to support the GOP nominee to attend the first primary debate on August 23 on Fox News.

Trump said, “I’ve already decided and I’ll be announcing something next week.” . . .

Trump said, “Well, when you’re at 75, 78, 80%, and other guys are 0, 1%, 2%, 3%, you do say, ‘What’s the upside? Am I going to go up one point? But they could go up, you know. They’re not dumb people. They’re senators. They’re governors. They’re intelligent people. You have some very good people.”

Trump said, “I have a problem with the debate for another reason. I wouldn’t sign the pledge. Why would I sign a pledge if there are people on there that I wouldn’t have? I wouldn’t have certain people as, you know, somebody that I’d endorse. So, they want you to sign a pledge, but I can name three or four people that I wouldn’t support for president. So there is a problem right there.” . . .

All Eyes on Georgia as Trump Could Face Fourth Indictment

A potential fourth indictment stemming from the Fulton County investigation into former President Donald Trump could include racketeering charges as a grand jury is expected to make a decision in the coming days.

Like the federal charges that came down last week in Washington, D.C., accusing Trump of four counts of conspiracy and obstruction to overturn the 2020 election, the potential indictment out of Georgia will lean on his alleged attempts to overturn the election results in the state, such as his call to Georgia Secretary of State Brad Raffensperger, asking him to “find 11,780 votes.”

Fulton County District Attorney Fani Willis has successfully brought similar cases under Georgia’s Racketeer Influenced and Corrupt Organizations Act, or RICO. The state’s law is modeled after the federal statute of 1970, which was intended to counter mafia crime networks.

When Willis first began her election interference investigation in 2021, she tapped one of Georgia’s ranking experts on racketeering charges, John E. Floyd, to advise the investigation. He has worked on major RICO cases for the district attorney’s office, including the 2013 Atlanta school cheating case which saw 35 indictments and eventually 11 convictions. Donald Trump: ‘More Enthusiasm Now’ Than in 2016, 2020

Former President Donald Trump believes there is “more enthusiasm now” for his campaign than there was in 2016 and 2020, making the remarks during a campaign stop in Windham, New Hampshire on Tuesday.

“Everyone can see the stunning contrast between our incredible success and Joe Biden’s horrendous failures, and that’s one reason why we’re leading so big in the polls,” Trump told the crowd, largely attributing his success to that stunning contrast.

“That’s really the reason, I think. It’s more enthusiasm now than 2016 or 2020, because you’ve seen how incompetent these people are,” Trump said, deeming that incompetence “horrible.”

“In the recent Rasmussen poll, we’re up 44 points with Trump at 57, Ron DeSanctimonious 13. And the rest of them down in single digits,” Trump said to cheers.

Judge Skeptical of Constitutionality of Grand Jury in Trump Classified Documents Case in Florida

A federal judge pressed special counsel Jack Smith on Monday to explain why he used a D.C. grand jury to investigate the Florida-based case against former President Donald Trump for mishandling of classified documents.

U.S. District Judge Aileen Cannon is based in South Florida, where Mr. Smith filed an indictment against the former president and where the trial is expected. But the charges were brought based on the recommendation of a grand jury in Washington, causing Judge Cannon to question whether the move was constitutional.

In a brief order, Judge Cannon ordered prosecutors to “address the legal propriety of using an out-of-district grand jury proceeding to continue to investigate and/or seek post-indictment hearings on matters pertinent to the instant indicted matter in this district.”

Judge Cannon’s order was in response to the special counsel’s request for a hearing to examine a potential conflict of interest for an attorney for Walter Nauta, a Trump aide who has also been charged in the case. Trump Calls for Recusal of Judge in Jan. 6 Case ‘On Very Powerful Grounds’

Former President Donald Trump claimed Sunday there is “no way” he’ll get a fair trial over the election-meddling indictment he faces — calling for a new venue and judge to oversee the federal case.

Trump, 77, said his lawyers will be asking for the recusal of Washington DC federal court Judge Tanya Chutkan — who is overseeing the case regarding the ex-president’s alleged attempts to thwart the 2020 election — “on very powerful grounds.”

“THERE IS NO WAY I CAN GET A FAIR TRIAL WITH THE JUDGE ‘ASSIGNED’ TO THE RIDICULOUS FREEDOM OF SPEECH/FAIR ELECTIONS CASE,” Trump posted Sunday morning on Truth Social.

“EVERYBODY KNOWS THIS, AND SO DOES SHE! WE WILL BE IMMEDIATELY ASKING FOR RECUSAL OF THIS JUDGE ON VERY POWERFUL GROUNDS, AND LIKEWISE FOR VENUE CHANGE, OUT IF D.C.,” he added.

Chutkan, who did not oversee the former president’s arraignment Thursday but is presiding over the case, has a reputation for being a harsh “punisher” of Trump supporters who stormed the US Capitol on Jan. 6, 2021. Donald Trump Lays Out Policy Vision for Country Upon Return to Office

Former President Donald Trump, the leading Republican candidate for president in 2024, told Breitbart News exclusively in a long-form video interview of his major policy vision for a return to the White House should voters send him back to the Oval Office next year.

Trump, who is currently leading by far in the GOP primary and in many cases leading or tied with incumbent Democrat President Joe Biden in general election surveys, said he is confident and hopeful he will be able to hang on and win another term in the White House.

“I think so. I hope so,” Trump said when asked if he believes he will win next year. “I hope so for the country or we’re going to have a country that’s finished. I have people coming up to me all the time crying — men, women, strong people, smart people — and they’re crying say ‘if you don’t win, sir, our country is finished. Our country is finished.’ I believe it.”

On his first day in office, Trump told Breitbart News he would again “create the greatest economy ever, in history.”

“You know, we had the greatest economy in history,” Trump said. “We’re going to do it again. Our jobs numbers, our employment numbers, we had the greatest economy in the history of the world frankly — and we’re going to do that again. But we’re going to be drilling for energy. We’re going to be using what’s under our feet — liquid gold. Trump Jokes He Needs ‘One More Indictment’ to Win Election

By Daily Caller. Former President Donald Trump joked Friday that he would win the 2024 election if he was hit with “one more indictment” during a speech before a dinner held by the Alabama Republican Party.

Trump pleaded not guilty to all charges during his Thursday arraignment after Special Counsel Jack Smith secured a four-count indictment of Trump relating to his efforts to contest the results of the 2020 election after Smith previously secured a 37-count indictment against Trump in June based on an investigation into allegations surrounding classified documents.

“They wanted to wait, and they did wait,” Trump said. “They waited right to the middle of an election and they waited until I became the dominant force in the polls because we’re dominating everybody, including Biden in the polls, and then they filed `em all, every one of of all that essentially one time, including local DA’s and AGs that even other cases right in the middle of the campaign, where we’re leading by so much and that’s not going to make any impact, because every time they file an indictment, we go way up in the polls. We need one more indictment to close out this election, one more indictment and this election is closed out. WSJ Columnist Points Out the Obvious Flaw in Jack Smith’s J6 Indictment Against Trump

By Townhall. Special Counsel Jack Smith has indicted Donald Trump over January 6 on a slew of charges that appear to encroach on free speech rights. The latest indictment seems to draw on what law professor Jonathan Turley warned about concerning Mr. Smith’s interpretation of criminal statutes: he stretches them into illogical territory. It’s why Smith’s past conviction of former Virginia Gov. Bob McDonnell was tossed out unanimously by the Supreme Court. This Trump indictment could suffer a similar fate.

The talking heads on CNN and MSNBC are loaded with left-wing legal clowns who fail to see that Smith’s charges set a precedent where everyone on the Hill would be jailed. Wall Street Journal columnist Kimberley Strassel took a katana to the reasoning behind the indictment, noting that Barack Obama would have been jailed under the Jack Smith protocol of ‘saying things that I don’t like, so I’ll draw up federal charges’ paradigm:

That’s the biggest problem with Mr. Smith’s latest broadside against Donald Trump, on top of its untested legal theories and evidence of a Justice Department double standard. As former Attorney General William Barr told CNN on Wednesday, “there were reasons not to bring” the case, and among them is “the slippery slope of criminalizing legitimate political activity.”

Take Mr. Trump out of the equation and consider more broadly what even the New York Times calls Mr. Smith’s “novel approach.” A politician can lie to the public, Mr. Smith concedes. Yet if that politician is advised by others that his comments are untruthful and nonetheless uses them to justify acts that undermine government “function,” he is guilty of a conspiracy to defraud the country. Dishonest politicians who act on dubious legal claims? There aren’t enough prisons to hold them all.
