Biden Stops Fining Illegal Aliens Who Do Not Depart U.S.

President Joe Biden’s Department of Homeland Security (DHS) has stopped fining illegal aliens who refused to depart the United States, the agency revealed.

In an announcement on Friday, DHS Secretary Alejandro Mayorkas stated that the agency has stopped issuing fines to illegal aliens who refused to depart the U.S. despite previously stating that they would depart.

Former President Trump, with the authority of the Immigration and Nationality Act, finally started requiring the federal government in 2018 to issue fines to illegal aliens who refused to depart the U.S. after the provision failed to be enforced for more than 20 years.

As Breitbart News reported at the time, the Trump administration started fining illegal aliens up to $500 every day they refused to depart the U.S. In some cases, illegal aliens racked up fines of close to $500,000 for violating federal immigration law.

Mayorkas, in a statement, said DHS has rescinded the use of fines on illegal aliens, claiming the authorized policy is not effective in deterring illegal immigration. Governor Blocks Biden Administration From Bringing Illegal Alien Children to State

Republican South Carolina Gov. Henry McMaster issued an executive order Monday preventing the state from taking in undocumented migrant children and placing them in the state’s foster care and group home system.

The South Carolina Department of Social Services (DSS), in a letter dated April 8, told McMaster the federal government was making inquiries about possibly transporting an unknown number of migrant children from the southern border to be placed in the state’s childcare systems.

McMaster issued an executive order barring the state from taking unaccompanied minors in.

“South Carolina’s children must always be given first priority for placement into foster care and the State’s strained resources must be directed to addressing the needs of its children,” McMaster said in a statement. “Allowing the federal government to place an unlimited number of unaccompanied migrant children into our state’s child welfare system for an unspecified length of time is an unacceptable proposition.” (Read more from “Governor Blocks Biden Administration From Bringing Illegal Alien Children to State” HERE)

‘Texas, You’ll Just Have to Clean up the Mess’: Biden Admin to House 3,000 Immigrant Teens at Dallas Convention Center

Up to 3,000 migrants from the U.S.-Mexico border — teenage boys age 15-17 — are moving to the Kay Bailey Hutchison Convention Center in Dallas “within the week,” says Dallas County Commissioner for District 2, J.J. Koch. But just who approved this plan?

Texas Gov. Greg Abbott (R) didn’t, and the city government kicked the responsibility to convention center management. Is it possible the Federal Emergency Management Agency (FEMA) intentionally sidestepped the GOP governor because of political animosity?

Koch joined the “Glenn Beck Radio Program” Thursday to provide the details he knows so far. Glenn asked Koch if it’s possible that FEMA and the Biden administration made these arrangements without even notifying county, city, or state level authorities.

“Technically, they can do that, but functionally, as a matter of working with your partners and actually getting stuff done, you never do that. You don’t blow past your county folks, your city folks, and you most certainly don’t blow past your partners at the state level. I mean, I don’t care how acrimonious a relationship is between a governor’s office and that of the presidency, if you’re bringing in FEMA, this is an emergency. This is something that we’re saying is important. So if it’s that important, you sure as heck have to get it right by having all the people at the table to make it work,” Koch answered.

“But they’re not interested in making it work,” he added. “They get their feel-good sugar rush. House Democrats Seek to Include Amnesty for Illegal Aliens in COVID Bill

About 100 House Democrats are urging House Speaker Nancy Pelosi (D-CA) to include an amnesty for certain subgroups of illegal aliens in a relief package for Americans impacted by the Chinese coronavirus crisis.

The group of House Democrats, led by the Congressional Hispanic Caucus, want to include an amnesty for at least five million illegal aliens who consider themselves “essential workers” and who are recipients of Temporary Protected Status (TPS) and the Deferred Action for Childhood Arrivals (DACA) programs. The letter states:

As you continue to work on assembling a COVID-19 reconciliation package and begin work on an economic recovery and jobs package, we urge you to include a pathway to citizenship for essential immigrant workers, Dreamers, and TPS holders, as well as their families, in order to ensure a robust recovery that is inclusive and equitable for all Americans regardless of their immigration status.

The amnesty would pack the United States labor market with millions of newly legalized illegal aliens who would be allowed to legally compete for jobs against 18 million unemployed Americans and another 6.2 million Americans who are underemployed. Supreme Court Green-Lights Trump Removal of Illegal Aliens From Census Count

Throwing out a challenge from New York state, the Supreme Court called it premature Friday to rule on an executive order that directs census officials to exclude undocumented immigrants as part of the count to apportion seats in Congress.

“At present, this case is riddled with contingencies and speculation that impede judicial review,” the unsigned 7-page opinion states. “The president, to be sure, has made clear his desire to exclude aliens without lawful status from the apportionment base. But the president qualified his directive by providing that the secretary should gather information ‘to the extent practicable’ and that aliens should be excluded ‘to the extent feasible.’ Any prediction how the Executive Branch might eventually implement this general statement of policy is ‘no more than conjecture’ at this time.’

The three Democratic judges on the court dissented, saying there is enough risk of injury to rule on the order from President Donald Trump that, to their mind, is clearly illegal.

“The government has announced a policy to exclude aliens without lawful status from the apportionment base for the decennial census,” wrote Justice Stephen Breyer. “The government does not deny that, if carried out, the policy will harm the plaintiffs. Nor does it deny that it will implement that policy imminently (to the extent it is able to do so). Under a straightforward application of our precedents, the plaintiffs have standing to sue. The question is ripe for resolution. Biden Announces He Will Immediately Move to Give Citizenship to Millions of Illegal Aliens

Joe Biden announced during an NBC News interview that aired on Tuesday evening that he will immediately move to give citizenship to millions of illegal aliens once he gets into office in two months.

“I’m going to make a commitment in the first 100 days, I will send an immigration bill to the United States Senate with a pathway to citizenship for over 11 million undocumented people in America,” Biden said. “I will also be moving to do away with some of the I think very damaging executive orders that have significantly impacted on making the climate worse and making us less healthy.”

Biden has already pledged to dramatically increase the number of refugees that he admits into the U.S. from 15,000 under President Donald Trump to 125,000. Biden has also pledged to end the Trump administration’s travel ban on nations that are considered to be hot beds of terrorism.

Whether Biden is able to grant citizenship to millions of people who are unlawfully in the U.S. depends on who controls the Senate, which could be decided in January as Georgia has two runoff elections. If Republicans win just one of the two races they will keep control of the Senate when Biden takes office. Democrats would need to win both races just to have a 50-50 tie with Republicans and would need all 50 of their Senators to vote together so that incoming-Vice President Kamala Harris could be the tie breaker. Why Is the Trump Administration Allowing Judges to Illegally Release Criminal Aliens?

Attorney General Barr threatened to file lawsuits against governors overstepping their power to infringe upon civil liberties, yet the only lawsuits that are succeeding are the ones from illegal aliens. Suddenly, when it comes to those with no right to be in our communities, the courts are all-powerful and the executives are weak. In fact, the president really has the power to deport illegal aliens and prevent them from being released into our communities.

Late on Thursday, U.S. District Judge Marcia G. Cooke in Miami became the latest federal judge to illegally mandate that ICE release “vulnerable” populations in detention facilities. She charged that ICE acted with “deliberate indifference” and engaged in what amounts to “cruel and unusual punishment” against illegal aliens by not releasing them during the coronavirus epidemic.

Therefore, Cooke ordered ICE to submit twice-weekly reports on the status of the detainees and who is being released. She also ordered that ICE shall immediately provide masks to all detainees and replace them once a week.

Well, I don’t have masks – maybe I can get a judge to order them for me too?

There’s one ingredient missing here, and it sheds light both on the morality of detaining illegal aliens during this epidemic and the legality of a judge ordering them released into our communities rather than released to their home countries. These people are in detention of their own volition. They broke into our country and can always voluntarily depart. The only reason they are being held is because they are the ones resisting repatriation and are trying to litigate their way into the country. That is their choice. If they want to do so during an epidemic they must wait in detention. If they are truly concerned about dying of the virus – enough to file a lawsuit – then they should ask for voluntary departure.

This is an illegal ruling. 8 U.S.C. §1226(e) states plainly that these decisions are not subject to judicial review: “The [AG’s] discretionary judgment regarding the application of this section shall not be subject to review. No court may set aside any action or decision by the [AG] under this section regarding the detention or release of any alien or the grant, revocation, or denial of bond or parole.”

Indeed, ICE lawyers as well as the magistrate judge originally hearing the case under Judge Marcia Cooke agreed there is no authority to adjudicate this case.

Now, an illegal ruling can potentially lead to the release of another 1,200 into our communities, but only if the administration lets it happen.

It’s truly disgusting how during a time of unprecedented executive power, when courts are so passive in the face of the onslaught against citizens’ rights, the federal government is so passive and submissive to an illegal court ruling purporting to govern people who have no right to be here.

If this is truly against statute, the executive branch has an obligation to uphold statute. Yes, all things equal, the law provides these illegal aliens with an immigration court process. But that requires detention, and if a judge is going to subvert detention, then Trump has every right to remove them from the country.

The Supreme Court has said for 130 years, in what is considered one of the most uninterrupted chains of case law, that illegal aliens who have not been affirmatively and consensually admitted to this country are as if they are standing physically outside our country. Clarence Thomas has suggested that perhaps the president has inherent authority to deport even a legal immigrant who is here under statute. But Trump certainly can apply that to an illegal alien who is considered as if he’s standing outside our country.

Already as far back as the 1950s, the Supreme Court had already said, “For over a half century this Court has held that the detention of an alien in custody pending determination of his admissibility does not legally constitute an entry though the alien is physically within the United States.” Leng May Ma v. Barber, 1958.

Even an alien under questionable status, and certainly someone who snuck into the country “was to be regarded as stopped at the boundary line and kept there unless and until her right to enter should be declared.” Kaplan v. Tod, 267 U.S. 228, 230 (1925). Even after she was no longer detained, “[s]he was still in theory of law at the boundary line and had gained no foothold in the United States.”

Once they are regarded as if they are outside the country, not only does the president have inherent constitutional authority (governing foreign affairs and foreign commerce) to repatriate them, but even delegated authority under his emergency health crisis powers.

In fact, what the courts are doing – mandating the release of illegal aliens rather than returning them – is not only harming our security and breaking our laws, but is going to spread the virus even more.

Here’s the reality: the ACLU is right – coronavirus spreads like wildfire in prisons and ICE facilities. But that ship has sailed a long time ago. The good news is it demonstrates that the fatality rate, especially for this predominantly young population, is remarkably low. Out of over 50,000 foreign nationals detained in ICE detention facilities, not a single one has died (although two guards have died). We don’t know how many have contracted COVID-19, but over 60% of the over 1,000 who were tested for it were confirmed positive. Which means it’s likely that thousands have been exposed. This is yet one more data point showing the virus has an even lower fatality rate than people think.

But on the other hand, by releasing them, you will be taking predominantly younger people who have already developed herd immunity in a confined setting and releasing them into a population that has not been exposed quite as much. Moreover, as I noted with regard to domestic criminals being released under COVID-19 jailbreak, they are being thrust suddenly into communities without much of a home and will get even less treatment than they would in the facilities. This is certainly true for illegal aliens who often have no connection to a community but receive better health care at ICE facilities than American inmates in prison. Why release them and not remove them?

What sense does that make? Who knows, but one thing is clear: Like every policy decision revolving around this virus, it is not determined by either science or law. Donald Trump Responds to Illegals Not Getting Stimulus Checks; Trump Administration Urged to Release Illegal Aliens

“Well, you know, you are saying undocumented, meaning they came in illegally,” Trump said. “A lot of people would say that we have a lot of citizens right now that won’t be working, so what are you going to do?” . . .

Trump Administration Urged to Release Illegal Aliens Amid Coronavirus

By New York Post. The Trump administration is facing a looming deadline to figure out whether it will continue to hold illegal immigrant detainees at migrant detention centers amid concerns over the spread of coronavirus.

Over the weekend, a federal judge ordered the Department of Health and Human Services (HHS) and Immigration and Customs Enforcement (ICE) to either release illegal migrant minors in their custody or explain why they must remain detained amid the virus outbreak.

The judge also warned that ICE officials will be given a week to show the court that three specific family detention centers are providing adequately hygienic conditions for migrants being housed there.

New Border Patrol Chief Says He Won’t Turn Illegal Aliens Over for Criminal Prosecution If Sanctuary Jurisdictions Won’t Return Them

The Border Patrol’s new chief said this week that the law enforcement agency won’t be turning over illegal aliens accused of crimes if the prosecuting jurisdiction can’t guarantee that they’ll be given back to federal authorities for deportation afterward.

“My job is to protect the United States and to secure the borders, not to get prosecutions, so we are deporting people that have active warrants because the state will not give back that person to us, and we have to pick: federal law or state law,” Rodney Scott said recently at a briefing, as reported Tuesday by the Washington Examiner.

The new chief also said it doesn’t matter what kind of crime the illegal alien has been charged with if a jurisdiction won’t cooperate with immigration authorities.

“It doesn’t really matter the charge,” Scott explained, according to the report. “If they will not give confirmation that they are going to return the individual, then we are not going to turn them over. We’ll prosecute them federally, then deport them.”

Scott, a 27-year veteran of the U.S. Border Patrol, was named chief of the agency in late January. Before that, he headed up the agency’s San Diego Sector, which includes 60 miles of land border with Mexico and over 930 miles of coastal border stretching from California to Oregon. The sector also employs over 2,200 uniformed agents, according to its Fiscal Year 2019 report. ICE Catches Illegal Alien Accused of Child Rape After NYC Authorities Released Him From Custody

An illegal alien charged with raping a child was released by New York City authorities because of the city’s sanctuary policies, but Immigration and Customs Enforcement (ICE) agents were able to apprehend him shortly afterward.

ICE agents on Monday apprehend Miguel Federico Ajqui-Ajtzalam, a 20-year-old illegal alien from Guatemala, according to a press release by the agency.

Ajqui-Ajtzalam was previously in New York Police Department custody for allegedly raping a person under 14 years of age, but local authorities did not honor the ICE detainer lodged against him, and chose instead to release him back into the community.

“It’s inconceivable that a individual who was arrested for local charges of rape and sexual abuse of a child, would be released back into the community instead of being transferred to ICE who had a detainer in place,” ICE spokesman Thomas Decker said in a statement released Tuesday.

“It’s frightening that our detainer was ignored and he was released onto New York City streets to possibly re-offend,” he continued. “The safety of city residents, especially the more vulnerable, continues to be a priority for ICE enforcement.” (Read more from “ICE Catches Illegal Alien Accused of Child Rape After NYC Authorities Released Him From Custody” HERE)
