GOP Groups Sue California Gov. Newsom, Claim Vote-By-Mail Order Is ‘Brazen Power Grab’
By Fox News. The Republican National Committee, National Republican Congressional Committee and California Republican Party sued Gov. Gavin Newsom and the state’s Secretary of State Alex Padilla on Sunday, claiming an executive order sending mail-in ballots to all registered voters in the state is an “illegal power grab” that invites potential fraud.
Newsom’s order, aimed at allowing voters to avoid exposure to coronavirus, will send ballots to all registered voters including inactive voters. This has led to concerns that ballots sent to people who have moved or died will end up being filled out and submitted anyway unless voter rolls are inspected and cleaned out before ballots are mailed. Many Republicans have expressed concern that Democrats could try using these ballots improperly, to swing races in their favor.
“In a direct usurpation of the legislature’s authority, Governor Newsom issued an executive order purporting to rewrite the entire election code for the November 2020 election cycle,” read the complaint, filed Sunday in the U.S. District Court for the Eastern District of California. “This brazen power grab was not authorized by state law and violates both the Elections Clause and Electors Clause of the U.S. Constitution.”
The lawsuit claimed Newsom “has created a recipe for disaster” by ordering ballots be sent to everyone registered to vote including inactive voters, arguing that “it invites fraud.” The Republicans also claimed that by giving Newsom the sole power over determining where and if in-person voting will take place, it will lead to “arbitrary and disparate treatment of individual voters,” violating the Fourteenth Amendment’s Equal Protection Clause.
As examples of potential foul play, the complaint noted that mailed ballots easily could be intercepted by the wrong parties if they’re mistakenly sent to the wrong addresses or if the recipients lived in large residential buildings. Additionally, the Republicans wrote, voters could be susceptible to pressure from others when voting outside the private, secret confines of a voting booth. By National Review. Joe Biden said in a Friday interview that a black voter who can’t decide between him and President Trump in the 2020 elections isn’t really black.
“If you have a problem figuring out whether you’re for me or Trump, then you ain’t black,” Biden told radio DJ Charlamagne tha God on The Breakfast Club. (The comments come at around the 17:15 mark.)
“It don’t have nothing to do with Trump, it has to do with the fact — I want something for my community,” Charlamagne responded.
The comments came after Biden said his campaign was looking into “multiple” African-American women to pick as his running mate.

Joe Biden Expresses Regret Over ‘You Ain’t Black’ Comments: ‘I Shouldn’t Have Been so Cavalier’
By Fox News. Joe Biden expressed regret Friday during a call with black business leaders for suggesting in an earlier interview that African-Americans unsure about whether to support him or President Trump “ain’t black.”
“I shouldn’t have been so cavalier,” Biden said in an afternoon phone call with the U.S. Black Chambers, addressing the controversy within seconds of the session starting.
The public attempt to walk back the remarks underscored how explosive the issue became for the presumptive Democratic presidential nominee’s campaign in a matter of hours, at a time when he’s working to unite the party and avoid the kind of internal divisions that helped Trump win in 2016.
Biden said he understands the comments sounded like he was taking the black vote “for granted” but insisted that wasn’t the case.

By New York Post. Leaked phone conversations between Joe Biden and then-Ukraine President Petro Poroshenko have been made public by a Ukrainian lawmaker.
Edited recordings of the calls were played at a news conference Tuesday in Kiev by Andriy Derkach, who has claimed he has proof showing that Burisma Holdings, the Ukrainian natural gas company that employed Biden’s son Hunter Biden, paid then-Vice President Joe Biden $900,000 in lobbying fees. . .
Derkach said he received the leaked audio from “investigative journalists” — and that the recordings were made by Poroshenko himself. . .
“It’s going to be critical for him to work quickly to repair the damage that Shokin did,” Biden said in the call. “And I’m a man of my word. And now that the new prosecutor general is in place, we’re ready to move forward to signing that new $1 billion loan guarantee.” . . .

Zelensky Seeks Probe Over Leaked Audio of Biden Linking U.S. Aid to Ukraine Prosecutor’s Ouster
By Fox News. Ukrainian President Volodymyr Zelensky called for an investigation Wednesday of leaked recordings purportedly depicting then-Vice President Joe Biden telling Zelensky’s predecessor Petro Poroshenko that his country would receive U.S. aid once top prosecutor Viktor Shokin was replaced.
The presumptive Democratic presidential nominee already has acknowledged such an arrangement publicly. But the leaked audio revived criticism that Biden was engaged in a kind of quid-pro-quo, much like President Trump was accused — during impeachment proceedings — of linking U.S. aid to calls for Zelensky to probe Shokin’s ouster.
The new audio indicates Poroshenko went along with Biden’s plan but did not think Shokin was involved in wrongdoing.
Shokin purportedly has said under oath that he had launched a probe concerning Hunter Biden’s role at Ukrainian energy firm Burisma Holdings when he was ousted. Hunter Biden held a lucrative post there, despite limited expertise, while his father handled Ukrainian policy as vice president. At the least, Ukrainian prosecutors had previously been investigating Burisma’s founder. Biden’s defenders have argued his intervention had nothing to do with Burisma and was focused on corruption concerns.
Zelensky said at a news conference in Ukraine that the contents of the leaked conversations, however, “might be perceived, qualified as high treason,” according to The Washington Post. Ukrainian prosecutors have said they are looking into sweeping “international corruption.” Zelensky has tried to maintain good relations with the Trump administration, even as his 2019 discussions were at the core of the U.S. president’s impeachment. Biden tells a fundraiser that anti-Semitism is “the mother of all conspiracy theories” and adds: “People are walking into the state legislative body and in front of her driveway carrying assault rifles, Nazi banners and Confederate flags and the president is not saying a word.”
Not only has Trump repeatedly condemned antisemitism, but he did so extensively just a few weeks ago, in issuing a proclamation declaring May to be Jewish Heritage Month. The president said:

The former vice president and presumptive Democratic nominee revealed on Monday that he’s calling Trump “President Tweety.”
Arguing that the president’s been slow to get federal relief aid to the American workers and businesses hurt by the shutdown of much of the nation’s economy the past two months to slow the coronavirus pandemic, Biden noted, “Trump is out there tweeting again this morning. I call him President Tweety. Reopen the country, end of quote.”

Former Vice President Joe Biden once bragged about nearly being arrested for chasing a “lovely group of women” into an all-female dormitory in his youth.
Biden, who is now under scrutiny after facing sexual misconduct allegations from a former Senate staffer, regaled voters during a campaign swing through Athens, Ohio, in October 2008, with a story about what occurred during his last visit to their city. At the time, Biden, who was the Democrat vice presidential nominee, claimed he had journeyed to the city for a football game between his alma mater, the University of Delaware, and the local, Athens-based Ohio University sometime in 1963.
“Now I made a little mistake here that day, I made a little mistake,” Biden told the crowd at the time. Adding, according to reporters in attendance, with a wink that after the game he wandered around and “met this lovely group of Ohio University…students.” . . .
“And uh, without knowing it, I shouldn’t admit this on national television because it’ll reveal that I’m over 60, but I thought that we were gonna go get something to eat,” he said. When the “two young women” claimed they would “be right back,” he offered to escort them to their dormitory, where trouble quickly ensued with campus security.

That sound you hear is the deep groan of disappointment by people who had hoped that Attorney General Bill Barr would investigate former President Obama for his part in “Obamagate.”
In just the past few days it’s been publicly disclosed that both Obama and Vice President Biden were in an Oval Office meeting in which the investigation into Trump National Security Adviser General Mike Flynn was discussed. It was also revealed that Biden personally “unmasked” Flynn’s name to discover more information about Flynn. President Trump calls the spy program “Obamagate.” . . .
But Barr said Monday that the Department of Justice is unlikely to charge either former President Obama or Vice President Joe Biden in the “Obamagate” spying program on the Trump campaign, Law and Crime reports.
“This is especially true for the upcoming elections in November,” Barr said, adding that it is “critical” that we have a 2020 election in which the American people have a chance to vote based on “robust” policy debate — not criminal debate.
“Any effort to pursue an investigation of either candidate has to be approved by me,” Barr noted. In January, Barr said that the FBI, heading forward, would have to get approval from him before “opening of a counterintelligence investigation of a presidential campaign.”

Activists cheered when Joe Biden committed to not pardoning President Trump. But the concern at the root of the question is not based on substantive evidence any top Democrats think pardoning Trump would be a beneficial move should they win the White House.
In a Thursday MSNBC town hall, a viewer submitted a question for the presumptive Democratic presidential nominee: “Would you be willing to commit to not pulling a President Ford and giving Donald Trump a pardon under the pretext of healing the nation?” he asked, referring to the pardon of President Richard Nixon after he resigned in 1974 amid the Watergate scandal. “In other words, are you willing to commit to the American ideal that no one is above the law?” . . .
“Absolutely, yes. I commit,” Biden said. “It’s hands-off completely. Look, the attorney general of the United States is not the president’s lawyer. It’s the people’s lawyer.” . . .
House Intelligence Committee Chairman Rep. Adam Schiff in July 2019 tweeted an exchange with special counsel Robert Mueller that noted the president could technically be legally prosecuted for actions he took after he leaves office that the Department of Justice thinks he could not be constitutionally charged with now.
Mueller was asked, “Did you actually totally exonerate the president?"
He responded simply, “No,” and said, “The president was not exculpated.”
When asked if it was true Trump could be charged when he leaves office, Mueller responded simply, “True.”
Though it is not likely, the question about pardoning Trump is a way for Democrats to allow Biden and prominent candidates to hint at the possibility of prosecuting Trump while avoiding having to make a legally and politically messy pledge to prosecute him.
