Judge Rules New York Must Allow Religious Exemptions to COVID Vaccine Mandate

A federal judge ruled on Tuesday that New York state cannot impose a COVID-19 vaccine mandate on healthcare workers without allowing their employers to consider religious exemption requests.

U.S. District Judge David Hurd in Albany, New York, ruled that the state’s workplace vaccination requirement conflicted with healthcare workers’ federally protected right to seek religious accommodations from their employers.

The ruling provides a test case as vaccine mandate opponents gear up to fight plans by President Joe Biden’s administration to extend COVID-19 inoculation requirements to tens of millions of unvaccinated Americans.

Vaccines have become highly politicized in the United States, where only 66% of Americans are vaccinated, well short of the initial goals of the Biden administration.

Seventeen healthcare workers opposed to the mandate sued, saying the requirement violated their rights under the U.S. Constitution and a federal civil rights law requiring employers to reasonably accommodate employees’ religious beliefs. Report: Man Dies From COVID-19 After Hospital Rejects Court Order for Ivermectin

A 75-year-old New York man died last weekend after a hospital refused to give him the drug Ivermectin in a last-ditch effort to save his life, despite an order from a judge, an exclusive report from News10NBC’s Jennifer Lewke revealed.

Although Jeremy L. Carter was vaccinated against COVID-19, he still caught the virus at the end of August, Lewke detailed. He became sick enough to be hospitalized at Rochester General Hospital and continued to deteriorate to the point where he was placed on a ventilator.

After consulting with Carter’s primary care doctor, Carter and his daughter Jill Alvarado wanted to try Ivermectin. Although the drug is not approved by the U.S. Food and Drug Administration (FDA) to treat COVID-19, and the FDA has explicitly warned against using it, some doctors have prescribed Ivermectin for COVID-19 patients.

However, the hospital refused to administer the drug to Carter, even though the family said they would gladly sign away any right to file a malpractice lawsuit.

This forced Alvarado to sue Rochester Regional Health, where Rochester General Hospital falls — and she was successful. Vax Attack: Video Shows Tourists Fight With NYC Restaurant Hostess Over Vaccination Proof

A disturbing cellphone video shows the wild incident in which three tourists from Texas attacked a Manhattan restaurant hostess who had asked for proof they’d been vaccinated against COVID-19, according to a report.

One assailant was recorded swinging a wild, overhand blow at the hostess amid the chaos outside Carmine’s on the Upper West Side, according to a 49-second clip obtained by NBC New York and posted on Twitter.

“F–k! Oh my God! What the f–k!” the hostess screamed.

The mobile seating station outside the Italian eatery was also pushed over during the turmoil but was prevented from hitting the ground by two male bystanders.

One of the men then waded into the fracas, grabbed a woman around her torso from behind, lifted her off her feet and carried her away.

CUOMO’S BODY COUNT: New York Health Officials Finally Reveal State’s True COVID Death Toll

The tally of New Yorkers killed by the coronavirus pandemic stands at more than 55,000 people, the state Health Department confirmed late Tuesday — far more than the 43,000 long reported by now-departed Gov. Andrew Cuomo.

DOH officials released the revised tallies just hours after Gov. Kathy Hochul was sworn into office, finally bringing the state’s death count into line with figures long published by the Centers for Disease Control and Prevention and Johns Hopkins University.

“It’s a good first step by Hochul,” said Bill Hammond, a health care policy expert at the conservative-leaning think tank The Empire Center, which aggressively pressed state officials over their handling of nursing home safety measures during the pandemic.

“The higher COVID death totally is significantly important,” he added. “She’s acknowledging how bad things got. She’s not sugarcoating the problem. Cuomo was trying to keep the numbers as low as he could.”

For months, the Cuomo administration had only released partial tallies of those killed by the coronavirus pandemic — counting just those who died in hospitals, nursing homes and adult care facilities — in its daily public summaries of COVID-19 data. Former Councilman and Retired Priest Accused of Sexually Assaulting Minor

Retired priest and former New York City Councilman Louis Gigante was slapped with a lawsuit that accused him of sexually assaulting a 9-year-old boy in the 1970s in a Bible study course.

Gigante, whose brother was mob boss Vincent “The Chin,” allegedly forced the kid to perform oral sex at St. Athanasius Church in the Bronx, documents filed in Bronx County court showed.

“The Archdiocese knew or should have known that Father Gigante was sexually abusing children and/or had the propensity to do so,” the complaint reads, according to The Bronx Times.

“The defendants Roman Catholic Archdiocese of New York, and St. Athanasius Roman Catholic Church knew or should have known of the abuse that Mr. Doe and other young children were suffering at the hands of their clergy.” (Read more from “Former Councilman and Retired Priest Accused of Sexually Assaulting Minor” HERE)

This State Wants to Ban Chick-fil-A From Rest Stops for Being ‘Homophobic’

Chick-fil-A is getting skewered by a group of New York lawmakers who are looking to block the company’s bid to open restaurants at state highway rest stops because of its owner’s anti-LGBTQ stance.

The Atlanta-based fast-food chain is among a handful of restaurants that were awarded contracts by the New York State Thruway Authority to be part of a $450 million plan to renovate 27 service areas.

But Chick-fil-A’s chief executive, Dan Cathy — whose father, S. Truett Cathy, founded the $8.4 billion company in 1946 — has publicly disparaged LGBTQ rights, which some legislators say should disqualify the privately owned company from opening eateries at state-run highway rest stops.

Assemblyman Harry Bronson, a Rochester-area Democrat, sent a letter to Thruway Authority Executive Director Matthew Driscoll asking him to “re-examine the list of approved concessions” for the rest stops because of Chick-fil-A’s past support of anti-LGBTQ groups, according to the Auburn Citizen. . .

Chick-fil-A’s foundation has given money to anti-LGBTQ organizations and supported opponents of same-sex marriage ballot initiatives, according to the report. Chick-fil-A’s restaurants are also closed on Sundays — missing out on more than $1 billion in revenue — so that its employees can go to church if they choose to. Freedom! NYers Celebrate End Of COVID-19 Lockdowns On July Fourth (VIDEO)

New Yorkers declared their independence from the COVID-19 crisis on Sunday by heading to beaches, parks and prime spots for watching fireworks — free of the lockdowns, social distancing and masks that wrecked last year’s July Fourth.

In Manhattan, city dwellers and out-of-towners alike arrived early to get onto the FDR for the pyrotechnics set to start at 9:30 p.m.

“It’s on my bucket list, watching the Fourth of July fireworks in New York City,” said Kathy Gaherty, 63, of Connecticut.

“I got here around 12:30 p.m. I’ve been exposed to so much and there are so many things I want to do before I die.”

Gaherty — a retired paralegal who wore a red, white and blue hat, scarf and shoes emblazoned with “USA” — said she previously “watched the fireworks live on TV.”

WATCH: AOC Brushes off Concerns over Surging Crime as ‘Hysteria’

US Rep. Alexandria Ocasio-Cortez (D-NY) sparked outrage Tuesday for dismissing concerns about surging crime as “hysteria.”

The Bronx-Queens congresswoman, a far-left progressive routinely referred to by her initials, AOC, made the remark during a Zoom chat with freshman US Rep. Jamaal Bowman (D-NY), a fellow proponent of the “Defund the police” movement who represents the Bronx and Westchester.

“We are seeing these headlines about percentage increases,” Ocasio-Cortez said, reducing recent incidents such as a tourist shot in broad daylight in Times Square and kids ducking for cover amid a gang shooting in the Bronx to mere statistics.

“Now I want to say that any amount of harm is unacceptable and too much. But I also want to make sure that this hysteria, you know, that this doesn’t drive a hysteria and that we look at these numbers in context so that we can make responsible decisions about what to allocate in that context.”

Police Officer Saves Six-Week-Old Baby From Choking

. . .Just before midnight, Bethlehem [New York] Police Department Officer Caitlyn Krage responded to an emergency call for an unresponsive infant at a home on Griffin Circle in North Bethlehem.

Krage arrived at the home within minutes of the call and found the infant motionless and foaming at the mouth.

Rudy Giuliani Suspended From Practicing Law in New York State

Rudy Giuliani, the former personal lawyer for former President Donald Trump who once held one of the legal profession’s most prestigious jobs, was suspended Thursday from practicing law in New York state by an appellate court that found he made “demonstrably false and misleading statements” about the 2020 election.

In a ruling released following disciplinary proceedings, the court concluded that “there is uncontroverted evidence” that Giuliani, the former Manhattan US attorney, “communicated demonstrably false and misleading statements to courts, lawmakers and the public at large in his capacity as lawyer for former President Donald J. Trump and the Trump campaign in connection with Trump’s failed effort at reelection in 2020.”

Giuliani’s “conduct immediately threatens the public interest and warrants interim suspension from the practice of law,” the court wrote.

The suspension of his law license marks a precipitous fall for the former New York City mayor, once considered an accomplished and formidable force in legal circles. In recent years, however, Giuliani’s reputation has suffered as he has come under criminal investigation by the office he used to lead, the Manhattan US attorney’s office, for possible illegal lobbying.
