Illegal Alien Accused of Officer’s Death Claims Victimhood by Alleging Racism (VIDEO)
Virgilio Aguilar-Mendez, a 19-year-old illegal alien from Guatemala, stands accused of causing the death of St. Johns County, Florida, Sheriff’s Office Sgt. Michael Kunovich. However, Aguilar-Mendez is not just facing charges; he is asserting that he is a victim of racism, police brutality, and a violation of his “constitutional rights.”
The incident, which unfolded in May 2023, has taken a complex turn as Aguilar-Mendez’s defense attorney, Phillip Arroyo, has issued a threat of a federal lawsuit against St. Johns County prosecutors. Arroyo claims that his client’s rights have been violated, and he demands the charges be dropped [via Breitbart News]:
“Mr. Virgilio was a victim of police brutality. He was a victim of racial profiling,” Arroyo said. “He was a victim of violation of his fourth, fifth, and sixth amendment constitutional rights. Those who are responsible for this abuse will be held accountable.”
Arroyo also said the charges against Aguilar-Mendez are some “of the greatest injustices he’s ever seen” in the court system, calling them a “grave injustice” and “disheartening.”
The threat of a federal lawsuit comes as a local judge recently found Aguilar-Mendez incompetent to stand trial and ordered him to undergo competency treatment while he remains in St. Johns County custody.
According to police accounts, the fatal encounter occurred when Sgt. Kunovich lawfully attempted to pat down Aguilar-Mendez, who was sitting outside a closed business. Instead of complying, Aguilar-Mendez resisted and attempted to flee, sparking a confrontation that involved multiple officers.
The struggle between Kunovich and Aguilar-Mendez endured for over six minutes, during which Aguilar-Mendez allegedly attempted to seize the officer’s taser. Despite being handcuffed and disarmed of a pocketknife, Aguilar-Mendez’s resistance led to the tragic collapse of Sgt. Kunovich. Despite efforts by first responders, Kunovich was pronounced dead after being rushed to a nearby hospital.
Aguilar-Mendez’s status as an illegal alien has added a layer of complexity to the case. Having arrived at the United States-Mexico border the previous year, he was released into the United States.
