Court Unleashes Stunning Ruling That Could Impact Jan. 6 Convictions

A federal appeals court has unleashed a stunning ruling that could end up impacting the Jan. 6, 2021, convictions of protesters at the U.S. Capitol.

It is the 5th Circuit Court of Appeals that determined that geofence searches are not allowed under the U.S. Constitution. Those are identifications of individuals using GPS or other technology that provides authorities with names and locations of individuals at a particular time.

The case at hand involved robbery, and Judge James C. Ho, a possible candidate under a Trump presidency for the Supreme Court, explained with clarity how the geofence technology isn’t allowed in a ruling that now conflicts with a ruling from another circuit, making a Supreme Court decision more likely.

He said, “Geofence warrants are powerful tools for investigating and deterring crime. The defendants here engaged in a violent robbery – and likely would have gotten away with it, but for this technology. So I fully recognize that our panel decision today will inevitably hamper legitimate law enforcement interests.”

But, he continued, “Hamstringing the government is the whole point of our Constitution. Our Founders recognized that the government will not always be comprised of publicly spirited officers – and that even good faith actors can be overcome by the zealous pursuit of legitimate public interests. ‘If men were angels, no government would be necessary.’ The Federalist No. 51 … ‘If angels were to govern men, neither external nor internal controls on government would be necessary.’ But ‘experience has taught mankind the necessity of auxiliary precautions.’ It’s because of ‘human nature’ that it’s ‘necessary to control the abuses of government.'” (Read more from “Court Unleashes Stunning Ruling That Could Impact Jan. 6 Convictions” HERE)

Trump’s Driver on J6 Disputes Infamous Claim POTUS Tried to Grab Steering Wheel to Go to Capitol: Report

Former President Donald Trump’s driver disputed the infamous claim that the former president tried to grab the steering wheel from him on Jan. 6, 2021, and go to the U.S. Capitol, according to a transcript obtained by The New York Times (NYT).

Following his speech on Jan. 6, 2021, Trump reportedly entered his armored vehicle and began discussing how big the crowd was at his address. Trump then said that he wanted to go to the U.S. Capitol, the president’s driver said in an interview with House lawmakers, according to The NYT. Trump’s lead Secret Service agent Robert Engel told the president that such a move was not possible because they did not have the plans to do so, the driver told The NYT. At no point did Trump yell at the driver to go to the Capitol nor did he lunge for the steering wheel, the driver reportedly testified.

“The president was insistent on going to the Capitol,” the driver said in the transcript, according to The NYT. “It was clear to me he wanted to go to the Capitol. He was not screaming at Mr. Engel. He was not screaming at me. Certainly his voice was raised, but it did not seem to me that he was irate — certainly not, certainly didn’t seem as irritated or agitated as he had on the way to the Ellipse.”

The driver’s testimony contradicts that of Cassidy Hutchinson’s, a former White House aid to Trump’s chief of staff, Mark Meadows. Hutchinson previously testified that she had heard that the former president had reached for the steering wheel the day of the Capitol riot. Hutchinson told House investigators that Trump had ordered his deputy chief of staff Tony Ornato and Engel to take him to the Capitol before then reaching for the steering wheel from the backseat and grabbing Engel by the clavicle.

“I did not see him reach,” the driver told investigators, The NYT reported. “He never grabbed the steering wheel. I didn’t see him, you know, lunge to try to get into the front seat at all. Second Gay Sex Tape Allegedly Filmed in U.S. Capitol: Report

Another gay sex tape was allegedly filmed inside the U.S. Capitol, which comes after news broke last week about an aide for Sen. Ben Cardin (D-MD) who allegedly filmed a gay sex video inside a Senate committee hearing room.

Semafor reported on Wednesday that an investigation was launched in June 2022 into a senior aide who worked for Rep. Dan Newhouse (R-WA) over reports of “purported, unbecoming behavior.”

The senior aide, whom the publication decided to not name, denied that he was in the videos and said that he was informed by the congressman that the investigation found “no evidence to the allegation.”

The publication said that it was “clear” though that there was “in fact, a second set of Capitol sex videos, which circulated on Snapchat last year.”

Oregon Legislator Is 1st-Ever Ousted After Capitol Breach

Republican lawmakers voted with majority Democrats in the Oregon House of Representatives to take the historic step of expelling a Republican member who let … protesters into the state Capitol on Dec. 21.

Legislators said on the House floor that this could be the most important vote they ever cast. They then proceeded Thursday night to expel an unapologetic Rep. Mike Nearman with a 59-1 vote, marking the first time a member has been expelled by the House in its 160-year history. The only vote against the resolution for expulsion was Nearman’s own.

“The facts are clear that Mr. Nearman unapologetically coordinated and planned a breach of the Oregon State Capitol,” House Speaker Tina Kotek, a Democrat, said after the vote. “His actions were blatant and deliberate, and he has shown no remorse for jeopardizing the safety of every person in the Capitol that day.” (Read more from “Oregon Legislator Is 1st-Ever Ousted After Capitol Breach” HERE)

Capitol Physician Lifts Mask Mandate

Vaccinated members of the House of Representatives will no longer be required to wear a face covering when on the House floor after the Capitol Attending Physician lifted the chamber’s mask mandate Friday afternoon.

“The guideline document reflects that fully vaccinated individuals may discontinue mask wear and 6-foot social distance separations in most situations consistent with the CDC revision regarding fully vaccinated individuals of May 13, 2021,” explained the new guidance that came almost a month after the federal government decreed masks and social distancing precautions were no longer necessary for vaccinated Americans.

Fox News’s Chad Pergram reported that the decision was made based on low community spread of the Wuhan coronavirus and a high rate of vaccination among those in the Capitol complex.

Report: Dems Are Refusing to Allow GOP to View Capitol Riot Videos

Democrats running the U.S. Capitol building have refused to let Republicans see the video documentation of what happened there on Jan. 6, according to Rep. Devin Nunes, R-Calif. . .

Nunes was blunt:

“Tell me how many people actually carried a hammer, broke windows, or aided and abetted those people that destroyed federal property?” he said. “Why won’t you show us the videotapes? Republicans have yet to see the videotapes of what happened on January 6. Why are they not showing us the videotapes and why don’t we know who broke the windows and damaged public property?

“Because I tell you, I am all for those people who broke windows to going to jail for a long time. But what I’m not for is for people sitting in jail, like I understand, there is very few people reporting on this right now, but what I understand there are people who are sitting in jail right now who are having their due process rights violated. I talked to a lot of people who said, ‘Hey, we didn’t even know we couldn’t be in the Capitol.'” . . .

BLM Activist Admits: I Went to Capitol Protest With Megaphone to ‘Instigate’ Trump Supporters

The Department of Justice (DOJ) filed new charges against reported Black Lives Matter activist John Sullivan for his role in the Jan. 6 Capitol breach, saying that Sullivan allegedly told others later that he brought along a megaphone to incite riots inside the building.

According to court documents filed last week by federal prosecutors, Sullivan, of Utah, is facing new weapons charges. Sullivan, in statements online and in reports, said he attended a number of Black Lives Matter protests last year, posted numerous anti-police and anti-Trump statements, and also allegedly posted support on Twitter for armed revolution.

After leaving the Capitol on Jan. 6, Sullivan was seen, according to federal prosecutors, telling a witness that he “brought my megaphone to instigate [expletive]” and wanted to “make these Trump supporters [expletive] all this [expletive] up” inside the Capitol building.

Sullivan, they said, also portrayed himself as a journalist who was documenting the incident. However, they said that he was actively participating in the breach—and even apparently broke a window. . .

He also said in the Capitol: “We accomplished this [expletive]. We did this together. [Expletive] yeah! We are all a part of this history,” and “Let’s burn this [expletive] down,” according to the court papers. Federal prosecutors alleged that he attempted to incite others to burn the Capitol down several times. Cause Of Capitol Police Officer Brian Sicknick’s Death Revealed

Capitol Police Officer Brian Sicknick suffered two strokes and died of natural causes the day after he confronted rioters during the Jan. 6 attack on the U.S. Capitol, according to the chief medical examiner in Washington, D.C.

The Washington Post reported that medical examiner Francisco Diaz “said the autopsy found no evidence the 42-year-old officer suffered an allergic reaction to chemical irritants, which Diaz said would have caused Sicknick’s throat to quickly seize. Diaz also said there was no evidence of internal or external injuries.”

The newspaper noted that “the ruling, released Monday, likely will make it difficult for prosecutors to pursue homicide charges in the officer’s death.”

The publicly disclosed timeline of events shows that Sicknick was sprayed with a chemical substance outside the U.S. Capitol around 2:20 p.m. Jan. 6. After returning to his office around 10 p.m. that evening, the officer collapsed and was transported to a local hospital. . .

Following the release of the medical examiner’s report, the Capitol Police issued a statement saying the department accepts the findings “but this does not change the fact Officer Brian Sicknick died in the Line of Duty, courageously defending Congress and the Capitol,” NBC News reported. Woman Who Was Fired After Capitol Riots Sues Former Employer for Adopting Version of Events Advanced by ‘Cancel Culture Media’

A California woman who was fired after posting about her so-called uplifting experience at the U.S. Capitol on Jan. 6 filed a wrongful termination and retaliation lawsuit claiming that she merely participated in a peaceful protest while her employer had simply bought into a “cancel culture” narrative.

Leah Snyder, a computer programmer and coder at Alight Solutions, was terminated after she posted two selfies of herself at the Capitol, claiming it “was a peaceful and fun day,” and telling others the media was lying about what transpired.

Another social media user pointed out the fact that people had died during the riots, saying that was a pretty clear indicator of who was actually lying about happened.

“Yes. The media,” Snyder answered. “If people got in it’s because they let them in. I think the woman shot was a huge mistake. I talked to the guards. They said they were told to stand down until they got an order and were super nice. They said they would let us know if they did. They never did the whole time. We were told to go home around 5 and everyone did. So nope. Not a liar. The media is. Turn it off for the love of god.”

Snyder’s filed complaint said she had nothing to do with the insurrection at the Capitol—which resulted in at least five deaths (including one police officer), and dozens of arrests. Snyder, like others who were fired after self-reporting their presence at the Capitol on Jan. 6, said she was only peacefully protesting that day. 25,000 Troops, Officers Securing D.C., Joe Biden Inauguration — 5x as Many as Stationed in Iraq, Afghanistan; Media, Democrats Quickly Abandoned Joe Biden’s Push for ‘Unity’

By Breitbart. The Pentagon is putting 20,000 National Guard on the streets of D.C. in the wake of the assault on the U.S. Capitol to support Metropolitan Police Department and the U.S. Capitol Police for the inauguration on Jan. 20 of President-elect Joe Biden.

That is in addition to the more than 6,000 officers who are part of the U.S. Capitol Police and who are officers with the D.C. Metropolitan Police Department.

The more than 25,000 members of law enforcement personnel that are being deployed is five times the number of United States military deployed in Afghanistan and Iraq.

Democrat Mayor Muriel Bowser’s request from President Donald Trump for an emergency declaration ahead of the inauguration comes at the same time the Department of Defense said it would comply by Friday with Trump’s orders to draw down troops to 2,500 in each country. Media, Democrats Quickly Abandoned Joe Biden’s Push for ‘Unity’

By Daily Caller. Democrats and members of the media have quickly abandoned President-elect Joe Biden’s push for a “healed” and “united” country.

Biden has pushed a message of unity and healing since being declared the winner of the 2020 presidential election – from his tweets to his acceptance speech. The former vice-president’s inauguration theme, in fact, is “America United,” and the media has propped up the incoming president and his administration with puff pieces and declarations that his team will be “delightfully boring.”

Biden’s acceptance speech in November was hailed by many as a much-needed call to overtake division within America. The New York Times wrote that Biden “renewed his promise to be a president for all Americans in a polarized time” and CNN’s chief political analyst Gloria Borger said that it “was a presidential address, even kind of a fireside chat,” among others.

Journalist Megyn Kelly was quick to condemn those who were “sanctimoniously demanding ‘civility’” after spending years attacking Trump’s supporters – and it seems this call for civility has not lasted long, with renewed calls for justice and cancellations after some of Trump’s supporters rioted at the U.S. Capitol on Jan. 6.

Similarly, some media pundits have raised rallying cries against Republicans and the president’s supporters. MSNBC host Joy Reid and Nicolle Wallace pondered how the Republican Party can go about a “de-Baathification” process on Wednesday night.
