Hunter Biden Misdemeanor Charges Dismissed by Judge Following Plea Deal Breakdown

Hunter Biden’s misdemeanor tax charges have been dismissed by a federal judge in Delaware, an expected move after his “sweetheart” plea deal fell through last month during his first court appearance in the case.

The Justice Department submitted a filing last week to dismiss the case ahead of a possible trial on Biden’s felony gun charge in a different district.

After the plea deal fell apart, Biden pleaded “not guilty” as federal prosecutors confirmed he is still under federal investigation. He was expected to plead guilty to the two misdemeanor tax counts of willful failure to pay federal income tax as part of the plea deal to avoid jail time on the felony gun charge.

Biden’s attorneys and Special Counsel David Weiss are still fighting over a diversion agreement concerning the felony charge that would allow him to avoid any jail time. Weiss has indicated he plans to potentially take Biden to trial in the future in either Washington, D.C., or California.

Former Intelligence Director Slams New Biden Docs as the ‘Smoking Gun and the Bloody Knife’

Former Director of National Intelligence John Ratcliffe said new documents involving Joe and Hunter Biden were a “smoking gun and the bloody knife” Thursday.

Republican Rep. James Comer of Kentucky, the chairman of the House Oversight Committee, demanded access to documents from then-Vice President Joe Biden’s emails Thursday in a letter to the National Archives and Records Administration. A May 26, 2016 email to one of then-Vice President Joe Biden’s pseudonyms discussed an upcoming meeting with then-Ukrainian President Petro Poroshenko.

“These are Joe Biden’s documents. One of the emails on the NARA website is literally titled, ’emails between vice President Joe Biden and Hunter Biden regarding Ukraine and Burisma,’” Ratcliffe told Fox News host Laura Ingraham. “I mean, that’s not a smoking gun, that’s a smoking gun and the bloody knife. I mean, that’s really significant evidence that we really shouldn’t just be finding about now. Takeaways From the Hunter Biden Special Counsel Appointment You Won’t Hear From Big Media

Friday’s news dump featured an announcement by Attorney General Merrick Garland that he had named Delaware U.S. Attorney David Weiss as special counsel to continue the investigation into Hunter Biden “as well as any matters that arose from that investigation or may arise from the Special Counsel’s investigation.”

While the official appointment order barely filled a page and the attorney general’s accompanying comments provided little additional texture, the news is hugely significant. Here’s how.

When news broke that Garland had named Weiss as special counsel, Republicans jumped on the appointment as further proof of a cover-up to protect the Biden family. After all, the House had finally succeeded in uncovering and exposing massive evidence of corruption reaching all the way to the Big Guy, and whistleblowers continue to provide Sens. Chuck Grassley and Ron Johnson further material, including evidence that implicates the Department of Justice in obstructing the investigation.

However, court filings in United States v. Biden from Friday indicate the collapse of Weiss’s plea deal with Hunter Biden spurred the request for special counsel status. The president’s son had appeared before Judge Maryellen Noreika on July 26, 2023, ready to enter a guilty plea on two misdemeanor tax counts. But after questioning by the federal judge on the interaction between the plea agreement and a separate pretrial diversion agreement the parties entered on a gun offense, Hunter Biden pled not guilty and the court continued the hearing, ordering the parties to provide supplemental briefing. Noreika was particularly concerned that the pretrial diversion agreement related to the gun offense included a provision granting wide-ranging immunity to Hunter Biden, whereas normally that provision would be included in the plea agreement.

On Friday, the Delaware U.S. attorney’s office filed a motion with Judge Noreika stating that following the late-July hearing, the parties had entered additional plea negotiations but had “reached an impasse” and that the government now believes the case will not resolve short of trial. And because “venue,” meaning the proper location for a trial, does not lie in Delaware but rather Washington, D.C., or the central district of California, Weiss’s office moved to dismiss the charges against Hunter Biden “without prejudice,” meaning charges could be refiled elsewhere. Ex-FBI Agent Says IRS Whistleblower Was Right, Bidens Were Tipped off During Investigation

A former FBI agent who worked on the investigation into Hunter Biden has corroborated a major claim made by whistleblower and IRS supervisory special agent Gary Shapley.

The unnamed retired FBI supervisory special agent testified to the House Committee on Oversight and Accountability in a closed-door session on July 17. The committee released the 65-page transcript of that testimony on Monday.

The ex-agent backed up allegations made by Shapley that President Joe Biden’s transition team was tipped off about the FBI’s intent to interview Hunter. The agent said he was notified the evening before the date of the expected interview – planned to be held on December 8, 2020 – that the Biden transition team had been warned.

“I was refreshed by the testimony of supervisor No. 2, and I believe he’s correct. I believe I – you know, and now getting into the frame of mind, I know I was upset when I learned about it,” the agent told lawmakers. Former FBI Agent Says He Was Not Aware of Interference in Hunter Biden Probe

A former FBI agent who helped lead the probe of Hunter Biden told congressional investigators that he was not aware of any political interference in the case, though he said higher-ups blocked an interview with President Joe Biden’s son weeks after the 2020 presidential election, transcripts show.

In transcripts from a July 17 interview with the Republican-controlled House of Representatives Oversight Committee, the unidentified FBI supervisory agent corroborated earlier testimony by an Internal Revenue Service whistleblower that investigators were not allowed to interview Hunter Biden on Dec. 8, 2020, after top Secret Service officials and the Biden transition team were notified of the plan.

The former agent, who retired last year after more than 20 years with the agency, told investigators that he was frustrated over the decision by more senior officials to block the interview but didn’t consider the outcome problematic.

“I wasn’t aware of political interference, personally,” the former agent said.

Republicans pointed to the testimony as evidence that the Justice Department intervened to delay the Hunter Biden probe, even though the events took place while Republican President Donald Trump was in office. Hunter Biden’s Attorney Says He’s ‘Confident’ First Son Won’t Face New Criminal Charges

A lawyer for Hunter Biden said Friday that he’s confident that the first son won’t face new criminal charges even after Delaware U.S. Attorney David Weiss was named special counsel, arming him with new powers in the investigation.

Defense attorney Chris Clark said he’s unaware of any wrongdoing Hunter Biden committed outside of Delaware and that he is baffled that Mr. Weiss would ask to be named special counsel.

“It is hard to see why [Mr. Weiss] would have proposed such a resolution if there were other offenses he could have successfully prosecuted, and we are aware of none,” Mr. Clark said. “We are confident when all of these maneuverings are at an end my client will have resolution and will be moving on with his life successfully.”

Mr. Clark’s statement comes after Attorney General Merrick Garland announced that he was elevating Mr. Weiss to special counsel to continue his Hunter Biden probe.

It also follows federal prosecutors’ motion Friday asking a judge in Delaware to drop the tax charges against Hunter Biden so they could refile them in California and that the case would likely result in a trial. So when the then vice-president of the United States had clandestine dinner meetings with some of his troubled son Hunter’s cronies, he did so in a very private room at his favorite Washington, DC, restaurant, Café Milano.

According to records found on Hunter Biden’s laptop, a dinner with Vadym Pozharskyi, an executive of the Ukrainian energy company Burisma, took place in the restaurant’s Garden Room in April of 2015.

The Bidens are also said to have met with Kazakh oligarch Kenes Rakishev and former Kazakhstan prime minister Karim Massimov at Milano.

Hunter Biden’s ‘Sugar Brother’ Attorney Could Be on the Hook Next

Entanglements with President Joe Biden’s embattled son Hunter Biden could potentially bring down high-powered California attorney Kevin Morris — who was recently spotted reportedly smoking a bong on the balcony of his Malibu home.

Morris, a longtime Democrat donor who was best known for throwing money around in Hollywood — helping to broker a licensing deal for “South Park,” among other things — has been linked to Hunter Biden since 2019 in what the New York Post called “more of a bromance than an attorney-client relationship.”

According to the Post’s report, Morris earned a reputation as Hunter’s “Sugar Brother” — in addition to allegedly acting as a “fixer” for the president’s son, Morris may have assisted in marketing and selling some of his paintings and reportedly loaned him the money when he needed to pay back $2 million in federal tax debt.

Facebook Docs Reveal FBI Agent Made ‘Completely False’ Congressional Statements Involving Hunter Biden Laptop, Jordan Says

An FBI agent made “completely false” statements during a congressional deposition about the agency’s role in suppressing the Hunter Biden laptop story on social media platforms, Rep. Jim Jordan (R-OH) said on Monday in his fourth edition of the “Facebook Files.”

Jordan, who chairs the House Judiciary Committee, said internal Facebook communications reveal San Francisco-based FBI Special Agent Elvis Chan was “the main conduit” between the bureau’s Foreign Influence Task Force and big tech companies to suppress the scandalous story involving alleged foreign business deals with then-presidential candidate Joe Biden just weeks before the 2020 election.

Chan told lawmakers during testimony the FBI had not communicated with Facebook outside of a meeting that occurred the same day the New York Post published the Biden laptop article on October 14, 2020. But according to the Jordan, Chan was involved in a “secret ‘follow up’ call” with the social media giant the next day, allegedly contradicting a claim he made during a November 2022 deposition in the government censorship case Missouri v. Biden

The federal agent also spoke with a Facebook employee that same day, who said, “Chan advised that he was up to speed on the current state of the matter within the FBI.” Chan also told the social media platform that “there was no current evidence to suggest any foreign connection … of the leaks,” according to the documents released by Jordan. Hunter Business Partner: Bidens ‘Intimidated’ People Not to Legally Mess With Them

The Biden brand “intimidated” people to not legally mess with the Biden family, Devon Archer told Rep. Daniel Goldman (D-NY) during his transcribed congressional interview.

Archer, who testified that Hunter Biden included then-Vice President Joe Biden on speakerphone more than 20 times with business associates to sell “the brand,” also told Goldman the Bidens intimidated people into not legally probing the family’s business activities.

Archer told Goldman that Hunter Biden was able to survive on the board of Burisma Holdings because of the Biden brand.

“I don’t understand. How does that have an impact?” Goldman asked.

“The capabilities to navigate D.C. that they were able to basically be in the news cycle. And I think that preserved them from a longevity standpoint.
