Prosecutors Say Sussmann ‘Manipulated and Used’ FBI to Smear Trump, Gin up October Surprise in 2016

Prosecutors argued Tuesday, the opening day of a criminal trial testing special counsel John Durham’s Russia investigation, that a Hillary Clinton campaign attorney “used and manipulated the FBI” with anti-Trump dirt to create an October surprise before the 2016 presidential election.

Prosecutors said the lawyer, Michael Sussmann, intended to deceive FBI officials in September 2016 in a scheme to sabotage Donald Trump’s campaign.

“The evidence will show the defendant’s lie was all part of a bigger plan. It was a plan to create an October surprise on the eve of a presidential election — a plan that used and manipulated the FBI,” federal prosecutor Brittain Shaw said in her opening statement. “It was a plan that largely succeeded.”

Mr. Sussmann is charged with lying to federal agents in the first trial of Mr. Durham’s probe of the origins of the FBI’s Trump-Russia collusion investigation.

He is accused of concealing the fact that he was representing the Clinton campaign and was a technology executive when he presented a top FBI official with two white papers and two thumb drives detailing now-debunked evidence of covert communication between the Trump Organization and Russia’s Alfa Bank. Judge Allows Clinton, AOC Donors in Jury Pool for Ex-Clinton-Lawyer’s Russia Trial

By New York Post. As many as three Hillary Clinton donors — including one who also supported US Rep. Alexandria Ocasio-Cortez — are among the prospective jurors for former Clinton campaign lawyer Michael Sussmann’s trial.

Federal Judge Christopher Cooper [appointed by Obama] said the man — who works in public policy for Amazon and appeared to be in his 40s — “expressed a high degree of confidence” that he could be impartial. . .

Another Clinton supporter, a former bartender who appeared to be in her 20s, said she’d also donated to progressive firebrand Ocasio-Cortez (D-The Bronx, Queens). [Yet another woman allowed in the jury pool] told prosecutor Michael Keilty that she had “a strong preference of one candidate over the other” in the election [but] she insisted she could be impartial. . .

A prospective juror who works at an engineering firm and appeared to be in her 30s said that her husband worked for Clinton’s 2008 presidential campaign but was allowed to remain on the panel after saying it wouldn’t affect her ability to be impartial

This Week’s Spygate Trial Is Bad News for Hillary Clinton

Subpoenaed Fusion GPS employee Laura Seago is likely to stay mum during questioning at the criminal trial of Michael Sussmann that starts this week. Her silence will be yet further evidence that the Hillary Clinton campaign financed and seeded the Russia collusion hoax to both the press and U.S. intelligence agencies.

Jury selection is scheduled to begin this morning in a D.C. federal court in the criminal case against former Clinton campaign attorney Michael Sussmann. While Sussmann faces a single charge of making a false statement to former FBI General Counsel James Baker, proof of that federal crime requires prosecutors to show Sussmann lied when he shared Alfa Bank data and whitepapers with Baker, telling the FBI lawyer that he was not acting on behalf of a client.

To prove that lie, Durham’s team, led by long-time prosecutor Andrew DeFilippis, will present evidence to the jury that Sussmann, in fact, was acting on behalf of two clients—the Clinton campaign and tech executive Rodney Joffe. The special counsel has already previewed much of the evidence it intends to present over the course of the expected two-week trial.

Prosecutors will first seek to establish that the Alfa-Bank hoax—a conspiracy theory that claimed Donald Trump had established a secret communications channel with the Russia-based Alfa Bank—originated with Sussmann’s client, Joffe, but was then shared with the Clinton campaign through its Perkins and Coie attorneys. The testimony of Georgia Tech researcher Dave Dagon, whom the special counsel gave immunity to last summer, will be key in this regard.

In the months leading up to the 2016 presidential election, Dagon worked closely with Joffe and the originator of the Alfa-Bank data, April Lorenzen, reviewing the data and a whitepaper supposedly showing the Russia-Trump connection. According to Durham’s indictment, Dagon also collaborated with Joffe and Lorenzen to craft another conspiracy theory related to the Russian-made Yota cell phones. In February 2017, Sussmann provided the CIA data related to the Yota cell phones, claiming that the Russian phones were typically used by top Russian officials and that the data showed the cellphones being in multiple locations near Trump, including in the executive office building of the president. Hillary Clinton Accuses Republicans of Wanting Babies to Starve

Hillary Clinton took to Twitter to accuse GOP members of wanting to “kill certain babies” amid the nation’s baby formula shortage, while she and the Democratic Party support unlimited abortion on demand, making further clear their hypocrisy on respect for life.

In response to Governor Greg Abbott’s (R-TX) statement addressing his fury that baby formula is being shipped to border migrant camps, Clinton said “The Republican, ‘pro-life’ position is now that certain babies should starve.”

The mishandling of the formula shortage is one more way in which the Biden Administration is putting American families last, at the expense of others.

Clinton’s comment came after Abbott pushed back against the Biden administration’s decision to send much-needed baby formula to illegal immigrants, while thousands of grocery store shelves remain empty, leaving parents in a panic. Court Grants Durham Access to 22 Emails Fusion GPS Claimed Were Privileged

A federal judge on Thursday ordered the research firm Fusion GPS to turn over nearly two dozen emails to special counsel John Durham, a victory for the special counsel over Fusion’s and others’ claims that the emails were privileged communications.

Durham asked D.C. District Court Judge Christopher Cooper to review 38 Fusion emails “in camera,” or out of view of the public, to determine whether they were being improperly withheld from Durham’s team. After reviewing the documents, Cooper ruled that over half of them did not fall under attorney-client privilege as cybersecurity attorney Michael Sussmann, Hillary Clinton’s 2016 campaign, and Fusion argued.

Sussmann is set to stand trial next week for allegedly lying to the FBI in 2016 when he approached then-FBI general counsel James Baker about a secret backchannel between the Trump Organization and Alfa Bank, one of the largest private banks in Russia. Durham has alleged that, contrary to Sussmann’s claims, the cybersecurity attorney approached Baker as a Clinton campaign operative to spread now-debunked claims about former President Donald Trump.

While Durham has gained access to the 22 of the 38 emails he requested, Cooper forbid prosecutors from introducing them as evidence in the Sussmann trial. Cooper said that entering the emails into evidence days before the trial would “prejudice Mr. Sussmann’s defense.”

“Still, the record shows that these discussions ended in January 2022—yet the Special Counsel waited to file this motion until April 6, 2022, just over a month before trial was set to begin. And, given the number of privilege holders involved and the fact-bound nature of the issues, resolving the motion has naturally taken us to the eve of trial,” Cooper wrote. “Under these circumstances, allowing the Special Counsel to use these documents at trial would prejudice Mr. Sussmann’s defense.” (Read more from “Court Grants Durham Access to 22 Emails Fusion GPS Claimed Were Privileged” HERE)

Spygate Judge Tries to Protect Hillary Clinton in Latest Pre-Trial Rulings

The Obama-appointed judge presiding over the criminal case against former Hillary Clinton campaign attorney Michael Sussmann let politics trump the law when he declared in a weekend opinion he would not rule on whether the Clinton campaign and Democratic National Committee conspired with others to peddle the Russia collusion hoax.

Special Counsel John Durham charged Sussmann last September in a one-count indictment with making a false statement to then-FBI General Counsel James Baker when Sussmann provided Baker data and “whitepapers” purporting to show a secret communication network between Donald Trump and the Russian-based Alfa Bank. According to the indictment, Sussmann told Baker he was sharing the information on his own, when, in fact, Sussmann represented both tech executive Rodney Joffe and the Clinton campaign.

With trial set to begin in one week, the last month has seen a flurry of pretrial motions—called “motions in limine”—seeking pretrial rulings on the admissibility of evidence. The court previously ruled on several of the issues the parties presented, holding in many cases that a final decision must await trial. Then, late Saturday, presiding Judge Christopher Cooper issued a further opinion resolving many of the still-outstanding evidentiary challenges.

Overall, Cooper’s Saturday night opinion, like his previous rulings in this case, represented a studious and a balanced approach to the legal issues, with Sussmann prevailing at times, but the special counsel succeeding on other issues. For instance, in a victory for Durham, the court ruled that prosecutors could present evidence concerning how the Alfa Bank “data came into being and who was involved in its collection and analysis, as well as how Mr. Sussmann came to possess the data, what he did with it, and why.”

But the court also ruled in Sussmann’s favor, first reiterating its previous holding that unless Sussmann claims at trial that the Alfa Bank data is accurate, the government may not present evidence challenging its validity. Cooper further held that the government could not present evidence that Joffe inappropriately accessed proprietary or sensitive government information to gather the data or write the whitepapers, absent some evidence “showing that Mr. Sussmann had concerns that the data was obtained inappropriately.” (Read more from “Spygate Judge Tries to Protect Hillary Clinton in Latest Pre-Trial Rulings” HERE)

Hillary’s ‘Disinformation’ Used to Deceive 2016 Voters?

A former FBI official has concluded that Hillary Clinton’s campaign and the Democrat Party used “contrived disinformation” in an attempt to deceive voters before the 2016 presidential election, when she became a two-time loser with her loss to President Donald Trump.

“What [special counsel John] Durham is methodically doing, is laying out a case that the Hillary Clinton campaign, the Democrat Party used contrived disinformation in a conspiracy, in a conspiratorial way, to deceive the American voter ahead of the election,” explained retired Assistant Director for Intelligence Kevin Brock. . .

“This is more than just political dirty tricks,” he explained. “Political dirty tricks usually have some foundation in truth. But they just made stuff up.”

Durham, in fact, is investigating the origins of the Democrats’ now-debunked Russia collusion claims they made against Trump as a candidate, and then later as president.

The charges were that Trump’s campaign was somehow colluding with Russia to win the American election, when the evidence now has revealed that it was the Clinton campaign that funded the fabrication of the “Steele dossier” claims, now known to be false, against Trump using some information from Russian sources. Biden Just Had His ‘Deplorables’ Moment

Six years after Hillary Clinton wrote off half the country as “deplorables” and derailed her own campaign, a desperate Joe Biden is following her failed playbook, only this time as president.

At the White House on Wednesday, Biden stoked hysteria over the potential overturning of Roe v. Wade after a majority draft opinion from February was leaked on Monday night. In doing so, Biden depicted half the country he represents in the Oval Office as zealous extremists who are hellbent on a new era of segregation.

“What happens if you have states change the law saying that children who are LGBTQ can’t be in classrooms with other children?” Biden said. “What are the next things that are going to be attacked? Because this MAGA crowd is really the most extreme political organization that’s existed in American history, in recent American history.”

Biden’s characterization of the more than 74 million Americans who voted for Trump as the “most extreme political organization” in U.S. history, even “recent” history, would usurp Antifa or the Ku Klux Klan, which is still active today.

Mr. Civility’s depiction of this imaginary GOP-led segregation targeting LGBT people in schools is as ridiculous as it sounds. No doubt in reference to recent legislation passed in Florida — dubiously branded by the left and its allies in the corporate press as the “Don’t Say Gay” law — Biden, determined to energize his own base ahead of a hostile midterm cycle, engaged in his own extremist fearmongering to warn that Republicans are in pursuit of something they are not. Report: FBI Pursued ‘Bulls*** Rumor’ to Spy on Trump Aide

The FBI decision to spy on a former Trump campaign adviser hinged on an unsubstantiated rumor from a Clinton campaign-paid dossier that the Washington Post’s Moscow sources had quickly shot down as “bulls***” and “impossible,” according to emails disclosed last week to a D.C. court hearing the criminal case of a Clinton lawyer accused of lying to the FBI.

Though the FBI presumably had access to better sources than the newspaper, agents did little to verify the rumor that Trump foreign policy adviser Carter Page had secretly met with sanctioned Kremlin officials in Moscow. Instead, the bureau pounced on the dossier report the day it received it, immediately plugging the rumor into an application under the Foreign Intelligence Surveillance Act to wiretap Page as a suspected Russian agent.

The allegation, peddled to both the press and FBI in the summer of 2016 by Fusion GPS, an opposition research firm hired by Hillary Clinton’s campaign to dig up dirt on Trump during the presidential race, proved to be the linchpin in winning approval for the 2016 warrant, which was renewed three times in 2017 – even though the FBI learned there were serious holes in the story and had failed to independently corroborate it.

The revelations of early media skepticism about the Trump-Russia narrative before journalists embraced it are included in a 62-page batch of emails between Fusion and prominent Beltway reporters released by Special Counsel John Durham, who is scouring the FBI’s investigation of the Trump campaign for evidence of abuse and criminal wrongdoing.

The documents suggest that some journalists, as keen as they were to report dirt on Trump, were nevertheless more cautious than FBI investigators about embracing hearsay information served up by Clinton agents. The new material also offers a look at the lengths to which those working on Clinton’s behalf went in order to seed the government with unverified rumors about Trump and Russia that amounted to a disinformation campaign. Among those targeted were powerful Democratic members of Congress, including House Intelligence Committee Chairman Adam Schiff, who proved to be a willing collaborator. Democrats Admit It’s Women Who Get Abortions After All

Democrats made an admission about what type of people can actually get abortions in the wake of a leaked Supreme Court draft opinion showing justices could potentially overturn Roe v. Wade.

After many liberals pushed for gender-neutral terms surrounding pregnancy and abortion such as “birthing people” instead of “women,” prominent Democrats made statements appearing to suggest only women can get pregnant and have abortions.

President Joe Biden characterized abortion as a women’s rights issue in a Tuesday statement that emphasized women’s reproductive freedom.

“I believe that a woman’s right to choose is fundamental,” he said. “[I]f the Court does overturn Roe, it will fall on our nation’s elected officials at all levels of government to protect a woman’s right to choose.”

Hillary Clinton also painted abortion as a women’s issue.
