Illegal Aliens Face Criminal Charges for First Offenses

Migrants who are caught crossing the border illegally for the first time are now facing criminal charges in federal court in Arizona as the Trump administration steps up efforts to deter illegal immigration.

That changed as of June in the Tucson Sector, which includes most of Arizona’s border with Mexico, the agency said in a news release on Thursday. The new program has led to 565 prosecutions.

The illegal immigrants are charged with misdemeanors and tried in federal court under Operation Streamline, a 12-year-old initiative in which the migrants are charged, enter pleas and are sentenced within a few minutes in large groups. House Cracks Down on Illegal Alien Crime With Two BIG Votes

Illegal immigrant crime became a central theme in candidate Donald Trump’s presidential campaign. This week, the House of Representatives takes steps to crack down with two key pieces of legislation.

Kate’s Law would increase penalties for criminal illegal aliens who attempt to re-enter the United States after deportation. The bill is scheduled for a vote on the House floor Thursday.

During his campaign, President Trump promised to ask Congress to pass Kate’s Law on his first day in office. The White House released a statement Tuesday strongly urging the Congress to pass the bill and declaring that President Trump would sign it in its current form.

The Administration strongly supports H.R. 3004, Kate’s Law. This bill commemorates Kate Steinle, the 32-year-old woman who was shot and killed two years ago in San Francisco as she walked along a pier with her father. The alleged shooter, Francisco Sanchez, was an illegal immigrant who had already been deported five times and had seven felony convictions.

H.R. 3004 would increase the penalties that may be imposed on criminal aliens convicted of illegal reentry, deterring reentry and keeping criminal aliens off our streets. The bill is consistent with the Administration’s broader efforts to strengthen enforcement of our immigration laws and improve the security of our Nation’s borders.

If H.R. 3004 were presented to the President in its current form, his advisors would recommend that he sign the bill into law.

The second piece of legislation, the No Sanctuary for Criminals Act, targets sanctuary cities that violate federal immigration policy. The bill would defund sanctuary jurisdictions by withholding Homeland Security and Justice Department grants from cities that refuse to comply with federal immigration law. It would also expand mandatory detention policies to cover illegal immigrants with D.U.I. violations and those who have had a visa revoked.

House Judiciary Committee Chairman Bob Goodlatte, R-Va., is sponsoring both pieces of legislation.

“The House Judiciary Committee is working to improve our nation’s immigration laws and policy, and today I have introduced two, straightforward bills to enhance public safety,” Goodlatte said in a press release Friday. “We owe it to the families of those who lost loved ones to take action to prevent these horrible crimes. They have waited far too long.”

House Democrats are opposed to both bills, but according to The Hill, Democratic leadership is going easier on Kate’s Law. The “public’s perception of allowing people to come back in, commit crimes and not have a more serious sentence” might harm vulnerable Democrats during election season, said House Minority Whip Steny Hoyer, D-Md.

‘Over Our Dead Bodies’: This Ohio Conservative Is Taking on Liberals and Establishment GOP Over Sanctuary Cities

Josh Mandel will stop at nothing to keep the people of Ohio safe from illegal immigrant crime. But that is a little unusual when you consider that immigration issues don’t really fall into his job description.

Mandel is Ohio’s state treasurer and is currently locked in a political fight with liberal politicians over whether or not two of the Buckeye State’s biggest cities should help illegals skirt federal law enforcement. He is coming up against a political machine that is thoroughly bipartisan.

Earlier this year, the mayors of Columbus and Cincinnati announced that they wanted their cities to become sanctuary cities – municipalities that protect illegal immigrants from the repercussions of obfuscating federal immigration law.

Mandel – who is also a candidate for U.S. Senate – wasn’t about to let that happen, knowing the effects that these policies have had on countless families like that of Kate Steinle, who was gunned down in broad daylight by an illegal immigrant in San Francisco. Her killer had been previously shielded from deportation by the city’s sanctuary policy.

A day after Cincinnati Mayor John Cranley announced his sanctuary intentions, Mandel countered he would fight tooth and nail to block the effort (as well as any other such effort in the state).

“You’re seeing the city of Cincinnati, Hamilton County, and the state coming together here, to say over our dead body will Cincinnati become a sanctuary city,” he said at a press conference in late January.

“When a mayor like Mayor Cranley decides to publicly announce that he’s violating federal law, and that he’s going to make a city less safe against radical Islam and the threats we face, we have a responsibility as Americans, as citizens, to oppose this type of act from a mayor, from a politician.”

Josh Mandel, along with a Candice Keller, a Republican state representative from Butler County, introduced a bill that seeks to block sanctuary efforts. Going beyond the typical defund-threat approach, the legislation would impose criminal penalties on mayors of sanctuary cities when their citizens fall victim to criminal alien crime.

Situations like Kate Steinle’s aren’t limited to large cities, either. Last October, CR’s Carly Hoilman spoke with residents of Milford, Mass. – a town of 27,000 people – where multiple families have been torn apart by the after effects of lax immigration policy.

“Illegal immigration is not a victimless crime,” Maureen Maloney, whose son was killed by a criminal alien, told Hoilman. “Our family is permanently separated by his death.”

Mandel says his legislation in Ohio – which would hold culpable officials to a fourth-degree felony charge – is crucial for accountability.

“We want to include as strong a deterrent as possible to ensure that liberal politicians and others in the political establishment are not making their cities sanctuary cities and are not putting their citizens in harm’s way,” he told Conservative Review.

“For me, this issue is first and foremost about safety and security of families throughout the state of Ohio,” he said. “I believe that we have a duty to learn everything we can from horrendous policies like those in San Francisco and make sure that they never come to the heartland.”

Just as much as safety, Mandel says the debate is just as much about “the Constitution and the rule of law.”

“Federal law is pretty clear that local law enforcement has an obligation to report these illegal immigrants to federal immigration authorities,” he said. “And the politicians who think that they’re above the law are putting local cops in a terrible position just to score political points with left-wing activists.”

Right now, allies are sparse for a conservative like Mandel, who says he’s not only squaring off against the usual crowd of liberal, open-borders organizations and activists, and a liberal media, but also a state-level GOP establishment that is hesitant – or even hostile – to rocking that boat, contrary to their campaign promises and rhetoric.

“As usual, a lot of the squishy, moderate Republicans in Ohio are saying one thing to their constituents and doing another thing in Columbus,” Mandel told CR. “When they talk with conservative activists, they say they want to stop sanctuary cities, but when they run into me and other conservative leaders in the halls of the statehouse, they complain that we’re being too conservative.”

The treasurer is, to date, the only state-level official in Ohio to take a public stance on the issue.

But he’s used to leading a lone charge like this, which was the case for his crusade against other initiatives in the state like Medicaid expansion and Common Core — the latter of which he says started with him and two homeschooling moms around a kitchen table.

“We had the political establishment laughing at us and ridiculing us. Then we motivated the grassroots conservatives around the state to start contacting their public officials,” Mandel recalls.

“All of a sudden, the politicians in Columbus changed their tune.”

He hopes this fight will be no different.

Tucson Police Obstruct Border Patrol From Arresting Violent Illegal Alien Escapee

Since Donald Trump became president, local governments in highly Democratic areas have announced their intentions to shield illegal immigrants from deportation. Now, a local law enforcement agency in Arizona is joining in the obstruction.

Last weekend, the Tucson Police Department (TPD) refused to assist the U.S. Border Patrol with recovering a violent illegal immigrant who had escaped from custody. According to U.S. Border Patrol Agent Art del Cueto, 37-year-old Carlos Erazo-Velasquez violently assaulted a border patrol agent before escaping.

From Honduras,Erazo-Velasquez has been deported before and has a serious criminal history. Exhausted from running, he was soon caught, and transported to a hospital for medical treatment. While undergoing treatment, he escaped again.

As Border Patrol agents looked for Erazo-Velasquez, protesters in the predominantly Democratic city reportedly blocked one of their vehicles. Agents set up an incident command center in the TPD parking lot, according to Breitbart Texas. At first, TPD cooperated with them.

But later a police supervisor informed them that “Due to the recent political climate, the Tucson Police Department could no longer assist the Border Patrol.” The Border Patrol was ordered off the property.

TPD claims this was done in part due to a lack of staff and a busy night dealing with other types of crime, posting a full statement in response.

The Tucson Sector Border Patrol’s union posted a frustrated rant on its Facebook page.

This is now the times we are living in. Where one law enforcement agency has put politics over rule of law and oath of office. Never has Border Patrol or Border Patrol Agents refused or ignored a call for help from Tucson Police Department.

Nothing to Do With Immigration

“It has nothing to do with immigration,” del Cueto said, according to a report by Tucson News Now. “It has something to do with a convicted felon running around the streets of Tucson, and Tucson changing their mind and stopping from doing the right thing because of political pressure, and that is wrong.”

The TPD is headed by liberal Police Chief Chris Magnus, known for supporting Black Lives Matter when he was police chief of the Richmond Police Department in California. He admitted to the East Bay Times in a 2012 interview, “I’m probably not a cops’ chief.” He is also known for posting articles on Facebook by liberal New York Times columnist Maureen Dowd.

Erazo-Velasquez remains at large, and criticism of the department has begun mounting. Tucson has one of the highest violent crime rates in the nation. On a scale of 1 to 100, with 100 being the safest city, Tucson scores a 1 on the website NeighborhoodScout’s report.

A study done a few years ago in neighboring Maricopa County, Arizona, found that illegal immigrants commit crimes at a rate significantly higher than the general population. While they comprise 9 percent of the population, they commit 21.8 percent of felonies. Illegal Alien Speaks out at Press Conference About Being Illegal, Then Is Promptly Detained by ICE

An illegal alien decided to speak publicly at a news conference about her immigration status Wednesday. She was later detained by Immigration and Customs Enforcement officers.

Daniela Vargas, 22, was detained in Jackson, Miss. shortly after speaking at the press conference, The Clarion-Ledger reports. Vargas, an Argentine national who arrived in the U.S. at age 7, was previously protected under President Obama’s Deferred Action for Childhood Arrivals (DACA) program. Her DACA status, however, recently expired.

Vargas’ attorney Abby Peterson told The Clarion-Ledger that Vargas’ car was pulled over by ICE agents moments after the news conference, and they told her, “You know who we are, you know what we’re here for.”

The press conference was hosted by local churches, immigration attorneys and the Mississippi Immigrants Rights Alliance to speak about recently deported families. “A path for citizenship is necessary for DACA recipients but also for the other 11 million undocumented people with dreams,” Vargas said at the press event.

ICE Chief Refuses Senator’s Request for Criminal Illegal’s Case File

Immigration and Customs Enforcement (ICE) officials refuse to share the case file of a convicted criminal and illegal alien suspected of murdering five men, including one of Sen. Claire McCaskill’s constituents, the Missouri Democrat said Wednesday.

An exasperated McCaskill said to the Senate Committee On Homeland Security and Governmental Affairs (HSGAC) hearing on border security that the file that may provide answers to how ICE failures allowed convicted felon Pablo Antonio Serrano-Vitorino to escape. He skirted multiple encounters with police, re-entered the country illegally after deportation, and allegedly murdered four men in Kansas and 49-year-old Randy Nordman in Missouri in March 2016.

“If we want to stop future tragedies, we have to see that file,” said McCaskill, who is the panel’s ranking minority member, as she faced Nordman’s widow, Julie, who testified Wednesday. “We have to understand the mistakes that were made. And we have to have our questions answered.”

ICE officials cited privacy concerns for refusing to disclose the file, a claim that “flies in the face” of President Donald Trump’s recent executive order declaring non-citizens have no privacy rights, McCaskill said.

McCaskill said ICE Director Thomas Homan also refused to appear at Wednesday’s hearing, or send a representative. President Donald Trump named Homan acting director of the agency in January. (Read more from “ICE Chief Refuses Senator’s Request for Criminal Illegal’s Case File” HERE)

Illegal Alien With a Violent History Charged With Killing 5. Now a GOP Senator Is Asking Questions.

The Republican leader of the Senate Judiciary Committee is seeking further answers from the Obama administration about why an illegal immigrant charged with murdering five homeless people in a Los Angeles arson fire this summer was not previously deported.

Sen. Chuck Grassley of Iowa on Wednesday wrote a letter to Sarah Saldana, the director of Immigration and Customs Enforcement, asking follow-up questions related to the government’s response to a previous inquiry by the senator into how Johnny Josue Sanchez of Honduras, the suspect, was able to stay in the country despite having a violent history.

“Specifically, [Grassley] is asking whether Sanchez was not considered a priority under the Obama administration’s Priority Enforcement Program and whether federal authorities were blocked by local sanctuary policies that prevent cooperation with federal immigration officials,” the letter states.

Sanchez was arrested by the Los Angeles County Sheriff’s Office on June 13 for five counts of murder and two counts of attempted murder after he allegedly set fire to a vacant building where five homeless people were squatting, including four individuals from Iowa.

Shortly after the incident, on June 27, Grassley and Rep. Bob Goodlatte, R-Va., the chairman of the House Judiciary Committee, wrote a letter to Jeh Johnson, the Department of Homeland Security secretary, to learn more about Sanchez, who, according to media reports, had been arrested three times in the months before the fire.

The Los Angeles Times reported that Sanchez was arrested by border patrol agents in 2012 for illegally entering the country at the southeastern California border. Sanchez was promptly released from custody, the newspaper reported, because he had no previous immigration violations or criminal history.

Sanchez was then placed under supervision and ordered to report regularly to immigration authorities, but he stopped reporting in August 2014.

But in January of this year, the Los Angeles Police Department arrested Sanchez on suspicion of domestic violence. He was arrested again in May and June on suspicion of drug possession. His most recent arrest was less than a week before he allegedly set fire to the Los Angeles building. He was released the next day.

According to the Times, the Los Angeles Police Department does not honor immigration requests from the federal government to be notified of a person’s release from jail unless a warrant is issued or a judge has vetted the request.

In response to Grassley and Goodlatte’s original inquiry, the senator says, the Obama administration acknowledged more details about Sanchez’s history.

Grassley says he learned that Sanchez lied about his birth date to the border patrol upon entering the country illegally, which allowed him to be processed as a juvenile and sent to a youth shelter in California.

Sanchez stayed at a juvenile facility in Fullerton, California, for seven days, Grassley says, until the Honduran Consulate in Houston, Texas, verified Sanchez’s true birth date and provided a birth certificate showing he was not a juvenile.

After receiving this information, Immigration and Customs Enforcement regained custody of Sanchez and then released him after he signed a document promising to report to future court appearances related to his immigration status.

He never made it to court.

“Considering that Sanchez had intentionally misled federal authorities, it would seem inevitable that Sanchez would fail to appear before ICE [Immigration and Customs Enforcement] as directed,” Grassley wrote in Wednesday’s letter. “Sanchez should have been detained until his removal was completed.”

But more concerning to Grassley, he says, was that Immigration and Customs Enforcement, after Sanchez’s subsequent arrests this year, never requested that the Los Angeles Police Department issue a detainer on him to hold him in custody, or notify federal immigration authorities of his pending release from jail.

Grassley wants to know why those requests were never made to the local police department, and whether this decision was related to the Obama administration’s decision in 2014 to narrow the types of people it seeks to deport.

Immigration and Customs Enforcement officers are told to first target illegal immigrants considered to be threats to national security and public safety, who have likely been convicted of a felony. Other priorities for deportation include individuals who have been convicted of multiple misdemeanors, and recent arrivals who came here illegally after Jan. 1, 2014.

Grassley also asks in the letter whether Immigration and Customs Enforcement even knew about Sanchez’s previous arrests this year, or if its knowledge was limited because of Los Angeles’ policy to limit cooperation with federal immigration requests.

“Was Sanchez not considered a priority under the administration’s Priority Enforcement Program (PEP)? Her Child Was Killed by an Illegal Alien. Now They Call Her a Racist Nazi

Sabine Durden is many things. She’s a German immigrant, an avid Trump supporter, and an outspoken advocate for legal immigration. But above all of these things, she is a proud mother.

Durden’s son, Dominic, was killed four years ago in a fatal motorcycle crash. On July 12, 2012, Dominic, 30, was on his way to work when an illegal immigrant driving an unlicensed pickup truck took a wrong turn. Dominic was killed instantly.

The driver, Juan Zacarias Lopez Tzun, was an illegal immigrant from Guatemala with a record of drunk driving convictions. His initial sentence included nine months’ jail time, five years of probation, and a restitution fee of $18,800.

Thanks to the tireless work of Ms. Durden, Tzun was deported in March of 2014. Since then, Durden has continued in her efforts to fight illegal immigration and keep her son’s beautiful legacy alive.

Durden spoke with Conservative Review about her continued cause.

“The first thing I’d like to achieve is to share with everybody the incredible young man he was. The community loved him,” she said.

Durden shared that, to this day, she still receives regular feedback from individuals who knew her son dating back to grade school. Dominic’s old friends are now teaching their children about “Uncle Dominic,” a beaming teddy bear of a man who lived a life of service to his friends, family, and community.

Dominic, or Dom, as he was affectionately called by friends and family, worked as a 911 dispatcher at the Riverside County Sheriff’s Department. He was a licensed pilot and a volunteer firefighter who had earned multiple awards for his service to his community. Dom was on track to realizing his goal of becoming a motorcycle patrolman, and eventually a helicopter pilot.

Early this summer, the city of Moreno Valley erected the Dominic Durden Trailhead, a memorial plaque honoring Dominic’s work as a local volunteer and public safety servant.

For Ms. Durden, the hardest part about Dominic’s untimely death was knowing that his killer was permitted to remain in a “sanctuary city” of Riverside County, California, after having demonstrated irreverence for its laws on multiple occasions.

“I want my country to be protected, and I want others to never know the kind of pain and grief this causes — not just when your child gets killed, but when it’s avoidable,” she told CR.

“I’ve been called racist, Nazi, Hitler,” she said, adding that she commonly has to report threatening Facebook messages she receives from strangers. But even more upsetting, she shared, are the biting comments from people who she “thought were friends,” telling her that she should “leave things alone and not separate families.”

“And then I remind them, ‘What about my family?’ I don’t have one left. My only child is dead,” she said.

“When they call me a racist, I show them a picture of Dominic and tell them, ‘That was my son,’” she laughed, referring to Dominic’s mixed race.

But when that doesn’t work, she offers this analogy to help other parents understand her “America first” approach to public safety as it relates to immigration.

“The other thing I always tell them is this: You live in a house that has walls and doors. And you have your kids, and you love them, and you want them protected,” she said. “Why is it so wrong for your country and for the next president to want to protect its citizens?”

“It has nothing to do with race,” she continued. “It has nothing to do with not liking a certain color … I’m talking about any illegal from any country — any color. When you want to come here — and you’re more than welcome, and America sure has been welcoming to me as a legal immigrant — you have to do it the right way.”

Speaking from experience, Ms. Durden shared that she was always proud of her journey as a legal immigrant.

“I was always telling people how proud I was for choosing to become an American,” she said.

She was sworn in at the Los Angeles Convention Center in 1994, accompanied by her own mother — who flew over from Germany to witness the special moment — and, of course, Dominic.

“He was proud of me,” she said of her son, who fondly used to refer to himself as “German chocolate,” a nod to his black American father and white German mother.

Sabine Durden was one of the earliest and most prominent members of the Remembrance Project, an organization founded in 2009 to honor the families of victims of illegal immigrant crime. The group coined the term “Angel Moms,” which has been attributed to the parents of these victims.

Without going into detail, Durden told CR that she has recently cut ties with the group.

“I had to take care of myself first. And I had to look out for my son, not being used — his image and his name,” she said.

These days, she simply goes by “Dom’s mom.”

And, as for politics, she prefers to focus on the bipartisan issues of national security and family policy. But when asked, she’ll happily tell you which presidential candidate has her vote.

“Donald Trump is my ultimate hero,” Durden, a former lifetime Democrat, said of the Republican nominee.

“He brought [illegal immigration] to the forefront,” she added. Durden said that before Trump announced his bid for the presidency in June 2015, no other national leader had taken such a firm stance against illegal immigration.

“Nobody wanted to listen to Dominic’s story. They wanted to leave the ‘illegal’ part out of it,” she said. “And I started losing ground and the depression became harder.”

On July 10, 2015, Ms. Durden received a call asking her if she would like to meet Trump. Later that month, Durden and other parents met with Trump at a hotel in L.A., with no media present. After hearing their stories, Trump escorted the group to another room, where members of the press were waiting to hear their stories.

“He listened to us,” Durden said.

Fast-forward a year, when Durden was offered a prime-time slot to speak at the Republican National Convention in Cleveland, a moment she called “a highlight of my life.”

“That man not only saved my life; [Donald Trump] gave my son a voice,” she said.

Durden clarified again that she is a strong proponent of legal immigration, and she believes in helping struggling families looking to provide a better life for their children. But to this, she adds one important qualification.

Clinton Releases Plan to Dissolve U.S. Border Within 100 Days

Professional Republicans in the #NeverTrump movement continue to oppose the presumptive nominee selected by the GOP electorate and are now floating strategies to throw the election to Hillary Clinton.

However, an examination of Clinton’s campaign promises reveals that Republicans who are willing to thwart Trump in favor of Clinton will be complicit in electing a President who would seek to bring about the complete and, possibly irreversible, dissolution of our nation’s borders.

A review of Clinton’s stated positions on the issue suggests she is perhaps the most extreme candidate on immigration ever to run for the office of the U.S. Presidency. Her views place her even further outside the mainstream of the American electorate than President Barack Obama, who systematically dismantled U.S. immigration law during his two terms in office . . .

Clinton has pledged to enact amnesty within her first 100 days in office. As NBC recently reported: “If elected, the former secretary of state has promised to build on President Obama’s executive actions and introduce comprehensive immigration reform during her first 100 days in office.”

Clinton’s website has explained that by “comprehensive immigration reform,” Clinton means full citizenship for illegal immigrants, which would give them welfare access, voting privileges, and the ability to bring over their family members through chain migration. Undocumented Cal State Students Fear Border Patrol’s Participation in Career Fair

Border_Patrol_ATV_IMG_5278Students at the California State University, San Marcos staged a demonstration Thursday protesting the inclusion of Border Patrol representatives at the school’s career fair.

Sociology professor Marisol Clark-Ibanez tweeted a photo Thursday evening showing students holding signs with messages such as “Stop tearing us apart” and “CSUSM: A Safe Space?” in front of the table advertising positions with U.S. Customs and Border Protection (CBP), while a uniformed officer records them on a cell phone.

The next day, she sent an open letter to Career Center Director Pamela Wells explaining that, as faculty advisor to the Standing Together As oNe Dream (STAND) student group, she became alarmed upon arriving on campus Thursday morning to find a CBP vehicle and three police cars (all empty) parked near the student union.

“My heart froze because I immediately became concerned for our students’ safety and wellbeing,” she recalls. “When I parked in the parking garage, I texted Julio (STAND president) and let him know what I saw, ask where he was, and if he (and others) were okay.”

After determining that the law enforcement vehicles were on campus for the career fair taking place that day, Julio “gathered students to assemble an impromptu protest to let Border Patrol know their practices in our community were unjust and detrimental,” during which both sides took photos and videos in case the demonstration got out of hand.
