Oregon Bakers’ Legal Battle Continues, as Same-Sex Couple Speaks Out

Aaron and Melissa Klein, the Oregon bakers who refused to make a cake for the wedding of two women, filed new documents Thursday with the Oregon Court of Appeals in response to the same-sex couple’s arguments that the Kleins had no legal right to refuse them service.

“We are hopeful that these judges will understand that [Oregon officials] violated Aaron and Melissa’s rights, including rights of free speech and due process that judges tend to respect regardless of judicial philosophy,” Ken Klukowski, a lawyer for the bakers, said.

In the new brief, the Kleins’ lawyers challenge the argument that the government can force citizens to create art and engage in speech that goes against their religious beliefs.

“None of this would have happened had everyone simply lived in peace according to their own beliefs,” Klukowski, senior counsel for First Liberty Institute, a conservative legal group representing the Kleins, told The Daily Signal.

The Kleins initially filed their appeal in April, challenging the July 2015 decision by the Oregon Bureau of Labor and Industries that they had discriminated against Rachel and Laurel Bowman-Cryer, the lesbian couple who the Kleins declined to serve.

An administrative judge for the state agency ordered the Kleins to pay the Bowman-Cryers $135,000 for physical, emotional, and mental damages.

The Bowman-Cryers, responding to the appeal to Oregon’s second-highest court, argued the agency’s ruling should stand.

The Kleins’ new legal brief was the last step before both parties head to the appeals court for oral arguments.

The Kleins paid the ordered $135,000 in damages—plus interest—in December. The Bowman-Cryers have not received the money, which is being held in a separate account by the Oregon Bureau of Labor and Industries until the appeals process plays out.

The dispute began in January 2013, when Aaron Klein told Rachel Cryer that the Kleins’ bakery, Sweet Cakes by Melissa, would not make the wedding cake after learning it was for two women.

The Kleins are Christians and say they believe marriage is the union of one man and one woman.

The Bowman-Cryers, now married, filed a complaint with the Oregon Bureau of Labor and Industries under the state’s public accommodation law, which bans discrimination based on sexual orientation.

The Oregon agency pursued charges against the Kleins on behalf of the same-sex couple.

Up until recently, the Bowman-Cryers had not spoken publicly about their case, and declined multiple interview requests from The Daily Signal through their lawyers.

But on Tuesday, the couple broke their silence.

“In recent months we’ve decided to speak out for one primary reason,” Rachel and Laurel Bowman-Cryer wrote in The Advocate, a publication focused on LGBT issues. “We don’t want any person or family to go what we’ve gone through. Every family deserves respect, dignity, and a life free from discrimination and harassment.”

The couple also shared why they got married:

Part of the reason we decided to get married in the first place was to provide stability for our daughters. Before we became engaged, we became foster parents for two very high-needs girls after their mother, a close friend of ours, died suddenly. Lizzy, now 9, has cerebral palsy, autism, and a chromosomal disorder that causes developmental delays. Anastasia, now 7, has Asperger’s and stopped speaking when her mother died.

While the case wound its way through the courts, we won full adoptive custody of Lizzy and Anastasia, and they are the light of our lives.

For their part, Aaron and Melissa Klein chose to participate in some media interviews, including with The Daily Signal. The couple also launched a fundraising account that has brought in close to $500,000.

In their article, the Bowman-Cryers described the Kleins’ as “media darlings of the right wing.”

In interviews with The Daily Signal, Melissa Klein became emotional describing the hardships the family of seven also has faced because of the case, including closure of the bakery. (The Daily Signal documented some of the backlash here.)

Klukowski, the lawyer who represents the Kleins, said the couple “never wanted to have to go through this ordeal” and had sought only “to run their little bakery consistent with their Christian faith as their ministry to their neighborhood.”

He said in an email to The Daily Signal:

Leftist media outlets have grossly and irresponsibly exaggerated the amount the Kleins received when generous Americans heard that the Kleins’ business was being driven into the ground due to this case, and $135,000 from that generosity had to be turned over to the [Oregon Bureau of Labor and Industries] to hold in escrow in order for this appeal to be pursued.

Aaron and Melissa continue to suffer from lack of good job opportunities, and lack of educational opportunities for their children, because of the government’s draconian pursuit of them and their family, aided by the relentless mocking and derision of liberal media outlets and intolerant activists, fueling ongoing hurtful attacks on their family.

Oregon Militia Members Were Just Delivered Devastating News

The Oregon militia members who occupied a wildlife refuge in protest of the government could face decades in prison under a set of new criminal charges, including firearm offenses, theft of public property and damaging a Native American archaeological site.

Federal prosecutors in Portland have greatly expanded their case against brothers Ammon and Ryan Bundy and more than a dozen defendants who participated in the armed takeover of the Malheur national wildlife refuge in the high-profile standoff that began 2 January and dragged on for 41 days in rural Oregon.

Last month, after the final four occupiers surrendered to the FBI, officials arrested and charged a total of 25 people for their roles in the armed anti-government demonstration on public lands controlled by the federal government.

The rightwing activists, who traveled from across the US to protest the government’s land-use restrictions in the west, are all accused of using “force, intimidation and threats” to conspire against and impede government officials – a federal felony offense that carries a maximum sentence of six years in prison.

But on Wednesday, prosecutors unveiled a slew of new charges against 19 of the 25 defendants in the case – an indication that the federal government plans to aggressively target the protesters, some of whom could face more than 20 years in prison if convicted of all the offenses. Ammon Bundy, Others Plead Not Guilty in Oregon Refuge Case

Ammon Bundy and another 15 defendants pleaded not guilty Wednesday to federal conspiracy charge related to 41-day occupation of an Oregon wildlife refuge. Several of the accused, however, expressed doubt that they enjoy the presumption of innocence.

Bundy sat at the main defense table while most of his co-defendants sat in the jury box as they listened to a government prosecutor read the indictment and U.S. District Judge Anna Brown tell them their rights.

Brown reminded the defendants that they are considered innocent until proven guilty. One by one, she asked them if they understood. 41-Day Standoff Ends as Last Armed Oregon Refuge Protester Surrenders to the FBI

The four remaining holdouts of the armed protest group that has occupied a federal wildlife refuge in Oregon for the past 41 days turned themselves in peacefully Thursday . . .

After the first three protesters surrendered to authorities at around 9:40 a.m. local time, the last occupier, David Fry, initially resisted. But just after 11 a.m., Fry turned himself in to the FBI, according to the Oregonian.

Fry had said on a live audio webcast that he was “feeling suicidal” and would “die a free man.” At one point he said he was pointing a gun at his head. He ranted about abortion, UFOs, the government “chemically mutating people” and Syria . . .

But eventually, after requesting listeners yell “Hallelujah,” he walked out to meet authorities . . .

One of the three protesters who turned themselves in first was holding an American flag as the group went out to meet authorities. Another protester said on an audio webcast that officials were not being rough and did not have guns pointed at the group. FBI Has ‘Encircled’ Remaining Occupiers at Oregon Wildlife Refuge, Agents in Armored Vehicles Demanding Surrender

The FBI has encircled remaining occupiers at the Malheur National Wildlife Refuge near Burns, Oregon, which armed protesters took over in early January.

Les Zaitz, senior investigative reporter for the Oregonian, posted the following tweet: . . .

Refuge occupier Sean Anderson adds additional confirmation that FBI will not advance tonight, but will allow occupiers to meet at checkpoint with Fiore and Graham later Thursday morning.

Anderson says occupiers will put their weapons in their vehicles when they turn themselves in as they march toward the checkpoint with American flags.

Anderson added that turning themselves in to the FBI is “going against everything we believe in,” but said they will “proceed with our surrender” once Fiore and Graham arrive at the refuge.

Watch: The Haunting Words Oregon Protester LaVoy Finicum Said the DAY Before He Was Killed

Photo Credit: YouTubeThe militia spokesman killed in a confrontation with law enforcement in Oregon said in an interview the day before he died that the government appeared to be ramping up for action.

“They’re doing all the things, they’re doing all the things that shows that they want to take some kinetic action against us,” said Robert “Lavoy” Finicum.

Although the identification of the dead protester has not been formerly released, family members identified Finicum as the one killed Tuesday. One of the group’s leaders, Ryan Bundy, was reportedly wounded after law enforcement initiated arrests at a traffic stop of some of the militia group traveling to a community meeting in the city of John Day. According to reports, Fincum and Ryan Bundy refused to obey orders to surrender . . .

The anti-government group took over an unoccupied outpost in the Malheur National Wildlife Refuge near Burns, Ore., in Harney County almost four weeks ago as a protest against government encroachment on private lands. The group said after Tuesday’s incident that they intend to stay and continue to protest.

There have been decades of complaints that the Bureau of Land Management (BLM) has allegedly taken over private lands and uses unscrupulous methods to do so. The arrest and conviction of rancher Dwight Hammond, 73, and his son Steven Hammond, 46, on terrorism charges for performing a controlled burn on federal land was the catalyst for the refuge takeover, even though the Hammonds’ family is not connected to the militia movement.

Finicum’s death lacks details, and this has prompted questions as well as accusations from his family, friends and those watching the scenario unfold. Finicum told a reporter in his last interview that the group had no plans to disrupt public meetings held nearby and did not want violence. LaVoy Finicum’s Family Questions Shooting Despite FBI Video

By Jason Sickles. The FBI’s aggressive move to release video evidence which they say shows anti-government protester LaVoy Finicum reaching for a gun before being shot and killed by police apparently did little to persuade the dead man’s family.

“LaVoy was not ‘charging’ anyone,’” his survivors said Friday afternoon in a statement released through their attorney. “He appears to have been shot in the back, with his hands in the air.”

Their comments, first reported by Reuters, come a day after the FBI took the unusual step of making a 26-minute surveillance video public two days after Finicum was killed. The aerial video, which the bureau published to its YouTube page, had more than 1.5 million views in less than 24 hours.

A state trooper shot Finicum, 54, Tuesday when a team of law enforcement officers set up a traffic stop to arrest several leaders of the month-long protest over federal control of ranch lands. (Read more from “LaVoy Finicum’s Family Questions Shooting Despite FBI Video” HERE)

FBI Releases Video Footage of LaVoy Finicum Shooting

By Kelly House. As state troopers trained their guns on Robert “LaVoy” Finicum along a secluded eastern Oregon highway, he reached twice for a pocket that police say contained a 9 mm semi-automatic handgun.

That’s when they fatally shot Finicum, a video released Thursday by the FBI appears to show.

The federal agency played the video in an attempt to dispel rumors about the circumstances of Finicum’s death two days earlier as he and other leaders of the armed standoff at the Malheur National Wildlife Refuge were driving to a meeting.

Conflicting accounts of his shooting fueled outrage among supporters of the refuge occupiers and prompted the leader of a Northwest militia group to issue a call for members to report to Burns.

Watch: The Last-Standing Oregon Militia Men Say They Are ‘Willing to Die’ If the FBI Won’t Give in to Their Demands

By Daily Mail Online Reporter. Four militiamen are still refusing to leave the Malheur National Wildlife Reserve where they have been locked in a 27-day stand-off with police, which has left one dead; 11 arrested and has brought widespread condemnation from the local community.

In a live video broadcast from the Oregon ranch this week, one of the last-standing members, said he believes the FBI is ‘going to kill them’, but refused to leave unless the authorities would meet their demands.

Another militiaman added he is ‘willing’ to die in a final bloody siege with the authorities if negotiations fail. Their comments come after the last leader of the occupation voluntarily handed himself in at a police checkpoint.

Where Was the FBI During the Armed Standoff in Oregon? Out of Sight, but Listening and Watching

By Nigel Duara. As the armed occupation of the Malheur National Wildlife Refuge in Oregon dragged on for most of January, local law enforcement was spread thin and federal agents were nowhere to be seen.

Behind the quiet facade, however, the FBI was running surveillance on the occupation and recording the activists’ public statements, mostly drawn from media reports and the activists’ use of social media, while FBI agents encouraged locals to report their experiences with the new strangers in town.

According to the allegations in an indictment and supporting affidavit, the FBI was collecting information that confirmed the occupiers were armed, angry and willing to die.

The court documents detail how a source told a Harney County sheriff’s officer that the protesters “had explosives, night vision goggles, and weapons and that if they didn’t get the fight they wanted out there they would bring the fight to town.” The documents show that authorities grew concerned as the occupiers used increasingly heated rhetoric when discussing their plans and the occupation. Ammon Bundy Urges Protesters to Leave Refuge

Oregon militia leader Ammon Bundy is urging his followers at a wildlife refuge near Burns, Ore., to leave, according to a statement released by his attorney.

Bundy’s lawyer, Mike Arnold, read a statement by Bundy, arrested Tuesday, on the steps of a courthouse in Portland.

“Right now, I am asking the federal government to allow the people at the refuge to go home without being prosecuted,” the statement read. “To those remaining at the refuge, I love you. Let us take this fight from here. Please stand down. Go home and hug your families. This fight is ours for now in the courts. Please go home.”

The statement also paid tribute to Robert “LaVoy” Finicum, the protester who died on Tuesday, as federal and state authorities arrested Bundy and seven others during a traffic stop on Highway 395 between the Malheur National Wildlife Refuge refuge and John Day, Oregon. Bundy and the protesters had holed up at the refuge since Jan. 2. Authorities said the arrests came after futile efforts to end the standoff peacefully for 25 days.

As of 8:15 p.m. PT, it was unclear if any of the protesters had left. But several armored law enforcement vehicles arrived at that time and told media members to leave the area. (Read more from “Ammon Bundy Urges Protesters to Leave Refuge” HERE)

Oregon Militia Standoff: One Dead After Ammon Bundy and Others Arrested

By Sam Levin. An associate of the armed Oregon militia occupying a wildlife refuge was shot dead on Tuesday after a shootout with federal agents that resulted in the arrest of the group’s leader Ammon Bundy and a group of protesters.

The shootout appears to have taken place on a highway in rural Oregon – away from the federal refuge the armed militia have been occupying.

FBI officials said they arrested Bundy, his brother Ryan Bundy, Bryan Cavalier, Shawna Cox and Ryan Payne on Tuesday afternoon after they stopped them along the highway.

The agency described the shootout and arrests as resulting from “an enforcement action to bring into custody a number of individuals associated with the armed occupation of the Malheur National Wildlife Refuge” that occurred at 4.25pm PST. Ammon Bundy, Other Protesters Arrested in Oregon; LaVoy Finicum Killed

By Evan Perez, Holly Yan and Dana Ford. Ammon Bundy, leader of the armed protesters who took over a federal wildlife refuge in Oregon, was arrested and one of his followers killed in a highway traffic stop Tuesday.

A law enforcement official told CNN that authorities pulled over two vehicles. Everyone obeyed orders to surrender except two people: LaVoy Finicum and Bundy’s brother, Ryan Bundy, the official said.

Shots were fired, but it’s not known who fired first, the official said. Ryan Bundy was injured, but Finicum died, the official added.
